SUBJECT: Report and recommendation regarding a determination of use in the CBD zone:
That education/tutoring centers may occupy the ground floor of an existing office
building, subject to a Conditional Use Permit.
SUMMARY
The City received the attached letter from Compass Medical Education Network regarding their
interest in 128 E. Huntington Drive. Because of the emphasis on retail uses in the CBD zone,
education/tutoring uses are supposed to be above the ground floor. However, this is inconsistent
with the provision that allows business service uses to occupy the ground floor of those buildings
that were specifically designed, constructed and maintained to serve office-type uses.
Compass Medical Education Network is requesting a determination that education/tutoring uses
are a type of business service use that should be allowed to occupy the ground floor of those
buildings that were specifically designed, constructed and maintained to serve office-type uses.
The opinion of the Development Services Department is that education/tutoring uses should be
allowed on the ground floor of those buildings that were specifically designed, constructed and
maintained to serve office-type uses, subject to an approved Conditional Use Permit.
DISCUSSION
Section 9264.2.7 of the Arcadia Municipal Code lists those uses that are allowed in the CBD
zone subject to a Conditional Use Permit. Listed as item no. 6 is, "Education/tutoring centers,
above the ground floor only." This use was listed to prevent uses other than retail -from
occupying the ground floor of retail buildings.
Section 9264.2.9.2, however, provides for the following:
Where a structure has been specifically designed, constructed and maintained
to serve office-type uses, and where because of limited pedestrian access the
structure would not serve retail-type uses, then office and business service uses
may occupy the ground floor, including the front one-third (1/3) of the structure.

The restricting of education/tutoring centers to above the ground floor should have included the
phrase, "of retail buildings." When the CBD zone regulations are revised, the listing for
education/tutoring centers should be clarified to indicate that they must be above the ground floor
in retail buildings.
The structure at 128 E. Huntington Drive was originally a bank building. It was later occupied
by a real estate office, and in May, 1996, building permits for medical office improvements were
issued. Construction of those tenant improvements have been abandoned.
While the conversion of this structure to a retail use is not inconceivable, its design and location
do not lend itself to such a use. The building was built on the westerly property line, therefore no
openings are allowed in that wall. The front of the building is setback from the sidewalk by a
columned overhang which extends beyond the easterly wall. This overhang diminishes visibility
into the interior of the building. Also, the building is adjacent to a service station which is not a
generator of pedestrian activity.
It is the opinion of the Development Services Department that education/tutoring centers were
not intended to be prevented from occupying the ground floor of existing office buildings, and
that the building at 128 E. Huntington Drive satisfies the provision of Section 9264.2.9.2.
RECOMMENDATION
The Development Services Department recommends that education/tutoring centers be an
allowed use on the ground floor of existing office buildings, subject to an approved
Conditional Use Permit.
ACTION
The City Council may determine that education/tutoring centers are an allowed use on the
ground floor of existing office buildings, subject to a Conditional Use Permit.

I am writing for Compass Medical Education Network, ArcVentures, LLC. We are
currently in the process of identifying a new location for our Western Regional facility,
and are seriously considering 128 East Huntington Drive, Arcadia.
We have been informed by the city planning office that in order to receive the proper
permits and a business license, the City Council must make'a determination that a ground
floor unit could be occupied by an office-related use.
The subject site is a single story building that was originally built as a bank. Compass
Medical Education Network is requesting the necessary approvals to lease the building as
a lecturing and tutoring location for prospective medical professionals. The subject
location is ideal because the surrounding area offers reasonably priced hotels, restaurants
and other service amenities needed by our predominantly out-of-town clientele.
By way of background, Compass Medical Education Network, ArcVentures, LLC, is an
affiliate of Rush-Presbyterian-St. Luke's Medical Center, which is based in Chicago,
Illinois. Compass was founded in 1988 and currently operates seven regional offices
across the U.S., and three sites abroad. Our clients consist of medical school graduates
preparing for their national medical board exams. A typical tutoring session will consist of
a seven-week lecture session reviewing medical text material. The average number of
students for a session will be between 75 and 100 physicians.
Given the typical profile of our clients, we believe that the proposed Compass facility at
128 East Huntington Drive will be a mutually beneficial experience. Specifically, local
hotels, restaurants and retailers will greatly benefit from the patronage of our long-stay
clients. In each market where we are located, our tenancy has enhanced the image of the
area and provided significant revenue to the local economy. Since most of our clients fly

in from out of the area and typically use public transportation or carpool, our use will not
add to the local traffic congestion.
Compass' existing Western Regional facility has been located for the past seven years at
the Pasadena Holiday Inn. Due to convention and office expansion needs, the Holiday Inn
has notified Compass of the need to relocate elsewhere. The proposed Arcadia location
provides the convenient area location and support services previously enjoyed in
Pasadena.
A review of the proposed use, combined with our seven-year experience in Pasadena,
leads us to believe that the proposed use will not have any adverse impact in the area. On
the contrary, we believe that the local economy will benefit from our use.
