ADJOURN City Council to July 7, 1998 at 6:00 p.m. Adjourned ac io:os p.m. • U .� Z , - 5 o //t.) .S May ef- 0 °HP°R•Tf° ' STAFF'REPORT June 16, 1998 DEVELOPMENT SERVICES DEPARTMENT TO: Arcadia City Council FROM: Don Penman, Deputy City Manager/Development Services Director, By: Donna Butler, Community Development Administrator SUBJECT: Report and recommendation to confirm the costs of $8,296.72 for abatement of code violations at 1106 South Mayflower Avenue and direct the Administrative Services Director to assess the property, owner (Philip Whitlatch) for said costs, per City Council Resolution; 5991 SUMMARY Pursuant to Section 9406.5 of the Arcadia Municipal Code, the purpose of this hearing is to allow the City Council the opportunity to hear any protests on objections to the cost of abatement of code violations in the amount of $8,296.72, for the property at 1106 South Mayflower Avenue. At the conclusion of they hearing, the Council may correct, modify or confirm the costs for abatement and assess it against the property owner, Phillip Whitlatch, per City Council Resolution 5991 adopted May 6, 1997. The Development Services Department is recommending that the City Council authorize the Administrative Services Director to collect the cost for abatement in the amount of $8,296.72 from the property owner, Phillip Whitlatch, and if necessary, transmit the bill to the County Assessor and Tax Collector for inclusion on the tax rolls for collection. BACKGROUND AND DISCUSSION s: On May 6, 1997, the City Council adopted Resolution 5991 declaring a public nuisance and ordering the rehabilitation of real property located at 1106 South Mayflower Avenue, and authorizing the Administrative Services Director to collect the cost for abatement, if abatement at City expense was required, per Sections 9406.8, 9406.5 and 9406.3 of the Arcadia Municipal Code. Able II Construction — general-clean- up, including removal of all debris, tires $4,250.40 and other material and extensive yard clean-up Active Sandblasting — sandblasted and painted the entire house which was $2,075 weathered and peeling Cardinal Electric — removed all illegal wiring from the house to the garage - $150.00 and removed illegal garage circuit panel, open wiring and other illegal electrical installations Island Environmental Services — removed "hazardous waste" in 40 gal. $495.00 Container Johnson Tree Service — removed the deadwood from the front deador tree $370.00 Newco — provided 3 yard bin, plus storage bin $405.72 Cost for Code Services — includes. 20 hours of Code Service Inspector's time $550.60 TOTAL COSTS $8296.72 All of the above companies providing services to abate the property nuisance have been reimbursed by the City out of funds set aside in the Nuisance Abatement Account. Since clean up was completed in March, Mr. Whitlatch has once again started • storing miscellaneous items and material outside along the Short Street side yard area. The City will proceed with further abatement to clean up this property as necessary. ACTION . On June 3, 1998 a "Notice re Equalization of Assessment for Abatement of Code Violations" along with a "Statement of Expenditures" was sent to Mr. Whitlatch advising him of tonight's meeting and his opportunity to contest the costs for clean-up. The City Council, sitting as the Board of Equalization, may modify Or correct any assessment that, in its opinion, is excessive or otherwise incorrect. Butler, Community Development Administratorie/ SUBJECT: Recommendation to declare the property located at 1106 South Mayflower, a public nuisance for the purpose of abatement (Phillip Whitlatch, property owner) and adopt Resolution No. 5991 declaring the subject property a public nuisance and ordering the rehabilitation of the property located at 1106 Mayflower Avenue and authorizing the Administrative Services Director to collect the cost for abatement, if abatement at City expense is required SUMMARY This hearing has been scheduled pursuant to Section 9406 of the Arcadia Municipal Code to allow the City Council the opportunity to determine what action is necessary to abate the violations set forth in this report which were cited on the property at 1106 South Mayflower Avenue. BACKGROUND AND DISCUSSION The subject site has been a property maintenance problem for the past few years and is inharmonious with the level of maintenance and appearance of the surrounding properties. In 1993, the property owner, Phillip Whitlatch participated in our housing rehabilitation program at which time several code .violations were brought ;into conformance and a new roof was installed. In April of 1996, a misdemeanor criminal case was dismissed against Mr. Whitlatch based upon the fact that the property had been brought into minimal compliance. At that time it was noted that "if further legal action is needed to gain compliance with regard to your property, there will be no disposition of the case and the City will seek reimbursement of costs." In August of 1996, we received another complaint regarding the maintenance of the property and the house. Based upon Code Services' Whitlatch, Property Maintenance May 6, 1997. Page 1 _ I ✓ Contractors hired by the City and under supervision of City staff will do general clean up of the property including the parkway and yard areas. Junk and debris will be removed from the premises along-with the inoperative vehicles. The machinery (generator and mixer) will either be removed or stored in an appropriate location. 1 ✓ Once complete, a statement of the expenses incurred in the clean up, (including inspection and related enforcement costs) shall be filed with the City Clerk. ✓ Within ten (10) days after the filing of the statement, the City Clerk shall have a copy of the statement served to the owner either personally or by general delivery along with a Notice of Equalization of Assessment. ✓ The Notice of Equalization of Assessment sets forth a date and time that the City Council shall hear any protest or objection to the cost of clean up. At this meeting the City Council may modify or confirm the costs for abatement. ✓ If the cost is confirmed, the Administrative Services Director then sends out a bill for the assessment. ✓ Any bills unpaid at the end of thirty (30) days are then referred to the Administrative Services Director for collection by transmitting the bill to the County Assessor end Tax collector for inclusion on the tax rolls and the amount is collected at the same time and in the same manner as ordinary municipal taxes. FISCAL IMPACT The City has not incurred any direct cost to date (staff time is not considered "direct" costs). Be_ cause of the various code violations, more than one contractor will be required to bring the property into minimum code compliance (painting, landscaping, removal of debris, cars, etc.) As of this time, we do not have cost estimates to complete these tasks. The City has $6,000 set aside in the Nuisance Abatement.fund. Final costs for clean up will be submitted to the City Council for their review and approval. The total cost for abatement, including staffs time is assessed against the property and charged to the property owner for reimbursement to the City. If the property owner does not pay the invoice, the charges are then added to the property tax bill for reimbursement through the County Tax collector.
