ADJOURN City Council to May 26, 1998 at 6:00 P.M. at 8:53 p.m. df s_ ©^-!d r" STAFF REPORT CpR►OR�SfO •�� DEVELOPMENT SERVICES DEPARTMENT DATE: May 19, 1998 TO: Mayor and City Council FROM: Don Penman, Deputy City Manager /Development Services Director By: Ed Cline, Traffic Engineer SUBJECT: REPORT AND RECOMMENDATION CONCERNING A REQUEST BY THE ARCADIA BUSINESS ASSOCIATION (ABA) FOR REMOVAL OF "STOP" SIGNS ON FIRST AVENUE SOUTH OF HUNTINGTON DRIVE BACKGROUND The City received a request from Mr. Garland Roberson, representing the Arcadia Business Association, to remove the "Stop" signs on First Avenue at several intersections immediately south of Huntington Drive. The specific locations are: • Alta Street • Bonita Street • California Street Stop controls were added to the north /south traffic flow on First Avenue at each of these intersections in conjunction with the construction of angle parking and landscaped islands as part of the Downtown 2000 plan. Each intersection became a four -way stop controlled location since east/west traffic was already controlled in each case. These four -way stop intersections have been in place approximately two years. Staff understands that the request to remove the "Stop" signs from First Avenue stems from concerns regarding reduced traffic volumes on First Avenue. Apparently, some First Avenue merchants have associated the alleged drop in traffic volumes to a reduction in business opportunities. The City Council requested that staff place this matter on the agenda for City'Cou6cii review. DISCUSSION Traffic counts were obtained on First Avenue in April 1997 in concert with the proposal to close the street for the Farmer's Market. Staff has compared these volume counts with Lpnr -? IJ 11�1,!��f . ,I_ %i n Mayor and City Council May 19, 1998 Page 3 E5 Staff has serious safety related concerns regarding the removal of any of the "Stop" signs on First Avenue at any of the noted locations. First, a substantial habit pattern has been established with respect to driver expectancy at these locations. Changing these habit patterns could result in some driver assumptions which would no longer be true. Regardless of the number of warning signs and other visual clues that the controls have been changed, the street would remain the same. The textured pavement and other physical features could induce the belief in some drivers that the intersections continue to be controlled in all directions by "Stop" signs. This situation would probably diminish in time. What would not diminish in time is the visibility limitations at each intersection created by the landscaped planters and angle parked cars. These obstacles to sight distance at the intersections would remain. Staff has prepared detailed diagrams of each of the intersections which are attached. These diagrams show the traffic lanes, stop controls, crosswalks, pavement texture, planter areas, and angle parking. The diagram prepared for Bonita Avenue also depicts a driver's line of sight from the eastbound approach (west side) to the north. This diagram references two actual photographs taken at random on a weekday in March. As shown on the Bonita Avenue diagram and the attendant photographs visibility is severely limited for a motorist on Bonita Avenue from the normal stop location behind the crosswalk (Photo #1). Visibility does not improve significantly even as the vehicle on Bonita Avenue eases out over the crosswalk to a position in line with the edge of the planters and cars parked at an angle (Photo #2). Bonita Avenue is provided as an example. As shown on the other diagrams, visibility is equally restricted at all of the other locations. FISCAL IMPACT The fiscal impact will vary depending on the action, if any, the City Council may take. IT' stop signs are removipd, and no other changes are made, the costs would be minimal. Dale , Administrative Services Director ?0— SUBJECT: Report and Recommendation to Authorize Staff to Fill the Position of Purchasing Officer SUMMARY: The Administrative Services Department is requesting authorization to fill the position of Purchasing Officer which was recently vacated. This position is fully funded in the current year's (1997 -98) Operating Budget and is included in the proposed budget for 1998 -99. DISCUSSION: The City has one individual that serves as the City's Purchasing Officer. This individual is charged with the responsibility of purchasing all supplies, materials, capital equipment and services and to perform related duties. The Purchasing Officer is a key position in the operation of the City and all decisions that involve the acquisition of services and supplies are channeled though this individual. The Purchasing Officer consults with departments to obtain specification data and other critical purchasing conditions, writes purchasing specifications and provides cost estimates and pricing information. The Purchasing Officer also prepares and advertises for potential bidders, solicits formal and informal bids and arranges for the delivery of the purchased goods. The Purchasing Officer develops, implements and maintains purchasing policies and procedures in conformance with legal purchasing requirements of the City, as adopted by the City Council, applicable purchasing requirements of the state and sound practices and procedures. 1 03 �� � M ,"o - I As indicated, the Purchasing Officer is an essential position within the Administrative Services Department. The critical nature and the responsibilities and duties this position performs and the relationship and support the Purchasing Officer provides to the entire city operation, makes it imperative that authorization to fill this position is granted. FISCAL IMPACT: The position of Purchasing Officer has a salary range of from $3,250 to $3,950 per month plus benefits. Funds for this position are included in the 1997 -98 Operation Budget and are included in the 1998 -99 proposed budget. SUMMARY: The Administrative Services Department is requesting authorization to fill a Computer Support Specialist position which was recently vacated. This position is fully funded in the current year's (1997 -98) Operating Budget and is included in the proposed budget for 1998 -99. DISCUSSION: The Information Services Division of Administration Services is currently staffed with two (2) full time professionals including the Data Processing Supervisor and a Computer Support Specialist. On May 7, the Computer Support Specialist position was vacated. The Computer Support Specialist is a critical position within the Administrative Services Department. The City's information system is a vital element in our delivery capability, not only to the residents of Arcadia but internally in the form of financial and other system requirements. The Computer Support Specialist provides essential support to our microcomputer users and other computer operation support service tasks. With the phased implementation of the City's Information Systems Master Plan, we are now in the process of implementing our Local Area Network / Wide Area Network (LAN /WAN) computer system. This system will introduce new technology to communicate electronically with the existing 1 LAS F R IMA 13ED 14W `40 computer system (HP) and will allow us to communicate with the Windows NT file servers. This conversion from an HP bases environment to Windows based is in part due to our need to be able to seek out and implement software packages fo continue to provide basic Municipal services beyond the year 2000. Full staffing of Information Services is essential if we are to meet the challenges that face us at this time and to continue to provide the necessary support services in the future. In addition to the support and assistance described above, the Computer Support Specialist also performs numerous other tasks. He or she operates our high volume printer to generate reports for various city departments, generate water bills, payables and payroll warrants and various other computer generated reports. This individual also creates and receives tapes and diskettes; maintains tape inventory and usage logs, performs system backup procedures and a host of other related duties. As indicated, the position of Computer Support Specialist is an essential position within the Administrative Services Department. With the limited staffing that currently exists in the Information Systems Division we will be essentially unable to provide even the most basic system support without filling this position FISCAL IMPACT: The position of Computer Support Specialist has a salary range of from $2,664 to $3,238 per month plus benefits. Funds for this position are include in the 1997 -98 Operation Budget and are also included in the 1998 -99 Operating Budget. Recommendation to adopt Ordinance No. 2084, Regarding the Cable Television Franchise Agreement with Cablevision of Arcadia/Sierra Madre, Inc. SUMMARY On May 5, 1998, the City Council approved the cable television franchise agreement with Cablevision of Arcadia/Sierra Madre, Inc., and introduced • Ordinance No. 2084, an ordinance of the City Council of the City of Arcadia, California, awarding to Cablevision of Arcadia/Sierra Madre, Inc. (DBA TCI Cablevision of Los Angeles County) a seven (7) year non-exclusive franchise with conditional three (3) year extension to construct, own, operate and maintain a cable system within the City of Arcadia, California; setting forth conditions accompanying the granting of said franchise; providing the City regulations and use of the City's public rights of way; providing for other lawful regulation of the cable system; and prescribing procedures and liquidated damages for violations of the ordinance. ACTION The City Council should move to adopt Ordinance No. 2084 as attached. Kelly, City Manager By: Cindy Rowe, Community Relations Officer SUBJECT: Report Regarding the Cable Television Franchise Renewal and Recommendation to Introduce Ordinance No. 2084 BACKGROUND At the April 7, 1998, City Council meeting, following a request from TCI to continue the public hearing regarding the cable television franchise renewal, staff was directed to place the item on the April 21 City Council agenda if a signed agreement was received by April 14. None was received. Accordingly, the public hearing was in effect tabled and the matter has come back to the City Council for final consideration. DISCUSSION While TCI and staff had reached consensus on issues referred to at the April 7 meeting, TCI needed review and approval by Century Communications since Century will be the managing partner of the Arcadia system. That approval was not received at the time the agenda_was prepared for the City Council meeting of April 21, and therefore, the item was continued to this meeting. The appropriate signatures have now been received and there are no other outstanding issues between the parties. Due to the delays experienced in the re-franchising process, in January TCI agreed to pay for three months' operational support, $3,750, as required in the existing franchise, plus $5,000 for additional administrative costs. Because of more recent delays, staff requested an additional $3,750 for another quarter of operational support, with an additional $2,000 to cover added expense. Kurt Taylor of TCI is to present a check to the City prior to the public hearing. } Cable Television Franchise Renewal May 5, 1998 Page two DISCUSSION (continued) The $393,000 capital grant from TCI will be due to the City upon acceptance and execution of the franchise document. On April 7 a question arose regarding a clarification of the "Letter of Credit." In the financial realm, a Letter of Credit is the unconditional promise by a bank or financial institution to pay a specified dollar amount if certain conditions are not met by the purchaser of the Letter of Credit. The bank or financial institution issuing the Letter of Credit makes that promise based on their analysis that the purchaser has adequate assets to cover that specified dollar amount should default occur. A copy of the April 7 staff report is attached, along with the final franchise document and a recent news article which makes reference to the Century/TCI partnership. CONCLUSION TCI meets all the criteria established by the FCC to be granted a franchise. Timely action on the item is important due to the impending merger with Century. City consultant, John Risk of Communications Support Group, along with special legal counsel, the City Attorney and staff believe this franchise renewal as set forth in, the required documentation is in the best interest of the City and to the extent allowed by Federal law, will meet the needs of the Arcadia community for the next decade. The public hearing on this issue was continued and has been re-noticed. The franchise renewal process does not accord the City authority to address specific rate regulation or specific programming issues; any new public input should pertain to the franchise document.
