SUBJECT: Recommendation to adopt Resolution No.6075, a Resolution of the
City Council of the City of Arcadia, California, Approving and
Adopting the First Amendment to the San Gabriel Valley Council of
Government's Joint Powers Authority Agreement
Summary
Attached for City Council review and consideration is Resolution No. 6075,
adopting the first amendment to the San Gabriel Valley Council of Government's
Joint Powers Agreement (JPA) creating the San Gabriel Valley Gateway to
American Alameda Corridor East Construction Authority. The Construction
Authority will be responsible for the daily administration and management of the
Alameda Corridor East project including funding requests, appropriations and
construction oversite.
The Development Services Department is recommending adoption of Resolution
No. 6075, approving the first amendment to the San Gabriel Valley Council of
Government's Joint Powers Authority Agreement.
Discussion
The San Gabriel Valley Council of Government's ( SGVCOG) Joint Powers
Agreement was created and entered into by the City on March 1, 1994. The
purpose of the SGVCOG is to identify regional issues and develop a regional
consensus on solutions through the sharing of resources. Issues addressed by
the SGVCOG are considered regionally significant and include goods movement
issues along the Alameda Corridor through the San Gabriel Valley. The
SGVCOG is requesting to amend the current Joint Powers Authority to include
the development of the Alameda Corridor East (ACE) Construction Authority to

manage and administer the day -to -day implementation of the recently funded
Alameda Corridor East Project. The Alameda Corridor East Project does not fall
within the City of Arcadia limits. The project area lies along the most southern
portion of the San Gabriel Valley running east -west through the Cities of Industry,
El Monte and Montebello.
For the Authority to become effective September 17, 1998, fifty percent (50 %)
plus one (1) of the members of the COG must approve the amendment by this
date. If not, it will become effective once the required percentage of members
approve the amendment.
Attached for the City Council's information is an opinion letter from Burke,
Williams and Sorensen, Counsel to the COG. The letter indicates that in the
opinion of this firm the COG members will not be responsible for any debts,
obligations or liabilities of the COG or Construction Authority created by the
proposed First Amendment.
Fiscal Impact
As the project area lies outside of the City limits, there is no direct fiscal impact to
the City. However, the Alameda Corridor East Project may compete with the City
for regional transportation funds available through the Los Angeles County
Metropolitan Transportation Authority (LACMTA) Call for Projects grant program.
Currently, the Alameda Corridor east project is funded primarily with Federal
funds, but it is anticipated that some local funds will be sought for the corridor. It
is not possible to say at this time how much or what the impact will be.
RECOMMENDATION

that a resolution adopting the "First Amendment" be placed on
your city council agenda for adoption before September 17, 1998.

receipt of such funds will be conditioned by regulation, law or agreement.
The Gi�verning Board shal l have control of all such funds until such time
as responsibility for management and/or use of the funds is transferred to
the ACE Construction Authority by the Board by appropriate Board
Action. Such Action, in additional to the delegation of annual budgeting
authority, may contain restrictions on the use of such funds and on the
ACE Construction Authority, in addition to any found in the Board -
adopted by -laws, and as is required by Federal, State and local entities and
the SGVCOG.
e. The ACE Construction Authority may be dissolved by the Board upon a
majority (50% + 1) vote. In the event that the Committee is dissolved by
the Board, the Board shall succeed to the rights, responsibilities,
obligations and duties of the ACE.Construction Authority"
SECTION 2. This Amendment to the San Gabriel Valley Council of Governments Joint
Powers Agreement shall be effective September 17, 19 if =e'nt percent (50%) plus one
(1) of the members of the SGVCOG have signed this Am by that date. If not,
then the effective date shall be the first date upon which fi (50 %) plus one (1) of the
members sign this Amendment. This Amendment may be ex ted in counterparts.
The members of the San Gabriel Valley Council of GoverfiVents have caused this
Amendment to be executed on their behalf, respectively, as follows:

We have been asked to render an opinion regarding the
responsibility of each member city of the SGVCOG for the debts,
liabilities and obligations of the SGVCOG.
The "First Amendment" will amend the original SGVCOG Joint
Powers Agreement and will create the ACE Construction Authority,
a subsidiary body within the SGVCOG. The existing provisions of
the original SGVCOG Joint Powers Agreement are now in full force
and effect and will continue in full force and effect upon and
after the adoption of the "First Amendment" and will apply to the
"First Amendment ".
Section 16 of the SGVCOG Joint Powers Agreement entitled
"Obligations of Council" (defined as the SGVCOG) provides that:
"The debts, liabilities and obligations of the Council shall
be the debts, liabilities or obligations of the Council
alone. No Member of the Council shall be responsible,
directly or indirectly, for any obligation, debt or
liability of the Council, whatsoever."
Section 16 is authorized by the Joint Powers Law, Government
Code Section 6500, et se g. and other applicable law. Section
6508.1 of the Government Code provides that:
If the agency is not one or more of the parties to the
agreement but is a public entity, commission, or board
constituted pursuant to the agreement, the debts,
liabilities, and obligations of the agency shall be the
debts, liabilities, and obligations of the parties to the
agreement, unless the agreement specifies otherwise. (Gov't
Code § 6508.1) (Emphasis added.)
The SGVCOG Joint Powers Agreement specifies otherwise. It
provides that the debts, liabilities and obligations of the
SGVCOG shall be the debts, liabilities or obligations of the
SGVCOG alone.
It is our opinon that no member city of the SGVCOG is
responsible for any debts, obligations, or liabilities of the
SGVCOG, and /or any debts, obligations, or liabilities of the ACE

AUTHORIZING THE TEMPORARY CLOSURE OF SOUTH FIRST AVENUE
BETWEEN CALIFORNIA STREET AND DIAMOND STREET PURSUANT TO
VEHICLE CODE SECTION 21101(e) ON SATURDAY, OCTOBER 10, 1998

AVENUE PTA TO OPERATE A FAMILY FUN DAY/YARD SALE AND ADOPT
THE FIRST AVENUE PTA STREET CLOSURE REGULATIONS
SUMMARY
Ms. Ellen Velasquez, President of First Avenue PTA 1998 -99, has requested the closure of
South First Avenue from California Street to Diamond Street on Saturday October 10, 1998 from
7:00 a.m. to 2:00 p.m. to operate a Family Fun Day/Yard Sale. Staff recommends approval of
City Council Resolution No. 6076 with conditions as set forth in the accompanying First Avenue
PTA Street Closure Regulations.
DESCRIPTION
The City Council at its February 17, 1998 meeting approved the closure of South First Avenue
between Alta and California Streets for Farmers Market purposes. The Farmers Market street
closure is approved for Saturdays from 7:00 a.m. to 2:00 p.m. If approved, this street closure
will extend the Farmers Market street closure to one block south and will be under the same
conditions that were previously approved for the Farmers Market.
The First Avenue PTA is requesting that the street be closed on Saturday, October 10, 1998
from 7:00 a.m. to 2:00 p.m. (Attachment 1). First Avenue would be barricaded south of
California (see Attachment 2). The alley in the mid block between Diamond and California
Streets would be barricaded at the rear of the First Avenue stores so that cars coming down the
alley toward First Avenue could turn around.
It will be the responsibility of the applicant to pick up traffic barricades from the Maintenance
Services Department. It will also be the responsibility of the applicant to place the barricades in
the street and alley and to remove them at the appropriate time and return them to the
Maintenance Services Department.

Signs warning of the First Avenue closure will be placed in advance by the First Avenue PTA on
Diamond at south Santa Anita Avenue and at south Second Avenue warning drivers that the
street is closed at First Avenue.
The California Vehicle Code Section 21101(e) authorizes the City to close a street temporarily
for a special local event in order to ensure the safety and protection of the persons who will use
that portion of the street during the temporary closing. The section further permits the City to
adopt rules and regulations governing the closing of the street. City Council Resolution No.
6076 has been prepared to address this issue (see Attachment 3).
The proposed Street Closure Regulations have been reviewed by the Traffic Engineer, City
Attorney, Police, Fire and Maintenance Services Departments. The First Avenue PTA will be
required to comply with these regulations subject to approval by the City Council.
The PTA is indemnifying the City, as well as providing insurance as determined by the City
Attorney. Ms. Ellen Velasquez will be present at the meeting to respond to any questions.
FISCAL IMPACT
This street closure will have no fiscal impact on the City.
RECOMMENDATION
IT IS RECOMMENDED THAT THE CITY COUNCIL ADOPT RESOLUTION NO. 6076,
AUTHORIZING THE TEMPORARY CLOSURE OF SOUTH FIRST AVENUE BETWEEN

I am writing this letter requesting the closure of First Avenue Street in front of
First Avenue School during the Farmer's Market hours on Saturday, October 10,
1998. Continuing the closure of the Farmer's Market 1 more block, from
Diamond to California Avenue.
We are planning a Family Fun DayNard Sale. We would need the street for the
band to play and possibly for some games or other activity. We will be using the
front of the school for our yard sale. We will be featuring our Band and Drill
Team that day. We are hoping to have a Science Fair, Art Fair, Sidewalk Chalk
Art, display and a Continental Breakfast. This event is still in the early stages and
it has not all been planned as of yet. I wanted to get the street closure OK'd
before it gets too late.
I feel this would be great for the community and for the school. People from the
school will go to the Farmer's Market and people from the Market can cruise
down to the school
I spoke to Garland Roberson, whom I work for, and he seemed to think it was a
pretty good idea. I also have approval from our Principal, Dr. Klatt.

SUBJECT: Recommendation to authorize the appropriation of$15,750 in
Proposition A Local Return Funds for recreational transit excursions
throughout Los Angeles County.
Summary
As an eligible expense of Proposition A Local Return funds, staff is requesting
the City Council authorize the City Manager to appropriate $15,750 of
Proposition A Local Return funds for recreational transit excursions: All
recreational excursions, as listed on Attachment 1, are open to the general public
within the specified age group (i.e., youth or seniors) and may be attended by
those individuals residing within the City. Further, staff has determined that its
fiscal impact will be minimal as the City's balance of Proposition A Local Return
funds exceeds $2 million.
Discussion
Proposition A is a countywide '/2 cent sales tax dedicated for transportation
services. Twenty five percent of all Proposition A revenues received are set
aside by the MTA for allocation to local municipalities and the County as part of
the local return program for eligible uses such as recreational transit excursions.
Each year, the MTA approves an appropriation of Proposition A Local Return
revenues to the City. For FY 98-99, the City's allocation of Proposition A Local
Return revenues is $592,083.
. To encourage additional participation in recreational excursions as well as to
leverage General Fund monies, Proposition A Local Return funds are being
requested. The City Recreation Department is sponsoring these excursions.

Staff has received approval by the MTA to expend Proposition A Local Return
funds in the amount of$15,750 for recreational transit excursions as listed on
Attachment 1. These excursions are open to the general public within the
specified age groups.
Fiscal Impact
The City will receive $592,083 in Proposition A Local Return funds for FY 98-99.
Through the FY 98-99 budget process, $439,676 of Proposition A Local Return
funds have been appropriated by the City to eligible projects such as Arcadia
Transit and the Bus Stop Improvement Program. In addition, the City has a
carryover balance of roughly$2 million of Proposition A Local Return funds from
prior years. There are funds available in the Proposition A program to fund this
request.
RECOMMENDATION
IT IS RECOMMENDED THAT THE CITY COUNCIL AUTHORIZE THE
APPROPRIATION OF $15,750 IN PROPOSITION A LOCAL RETURN FUNDS
FOR RECREATIONAL TRANSIT EXCURSIONS THROUGHOUT LOS
ANGELES COUNTY.
