Discussion: The Arcadia Public Library Foundation is offering a donation to the Arcadia Public Library of $20,000 for the purchase of non - English language books. There has been a high demand for books in both Asian and Spanish languages. Since the Library book budget is limited, this area of the collection has depended largely on gifts from the community. This, however, has proved inadequate to meet the demand for these materials. This donation of $20,000 will therefore do much to help provide for this need in both children's and adult books. All gifts to the Library are subject to approval by the City Council pursuant to City Charter article VIII section 809(d). Fiscal Impact: The Library will experience an added $20,000 to its budget allocation for fiscal year 1999/00. Recommendation: It is recommended that the City Council approve the receipt of the $20,000 donation to the Arcadia Public Library from the Arcadia Public Library Foundation for the purchase of books in international languages in both the Children's and Adult Services Divisions. Butler, Community Development Administrator SUBJECT: RECOMMENDATION TO DENY AN APPEAL OF THE PLANNING; COMMISSION'S DENIAL OF AN APPEAL OF STAFF'S' CONDITIONAL APPROVAL OF ARCHITECTURAL DESIGN REVIEW APPLICATION NO. SADR 99-074 FOR TWO - ILLUMINATED CHANNEL-LETTER WALL SIGNS FOR "CHARLES SCHWAB" AT 1130 S. BALDWIN AVENUE, UNIT#B-1. SUMMARY Architectural Design Review Application No. SADR 99-074 was submitted for two wall signs for "Charles Schwab" at 1130 S. Baldwin Avenue, Unit #B-1. They applicant has appealed the Planning Commission's denial of an appeal of they Development Services Department's conditional approval. The applicant is requesting that the design of the signs be approved as originally proposed, rather than revised as required by staffs conditional approval. The Development Services Department is recommending denial of the appeal. BACKGROUND Architectural Design Review Application No. SADR 99-074 was submitted on December 2, 1999. The original plans are attached as Exhibit "A". Staff requested that the proposed wall signs be revised s o that the Chinese characters would be closer together to reduce their length so that they would be readily perceived as one word or message and satisfy the allowable area for identification limits in accordance with the City's definition of sign area. I On December 15, 1999, a revised proposal (Exhibit "B") was submitted which reduced the spacing between the Chinese characters. This proposal was approved on December 21, 1999 with the condition that the separation between the English and Chinese characters be reduced to a maximum of 3-feet for the LASER,,IMAGED - 6 7 • DISCUSSION Original Proposal The applicant is requesting that the City Council approve the original .proposal (Exhibit "A") that was submitted to the City. This proposal consisted of two channel-letter wall signs: One on the front of the building facing the parking lot and one on the side of the building facing Baldwin Avenue. The letters on the front of the building, are 18-inches high, and the letters on the side are 15-inches high. The letters for the English portion, "Charles Schwab" are very closely spaced with essentially no space between the individual letters, and less than 2-inches between "Charles" and "Schwab". In contrast, the four: Chinese characters are widely spaced: The sign facing the parking lot has approximately 3-feet between each of the individual Chinese characters and is separated from the English portion by approximately 10-feet. The sign facing' Baldwin Avenue has approximately 2.5-feet between each. Chinese character! and is separated from the English portion by approximately 4-feet. Because the four Chinese characters constitute one name or one message, they should be grouped more closely together, similar to the English portion of the sign. In addition, a more compact arrangement would clearly provide for the four Chinese characters to be measured together as one sign to provide for area measurements that would comply with the City's sign regulations, and they additional criteria established for this center by application no. SADR 99-046. According to the Arcadia Municipal Code (Sec. 9262.4.3.A.1) the area of a sign! is measured as follows: The area of a sign shall be considered to be the area encompassed by. a maximum of four (4) connected straight line segments drawn around the extremities of the sign frame or can (if a frame or can is used to support or define the copy background area), or the sign copy background area (if no sign, frame or can is used), or the sign copy (if no copy background area or frame or can has been used). Based on the above definition, staff determined that the two wall signs as originally proposed have the following area measurements: for the 18-inch high letters, both the English and Chinese portions measure 23+ square feet each,1 and for the 15-inch high letters, both the English and Chinese portions measure 16+ square feet each. These measurements do not comply with the 1/3 to 2/3' identification requirement of the Code as set forth below: SADR 99-074 Appeal to City Council March 21, 2000 Page 3 of 6 7 ' It is staffs opinion that the condition of approval (reducing the distance between the English and Chinese portions) together with the first revision requesting the reduced spacing between the Chinese characters will permit signs that comply] with the City's regulations and with the additional sign criteria approved for the subject commercial center. In addition, the signs will be visually cohesive, architecturally compatible with the building and with other signs on the building, and harmonious with other developments in the area. Staff has revised (i.e., cut & pasted) the applicant's plans to present various' configurations that would satisfy staffs conditional approval: See Exhibit "C". The applicant's reason for the distance between the English and Chinese' versions of the signs is in order to center each portion in relation to the architectural elements of the building (i.e., the vertical reveals that align with the columns, and the keystones over each window area). An Exhibit "D" was provided by the applicant that emphasizes the architectural features in relation, to the proposed signs. Attached are photographs that show close-ups of the architectural features as well as other signs in the center, which are in compliance with the City's requirements. These signs do not rely upon the architectural features of the building to determine their locations and do not detract from the appearance of the building. Architectural Design Review Criteria In addition to the City's sign regulations, the following criteria are to be considered when reviewing a proposed sign: A. That the designs and locations of the proposed signs are consistent with th character and scale of the building to which they are attached. B. That the proposed signs are visually harmonious with surrounding developments. C. That the designs and locations of the proposed signs are consistent with the provisions of the zoning ordinance: D. That the designs and locations of the proposed signs are consistent with the characteristics of the area in which the building and site are located. E. That the proposed signs are designed to be in keeping with the use to which they are related. Kelly, City Manager By: Linda Garcia, Special Projects Manager ,00 SUBJECT: RECOMMENDATION TO ADOPT RESOLUTION NO. 6169 AUTHORIZING THE FOOTHILL PRIVATE INDUSTRY COUNCIL AND POLICY BOARD TO ACT AS THE WORKFORCE INVESTMENT BOARD UNDER THE PROVISIONS OF THE WORKFORCE INVESTMENT ACT OF 1998 SUMMARY On August 7, 1998 the President signed the Workforce Investment Act (WIA) into law to replace the Job Training Partnership Act (JTPA) of 1983. Accordingly, JTPA will sunset on June 30, 2000 and WIA must be fully implemented by July 1, 2000. This change will necessitate modifications to certain areas of existing federally funded job training programs, including those provided by the Foothill Private Industry Council. Staff recommends that the City Council adopt Resolution No. 6169 which will assist with the timely conduct of WIA transition activities by authorizing the Foothill Private Industry Council and Policy Board to act as the Workforce Investment Board under the provisions of the Workforce Investment Act of 1998. BACKGROUND In 1983 the cities of Arcadia, Duarte, Monrovia, Sierra Madre, South Pasadena and Pasadena entered into a Joint Powers Agreement establishing the Foothill Employment and Training Consortium. The Consortium's mission is to develop and implement job- training programs as provided for by the Job Training Partnership Act. The Agreement created two oversight entities known as the Foothill Private Industry Council and Policy Board. It also named the City of Pasadena as the agency responsible for administering the Consortium on a daily basis. In 1998 the Workforce Investment Act was signed into law and it supersedes the JTPA effective July 1, 2000. This new legislation requires a number of modifications to the program's governance, administration and service delivery. Key among these modifications is the need to establish a Workforce Investment Board and Chief Local Official. The WIA allows new bodies to be selected for this purpose, or, as an alternative, the designation of the existing Private Industry Council to serve in this capacity. �P �i ea /. //— • Mayor and City Council — Resolution No. 6169 March 21, 2000 Page 2 DISCUSSION The City of Pasadena has asked that each of the members of the Foothill Employment and Training Consortium adopt a resolution authorizing the Foothill Private Industry Council and Policy Board to act respectively as the Workforce Investment Board and Chief Local Official. To date, the Private Industry Council has been an effective body in addressing employment and training programs in the referenced six-city area and demonstrates the capacity to grow and change as needed to promote successful implementation of the new WIA. The attached resolution is submitted for action now to assure the timely conduct of WIA transition activities. The other five cities in the Foothill Consortium must also approve the resolution. Following such approval, a revised Joint Powers Agreement reflecting the changes required by the WIA will need to be completed and approved by each City Council. FISCAL IMPACT There is no fiscal impact to the City of Arcadia as JTPA and WIA are federally funded. RECOMMENDATION It is recommended that the City Council adopt Resolution No. 6169 authorizing the Foothill Private Industry Council and Policy Board to act as the Workforce Investment Board under the provisions of the Workforce Investment Act of 1998. We have produced the new guidelines in a looseleaf binder format for the first time for easy reproduction and updating. You will find forms at the back of your guidelines in plastic sleeves. We have also provided your guidelines on computer diskette. In the future we will provide updates of sections of the guidelines which have changed instead of reproducing the guidelines in their entirety,resulting in long term cost savings. Your Local Guidelines are tailored to your specific needs and contain important information you may not find in the current or future editions of the State CEQA Guidelines. Your Local Guidelines are intended to supply you with a road map for assessing and analyzing the environmental implications of a project prior to approval. We still recommend that you consult with legal counsel when you have specific questions on major, controversial, or unusual projects. There has been very little substantive statutory changes to CEQA over the past year. However,there has been substantial case law pertaining to the application of CEQA and related laws. Therefore, a discussion of the more important cases follows. 1999 CEQA CASE LAW In National Parks and Conservation Association v. County of Riverside (1999) 71 Cal.App.4th 1341,the court analyzed each impact independently to determine ifthere was substantial evidence to support the agency's decision to approve the project and issue a statement of overriding considerations. The most significant of the court's findings related to the deferment of desert tortoise mitigation. The administrative record indicated that there were significant pros and cons to constructing a 52-mile fence along a railroad line. The U.S.Fish&Wildlife Service favored on-going monitoring of migration patterns and fencing as necessary. The appellate court found that where such unknowns exist, certain mitigation measures may be deferred in implementation.Deferred mitigation RVPUB\CS.T\549504 LAW OFFICES OF BEST BEST & KRIEGER L is generally not permitted under CEQA. In this case, a more dynamic approach to mitigation measures was allowed, because there was substantial evidence to support it. In Sunset Drive Corporation, v. City of Redlands (1999) 73 Cal.App.4th 215, the court found that a lead agency cannot avoid its responsibility for seeing that an EIR is completed by delegating that responsibility to the applicant. In this case, after a number of versions of a Draft EIR were submitted to the City by the developers consultant,the City took no further action on processing the Draft EIR. The court emphasized the City's responsibility for processing a project in a timely, progressive manner. In Snarled Traffic Obstructs Progress v. City and County of San Francisco, et al., (1999) 74 Cal. App. 4th 793,the court upheld a negative declaration for a project that was modified nine years after project approval. In this case, the court found that the incremental effect of the modified project did not result in significant impacts requiring further review under CEQA. Generally once a negative declaration is issued or an EIR is completed,that decision is protected by concerns for finality and presumptive correctness. (Pub.Resources Code§21167.2.) However,Public Resources Code Section 21166 and State CEQA Guidelines Section 15162 outline certain circumstances when the subject may be revisited. These circumstances generally include substantial changes to the project, changes to the circumstances of the project, or new information which was not known or could not have been known at the time of the original environmental review. All of these circumstances must result in either new significant environmental effects or an increase in severity of previously identified significant effects. The City was able to further support their actions based on the analysis by the City's environmental review officer. The court found that these circumstances and the environmental review officer's report constituted substantial evidence that the modified project did not involve any new significant environmental effects or an increase in the severity of previously identified significant effects. In Friends of Sierra Madre et al.v. City of Sierra Madre et al., (1999)No. B129139, Daily Journal D.A.R. 12413, the court found that an agency may not avoid CEQA review for an action by submitting it to the voters for approval, when other approval methods are available to the City which would cause the action to undergo CEQA review. Section 15378, subdivision (b)(3) of the CEQA Guidelines provide for an exclusion from the definition of"project" under CEQA, "the submittal of proposals to a vote of the people of the state or of a particular community." In order to avoid the cost of CEQA review, the City adopted a resolution ordering the submission of an amended Historic Preservation Ordinance that would remove properties from the its'historic register. The appellate court found that the Guideline may apply when an agency is acting only in a ministerial manner to place a citizen-initiated measure on the ballot, or when the agency has already undertaken CEQA review for a project and submits the issue of the project's approval to the voters. El Dorado County Water Agency(1999) 1999 Daily Journal D.A.R. 12253, the court held that an environmental impact report is fundamentally flawed if it is predicated on a draft,unadopted general plan. In this case,water agencies developed a plan to meet projected long-term (2020) demands outlined in the projected growth anticipated in the County general plan update. The general plan update was in draft form and had not yet been adopted by the County. The appellate court found that, predicating a project on a draft general plan does not ensure that the linked issues of water supply and population growth will receive appropriate environmental review. The project made additional water available, and a natural barrier to growth was removed, so that a major issue related to development no longer had to be considered. The court found this contrary to the CEQA process of moving from general project to more specific ones. Consequently, lead agencies should scrutinize environmental documents being circulated or approved to ensure that they do not wrongly rely upon unadopted general plans or other public agency plans or policies that are not yet finalized,particularly those that predict future growth or needs. CONCLUSION Please let us know if you have any questions about the changes in your Local Guidelines. We recommend that you keep this memorandum in the inside cover of your Local Guidelines for future reference.
