SUBJECT: Report and Recommendation to Approve Street Closures for the Arcadia
Festival of Bands to be held on Saturday, November 17, 2001.
SUMMARY
This report requests the City Council approve the closure of specific City streets for the
Arcadia High School Music Club's 48th Annual Festival of Bands to be held on Saturday,
November 17, 2001.
DISCUSSION
Forty-four of the top California high school bands have been invited to attend and
participate in the 48th Annual Festival of Bands. We have confirmed with the City
Attorney that the appropriate insurance binders have been issued to properly protect the
City.
The proposed route will have the bands exit Gate 1 from the Racetrack onto westbound
Huntington Drive, southbound on Baldwin Avenue to eastbound Camino Real Avenue.
At this point, the bands board their buses on the residential streets between Duarte road
and Norman Avenue and are taken to Arcadia High School. Parade awards are given
at the High School and then the bands move to Citrus College in Glendora for the Field
Competition.
Arrangements have been made for the temporary posting of "no parking" signs in the
staging and ending areas of the parade. Posting will occur the evening before the
event.
The Police Department provides parade route security for the event and Public Works
Services supplies barricades and assistance in preparation for street closure and traffic
diversion.
IMPACT AREA
The request covers the closure of Baldwin Avenue from Huntington Drive to Camino
Real Avenue, the residential streets bordered by Duarte Road and Norman Avenue,
and Holly Avenue and Baldwin Avenue. The closure in west Arcadia will be from 8:30
a.m. until 1:00 p.m.

The Arcadia High School Music Club will notify the business community as well as the
affected residential area by delivering letters to all who are impacted by this event.
FISCAL IMPACT
The police budget allows for an expenditure of $7,000 to cover Police Department
overtime expenses for this activity. The actual cost cannot be determined until the
event is complete, as salaries differ from employee to employee, but the expense
should not exceed the budgeted amount.

SUBJECT: RECOMMENDATION TO APPROVE THE NEW JOB DESCRIPTIONS OF
MANAGEMENT AIDE AND HISTORICAL MUSEUM CURATOR
SUMMARY:
The approval of the proposed new and revised specifications will amend the City's existing
personnel classification plan.
DISCUSSION:
Periodically, City departments experience the need to create new classifications or revise existing
job specifications to address new operating needs. They develop requests that are reviewed by the
City Manager, and then the Administrative Services Department/Human Resources Office conducts
appropriate assessment interviews, meetings and analyses to evaluate the requests and make
recommendations. The Human Resources Commission is responsible for reviewing and approving
all job descriptions, prior to the job descriptions being sent to City Council for final approval.
The proposed new job descriptions are explained in the following:
1. Historical Museum Curator — The City Manager has proposed that a Historical Museum
Curator classification (Exhibit I) be created and compensated at Salary Schedule No. 57 to
address the operations needs of the new Historical Museum that is scheduled to open this
fall.
2. Management Aide — The City Manager has proposed that the entry-level management
classification of Management Aide (Exhibit II) be established compensated at Salary
Schedule No. 51, in order to respond to the increasing budgetary, financial, administrative
and analytical support requirements that have been placed on the City.
The attached job descriptions were prepared by the Administrative Services Department and
reviewed by the management staff. At its regular meeting on 9- 13 -01, the Human Resources
Commission reviewed and approved the proposed job descriptions.

GEORGE BATES AUTOMOTIVE TO REFURBISH THREE (3)
CHEVROLET CAPRICE PATROL VEHICLES IN THE AMOUNT OF
$54,000 FOR THE POLICE DEPARTMENT
SUMMARY:
Staff is recommending that the City Council award a purchase contract to George Bates
Automotive to refurbish three (3) Chevrolet Caprice patrol vehicles in the amount of
$54,000 for the Police Department. Funds in the amount of $54,000 have been
budgeted in the 2001 -02 Equipment Replacement Fund for the refurbishment of these
three (3) vehicles.
BACKGROUND:
Over the years, the Police Department has used a variety of vehicles for law
enforcement purposes; and the Chevrolet Caprice has proven to be one of the most
durable and reliable patrol vehicles manufactured. In 1997, General Motors
discontinued production of the Caprice. Most law enforcement agencies have turned to
Ford Crown Victoria's as police units. While the Crown Victoria Police pursuit vehicles
have proven to be good patrol units, there are still a number of mechanical and handling
problems associated with them.
A number of Agencies, including the City of Arcadia and the Los Angles Sheriffs
Department are refurbishing old Chevrolet Caprice units. Over the last two (2) years,
four (4) patrol units have been refurbished and are performing to the Police
Department's satisfaction.
DISCUSSION:
The 2001 -02 Equipment Replacement Fund provides for the refurbishment of three (3)
Chevrolet Caprice patrol vehicles in lieu of purchasing three (3) new Ford Crown
Victoria patrol vehicles. Refurbishing these vehicles will result in a cost savings to the
City of approximately $20,000..

Staff has contacted the Los Angeles County Sheriffs Department to find out if the City
of Arcadia could again cooperatively refurbish our patrol units using their purchase
order with George Bates Automotive. In cooperation with George Bates Automotive,
the County has authorized the City to piggyback on their purchase order.
Public agencies often utilize other agencies formal bidding results to effect cooperative
purchases when the agreement between the agency and the vendor meets the
specifications of the using agency. Based on the performance of the last four units
refurbished by George Bates Automotive, staff feels they are a qualified company and
the vehicles being refurbished meet or exceed City specifications.
FISCAL IMPACT:
Funds in the amount of $54,000 have been budgeted in the 2001 -02 Equipment
Replacement Fund. The total cost for refurbishing three (3) Chevrolet Caprice patrol
vehicles is $54,000.
RECOMMENDATION:
It is recommended that the City Council:
1. Award a purchase contract to George Bates Automotive to refurbish three
(3) Chevrolet Caprice patrol vehicles in the amount of $54,000 for the Police
Department.
2. Waive the formal bidding process and authorize a cooperative
refurbishment using the Los Angeles County Sheriff's Department bid.
3. Authorize the City Manager to execute a contract in a form approved by the
City Attorney.

PASADENA FORD FOR THE PURCHASE OF TWO (2) 2002 FORD
CROWN VICTORIA 4 -DOOR SEDANS IN THE AMOUNT OF $47,662.24.
SUMMARY:
Staff is recommending that the City Council award a purchase contract to Pasadena
Ford for the purchase of two (2) 2002 Ford Crown Victoria 4 -door sedans in the amount
of $47,662.24. Funds in the amount of $60,000 have been budgeted for this acquisition
in this fiscal year's Equipment Replacement Fund.
DISCUSSION:
The 2001 -2002 Equipment Replacement Fund provides for the replacement of two (2)
Ford Crown Victoria sedans. These vehicles will replace a 1998 Crown Victoria (asset
#80035) for the City Manager and a 1995 Chevy Caprice (asset #60025) for Police
Investigation. Both of these units are high mileage vehicles that meet the requirements
of the City's vehicle replacement criteria policy.
Staff investigated the possibility of a cooperative purchase (commonly known as
piggybacking) with another larger municipality for vehicles with specifications equal to or
greater than the City of Arcadia's. The City of Pasadena, in cooperation with Pasadena
Ford, has authorized the City to piggyback on their purchase order. The purchase of
these vehicles at this particular time allows the City to benefit by receiving 2002 model
vehicles for the same price as the City of Pasadena received on May 22, 2001.

of the using agency. Staff has determined that Pasadena Ford is a qualified company

two -way radios and emergency lights will also be purchased out of this account for
these vehicles.

FOR A TOTAL COST OF $112,890.32
SUMMARY
Staff is recommending that the City Council award a purchase contract for one (1) 2002
Elgin Crosswind J Series Sweeper and exchange one (1) 1999 Elgin Air Sweeper with an
Elgin Crosswind J Series Sweeper in the amount of $112,890.32 to Haaker Equipment
Company. Funds in the amount of $135,000.00 have been budgeted in the Equipment
Replacement Fund in fiscal year 2001/02 for the acquisition of one (1) new street sweeper.
DISCUSSION
On September 7, 1999 the City Council approved the purchase of a new Street Sweeper at
a cost of $130,239.69 to assist in street sweeping operations that cover nearly 300 curb
miles of local roadway and to clean and maintain public parking areas throughout the City.
A 1999 Elgin Air Sweeper was received by the Department on January 19, 2000 to replace
one (1) 1990 Mobil Street Sweeper.
The vehicle was a new design concept, created to comply with anticipated new EPA
regulations, with an innovative, regenerative air cleaning process that essentially vacuums
pavement surfaces rather than the conventional sweeping method. The new vehicle was
designed to comply with the National Pollution Discharge and Elimination Systems
(NPDES) permit requirements by preventing street sweeping debris from being swept into
the local storm drain system by removing fine dirt particles from the street that are normally
left behind by traditional broom street sweepers.

Unfortunately, this street sweeper has spent the majority of its time in the vendors shop for
repairs. It has been unreliable due to mechanical problems primarily as a result of major
design modifications on the stabilization equipment, hopper system, hydraulic system and
electrical equipment. The Manufacturer alone has spent in excess of $30,000 in repair
costs associated with warranty related problems. The vendor has worked closely with
staff and has provided a loaner unit for the majority of the time the sweeper has been out
of service for repairs.
This street sweeper was purchased as a cooperative purchase (piggy- back), with the City
of Oakland. The City of Oakland's specifications for this street sweeper were equal to, or
greater than, the specifications proposed by the City of Arcadia. The City of Oakland, in
cooperation with Ricker Machinery Company, authorized the City to piggy -back on their
purchase order. The City of Oakland purchased five (5) of these units at the same time as
the City of Arcadia and has experienced similar problems with their units. During the last
several months, the City of Oakland and Arcadia staff shared information regarding
maintenance experiences and possible remedies with the manufacturer Elgin Sweeper
Company. Recently Oakland settled their dispute with Elgin but due to conditions included
in their settlement they are not at liberty to reveal the terms and conditions of the
settlement. Subsequently, staff negotiated a separate agreement requiring Elgin to replace
the Elgin Air Sweeper with a comparable unit.
Following considerable negotiations with Elgin Sweeper Company and Haaker Equipment
Company, they agreed to provide the City with a new street sweeper from the factory at no
additional charge to the City. However, the DMV requires that sales tax be paid on all new
vehicles registered in the State, requiring that a cost be established for a tax base. Elgin's
manufacturing cost of $96,802.00 was established for the tax base, making the sales tax
costs, for the exchange unit, $7,744.16.
As an additional part of the settlement Elgin was asked, by the City of Arcadia, if they
would consider selling a second unit at the same cost quoted for tax purposes. Elgin
agreed, with the understanding that this action resolves the City's dispute over the 1999
street sweeper and all associated problems. This settlement was reviewed by the City
Attorney and agrees with it in concept.
To validate the cost of this unit, staff asked Haaker Equipment to provide copies of invoices
for the similarly equipped sweepers. Eight invoices were submitted with purchase prices
ranging from a low of $106,500 to a high of $125,100. The invoices provided covered a
period from January 2000 through June 2001. Based on the average cost of $111,900.00
for a similarly equipped sweeper, staff feels the purchase base price of $96,902.00 is very
reasonable. Total price with tax for this unit is $104,654.16.
The Elgin Crosswind J Series Sweeper is a proven piece of equipment with several
successful years of operational history. Several local communities were contacted
regarding the reliability of these units and reported that they have been operating the
Crosswind sweeper for a number of years with good success. A demonstration unit was
also provided, by the distributor, for use by the Departments Equipment Operators for a

performance evaluation. All operators were impressed with the unit's performance and
found it to meet or exceed their operating expectations.
FISCAL IMPACT
Funds in the amount of $135,000.00 have been budgeted in the Equipment Replacement
Fund in fiscal year 2001/02 for the acquisition of a new street sweeper. The total cost to
purchase one (1) Elgin Crosswind J Series Sweeper is $104,654.16 and the cost to replace
the existing Elgin Air Sweeper represents sales tax of $7,744.16 for a total of $112,890.32.
RECOMMENDATIONS
It is recommended that the City Council:
1. Award a contract for the purchase of one (1) 2002 Elgin Crosswind J Series
Sweeper and replacement of one (1) 1999 Elgin Air Sweeper with one (1) 2002
Elgin Crosswind J Series Sweeper to the Haaker Equipment Company in the
amount of $112,890.32.
2. Waive competitive bidding process and award a contract in accordance with the
above recommendation.
3. Authorize the City Manager to execute a contract in a form approved by the City
Attorney.

SUMMARY
Tentative maps and final maps are required for all subdivisions that result in five or
more -parcels or condominiums. The City Council shall approve a final map if it
conforms to all the requirements of the subdivision regulations of the Municipal
• Code and the State Subdivision Map Act. It is recommended that the City Council
approve Final Map No. 53248 for an 8-unit residential condominium project at 1116
W. Huntington,Drive.

DISCUSSION
•
• Final Map No. 53248 has been reviewed by the Los Angeles County Department of
Public Works and the appropriate City Departments. Said map has been found to
be in substantial compliance with the tentative map, as approved by the Planning
Commission on October 24, 2000, and is in compliance with the subdivision
regulations of the Municipal Code and the State Subdivision Map Act.
RECOMMENDATION
The Development Services Department recommends approval of Final Map
No. 53248.

SUBJECT: Consideration of Final Map No. 53353 for a 5-unit residential
condominium project at 925 W. Duarte Rd.
SUMMARY
Tentative maps and final maps are required for all subdivisions that result in five or
more parcels or condominiums. The City Council shall approve a final map if it
conforms to all the requirements of the subdivision regulations of the Municipal
Code and the State Subdivision Map Act. It is recommended that the City Council
approve Final Map No. 53353 for a 5-unit residential condominium project at 925 W.
Duarte Rd.
DISCUSSION
Final Map No. 53353 has been reviewed by the Los Angeles County Department of
Public Works and the appropriate City Departments. Said map has been found to
be in substantial compliance with the tentative map, as approved by the Planning
Commission on January 23, 2001, and is in compliance with the subdivision
regulations of the Municipal Code and the State Subdivision Map Act.
RECOMMENDATION
The Development Services Department recommends approval of Final Map
No. 53353.

SUBJECT: REQUEST FOR DETERMINATION OF USE
RETAIL SALE OF WINE AND BEER IN THE CPD-1 ZONE
SUMMARY
Connie Hernandez who has a business located in the CPD-1 zone is requesting
a determination from the City Council, per Section 9260.1.4.(24) of the Arcadia
Municipal Code, that the sale of beer and wine become a compatible use in the
CPD-1 zone.
The Development Services Department is recommending denial of this use in the
CPD-1 zone.
BACKGROUND
The CPD-1 zone encompasses the general area north of the MTA railroad
tracks; east of Second Avenue; south of the 210 Freeway and west of Fifth
Avenue (map attached).
The CPD-1 regulations were adopted in 1981 and were designed to encourage
business and professional office uses, financial institutions, limited retail facilities
and service-oriented businesses. Other uses are permitted with a Conditional
Use Permit, such as eating establishments and health clubs.
In 1985, when the City Council was considering development proposals for both
the north and south side of Huntington Drive east of Second Avenue (the Arcadia
Landmark Center and the Arcadia Gateway Center),• it was apparent that the
market conditions at that time were such that consideration should be given to
allowing certain types of retail uses within this zoning designation that would be
compatible with other professional and/or services land uses. The Council

amended the code to allow "limited" commercial retail uses. A liquor store was
not included in the permitted uses.
In 1990, the City Council denied a request to allow "Convenience Stores" which
sell tobacco, beer and wine products in the CPD-1 zone. At that time the Council
noted that there are up-scale restaurants in the area and it was not felt that this
type of operation was compatible with other uses in that area.
REQUEST
Ms. Hernandez operates Sphinx Tobacco located in the Landmark Center. In
her letter she states she has received many requests from customers wanting to
buy wine and beer "so that they can go home and enjoy a glass of wine or a beer
with their cigar."
As noted in the background information, the original CPD-1 regulations were
adopted to primarily encourage business and professional office uses, financial
institutions, and very limited retail facilities and service-oriented businesses.
Typical retail/service uses in the CPD-1.zone include:
Printing services
Hair salon
Cleaners
Postal box service
Computer sales and academy
Golf shop
Travel shop
Florist
Gift shop
Tutorial school
Yogurt shop
Bakery
Tennis shop
Employment service
Mattress sales
Beauty supply
Gift shop
Swimming pool supply
Fast food establishments
Restaurants
The Development Services Department does not believe that the retail sales of
beer and wine is compatible with the CPD-1 uses described above. In addition, if
the retail sale of beer and wine is permitted in addition to the sales of tobacco
products, it becomes very similar to a "liquor store" or "convenience-type" store.

Redevelopment Agency staff has reviewed the proposal and does not believe it
is consistent with the intent and goals of the Agency when financial support was
provided for redevelopment projects in this area.
The City Council may:
1. Determine that the "sale of beer and wine" is a compatible use in the
CPD-1 zone and shall be a permitted retail use per Section 9260.1.6;
2. Determine that the "sale of beer and wine" should be permitted in the
CPD-1 zone only with an approved conditional use permit and
included in "Section 9260.1.12. Uses Subject to Conditional Use Permit";
or
3. Determine that the "sale of beer and wine" is not a compatible use in the
CPD-1 zone and, therefore, not a permitted use.
RECOMMENDATION
The Development Services Department recommends denial of Ms. Hernandez's
request to include the sale of beer and wine as a compatible use in the CPD-1
zone.
