Lewis, General Services�M ager; Jim Brophy, Warehouse Operations Subject: RECOMMENDATION TO APPROVE A CHANGE ORDER IN THE AMOUNT OF $20,000.00 TO WESTBURNE PIPE AND SUPPLY FOR THE PURCHASE OF VALVES, BRASS FITTINGS AND WATER RELATED MATERIALS Summary: Staff is requesting that the City Council approve a change order in the amount of $20,000.00 to Westburne Pipe and Supply increasing the existing purchase order from $29,000.00 to $49,000.00 for the purchase of valves, brass fittings and other related water parts for the remainder of this fiscal year. Discussion: Last July, bids were solicited for the purchase of valves, brass fittings and other related water repair parts. These bids were based on staff's projection of the number of parts needed for the next fiscal year. Since last summer, the Public Works Services Department established new procedures that allow developers and contractors to purchase water meters, valves and other water related parts from the City as part of the permit process. This enables the City to maintain quality control of the materials used in the City water system when private contractors install new or upgraded water services. As a result of the new procedures and the increased demand on the Department for these parts, it is necessary to purchase more parts and materials than originally planned. Westburne Pipe and Supply the lowest responsible bidder was awarded an annual purchase order for $29,000. They have agreed to hold prices previously agreed upon in the original Purchase order until the beginning of the new fiscal year July 1, 2002. This contract will be rebid for the next fiscal year. Lewis, General Services Mana er Ken Herman, Assistant Engineer SUBJECT: RECOMMENDATION TO REJECT THE BID SUBMITTED FOR CONSTRUCTION OF A SKATE PARK AND DIRECT STAFF TO REBID. FOR THE CONSTRUCTION OF A SKATE PARK AND TOT LOT AREA IN BONITA PARK SUMMARY The 2001-2002 Capital Improvement Program (CIP) includes the construction of a Skate Park to be located in the northeast portion of Bonita Park. In conjunction with this project the existing playground equipment will be relocated to a new playground area in the southeast portion of the Park. The final design and construction documents for this Park were completed in February 2002, and competitive bidding took place in February and March of 2002. As advertised, one sealed bid was received and opened by the City Clerk on March 12, 2002. Staff recommends that. the City Council reject the bid submitted for the construction of a Skate Park and direct staff to rebid for construction of a Skate Park and tot lot area BACKGROUND On December 5, 2000, the City Council authorized the retention of a professional landscape architect to conduct community workshops, collect and analyze. data, develop conceptual alternatives and to prepare final construction and bid documents for a skate park in the City of Arcadia. In October 2001, the City Council approved the conceptual design for the Skate Park. The final design, construction drawings, and specifications, completed in February 2002, incorporate the key.components suggested by the skaters into a 10,729 square- foot skateboard park. The relocation and reconstruction of the existing tot lot and the re-landscaping of the park area have been included in this capital program as part of the Park Rehabilitation Master Plan, also approved by the City Council. Estimated construction time for this facility is two (2) to three (3) months. LASER IMAGED ti Mayor and City Council �I ' March 19, 2002 Page 2 DISCUSSION - Notices inviting bids were published in the adjudicated paper and bid packages were distributed to qualified contractors. On March 4, 2002, a pre-bid conference and site walk was conducted and eleven (11) bidders attended. One (1) sealed bid was opened and publicly read by the City Clerk on March 12, 2002. The bid result is as follows: BIDDER LOCATION BID AMOUNT 4-Con-Engineering. Inc. Fontana $566,308.00 Staff contacted six (6) of the potential bidders to find out why they did not submit their bids. One (1) contractor did not submit his bid in time, and the other five (5) stated that they had other projects underway and decided not to submit a bid for this project. Because only one (1) bid was received and we know that there is at least one other potential bidder, staff recommends that the City Council reject the bid submitted for the construction of the Skateboard Park and direct staff to rebid the project. ENVIRONMENTAL IMPACT . This project is categorically exempt per Section 15301 class 1(c) from the requirements of the California Environmental Quality Act (CEQA). FISCAL IMPACT Funds in the amount of$300,000 were budgeted in the 2001-2002 Capital Improvement Program and $114,927 was authorized as part of the Park Master Plan to cover the cost of construction of the skateboard park, restroom, and related facilities. Reimbursement of funds will be requested from the County through Prop A for the work related to the tot lot area. Staff estimates that the Prop A funding could be approximately $55,000. Total funding available is approximately $470,000. RECOMMENDATION It is recommended that the City Council: . 1. Reject the bid sub mitted for the construction of the Arcadia Skateboard Park and Tot Lot 2. Direct staff to rebid for the construction of the Arcadia Skateboard Park and Tot Lot area. The Project,which involves the construction of Arcadia Skate Park in Bonita Park and relocation of existing playground equipment, must be completed within 68 calendar days, beginning ten (10) calendar days after the date on which the Notice of Award is sent by the Owner to the Contractor. Please Refer to Other Bid Documents: The Project is described in more detail in the Bid Documents. In particular, Bidders are strongly encouraged to review the Instructions to Bidders for more complete information regarding the submission of bids. Unless otherwise indicated, all capitalized terms shall have the meanings ascribed to them in the General Conditions for the Project. However, a person, firm, corporation or other entity that has submitted a subproposal to a bidder, or that has.quoted prices of materials to a bidder, is not thereby disqualified from submitting a subproposal or quoting prices to other bidders submitting a bid to the Owner. Contractors shall possess the following California Contractor's licenses in order to perform the Work:A or B. Subcontractors must possess the appropriate licenses for each specialty subcontracted. The bidders are to be experienced with the skate parks construction and must have successfully constructed at least 3 skate parks in the last 3 years in order to qualify to bid the project; Owner's Rights: Owner reserves the right to reject any or all Bids, to waive any informality or irregularity in any Bid received, and to be the sole judge of the merits of the respective Bids received. The award, if made, will be made to the lowest responsible bidder whose bid is determined responsive to the Bid Documents. Prevailing Wages: Bidders are advised that this Contract is a public work for purposes of the California Labor Code, which requires payment of prevailing wages. Owner has obtained from the Director of the Department of Industrial Relations the general prevailing rate of per diem wages and the general prevailing rate for holiday and overtime work. These rates will be on file at the Owner's office and they will be made available to any interested party upon request. Each Contractor to whom a Contract is awarded must pay the prevailing rates, post copies thereof at the job site and otherwise comply with applicable provisions of state law. Substitution for Retentions: Bidders are advised that if awarded this Contract they will be permitted, at their request and expense and in accordance with Section 22300 of the California Public Contract Code, to substitute securities equivalent to monies withheld by the Owner to insure performance under the Contract. Diversion of Recyclable Waste Materials: In support of the Owner's waste reduction and recycling efforts, Contractor will be required to divert all Recyclable Waste Materials to appropriate recycling centers rather than area landfills. For purposes of this requirement, Recyclable Waste Materials shall include asphalt, concrete, brick, concrete block and rock. Contractor will be required to submit weight tickets and written proof of diversion with its monthly progress payment requests. PROPOSAL AND ANALYSIS In February 2002, Westfield- Shoppingtown submitted revised, plans, for a 276,000+ square foot expansion, (net 208,000 sq. ft.) tO the existing mall arid construction of an at grade plus three level parking structure to accommodate 630 vehibles. The proposed plans are similar in design to the previously approved project; however, some of the uses have changed. The revised plan includes a multi- screen theater, restaurants and retail tenants including a bookstore, sporting goad' 'store and entertainment uses.' The square footage devoted to these uses is as follows: 104,000+ sq. ft. of retail 20,000 sq. ft. of restaurants 8,400+ sq ft. food court 86;000+ sq ft of specialty stores 58 000 sq ft of movie theaters—18 screens 3,000-4,000 seats. • • Architectural Design Review Mall Buildings , The existing mall contains 922,451 sq. ft of gross leasable area Westfield is proposing a 208,100 sq ft gross leasable area expansion to the existing mall (the total gross floor area is 276,300 sq. ft.). SUBJECT: PUBLIC HEARING AND CONSIDERATION OF A PROPOSED GENERAL PLAN AMENDMENT (G.P. 02-001) TO CHANGE THE GENERAL PLAN LAND USE DESIGNATION FROM COMMERCIAL TO MULTIPLE-FAMILY RESIDENTIAL (24 DU/AC MAX) AT 1510- 1516 SOUTH BALDWIN AVENUE SUMMARY General Plan Amendment Application No. GP 02-001 was submitted by Hank Jon , to amend the General Plan Land Use Designation from Commercial to Multiple Family Residential (24 :du/ac max.) at 1510-1516 S. Baldwin Avenue. The Development Services Department is recommending approval of this General PI n Amendment. The Planning Commission at its February 12, 2002 meeting voted 3-0 with o members absent to adopt Resolution 1667 recommending approval of the Gene al Plan Amendment from Commercial to Multiple-Family Residential (24 du/ac max). DISCUSSION • The subject site contains 20,189 square feet (0.46 acres) and is currently developed with a cleaners and four multiple-family dwellings constructed in 1950. The northerly 23'-4" foot wide portion of the site is zoned C-2 and the remaining 100'-0" foot w de southerly portion is zoned R-3. The General Plan designation for the entire sit is Commercial (see attached General Plan Map). The applicant is requesting a General Plan amendment to change the General Plan designation to Multiple-Family Residential 24 du/ac. The property to the north is developed with the Firestone TBA building and zo r ed C-2, properties to the east and south are zoned R-2 and R-3 respectively and developed with multiple-family dwellings; property to the west across Baldwin • LASER IMAGED • developed . with multiple-family dwellings; property to the west across Baldwin Avenue is developed with an office building and zoned C-2; properties to the south of the office building are zoned R-3 and developed with assisted housing (see aerial). The northerly 23+' of this site is zoned C-2 which is consistent with the "Commercial" General Plan designation. However, the remaining 100'-0" southerly feet is zoned R-3 which is inconsistent with the "Commercial" designation.. In order to permit a use consistent with the "Commercial" General Plan designation, the zoning would have to be changed on the southerly 100'-0" of property from R-3 to C-2. The C-2 zone allows such uses as retail, office and service-oriented businesses. It is the Development Services Department's opinion that this site is more appropriately suited for multiple-family residential than commercial. The site abuts properties developed with multiple-family units to the east and south. The General Plan designation of Multiple-Family (24 du/ac max.) would be consistent with the General Plan designation for the neighboring properties to the south and with the R-3 zoning on the major portion of the subject property. In addition, generally multiple-family development has less of an impact on adjacent residential properties than a commercial development. This General Plan amendment is the first'step in changing the land use designation and aligning the zoning boundaries with the northerly lot line of 1510-1516 South ' Baldwin Avenue. If this proposed General Plan amendment is approved the next step will be for the applicant to request a zone change from C-2 to R-3 for the northerly 23+ feet of the property. The long-term goal of the applicant is to develop this site with a condominium project, consistent with other development to the south and east. In order to subdivide a property into condominium units, State law requires that the zoning and the general plan be consistent. Planning Commission Recommendation The Planning Commission at its February 12, 2002 meeting voted 3-0 with two members absent to adopt Resolution 1667 recommending approval of the General Plan Amendment. It was the consensus of the Planning Commission that the General Plan Amendment to "Multiple-Family Residential" was the appropriate designation for this site rather than "Commercial" and would provide consistency between the General Plan and the Zoning. CC GP 02-001 March 19, 2002 Page 2 of 3 1 CEQA Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has prepared an initial study for the proposed project. Said initial study did not disclose any substantial or potentially substanti I adverse change in any of the physical conditions within the area affected by t e project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there �s no evidence that the proposed project will have any potential for adverse effect n wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this General Plan amendment. RECOMMENDATION The Development Services Department recommends approval of General PI n amendment G.P. 02-001 changing the General Plan designation for the properties at 1510-1516 South Baldwin Avenue from commercial to Multiple-Family Residential (24 du/ac).
