HomeMy WebLinkAbout6994RESOLUTION NO. 6994 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING CONDITIONAL USE PERMIT NO. CUP 13- 10 AND ARCHITECTURAL DESIGN REVIEW FOR THE CONSTRUCTION OF A 2,650 SQUARE FOOT MUSEUM EDUCATION CENTER ADJACENT TO THE GILB MUSEUM OF ARCADIA HERITAGE AT 380 WEST HUNTINGTON DRIVE AND FINDING THAT THIS PROJECT QUALIFIES AS A CATEGORICAL EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) WHEREAS, on August 26, 2013, applications were filed by TKE Construction, Inc. on behalf of the City Arcadia for the construction of a 2,650 square foot Museum Education Center adjacent to the Gilb Museum of Arcadia Heritage at 380 West Huntington Drive, Development Services Department Case Conditional Use Permit Application No. CUP 13 -10 and Architectural Design Review; and WHEREAS, on September 17, 2013, a public hearing was held before the City Council on said application, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the staff report dated September 17, 2013, are true and correct. SECTION 2. That this City Council finds: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. The project will not be detrimental in any way to the public health or the surrounding area. In fact, the project will benefit the public in many ways by providing additional educational options and opportunities for Arcadia residents. The construction of the building will also enhance the surrounding area and improve the connectivity between the three public buildings in this area. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. An educational building is exactly the type of use contemplated by the Public /Semi - Public zone. The City has made a commitment to going through its own CUP process in this zone to allow an opportunity for the public to be involved in all decisions should they choose to be. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. The Public /Semi Public zone is very flexible with regard to development standards. The Museum Education Center will be sited in such a way as to property fit into a fairly small space between the existing Gilb Museum of Arcadia Heritage and the Arcadia Community Center. The site is clearly adequate in size and shape to accommodate the building and all associated landscaping and hardscape. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. The site is located along Huntington Drive and also would have access to associated parking from Campus Drive. Clearly, these streets are adequate to serve the proposed use. 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. The General Plan has set aside a specific designation for public and semi - public uses in specific areas throughout the City. These locations -2- currently house City Hall, the Police and Fire Department locations, and the Community Center and Museum. The siting of this use carries out the intent of the General Plan. 6. That as new construction of a small structure, this project qualifies as a Class 3 Categorical Exemption per the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15303 of the CEQA Guidelines. SECTION 3. That for the foregoing reasons, this City Council approves Conditional Use Permit No. CUP 13 -10 and Architectural Design Review for the construction of a 2,650 square foot Museum Education Center adjacent to the Gilb Museum of Arcadia Heritage at 380 West Huntington Drive.
