SUBJECT: ACCEPT ALL WORK PERFORMED BY THE ORIGINAL MOWBRAY'S
TREE SERVICE FOR THE REMOVAL OF STONE PINE TREES (PHASE
3) PROJECT AS COMPLETE AND AUTHORIZE THE FINAL PAYMENT
TO BE MADE IN ACCORDANCE WITH THE CONTRACT DOCUMENTS
Recommendation: Approve
SUMMARY
On October 16, 2012, the City Council awarded a contract to The Original Mowbray's
Tree Service in the amount of $76,270, for Removal of Stone Pine Trees (Phase 3)
Project. The terms and conditions of this project have been complied with and the work
has been performed satisfactorily for a total project cost of $71,394.20. This amount
reflects the original contract amount of $76,270 minus quantity changes totaling
$4,875.60 or 7% below the original contract amount.
The terms and conditions of this project have been complied with, and the required work
has been performed to staff's satisfaction. It is recommended that the City Council
accept all work performed by The Original Mowbray's Tree Service as complete and
authorize the final payment to be made in accordance with the contract documents.
DISCUSSION
Over the years, the Stone Pine trees in the Highland Oaks area north of Elkins Drive
have caused significant damage to City streets, curbs and gutters, sewer laterals,
sprinkler systems, and private property hardscape. There have also been several
instances when trees or tree limbs have fallen due to the size of the trees. In response
to hazards associated with these massive trees, the Public Works Services Department
had an arborist review each Stone Pine tree in the Highland Oaks neighborhood and
assess the condition of the tree.

At the August 3, 2010 study session, the City Council directed the Public Works
Services Department to move ahead with its plan to remove the Stone Pine trees in the
Highland Oaks neighborhood north of Elkins Drive, and plant a replacement tree subject
to the tree species in the Urban Forest Master Plan. On October 16, 2012, the City
Council awarded a contract to The Original Mowbray's Tree Service for Removal of
Stone Pine Trees (Phase 3) Project in the amount of $76,270. The terms and
conditions of the tree removal contract have been complied with and the work has been
performed satisfactorily for a total project cost of $71,394.20. This amount reflects the
original contract amount of $76,270 minus quantity changes totaling $4,875.60 or 7%
below the original contract amount.
FISCAL IMPACT
$140,000 has been budgeted in the Fiscal Year 2012 -13 Capital Improvement Budget
for Phase 3 of the Project to rehabilitate City streets damaged by the Stone Pine trees
and to remove and replace the Stone Pine trees. This portion of the work was
completed for $71,394.20, which is within the approved contract budget.
RECOMMENDATION
It is recommended that the City Council accept all work performed by the Original
Mowbray's Tree Service for the removal of Stone Pine Trees (Phase 3) Project as
complete and authorize the final payment to be made in accordance with the contract
documents
