Quach, Administrative Services Director Heather McDowell, Senior Human Resources Analyst SUBJECT: AUTHORIZE AND DIRECT THE CITY MANAGER TO EXECUTE AN AGREEMENT FOR PROFESSIONAL SERVICES WITH THE STATE OF CALIFORNIA OFFICE OF ADMINISTRATIVE HEARINGS IN AN AMOUNT NOT TO EXCEED $20,000 FOR FISCAL YEAR 2013 -14 Recommendation: Approve SUMMARY It is recommended that the City Council authorize the City Manager to execute an agreement for professional services with the State of California Office of Administrative Hearings (OAH) in an amount not to exceed $20,000 for Fiscal Year 2013 -14. DISCUSSION The Office of Administrative Hearings provides local agencies with hearing and mediation services pursuant to Government Code section 27727. The OAH conducts personnel and disciplinary hearings for local agencies. In order to utilize these services, the City of Arcadia must execute a Standard Agreement for Local Agencies with the OAH. In December of 2012, the City of Arcadia's Fire Department adopted a Departmental Policy in accordance with the Firefighters Procedural Bill of Rights (FBOR), entitled FBOR and Appeals Process. The FBOR provides governance over discipline of fire personnel, including allowing sworn fire personnel the right to an Administrative Law Judge (ALJ) to preside over Human Resources Commission hearings, in compliance with Government Code §11512(b). The purpose of the ALJ is to advise the Human Resources Commission on matters of law and rule on the admission or exclusion of evidence. The City must secure the services of the Office of Administrative Hearings to fulfill this responsibility. Agreement For Administrative Hearing Services October 15, 2013 Page 2 of 2 The current billing rates for the Administrative Law Judges are $187 per hour. Additional costs may include hearing reporters, transcript costs, and filing fees of $80 per case. These rates will remain the same during the term of the agreement. It is recommended the City Council authorize and direct the City Manager to execute an agreement for professional services with the State of California Office of Administrative Hearings in an amount not to exceed $20,000. FISCAL IMPACT Adequate funding has been allocated in the Fiscal Year 2013 -14 Budget for the agreement with the Office of Administrative Hearings. RECOMMENDATION It is recommended the City Council authorize and direct the City Manager to execute an agreement with the State of California Office of Administrative Hearings in an amount not to exceed $20,000 for Fiscal Year 2013 -14 for professional services.
