Huntington Dr., Arcadia Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from Planning Services at 626-574-5423. CALL TO ORDER PLEDGE OF ALLEGIANCE ROLL CALL: Ed Beranek, Chairman Bill Baerg, Commission Member Ching Chiao, Commission Member Sam Falzon, Commission Member Tony Parrille, Commission Member SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS PUBLIC COMMENTS (5 minute time limit per person) Each speaker is limited to five(5)minutes per person, unless waived by the Planning Commission. Under the Brown Act, the Members are prohibited from discussing or taking action on any items not listed on the posted agenda. The matter will be referred to staff for an appropriate response, or will be placed on the agenda of a future meeting. PUBLIC HEARINGS All interested persons are invited to appear at a public hearing and to provide evidence or testimony concerning any of the proposed items set forth below for consideration. Separate and apart from the applicant(who may speak longer in the discretion of the Commission) speakers shall be limited to five (5) minutes per person. The applicant may additionally submit rebuttal comments, at the discretion of the Commission. You are hereby advised that should you desire to legally challenge in court any action taken by the Planning Commission regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Planning Commission at, or prior to,the public hearing. 1. Resolution No. 1884 - Conditional Use Permit No. CUP 13-11, Zone Variance No. ZV 13-02, Architectural Design Review No. ADR 13-32 and Lot Line Adjustment No. LLA 13-03 with a Negative Declaration per the California Environmental Quality Act (CEQA) to complete the Purchase and Sale Agreement between the City of Arcadia and the Paul P. Rusnak Family Trust for expansion of an auto dealership with a new 25,000 square-foot showroom and an ancillary service/storage/parking structure of 78,000 square feet. Applicant: Paul P. Rusnak Family Trust and the City of Arcadia as Successor Agency to the Arcadia Redevelopment Agency Any writings or documents provided to a majority of the Planning Commission regarding any item on this agenda will be made available for public inspection in the City's Planning Services Office located at 240 W Huntington Olive, Arcadia, California, during normal business hours. Recommended action: Approve CUP 13-11, Zone Variance No. 13-02, Architectural Design Review No. 13-32 and Lot Line Adjustment No. 13-03; adopt a Negative Declaration per CEQA; and adopt Resolution No. 1884. There will be a ten (10) day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Monday, November 4, 2013. 2. Appeal of the Arcadia Modification Committee's conditions of approval for Modification No. MC 13-18 and Single-Family Architectural Design Review No. SFADR 13-48 for setback Modifications and Single-Family Architectural Design Review for 1,171 square feet of one-story additions to an existing 2,749 square- foot, one-story, single-family residence at 136 W. Sandra Avenue. Appellant: Silvia Yu, daughter of Yueh Yu, Property Owner Applicant Felicia Fan of JWL Associates, Designer Recommended action: Deny appeal and uphold the Modification Committee's conditions of approval. There is a five (5) working day appeal period after the approval/denial of the appeal. Appeals to the City Council are to be filed by 5:30 p.m. on Tuesday, October 29, 2013. 3. Modification Application No. MP 13-11 with a Class 5 Categorical Exemption from the California Environmental Quality Act (CEQA) for side yard setback Modifications for a 1,429 square-foot, two-story addition to an existing 3,482 square-foot, one-story, single-family residence at 2251 Highland Oaks Drive. Applicant Stepan Vartanian and Linda Vartanian, property owners Recommended action: Find that this project is exempt from CEQA, and conditionally approve MP 13-11. There is a five (5) working day appeal period after the approval/denial of the Modifications. Appeals are to be filed by 5:30 p.m. on Tuesday, October 29, 2013. 4. Resolution No. 1882 - Tentative Parcel Map No. TPM 13-08 (72493), Modification No. MP 13-05 and Multiple-Family Architectural Design Review No. MFADR 12-07 with a Class 32 Categorical Exemption from the California Environmental Quality Act (CEQA) for a three-unit, residential condominium development at 20 Alta Street. Applicant: Twen Ma, Architect Recommended action: Find that this project is exempt from CEQA, conditionally approve TPM 13-08 (72493), MP 13-05 and MFADR 12-07, and adopt Resolution No. 1882. There is a ten (10) day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Monday, November 4, 2013. 5. Resolution No. 1883 -Tentative Parcel Map No. TPM 13-10 (72515) and Multiple- Family Architectural Design Review No. MFADR 13-20 with a Class 3 Categorical Any writings or documents provided to a majority of the Planning Commission regarding any item on this agenda will be made available for public inspection in the City's Planning Services Office located at 240 W. Huntington Drive, Arcadia, California, during normal business hours. Exemption from the California Environmental Quality Act (CEQA) for a two-unit, residential condominium development at 214 El Dorado Street. Applicant Sung Lam Chan, Designer Recommended action: Find that this project is exempt from CEQA, and conditionally approve TPM No. 13-10 (72515) and MFADR 13-20 and adopt Resolution No. 1883. There is a ten (10) day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Monday, November 4, 2013. 6. Resolution No. 1885 - Tentative Parcel Map No. TPM 13-11 (72502), Modification No. MP 13-08, and Multiple-Family Architectural Design Review No. MFADR 13- 18 with a Class 3 Categorical Exemption from the California Environmental Quality Act (CEQA) to consolidate two existing parcels and develop a four-unit, residential condominium with a Modification for a 25'-0° street side yard setback along Third Avenue in lieu of the minimum 35'-0" special setback requirement at 316-324 S. Third Avenue. Applicant: Robert Tong, Designer Recommended action: Find that this project is exempt from CEQA, and conditionally approve TPM No. 13-11 (72502), MP 13-08, and MFADR 13-18 and adopt Resolution No. 1885. There is a ten (10) day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Monday, November 4, 2013. CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine and can be acted on by one roll call vote. There will be no separate discussion of these items unless members of the Commission, staff, or the public request that specific items be removed from the Consent Calendar for separate discussion and action. 7. Minutes of the October 8, 2013, Regular Meeting of the Planning Commission Recommended action: Approve MATTERS FROM CITY COUNCIL LIAISON MATTERS FROM PLANNING COMMISSIONERS MATTERS FROM MODIFICATION COMMITTEE MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS ADJOURNMENT The Planning Commission will adjourn this meeting to November 12, 2013, at 7:00 p.m., in the City Council Chamber at 240 W.
