REGULAR MEETING MINUTES
TUESDAY, OCTOBER 1, 2013
CALL TO ORDER - Mayor Segal called the meeting to order at 6:00 p.m. in the Council Chamber
Conference Room.
ROLL CALL OF CITY COUNCIL MEMBERS
PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal
ABSENT: None
PUBLIC COMMENTS
Attorney Chris Sutton and his client, Ron Mills, appeared and distributed information from the Gold Line
Construction Authority; they made comments regarding the potential closure of a driveway near the
intersection of First Avenue and Santa Clara; they stated that the Public Utilities Commission (PUC)
approved a plan for the intersection that left the driveway open and are concerned that the City may
attempt to close the driveway through the Conditional Use Permit process.
CLOSED SESSION
a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators:
City Negotiators: Dominic Lazzaretto, City Manager
Employee Organizations: Arcadia Public Works Employees Association, Arcadia City
Employees Association, Arcadia Police Civilian Employees Association, Arcadia

employees.
The Closed Session ended at 7:00 p.m.

REPORT FROM CITY ATTORNEY ON CLOSED SESSION ITEM
City Attorney Deitsch reported that the City Council convened a Special Meeting to consider the
one item listed on the Special Meeting posted agenda under Closed session; no reportable action
was taken; he further reported that the City Council met in a Closed Session to consider the one
item listed on the regular posted agenda under Closed Session; no reportable action was taken.
SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS
City Manager Lazzaretto announced there was no supplemental agenda information.
MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE
READING IN FULL
A motion was made by Council Member Amundson, seconded by Council Member Harbicht, to
read all ordinances and resolutions by title only and waive the reading in full. Seeing no objections,
the motion was deemed to be approved.
PRESENTATIONS
a. Proclaiming October 6 -12 as Fire Prevention Week.
1. PUBLIC HEARING
a. Resolution No 6995 upholding the appeal of the Planning Commission denial of
Modification No MP 13 -09 and Single - Family Architectural Design Review No.
SFADR 12 -106 with a Class 5 categorical exemption from the California
Environmental Quality Act (CEQA) for a new 7,322 square -foot, two - story, sing-le-
family residence at 2314 S Santa Anita Avenue. (Continued from September 17,
2013
Recommended Action: Uphold the appeal, find that the project is exempt from
CEQA, conditionally approve the applications, and adopt Resolution No. 6995
City Manager Lazzaretto announced that, due to a miscommunication on his part, he requested the
City Council pull Public Hearing item 1.a again and continue it to the October 15 meeting in order to
provide Mayor Pro Tern Wuo, who was not present at the September 17, 2013, City Council
meeting, an opportunity to review the tape and be able to fully participate in the deliberations for the
item.
It was moved by Council Member Harbicht, seconded by Council Member Kovacic and carried on
roll call vote to continue Public Hearing item 1.a to the October 15, 2013, City Council Meeting.

Mayor Segal apologized to the applicant for the miscommunication, and explained that in order for
Mayor Pro Tern Wuo to participate in the deliberations, he is required to view the tape.

REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City
Council related to meetings attended at City expense [AB 1234]).
Council Member Kovacic, wished a happy 96th birthday to Mildred Shaw who has been a
tremendous asset to the community for many years; he voiced his concerns regarding the
proliferation of abandoned shopping carts on City streets, that he would like to see the development
of a better program, and informed residents of the City's process concerning the reporting of
abandoned shopping carts.
In response to an inquiry by Council Member Amundson, City Manager Lazzaretto confirmed that
staff is in the process of preparing an updated shopping cart ordinance; and provided information
on how to report abandoned shopping carts.
Mayor Pro Tern Wuo also voiced his concern regarding the enforcement of abandoned shopping
carts; and announced that October 1 is the People's Republic of China's National Holiday and
October 10 is the Republic of China and Taiwan's National Holiday and wished them the best.
Council Member Amundson commented on the cost of living for seniors and reminded everyone
that seniors can opt out of the Arcadia Unified School District's latest parcel tax by submitting an
exemption application to the District; he acknowledged the positive number of Arcadia Beautiful
Commission applications received and encouraged residents who are interested in serving on a
board or commission to attend a City Council meeting and speak to the City Council; and expressed
concern that businesses are not being given enough notice by the Gold Line on construction and
street closures and asked that everyone be patient during the construction period.
Council Member Harbicht had no comments.
City Clerk Glasco announced that on October 5, following the Historical Society's general meeting,
a presentation on the Thoroughbred Walk of Champions project will be given and invited everyone
to attend.
Mayor Segal commented on the ground breaking of the new Museum Education Center that took
place last Sunday; he expressed appreciation to the Arcadia Museum Foundation for raising the
funds needed to build the Museum Education Center, and he thanked the City Council for their
participation and support of the project; he congratulated Mayor Pro Tern Wuo and his wife, Jane
who will be honored at the Methodist Hospital Crystal Ball on October 19, and encouraged
everyone to attend and enjoy a performance by Smokey Robinson; and announced that the City of
Arcadia will be participating in the Foothill Fitness Challenge and Health Fair at the City of Hope on
October 5, and encouraged everyone to participate in the one mile walk challenge.
2. CITY CLERK ITEMS
a. Appointments to the Arcadia Beautiful Commission.
Recommended Action: Make Appointments
City Clerk Glasco presented the staff report and opened up the nominations.
Council Member Harbicht nominated Richard Cordano for reappointment, and to appoint Michael Reza
and Jean Voznick to the Arcadia Beautiful Commission for four year terms ending June 30, 2017.
Council Member Kovacic nominated Nestor Peig.

Seeing no other nominations, Council Members cast their votes as follows:

Based on the votes cast, Richard Cordano was reappointed, and Nestor Peig and Jean Voznick were
appointed to the Arcadia Beautiful Commission for four year terms ending June 30, 2017.
It was the consensus of the City Council that they were pleased with the number of applications
received as a result of the recruitment process.
City Manager Lazzaretto stated that staff will continue to conduct similar extensive recruitments to fill
future vacancies on all boards and commissions. He further stated that staff and the Commission would
look for ways to keep those who were not appointed involved in the community in some way.
In response to a question raised by Council Member Kovacic regarding the number of Commission
Members, City Attorney Deitsch explained that the number of members on the Commission is specified
by City Council resolution or ordinance.
3. CONSENT CALENDAR
a. Approve the Regular Meeting Minutes of September 17, 2013.
Recommended Action: Approve
b. Approve the closure of specific City streets for the 60th Annual Festival of Bands
Parade on Saturday, November 16, 2013.
Recommended Action: Approve
C. Accept all work performed by Doug Martin Contracting, Inc. for the 2012 -13 Annual
Slurry Seal Project as complete; authorize the final payment to be made in
accordance with the contract documents, subject to retention of $25,245.26; and
appropriate an additional $29,591 from Proposition C Funds to be included in the
project budget.
Recommended Action: Accept
d. Authorize and direct the City Manager to approve the purchase of a 2013 all- electric
aerial lift truck from Zerotruck Corporation in the amount of $65,907 and appropriate
an additional $20,000 of AQMD Grant Funds to be included in the budget.

e. Authorize and direct the City Manager to execute an agreement with EBSCO
Information Services for library subscription services for a period of one (1) year with
an option to renew for a maximum of three (3) additional one (1) year terms.

f. Authorize and direct the Citv Manager to execute a contract with CDW Government
LLC for the purchase and installation of Smart Classroom equipment for Fire Station
106 utilizing 2012 State Homeland Security Grant Program funds in an amount not to
exceed $75,000.
Recommended Action: Approve
g. Reiect the apparent low bid from Sully - Miller Contracting Company, due to a
nonresponsive bid, authorize and direct the City Manager to execute a contract with
Gentry Brothers Inc. in the amount of $537,627.25 for the Rehabilitation of the
Asphalt Pavement on First Avenue between Duarte Road and Camino Real Avenue,
and on Tenth Avenue between Camino Real Avenue and the southerly City limit,
approve a 10% contingency, approve an additional appropriation of $48,000 from
STP -L funds and $12,000 from Gas Tax funds, and approve the project as
categorically exempt pursuant to Section 15301, Class 1(c) from the requirements of
the California Environmental Quality Act (CEQA).

It was moved by Council Member Amundson, seconded by Mayor Pro Tern Wuo, and carried on roll
call vote to approve Consent Calendar items 3.a through 3.g.
