PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chiao, Falzone, Pamile and Beranek ABSENT: None SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS A memo relating to Item 1 was distributed to the Planning Commissioners. PUBLIC COMMENTS None. PUBLIC HEARINGS 1. Resolution No. 1884 - Conditional Use Permit No. CUP 13-11, Zone Variance No. ZV 13-02, Architectural Design Review No. ADR 13-32 and Lot Line Adjustment No. LLA 13-03 with a Negative Declaration per the California Environmental Quality Act (CEQA) to complete the Purchase and Sale Agreement between the City of Arcadia and the Paul P. Rusnak Family Trust for expansion of an auto dealership with a new 25,000 square-foot showroom and an ancillary service/storage/parking structure of 78,000 square feet. Applicant: Paul P. Rusnak Family Trust and the City of Arcadia as Successor Agency to the Arcadia Redevelopment Agency Recommended action: Approve CUP 13-11, Zone Variance No. 13-02, Architectural Design Review No. 13-32 and Lot Line Adjustment No. 13-03; adopt a Negative Declaration per CEQA; and adopt Resolution No. 1884. Economic Development Manager, Jerry Schwartz and Planning Services Manager, Lisa Flores presented the staff report. They said that staff is recommending the addition of two more conditions of approval. Condition Number 22 requires the applicant to cooperate in the restriping of Santa Clara Street to provide a center left turn lane and Condition Number 23 states that the building site shall be consolidated into one parcel at the expense of the applicant. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. The following responded: David Leckie, represented the applicant 10-22-13 Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Perri Ile, seconded by Commissioner Falzone, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Panille, seconded by Commissioner Falzone,to approve Conditional Use Permit No. CUP 13-11, Zone Variance No. 13-02, Architectural Design Review No. 13-32 and Lot Line Adjustment No. 13-03; adopt a Negative Declaration per CEQA; and adopt Resolution No. 1884 based on the findings and conditions recommended in the staff report and the two additional conditions recommended by staff. ROLL CALL AYES: Commissioners Baerg, Chiao, Faizone, Perrilie and Beranek NOES: None There will be a ten (10) day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Monday, November 4, 2013. 2. Appeal of the Arcadia Modification Committee's conditions of approval for Modification No. MC 13-18 and Single-Family Architectural Design Review No. SFADR 13-48 for setback Modifications and Single-Family Architectural Design Review for 1,171 square feet of one-story additions to an existing 2,749 square-foot, one-story, single-family residence at 136 W. Sandra Avenue. Appellant: Silvia Yu, daughter of Yueh Yu, Property Owner Applicant Felicia Fan of JWL Associates, Designer Recommended action: Deny appeal and uphold the Modification Committee's conditions of approval. Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if Ms. Fan would like to speak in favor of this appeal. Ms. Fan was not present Chairman Beranek asked if Ms. Hu would like to speak in favor of this appeal. Silvia Hu responded with the assistance of a translator. Chairman Beranek asked if anyone else would like to speak in favor of this appeal. There were none. 10-22-13 Chairman Beranek asked if anyone would like to speak in opposition to this appeal. There were none. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to dose the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Falzone, to find that this project is exempt from CEQA and to deny the appeal and uphold the Modification Committee's conditions of approval based on the findings in the staff report. ROLL CALL AYES: Commissioners Baerg, Chiao, Falzone, Perri Ile and Beranek NOES: None There is a five (5) working day appeal period after the approval/denial of the appeal. Appeals to the City Council are to be filed by 5:30 p.m. on Tuesday, October 29, 2013. 3. Modification Application No. MP 13-11 with a Class 5 Categorical Exemption from the California Environmental Quality Act(CEQA) for side yard setback Modifications for a 1,429 square-foot, two-story addition to an existing 3,482 square-foot, one- story, single-family residence at 2251 Highland Oaks Drive. Applicant Stepan Vartanian and Linda Vartanian, property owners Recommended action: Find that this project is exempt from CEQA, and conditionally approve MP 13-11. Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. There were none Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Falzone, to close the Public Hearing. Without objection the motion was approved. 10-22-13 MOTION It was moved by Commissioner Parril le, seconded by Commissioner Falzon, to find that this project is exempt from CEQA, and conditionally approve MP 13-11 based on the findings and conditions in the staff report. Resolution No. 1882 - Tentative Parcel Map No. TPM 13-08 (72493), Modification No. MP 13-05 and Multiple-Family Architectural Design Review No. MFADR 12-07 with a Class 32 Categorical Exemption from the California Environmental Quality Act(CEQA)for a three-unit, residential condominium development at 20 Alta Street. Applicant Twen Ma, Architect Recommended action: Find that this project is exempt from CEQA, conditionally approve TPM 13-08 (72493), MP 13-05 and MFADR 12-07, and adopt Resolution No. 1882. Associate Planner, Tim Schwehr, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. Applicant Sung Lam Chan, Designer Recommended action: Find that this conditionally approve TPM No. 13-10 (725155)�and MFADR from-20 and and No. 1883. adopt Planner, Jordan Chamberlin, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. The following responded. Resolution No. 1885 - Tentative Parcel Map No. TPM 13-11 (72502), Modification No. MP 13-08, and Multiple-Family Architectural Design Review No. MFADR 13-18 with a Class 3 Categorical Exemption from the California Environmental Quality Act (CEQA) to consolidate two existing parcels and develop a four-unit, residential condominium with a Modification for a 25'-0" street side yard setback along Third Avenue in lieu of the minimum 35'-0" special setback requirement at 316-324 S. Third Avenue. Applicant Robert Tong, Designer Recommended action: Find that this project is exempt from CEQA, and conditionally approve TPM No. 13-11 (72502), MP 13-08, and MFADR 13-18 and adopt Resolution No. 1885. Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. Robert Tong, Designer, responded. Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Falzon, seconded by Commissioner Chiao, to close the Public Hearing. Without objection the motion was approved. MOTION It was moved by Commissioner Parri lle, seconded by Commissioner Falzon, to find that this project is exempt from CEQA, and conditionally adopt Resolution No. 18 5 based on (72502), MP 13-08, and MFADR 1 the findings in the staff report. Minutes of the October 8, 2013, Regular Meeting of the Planning Commission Recommended action: Approve 10-22-13 MOTION It was moved by Commissioner Faizone, seconded by Commissioner Perri Ile, to approve the minutes of October 8, 2013. Without objection the motion was approved. MATTERS FROM COUNCIL LIAISON, JOHN WUO There was nothing to report. FROM PLANNING COMMISSIONERS There was nothing to report. MATTERS FROM MODIFICATION COMMITTEE Commissioner Faizone reported that the Modification Committee approved two applications; modifications for parking for a dental office and a small addition to a home. MATTERS FROM STAFF INLCUDING UPCOMING AGENDA ITEMS Mr. Kasama said the next agenda will include the update of the Housing Element of the General Plan, two Conditional Use Permit applications and an application for a lot split on Eighth Avenue. ADJOURNMENT Chairman Beranek adjourned this meeting at 8:22 p.m. to November 12, 2013, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
