HomeMy WebLinkAboutItem 1a - Special and Regular Meeting Minutes for November 5, 201355:0111 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY SPECIAL MEETING MINUTES TUESDAY, NOVEMBER 5, 2013 CALL TO ORDER - Mayor Segal called the special meeting to order at 4:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo and Segal ABSENT: None PUBLIC COMMENTS (5 minutes per person) — No one appeared. a. Report, discussion, and direction concerning proposed project at the Lower Azusa Road Reclamation Site. Assistant City Manager /Development Services Director Kruckeberg presented the staff report. After some discussion, the City Council was a little disappointed that the proposed project did not include any retail; however, they were accommodating to the proposed preliminary plans for a 1.6 million square foot warehouse /distribution project subject to the design review process, CUP process, and CEQA compliance. No formal City Council action was requested or taken. b. Report, discussion, and direction concerning potential Mixed -Use Project at the Southwest Corner of Duarte Road and First Avenue. Assistant City Manager /Development Services Director Kruckeberg and Community Development Administrator Kasama presented the staff report. After some discussion, the City Council felt that the current lack of demand for new commercial space should not be a reason to change land use designations to allow for more residential development; they were also concerned with the density and height of the project which exceeds what is allowed by the Code. No formal City Council action was requested or taken. Report, discussion, and direction concerning potential Residential Project at 132 Las Tunas Drive. Assistant City Manager /Development Services Director Kruckeberg presented the staff report. After some discussion, the City Council agreed that the land use designation of the area should be studied before a proposal for 17 townhomes can move forward. No formal City Council action was requested or taken. Report, discussion, and direction concerning re- evaluation of the intersections of Huntington Dr. at Santa Clara St. and Colorado PI., and possible modifications /additions to recent improvements. 11 -5 -13 55:0112 Deputy Development Services Director /City Engineer Wray presented the staff report. After some discussion, it was the consensus of the City Council that staff proceed with re- evaluating the intersections for possible modifications and /or additions to the recently made improvements. e. Report, discussion, and direction concerning shopping cart management policies Assistant City Manager /Development Services Director Kruckeberg and Community Development Administrator Kasama presented the staff report. After some discussion, the City Council agreed that most individuals may not know it is illegal to take shopping carts from the store; staff suggested that an educational mailer may help reduce the abandoned shopping cart issue; and that Code Services and the City Manager's office will handle the mailer distribution. The City Council also directed staff to come back with shopping cart management policy options for future uses; it was the consensus that there was no desire to develop regulations requiring current facilities to retrofit their properties. No formal City Council action was requested or taken. No other business was discussed. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None PUBLIC COMMENTS - No one appeared CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(2) to confer with legal counsel regarding potential litigation — one (1) case. b. Pursuant to Government Code Section 54957.6 to confer with labor negotiators: City Negotiators: City Manager Lazzaretto, Assistant City Manager /Development Services Director Kruckeberg, and Administrative Services Director Quach Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers' Association, Arcadia Firefighters' Association and unrepresented employees: Department Heads, Division Managers, Supervisors, and Part -Time employees. The Closed Session ended at 6:50 p.m. No reportable actions taken. CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Segal called the regular meeting to order at 7:00 p.m. INVOCATION - Reverend Terry Keenan, Police Department Chaplain PLEDGE OF ALLEGIANCE — Mary Beth Hayes, Director of Library and Museum Services ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None REPORT FROM CITY ATTORNEY ON CLOSED SESSION ITEM City Attorney Deitsch reported that the City Council convened a Special Meeting in order to consider the five items listed on the posted agenda, the City Council gave general direction to staff without taking formal action. 11 -05 -13 55:0114 City Attorney Deitsch also reported that the City Council convened to a Closed Session to consider the two items listed on the posted agenda (a) potential litigation concerning a potential claim against the City regarding a proposed project on Canyon Road, and (b) labor negotiations; no reportable action was taken on either item. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Mayor Pro Tern Wuo, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of certificates to Arcadia resident John Pigott for his service in WWII in the United States Navy, and to Arcadia resident SSG Gomez for his current military service in the United States Army. b. Presentation of a Proclamation to the Arcadia Festival of Bands. PUBLIC COMMENTS Steve Stafford appeared and expressed his concerns regarding a paint spill on October 9, 2013, at Naomi and Golden West; and how the Police and Public Works Services Department treated him and feels that the City should be more responsive to these types of situations. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City, expense CAB 1234]). Council Member Amundson announced that he serves on the San Gabriel Valley Council of Governments and at its last meeting, Arcadia was thanked for the betterments made to the bridge, which were paid for by Arcadia; he noted that Covina Council Member Kevin Stapleton is sponsoring a " Movember" which is to grow a mustache, and brings attention to men's health issues; he provided statistics on DUI's and the traffic enforcement grants received by the Arcadia Police Department, and noted that DUI's are on the rise; he congratulated Police Chief Guthrie on making Arcadians safer; and thanked the Mayor for honoring the veterans and noted that he would like to see this more often; and asked everyone to take time and remember a veteran on Veteran's Day. Council Member Harbicht had no comments. Council Member Kovacic congratulated the Race Track, the Police, Fire, and Public Works Services Departments, and all City staff for presenting the world with a wonderful two days of Breeder's Cup racing; and noted that the City should continue its lobbying efforts to keep Breeder's Cup at Santa Anita Park; he also thanked the Mayor for honoring John Pigott; he noted the "More Visions of Arcadia" book will debut on November 17, 2013, at the Church of Good Shepherd; he encouraged everyone to honor a past or current veteran; and invited Chief Guthrie to comment on the realignment program. 11 -05 -13 55:0115 Police Chief Guthrie commented on the realignment program and the impacts being caused to Arcadia by the release of prisoners; he provided statistics on crime; and provided information on how the Police Department has revamped the Neighborhood Watch Program, and recently conducted a Town Hall meeting in order to get citizens involved in reporting crimes; and stated that the Police Department has instituted a computerized program to better predict where and when crimes are likely to take place in Arcadia. Mayor Pro Tern Wuo thanked Police Chief Guthrie for the informative presentation on the realignment program, and noted that for the benefit of those watching on t.v. can see what the police are doing to protect the residents; he thanked Mayor Segal for recognizing the veterans, and invited everyone to attend the Veteran's luncheon on Friday; and welcomed City Manager Lazzaretto back from his vacation. City Clerk Glasco also thanked and commended all the ranks of the Police Department and all the public safety staff for a job well done during Breeder's Cup; and invited the public to attend the Veteran's luncheon on Friday and hoped that Mr. Pigott and Mr. Gomez attend. Mayor Segal thanked Mr. Harbicht for recommending Mr. Pigott and Mr. Gomez for recognition; he noted that Arcadia has many dedicated individuals who have served in the armed forces, and hopes that the City consider recognizing these individuals each year. CONSENT CALENDAR a. Approve the Special Meeting Minutes of October 10, 2013 and Regular Meeting Minutes of October 15, 2013. Recommended Action: Approve b. Introduce Ordinance No. 2312 amending Article VIII of the Arcadia Municipal Code relating to Building Regulations and adopting by reference the 2013 Editions of the California Building Code, Volumes 1 and 2, including State of California amendments applicable to local jurisdictions, and further adopting by reference including amendments, the 2013 California Residential Code, the 2013 California Green Building Standards Code, the 2013 California Plumbing Code, the 2013 California Electrical Code, the 2013 California Mechanical Code and the 2013 California Existing Building, the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, as published by the International Code Council and the 2013 Los Angeles County Building Code Appendix J- Grading. Recommended Action: Introduce and schedule a public hearing for December 3, 2013. Adopt Resolution No. 6996 Authorizing Submittal of the FY 2013 -14 Transportation Development Act - Article 4 Claim Forms to receive capital and operating funds for Arcadia Transit. Recommended Action: Adopt Authorize and direct the City Manager to execute a one year contract extension with Daniel's Tire Service for the purchase of tires and tire related services for City vehicles in the amount of $86,616. Recommended Action: Approve 11 -05 -13 55:0116 e. Authorize and direct the City Manager to approve the payment of $25,000 to the Los Angeles Turf Club from budgeted funds in the 2013 -14 Development Services Department budget for the creation of informational brochures, light pole banners, and street banners to promote the 2013 Breeders' Cup. Recommended Action: Approve It was moved by Council Member Harbicht, seconded by Council Member Amundson, and carried on roll call vote to approve Consent Calendar Items 1.a through 1.e. Introduce Ordinance No. 2313 amendina Article III of the Arcadia Municipal Code relating to fire regulations and adopting by reference the 2013 edition of the California Fire Code in its entirety, including appendices Chapter 4, B, C, D, E, F, G, I and K based on the 2012 edition of the International Fire Code published by the International Code Council. Recommended Action: Introduce and schedule a public hearing for December 3, 2013. Acting Fire Chief Norwood and Fire Marshal Krikorian presented the staff report. It was moved by Mayor Pro Tern Wuo, seconded by Council Member Harbicht, and carried on roll call vote to Introduce Ordinance No. 2313 amending Article III of the Arcadia Municipal Code relating to fire regulations and adopting by reference the 2013 Edition of the California Fire Code in its entirety, including appendices Chapter 4, B, C, D, E, F, G, I and K based on the 2012 Edition of the International Fire Code published by the International Code Council; and schedule a public hearing for December 3, 2013.
