HomeMy WebLinkAbout6997RESOLUTION NO. 6997 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, ADOPTING THE ADDENDUM TO THE CERTIFIED FINAL ENVIRONMENTAL IMPACT REPORT OF THE ARCADIA GENERAL PLAN (SCH #2009081034), ADOPTING ENVIRONMENTAL FINDINGS PURSUANT TO THE CALIFORNIA ENVIRONMENTAL QUALITY ACT, AND ADOPTING THE FINAL 2014 -2021 HOUSING ELEMENT UPDATE WHEREAS, in 2012 the City of Arcadia initiated General Plan Amendment No. GPA 13 -02 to update the Housing Element to meet the requirements of State law; and WHEREAS, Government Code Sections 65302(c) and 65583 mandate that the City's General Plan contain a Housing Element that consists of an identification and analysis of existing and projected housing needs; a statement of goals, policies, quantified objectives, financial resources, and scheduled programs for the preservation, improvement, and development of housing; and sites inventory and progress toward the Regional Housing Needs Assessment; and WHEREAS, Government Code Sections 65580 through 65589.8 require local agencies to adopt, implement and periodically revise housing element in their General Plans to accommodate their respective fair share of new and affordable housing; and WHEREAS, Government Code Section 65589.3 provides that if the California Department of Housing and Community Development ( "HCD ") finds that a housing element or housing element revision substantially complies with Article 10.6 of the Government Code (Sections 65580 through 65589.8), then the housing element or housing element revision is reputably presumed to be valid; and WHEREAS, the Draft 2014 -2021 Housing Element Update was submitted to HCD for its review and "substantial compliance" finding under Government Code Section 65589.3; and WHEREAS, on October 2, 2013, HCD sent a letter to the City stating that HCD completed its review of the City's draft Housing Element Update and found that the draft Housing Element Update will comply with State Housing Element Law (Article 10.6 of the Government Code Section) once the Housing Element Update is adopted; and WHEREAS, the adoption of the Housing Element Update will supersede and replace the existing 2010 Housing Element of the General Plan; and WHEREAS, in accordance with the California Environmental Quality Act ( "CEQA "), the City prepared a draft Initial Study and an Addendum to the Final Environmental Impact Report (" FEIR ") of the Arcadia General Plan (SCH #2009081034) for the proposed 2014 -2021 Housing Element Update, which concluded that the adoption of the proposed Housing Element Update would not have any significant effects on the environment, and thus, staff determined an Addendum to the FEIR for this project is appropriate; and WHERAS, a public hearing was held by the Planning Commission on November 12, 2013, at which time all interested persons were given full opportunity to be heard and to present evidence; and WHEREAS, the Planning Commission voted 4 -0 with one Commissioner absent to recommend that the City Council adopt the Addendum to the Certified Final Environmental Impact Report of the Arcadia General Plan and adopt the final 2014- 2021 Housing Element Update; and -2- WHEREAS, a public hearing was held by the City Council on December 3, 2013, at which time all interested persons were given full opportunity to be heard and to present evidence. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE, AND RESOLVE AS FOLLOWS: SECTION 1. That the factual data submitted by the Development Services Department in the December 3, 2013 staff report is true and correct. SECTION 2. That Section 15162 of the California Environmental Quality Act (CEQA) Guidelines identifies the circumstances under which a subsequent environmental document is required, and based on the following findings, there is no need to adopt a supplemental or subsequent Environmental Impact Report for the Housing Element Update: 1. There have been no substantial changes proposed in the project which would require major revisions to the previous Environmental Impact Report ( "EIR ") due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. Since the current Housing Element was adopted in November 2010, most of the information provided in it is still relevant, and only minor changes have been incorporated to meet changes in State law and to utilize the most recent data available. 2. No substantial changes have occurred with respect to the circumstances under which the project is undertaken that will require major revisions of the previous EIR due to the involvement of new significant environmental effects or a substantial increase in the severity of previously identified significant effects. The City has not -3- approved any General Plan Amendments or Zoning Code Amendments that would affect the availability of housing since the Final EIR was approved on November 16, 2010. Therefore, the circumstances under which the Housing Element will be implemented have not changed. 3. No new information of substantial importance, which was not known and could have not been known with the exercise of reasonable diligence at the time the previous EIR was certified as complete, shows any of the following: A) The project will have one or more significant effects not discussed in the previous EIR; B) Significant effects previously examined will be substantially more severe than shown in the previous EIR; C) Mitigation measures or alternatives previously found not to be feasible would in fact be feasible, and would substantially reduce one or more significant effects of the project, but the project proponent declines to adopt the mitigation measure or alternative; or proponent declines to adopt the mitigation measures or alternative; or D) Mitigation measures or alternatives which are considerably different from those analyzed in the previous EIR would substantially reduce one or more significant effects on the environment, but the project proponent declines to adopt the mitigation measures or alternatives. According to the Adequacy of Sites Inventory section of the Housing Element, the vacant and underutilized sites can potentially accommodate 1,054 units under the current General Plan within the 2014 -2021 Housing Element period. Therefore, the project will not have new or more severe significant impacts, and all mitigation measures identified in the Final EIR remain feasible. 4. The Addendum for the Final EIR has been completed in compliance with CEQA and the CEQA Guidelines. -4- 5. The Addendum to the Final EIR need not be circulated for public review pursuant to CEQA Guidelines Section 15164(c), but shall be attached to the Final EIR of the Arcadia General Plan for the City's 2014 -2021 Housing Element per CEQA Guidelines Section (Cal. Code Regs., Title 14, Chapter 3 § 15000 et seq.). SECTION 3. Based upon the proposed Housing Element Update, the following findings are hereby made: 1. The proposed Housing Element Update has been prepared in compliance with State Law (Government Code Sections 65350 -65362 and 65580- 65589.8), in that all required notices have been provided, timelines have been met, and the document incorporates all required information, including but not limited to, the City's projected housing needs; a statement of goals, policies, quantified objectives, financial resources; scheduled programs for the preservation, improvement, and development of housing. 2. The proposed Housing Element Update is in compliance with the Regional Housing Needs Assessment projections prepared by the Southern California Association of Governments, in that those projections have been incorporated into the document. 3. The proposed Housing Element Update is consistent with all other adopted elements of the City's General Plan, in that all of the proposed changes have been evaluated and have been found not to be in conflict with the policies contained in all other elements of the General Plan. Since the current Housing Element was adopted in November 2010, most of the information provided in it is still relevant, and only minor changes have been incorporated into the 2014 -2021 Housing Element Update so as to meet changes in State law and to utilize the most recent data available. -5- SECTION 4. The City Council hereby approves General Plan Amendment No. GPA 13 -02, thereby adopting the 2014 -2021 Housing Element Update. SECTION 5.
