A ARCADIA PLANNING COMMISSION ' - REGULAR MEETING MINUTES Tuesday, December 10, 2013 CALL TO ORDER - Chairman Beranek called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chiao, Falzon, and Beranek ABSENT: Commissioner Parrille MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao, to excuse Commissioner Parrille from the meeting. Without objection, the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None PUBLIC COMMENTS None. PUBLIC HEARINGS 1. Modification No. MP 13-16, Oak Tree Encroachment Application No. THE 13- 60 and Single-Family Architectural Design Review No. SFADR 13-104 for the following requests with a Categorical Exemption from the California Environmental Quality Act (CEQA) for a new, single-family residence at 1780 S. Santa Anita Avenue: A. A 50'-0"front yard setback in lieu of the 59'-10" requirement; B. An Oak Tree Encroachment Permit for the proposed lawn and landscaping to encroach on one, 48-inch diameter oak tree in the front yard; and, C. Architectural Design Review approval of the proposed 7,017 square foot, Santa Barbara style, two-story residence with 724 square feet of garage space. Applicant: Robert Tong, Designer Assistant Planner, Jordan Chamberlin, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. 12-10-13 The following responded: Mr. Todd Bowden, developer Mr. Robert Tong, project designer Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Falzon, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Falzon, to approve Modification No. MP 13-16, Oak Tree Encroachment Permit No. THE 13-60 and Single-Family Architectural Design Review No. SFADR 13-104 and find that the project is exempt from CEQA based on the findings and conditions recommended in the staff report. ROLL CALL AYES: Commissioners Baerg, Chiao, Falzon, and Beranek NOES: None ABSENT: Commissioner Perri lle There will be a five (5) working-day appeal period after the approval/denial of the applications. Appeals are to be filed by 5:30 p.m. on Wednesday, December 18, 2013. 2. Resolution No. 1890 — Conditional Use Permit No. CUP 13-16 with a Categorical Exemption from the California Environmental Quality Act (CEQA) to add chiropractic treatment services to an existing 6,093 square-foot day spa at 26—28 E. Huntington Drive (d.b.a. Spa Xanadu). Applicant Hank Kan, Business Owner of Spa Xanadu Associate Planner, Tim Schwehr, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. The following responded: Mr. Hank Kan, applicant Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. 12-10-13 MOTION It was moved by Commissioner Falzone, seconded by Commissioner Chiao, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Falzone, to approve Conditional Use Permit No. CUP 13-16, find that the project is exempt from CEQA and adopt Resolution No. 1890, which incorporates the Commission's specific findings and conditions of approval. ROLL CALL AYES: Commissioners Baerg, Chiao, Falzone, and Beranek NOES: None ABSENT: Commissioner Parrille There is a five (5) working-day appeal period after the approval/denial of the Resolution. Appeals are to be filed by 5:30 p.m. on Wednesday, December 18, 2013. 3. Resolution No. 1891 — Tentative Parcel Map No. TPM 13-13 (72511), Zone Variance No. ZV 13-04, and Multiple-Family Architectural Design Review No. MFADR 13-23 for the following requests with a Categorical Exemption from the California Environmental Quality Act(CEQA) to develop and subdivide the subject property with four residential condominium units at 225 Santa Rosa Road: A. Approval of a Tentative Parcel Map for a four-unit, residential condominium, B. A Zone Variance to develop a 13,185 square-foot, R-3 zoned lot with four units in lieu of the five-unit minimum density requirement; and, C. Architectural Design Review approval of the proposed four-unit, Mediterranean style condominium. Applicant: Mur-Sol Development, Contractor, and Robert Tong, Designer Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. The following responded: Mr. Jason Grohs, representing applicant Mr. Tim Murphy, current owner of property 12-10-13 "\ Chairman Beranek asked if anyone would like to speak in opposition to this project. Mr.Wei-Tsu Liu, neighbor Mr. Ibrahim Bagei, neighbor Ms. Julie Li, neighbor Chairman Beranek asked the applicant if he would like to speak in rebuttal. He declined. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Falzone, to close the Public Hearing. Without objection, the motion was approved. Minutes of the November 26, 2013, Regular Meeting of the Planning Commission Recommended action: Approve MOTION It was moved by Commissioner Falzone, seconded by Commissioner Chiao, to approve the minutes as presented. Without objection, the motion was approved. MATTERS FROM COUNCIL LIAISON, JOHN WUO Councilman Wuo wished everyone Happy Holidays. FROM PLANNING COMMISSIONERS Commissioner Baerg asked if anyone knew about a reprieve in the overnight parking regulations during the holidays. Mr. Kasama said that he believed the restrictions would be 12-10-13 waived for the month of December to January 5th and that he would verify that with the Police Department. Commissioner Chiao said that he has noticed a number of shopping carts being abandoned in his neighborhood and asked how the situation was being addressed. Mr. Kasama said that staff was aware of the problem and that the stores involved have been contacted to step up efforts to retrieve their carts. In addition, a mailer is being prepared for target neighborhoods explaining that it is a crime to take shopping carts and with the City's retrieval contact information. MATTERS FROM MODIFICATION COMMITTEE Commissioner Falzone reported that the Modification Committee meeting was cancelled. MATTERS FROM STAFF INLCUDING UPCOMING AGENDA ITEMS Mr. Kasama said the Planning Commission meeting scheduled for December 24 will be cancelled but the Modification Committee will meet that morning. ADJOURNMENT Chairman Beranek adjourned this meeting at 7:40 p.m. to January 14, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
