ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None PUBLIC COMMENTS - No one appeared STUDY SESSION a. Report, discussion, and direction concerning the proposed "Seabiscuit Pacifica" Specific Plan Project at 130 West Huntington Drive (Santa Anita Inn site). City Manager Lazzaretto and Assistant City Manager /Development Services Director Kruckeberg provided the City Council with a report regarding the proposed "Seabiscuit Pacifica" Specific Plan project at 130 West Huntington Drive (Santa Anita Inn site). It was the consensus of the City Council that this item be considered in the future once staff and the developer had an opportunity to further discuss the proposal. b. Report, discussion, and direction concerning traffic signal timing and regional coordination of east/west arterial corridors through the City. Deputy Development Services Director /City Engineer Wray presented a report regarding traffic signal timing and regional coordination of east/west arterial corridors through the City. No action was taken or required by the City Council on this item. The City Council received and filed the report. The Study Session ended at 6:20 p.m. CLOSED SESSION a. Pursuant to Government Code Section 54957.6 to confer with labor negotiators: City Negotiators: City Manager Lazzaretto, Assistant City Manager /Development Services Director Kruckeberg, and Administrative Services Director Quach Employee Organizations: Arcadia Public Works Employees Association, Arcadia City Employees Association, Arcadia Police Civilian Employees Association, Arcadia Police Officers' Association, Arcadia Firefighters' Association and unrepresented employees: Department Heads, Division Managers, Supervisors, and Part-Time employees. b. Pursuant to Government Code Section 54956.9(d)(4) to confer with legal counsel regarding anticipated litigation — two (2) cases. No reportable action was taken. The Closed Session ended at 6:50 p.m. 12 -03 -13 55:0124 CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Segal called the regular meeting to order at 7:00 p.m. INVOCATION - Reverend Jolene Cadenbach, Arcadia Congregational Church PLEDGE OF ALLEGIANCE — Hue Quach, Administrative Services Director ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEMS City Attorney Deitsch announced that the City Council met in a Study Session to consider and receive reports regarding the two items listed on the posted agenda; he reported that regarding Item a., the proposed "Seabiscuit Pacifica" Specific Plan Project at 130 West Huntington Drive (Santa Anita Inn site), the City Council heard and considered a conceptual proposal from the developer; no action was taken and the City Council will further consider the matter in the future; and regarding Item b., the traffic signal timing and regional coordination of east/west arterial corridors through the City; no action was taken by the City Council, the report was received and filed. City Attorney Deitsch further reported that the City Council convened to a Closed Session to consider the items listed on the posted agenda. No reportable action was taken. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that a technical revision was made to City Manager Item a, the Arcadia Fire Fighters' Association Memorandum of Understanding, which was electronically distributed to the City Council, and will be further discussed in open session. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Mayor Pro Tern Wuo, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation of Medal of Merit to Detective Walter Ashby; and Life Saving Awards to Sergeant Jason Davis and Detective Tony Juarez A representative from the Southern California Special Olympic and Torch Run presented a gift to Detective Walter Ashby for his part in the Torch Run fundraising. 2 12 -03 -13 55:0125 1. PUBLIC HEARING a. Resolution No. 6997 approving General Plan Amendment No GPA 13 -02 — An amendment to the Arcadia General Plan to adopt the 2014 -2021 Housing Element Update and an addendum to the Certified Environmental Impact Report for the Arcadia General Plan (SCH #2009081034). Recommended Action: Adopt Assistant City Manager /Development Services Director Kruckeberg, and Planning Services Manager Lisa Flores presented the staff report. Mayor Segal opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Harbicht, seconded by Council Member Kovacic, and seeing no further objection, Mayor Segal declared the public hearing closed. It was moved by Council Member Harbicht, seconded by Council Member Kovacic and carried on roll call vote to adopt Resolution No. 6997 approving General Plan Amendment No. GPA 13 -02 — an amendment to the Arcadia General Plan to adopt the 2014 -2021 Housing Element Update and an addendum to the Certified Environmental Impact Report for the Arcadia General Plan (SCH #2009081034). Ordinance No. 2312 amending Article VIII of the Arcadia Municipal Code relating to Buildinq Regulations and adopting by reference the 2013 Edition of the California Buildinq Code, Volumes 1 and 2, includinq State of California amendments applicable to local iurisdictions, and further adopting by reference including amendments, the 2013 California Residential Code, the 2013 California Green Building Standards Code, the 2013 California Plumbing Code, the 2013 California Electrical Code, the 2013 California Mechanical Code, the 2013 California Existing Buildings Code, the Uniform Code for the Abatement of Dangerous Buildings 1997 Edition, as published by the International Code Council and the 2013 Los Angeles County Building Code Appendix J- Gradin Recommended Action: Adopt Building Official Don Stockham presented the staff report. Mayor Segal opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Amundson, seconded by Council Member Harbicht, and seeing no further objection, Mayor Segal declared the public hearing closed. It was moved by Council Member Amundson, seconded by Council Member Kovacic, and carried on roll call vote to adopt Ordinance No. 2312 amending Article VIII of the Arcadia Municipal Code relating to Building Regulations and adopting by reference the 2013 Edition of the California Building Code, Volumes 1 and 2, including State of California amendments applicable to local jurisdictions, and further adopting by reference including amendments, the 2013 California Residential Code, the 2013 California Green Building Standards Code, the 2013 California 3 12 -03 -13 55:0126 Plumbing Code, the 2013 California Electrical Code, the 2013 California Mechanical Code, the 2013 California Existing Buildings Code, the Uniform Code for the Abatement of Dangerous Buildings, 1997 Edition, as published by the International Code Council and the 2013 Los Angeles County Building Code Appendix J- Grading. Ordinance No. 2313 amending Article III of the Arcadia Municipal Code relating to Fire Requisitions and adopting by reference the 2013 Edition of the California Fire Code in its entirety, including Chapter 1 and Appendices Chapter 4, B. C. D. E. F. G. I and K based on the 2012 Edition of the International Fire Code published by the International Code Council. Recommended Action: Adopt Acting Fire Chief Norwood, and Fire Marshall Mark Krikorian presented the staff report. Mayor Segal opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Kovacic, seconded by Mayor Pro Tern Wuo, and seeing no further objection, Mayor Segal declared the public hearing closed. It was moved by Council Member Kovacic, seconded by Mayor Pro Tern Wuo, and carried on roll call vote to adopt Ordinance No. 2313 amending Article III of the Arcadia Municipal Code relating to Fire Regulations and adopting by reference the 2013 Edition of the California Fire Code in its entirety, including Chapter 1 and Appendices Chapter 4, B, C, D, E, F, G, I and K based on the 2012 Edition of the International Fire Code published by the International Code Council. AYES: Council Member Kovacic, Wuo, Amundson, Harbicht, and Segal NOES: None ABSENT: None PUBLIC COMMENTS - No one appeared REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Kovacic congratulated Detective Ashby, Sergeant Davis and Detective Juarez on receiving their awards; he announced the Holiday Snow Festival at the Arcadia Community Center on Saturday, December 7; he commented on his trip to Massachusetts to celebrate Thanksgiving with his daughter; and provided information on how to purchase the "More Visions of Arcadia" book. Mayor Pro Tern Wuo thanked Council Member Kovacic for his time and efforts in putting together the "More Visions of Arcadia" book; he urged residents to be safe during the holidays and be aware of their surroundings; and he commended the police officers who received awards, and for keeping the residents of Arcadia safe. Council Member Amundson also expressed his appreciation and congratulated the police officers for all their hard work, and all City employees; he announced that December 5 is the deadline to submit nominations for the Holiday Home Decorating Awards, and that the Arcadia Beautiful Commission will be judging the holiday homes on December 9; he provided comments on the 4 12 -03 -13 55:0127 Housing Element Update, the Management and Disbursement Agreement and the remittance of assessment funds for the Downtown Community Benefit District; he announced that he represents the City on the San Gabriel Valley Council of Governments Board and commented on discussions made regarding the early release of prisoners and the impacts created to the needy and homeless; he noted the fake Obama care websites; and wished everyone a joyful and meaningful Christmas. Council Member Harbicht commented on the Battle of the Badges basketball game which takes place annually between the Fire and Police Associations; he noted an email he received from a resident thanking the City for a safe community; he thanked City Manager Lazzaretto for moving to the electronic agenda process; he commented on an article regarding lengthy City Council meetings because of the number of speakers, and congratulated the City Council and staff for taking care of the City's business in a timely manner; and he wished everyone Happy Holidays. City Clerk Glasco also congratulated the police officers on their awards; and explained the overnight parking permit process for 2014. Mayor Segal expressed his appreciation to all City staff and especially the officers who received awards for their efforts. 2. CONSENT CALENDAR a. Special and Regular Meeting Minutes of November 19, 2013. Recommended Action: Approve b. Resolutions relating to the All Mail Ballot General Municipal Election to be held on Tuesday, April 8, 2014. Resolution No. 7003 calling for the holding of an All Mail Ballot General Municipal Election on Tuesday, April 8, 2014 for the election of certain officers as required by the City Charter. Recommended Action: Adopt Resolution No. 7004 adopting regulations for candidates for elective office pertaining to candidates' statements submitted to the voters at an All Mail Ballot Election to be held on Tuesday. April 8. 2014. Recommended Action: Adopt Resolution No. 7005 requesting the Board of Supervisors of the County of Los Angeles to render specified services to the City relating to the conduct of an All Mail Ballot General Municipal Election to be held on Tuesday. April 8, 2014. Recommended Action: Adopt C. Cancellation of the December 17. 2013, regular City Council /Successor Agency to the Arcadia Redevelopment Agency meeting. Recommended Action: Approve d. Accept all work performed by Dominguez General Engineering, Inc. for the Water Main Replacement Project as complete and authorize the final payment to be made in accordance with the contract documents. Recommended Action: Approve 5 12 -03 -13 55:0128 e. Authorize and direct the City Manager to execute a Professional Services Agreement with Willdan Engineering for engineering services for the 2014 Citywide Traffic Counts and Engineering and Traffic Survey in the amount of $21,701; and approve a 10% contingency. Recommended Action: Approve Authorize the Citv Manager to Execute a Manaqement and Disbursement Agreement between the City of Arcadia and the Arcadia Improvement Association for the remittance of assessment funds that are collected with property tax payments from Los Anaeles Countv for the Downtown Communitv Benefit District. Resolutions approving Memorandum of Understandings establishing compensation and related benefits for certain represented employee groups. Resolution No. 7000 establishing compensation and related benefits for employees represented by the Arcadia Fire Fighters' Association (AFFA) for April 1, 20141 through June 30, 2018. Recommended Action: Adopt Resolution No. 7001 establishing compensation and related benefits for employees represented by the Arcadia City Employees Association (ACEA) for April 1, 2014, through June 30, 2018. Recommended Action: Adopt Resolution No. 7002 establishing compensation and related benefits for employees represented by the Arcadia Public Works Employees Association (APWEA) for April 1, 2014, through June 30, 2018. Recommended Action: Adopt City Manager Lazzaretto and Administrative Services Director Quach presented the staff report. Council Member Harbicht commended and thanked Administrative Services Director Quach and Assistant City Manager /Development Services Director Kruckeberg and all the Associations who bargained in good faith and reached a fair and equitable agreement. Mayor Segal and Council Member Kovacic also commended and thanked all the bargaining groups for negotiating in good faith and for their efforts.
