PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Falzone, and Beranek ABSENT: Commissioners Chiao and Perri lle MOTION It was moved by Commissioner Falzone, seconded by Commissioner Baerg, to excuse Commissioner Perrille from the meeting. Without objection, the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS A letter in opposition to Item 1 was distributed to the Commissioners. PUBLIC COMMENTS None. Commissioner Chiao joined the meeting at this point. PUBLIC HEARINGS 1. Resolution No. 1893 - Conditional Use Permit No. CUP 13-12 with a Categorical Exemption from the California Environmental Quality Act (CEQA) for the existing religious facility, and the use of a tent for outdoor events, activities, and services. The tent is 40 feet by 60 feet (2,400 square feet) and 14 feet in height and can accommodate up to 300 people, at 2607 S. Santa Anita Ave. Applicant: Arcadia Congregational Church Recommended action: Find that this project is exempt from CEQA, and conditionally approve Conditional Use Permit No. CUP 13-12 and adopt Resolution No. 1893. Assistant Planner, Nick Baldwin, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. 1-14-14 The following responded: Pastor Jolene Cadenbach, represented Arcadia Congregational Church Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Falzon, seconded by Commissioner Baerg, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Chairman Beranek, seconded by Commissioner Falzone, to approve Conditional Use Permit No. CUP 13-12 and find that the project is exempt from CEQA based on the findings and conditions recommended in the staff report with a condition to be revised to limit music at evening events to 10:00 p.m. for all days of the week. ROLL CALL AYES: Commissioners Falzone, and Beranek NOES: Commissioners Baerg and Chiao ABSENT: Commissioner Perrille Chairman Beranek asked the applicant if she would like to ask the Commission to consider continuing this item or appeal the result to the City Council. Pastor Cadenbach responded that she will appeal to the City Council. 2. Resolution No. 1892 — Conditional Use Permit No. CUP 13-14 with a Categorical Exemption from the California Environmental Quality Act (CEQA) to expand the existing 1,427 square foot medical spa into the adjacent unit for a proposed area of 2,652 square feet— 1004 and 1008 N. Santa Anita Avenue La Bella Laser&Slimming). Applicant Ms. Sarah Chan, Managing Director of La Bella Laser& Slimming, Inc. Recommended action: Find that this project is exempt from CEQA, conditionally approve Conditional Use Permit No. CUP 13-14, and adopt Resolution No. 1892. Assistant Planner, Jordan Chamberlin, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. There were none Chairman Beranek asked if anyone would like to speak in opposition to this project. 1-14-14 There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Falzon, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Falzone, to approve Conditional Use Permit No. CUP 13-14, find that the project is exempt from CEQA and adopt Resolution No. 1892, which incorporates the Commission's specific findings and conditions of approval. ROLL CALL AYES: Commissioners Baerg, Chiao, Falzon, and Beranek NOES: None ABSENT: Commissioner Parrille There is a five (5) working-day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m. on Tuesday, January 21, 2014. CONSENT CALENDAR 3. A one-year extension request for Conditional Use Permit No. CUP 11-18 Architectural Design Review No. ADR 11-29; and Modification No. MP 12-10 for a new 3-story office building with a ground floor restaurant at 125 W. Huntington Drive. Recommended action: Approve 4. A one-year extension request for Conditional Use Permit No. CUP 73-16 for a restaurant at 251 N. Santa Anita Avenue. Recommended action: Approve 5. Minutes of the December 10, 2013, Regular Meeting of the Planning Commission Recommended action: Approve MOTION It was moved by Commissioner Falzone, seconded by Commissioner Chiao, to approve the one-year extension for Conditional Use Permit No. CUP 11-18, Architectural Design Review No. ADR 11-29, and Modification No. MP 12-10, and to approve the one-year extension for Conditional Use Permit No. CUP 73-16, and to approve the minutes as presented. Without objection, the motion was approved. 1-14-14 MATTERS FROM COUNCIL LIAISON, JOHN WUO Councilman Wuo wished everyone a Happy New Year. FROM PLANNING COMMISSIONERS There was nothing to report. MATTERS FROM MODIFICATION COMMITTEE Commissioner Falzone reported that the Modification Committee approved two applications, including the remodeling of a building at First Avenue and California Street which will house medical offices. MATTERS FROM STAFF INLCUDING UPCOMING AGENDA ITEMS Mr. Kasama advised the Commissioners that there will be three multi-family applications on the agenda for the next meeting. ADJOURNMENT Chairman Beranek adjourned this meeting at 7:40 p.m. to January 28, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
