Pursuant to the Americans with Disabilities Act,persons with a disability who require a disability related modification or accommodation
in order to participate in a meeting,including auxiliary aids or services,may request such modification or accommodation from Planning
Services at 626-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure

PUBLIC COMMENTS (5 minute time limit per person)
Each speaker is limited to five (5) minutes per person, unless waived by the Modification
Committee. Under the Brown Act, the Members are prohibited from discussing or taking action
on any items not listed on the posted agenda.
PUBLIC HEARING
You are hereby advised that should you desire to legally challenge in court any action taken by
the Modification Committee regarding any Public Hearing item, you may be limited to raising only
those issues and objections you or someone else raised at the public hearing or in written
correspondence delivered to the Modification Committee at, or prior to,the public hearing.
1. Modification Application No. MC 13-27 and Single-Family Architectural Design Review
No. SFADR 14-14 at 1824 S. Sixth Avenue.
Applicant: Mr.Ariel Berrios, Property Owner
PROJECT DESCRIPTION: The applicant is requesting the following approvals for an existing
454 square-foot, nonconforming second unit with an attached 140
square-foot, laundry room and an attached 400 square-foot, two-
car garage:
1. Convert the existing nonconforming second unit on the property to an accessory dwelling unit,
requiring the following zoning modifications:
a. To maintain the existing 10'-0"rear yard setback of the second unit in lieu of 25'-0"
required for an accessory dwelling unit(AMC Sec. 9252.2.9.1);
b. To maintain the existing building attachment to the two-car garage serving the main
residence and to the laundry room in lieu of a requirement that an accessory dwelling unit
shall not be attached in any way to any other building (AMC Sec.9252.2.9.1).
2. A Zoning Modification to align a new 336 square-foot, covered patio with the existing 10'-0"
rear yard setback of the second unit in lieu of 25'-0" required for a covered patio attached to
an accessory dwelling unit(AMC Sec. 9252.2.9.1);and
3. Design Review approval of a new 110 square-foot addition, 336 square-foot, covered patio,
and façade improvements to the existing detached second unit (accessory dwelling unit),
laundry room,and two-car garage.
ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15305 of the CEQA
Guidelines Class 5 Exemption for existing facilities.
Conditionally approved, 3-0, subject to the following conditions:
1. The property owner/applicant shall file a covenant in a form approved by the City
Attorney, requiring that the accessory dwelling unit shall not be sold independently
of the main dwelling unit and parcel.
2. The property owner/applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against any claim,
action, or proceeding against the City of Arcadia, its officials, officers, employees or
agents to attack set aside, void, or annul any approval or conditional approval of the
City of Arcadia concerning this project and/or land use decision, including but not
limited to any approval or conditional approval of the City Council, Planning
Commission, Modification Committee, or City Staff, which action is brought within
the time period provided for in Government Code Section 88499.37 or other provision
of law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or land use
decision and the City shall cooperate fully in the defense of the matter. The City
reserves the right; at its own option, to choose its own attorney to represent the City,
its officials, officers, employees, and agents in the defense of the matter.
3. Approval of MC 13-27 and Admin. SFADR 14-14 shall not be of effect unless on or
before 30 calendar days after approval of this project, the property owner/applicant
has executed and filed with the Community Development Administrator an
Acceptance Form available from the Development Services Department to indicate
awareness and acceptance of these conditions of approval.
APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to
the Planning Commission within five (5) working days of the decision. Appeals are to be
filed by 5:30 p.m.on March 4, 2014. If no appeal is filed,decisions are final.
ADJOURNMENT
The Modification Committee will adjourn this meeting to March 11, 2014, at 7:45 a.m. in the City
Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia.
Any writings or documents provided to a majority of the Modification Committee regarding any Rem on this agenda will
be made available for public inspection in the City Clerk's office located at 240 W. Huntington Drive,Arcadia, California,
during normal business hours.
