CALL TO ORDER ROLL CALL: Sam Falzone, Chairman Dominic Lazzaretto, Committee Member Jason Kruckeberg,Committee Member PUBLIC COMMENTS (5 minute time limit per person) Each speaker is limited to five (5) minutes per person, unless waived by the Modification Committee. Under the Brown Act, the Members are prohibited from discussing or taking action on any items not listed on the posted agenda. PUBLIC HEARING You are hereby advised that should you desire to legally challenge in court any action taken by the Modification Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or prior to, the public hearing. 1. Healthy Oak Tree Removal Application No. TRH 14-01, Oak Tree Encroachment Application No. THE 14-19,and Single-Family Architectural Design Review No. SFADR 13-124 621 Santa Maria Avenue Applicant: Mr. Philip Chan, Architect PROJECT DESCRIPTION: The applicant is requesting the following approvals for a new 4,127 square-foot, two-story residence with a 410 square-foot, two-car garage: a. To remove one healthy Coast Live Oak tree in the rear yard due to its poor crown symmetry and leaning position(AMC sec. 9703); b. Allow the new landscaping and hardscape to encroach within the dripline of one Coast Live Oak tree in the rear yard and one Coast Live Oak tree in the rear yard of 625 Santa Maria Avenue(AMC Sec.9703);and, c. Design review for a new house. ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15303 of the CEQA Guidelines Class 3 Exemption for existing facilities. Conditionally approved, 3-0, subject to the following conditions: 1. Plant a 30"-box Southern Live Oak or Holly Oak in the front yard in a suitable location to be determined by the consulting arborist. 2. Prior to demolition the contractor and the consulting arborist shall meet onsite to make sure fences are properly placed and installed and to review the goals for the tree protection plan. The locations of the protected fences are drawn with dashed lines on the Site Plan included with the Arborist Report 3. Maintain the fences throughout the completion of the project. No staging of materials or equipment or washing-out is to occur within the fenced protection zones. 4. All demolition, excavation or grading within the driplines of the Protected Trees shall be done with hand tools and monitored by the consulting arborist 5. If any injury whatsoever should occur to the preserved oak trees or any other preserved tree, the consulting arborist shall be called immediately. Timeliness is critical to being able to provide the best mitigation treatment for injuries. 6. Supplemental irrigation will not be required on the oaks during construction, but will be required on the crape myrtle street tree. Monthly monitoring visits by the consulting arborist will include soil moisture evaluation. 7. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, Modification Committee, or City Staff, which action is brought within the time period provided for in Government Code Section 66499,37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 240 W. Huntington Drive,Arcadia, California, during normal business hours. 8. Approval of TRH 14-01, THE 14-19, and SFADR 13-124 shall not be of effect unless on or before 30 calendar days after approval of this project, the property owner/applicant has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to the Planning Commission within five (5) working days of the decision. Appeals are to be filed by 5:30 p.m. on March 18, 2014. If no appeal is filed, decisions are final. ADJOURNMENT The Modification Committee will adjourn this meeting to March 25, 2014, at 7:45 a.m. in the City Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia. Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 240 W Huntington Drive,Arcadia, California, during normal business hours.
