ARCADIA PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, March 11, 2014 CALL TO ORDER — Chairman Beranek called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Falzone, Parrille and Beranek ABSENT: Commissioner Chiao MOTION It was moved by Commissioner Parrille and seconded by Commissioner Falzone to excuse Commissioner Chiao from the meeting. Without objection the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None PUBLIC COMMENTS None. PUBLIC HEARINGS 1. Resolution No. 1900 — Conditional Use Permit No. CUP 13-19 to operate a 1,200-square-foot nail salon with a Categorical Exemption from the California Environmental Quality Act (CEQA) at 202 E. Live Oak Avenue (d.b.a. Nicely Nails). Applicant: Ngoc Hien Thi Le, Business Owner Recommended action: Find that the project is exempt from CEQA, conditionally approve Conditional Use Permit No. CUP 13-19, and adopt Resolution No. 1900. Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. Ms. Hien Mindy Le represented his sister, Ms. Ngoc Nguyen Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. 3-11-14 MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Falzone, seconded by Commissioner Parrille, to adopt Resolution No. 1900 and to conditionally approve Conditional Use Permit No. CUP 13-19 to operate a 1,200-square-foot nail salon with a Categorical Exemption from the California Environmental Quality Act (CEQA) at 202 E. Appeals are to be filed by 5:30 p.m. on Tuesday, March 18, 2014. 2. Resolution No. 1899 —Zone Variance No. ZV 13-01; Tentative Tract Map No. 72421; Multiple-Family Architectural Design Review No. MFADR 13-32; and Conditional Use Permit No. CUP 13-15 with a Categorical Exemption from the California Environmental Quality Act (CEQA) for the following requests at 681- 685 N. First Avenue and 723 and 805 N. First Avenue. A. A Zone Variance to allow a 6-unit multiple-family development at 681-685 N. First Avenue in lieu of the minimum 9-unit density requirement for this property (AMC Sec. 9255.2.7); to allow a zero landscape buffer between a portion of the proposed driveway and the southwest property line in lieu a minimum 3'-0" buffer requirement along the entire driveway (AMC Sec. 9255.2.10); and to allow a zero landscape buffer between portions of the proposed driveway and the new residential buildings in lieu of a minimum 2'-0" buffer requirement along the entire driveway (AMC Sec. 9255.2.10); B. A Tentative Tract Map to subdivide the new 6-unit multiple-family development into residential condominiums; C. Architectural Design Review approval of the proposed 6-unit multiple- family development; and D. A revision to the existing Conditional Use Permit for the church at 723 & 805 N. First Avenue to reconfigure the church parking lot, and update the existing church services and ancillary uses. Mr. Jason Grohs, representing the applicant, and Mr. Rob Tyler, the project architect responded. Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Parrille, to adopt Resolution No. 1899 with an amendment to condition 6.0 to conditionally approve Zone Variance No. ZV 13-01; Tentative Tract Map No. TTM 72421; Multiple-Family Architectural Design Review No. MFADR 13-32; and Conditional Use Permit No. CUP 13-15 with a Categorical Exemption from the California Environmental Quality Act (CEQA) for a six-unit residential condominium project at 681-685 N. First Avenue and to reconfigure the church parking lot at 723 and 805 N. First Avenue. Resolution No. 1898 - Tentative Tract Map No. TTM 72625; Multiple-Family Architectural Design Review No. MFADR 13-34; Oak Tree Encroachment Application No. THE 13-69; and Modification No. MC 14-05 with a Categorical Exemption from the California Environmental Quality Act (CEQA) for a six-unit, residential condominium development with the following requests at 19-23 Christina Street. A. An 8'-0" northerly rear yard setback in lieu of the 10'-0" requirement for an accessible lift (AMC Sec. 9255.2.5); B. A 4'-6" easterly side yard setback in lieu of the 10'-0" requirement for an accessible lift (AMC Sec. 9255.2.4); C. Provide 651 square feet of common open space in lieu of 100 square feet of private open space for each unit (AMC Sec. 9255.2.11); and, D. Encroachment into the protected zones of three oak trees. 3-11-14 Applicant: Simon Lee, Architect Recommended action: Find that this project is exempt from CEQA, conditionally approve the applications, and adopt Resolution No. 1898. Mr. Hank Jong, Civil Engineer, represented the applicant. Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. Minutes of the February 25, 2014, Regular Meeting of the Planning Commission Recommended action: Approve Without objection, the minutes were approved as presented. MATTERS FROM COUNCIL LIAISON, JOHN WUO Councilman Wuo was not present. 3-11-14 FROM PLANNING COMMISSIONERS Commissioner Parrille asked how the closing of Joanne's Fabric store will affect the nearby fitness center since the approval of the fitness center was based partly on their use of Joanne's parking lot. Mr. Kasama said the fitness center may have to work out a new agreement with the new tenant. MATTERS FROM MODIFICATION COMMITTEE Commissioner Falzone reported that a Modification and a tree removal application for a new home on Santa Maria Road were approved at the Modification Committee meeting. MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said the next agenda will include a three-unit condo on Fano Street; a four-unit condo on S. Second Avenue; a request from Westfield to change the restaurant limitations at the Promenade; and, a General Plan Amendment, Text Amendment and Zone Change to create a Residential Flex Overlay Zone for Las Tunas Drive and West Live Oak Avenue. He also mentioned that the Seabiscuit Pacifica project will be heard by the City Council at their next meeting. ADJOURNMENT Chairman Beranek adjourned this meeting at 7:40 p.m. to March 25, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
