Committee. Under the Brown Act, the Members are prohibited from discussing or taking action
on any items not listed on the posted agenda.
PUBLIC HEARING
You are hereby advised that should you desire to legally challenge in court any action taken by
the Modification Committee regarding any Public Hearing item, you may be limited to raising only issues and objections you or someone else raised at the public hearing or in written
correspondence delivered to the Modification Committee at, or prior to, the public hearing.

PROJECT DESCRIPTION: The applicant is requesting the following modifications and
architectural design review for a new 388.5 square foot,
attached two-car garage to the existing 1,704 square foot
home. The proposal also includes the conversion of the
existing 434 square foot,two-car garage to livable space:
a. A Modification to align the new two-car garage with the existing 5'-0°easterly side yard
setback in lieu of the 8'-0"requirement(AMC Sec. 9252.2.3);
b. A Modification to allow the new two-car garage to be 18'-6"wide by 21'-0" long in lieu of
20'-0"wide by 20'-0"long (AMC Sec.9252.2.6); and
c. Architectural Design Review approval of the project.
ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15305 of the CEQA
Guidelines Class 5 Exemption for the minor alterations in land use limitations.
Conditionally approved, 3-0, subject to the following conditions:
1. The applicant shall defend, indemnify, and hold harmless the City of Arcadia
and its officials, officers, employees, and agents from and against any claim,
action, or proceeding against the City of Arcadlia, its officials, officers,
employees or agents to attack set aside, void, or annul any approval or
conditional approval of the City of Arcadia concerning this project and/or land
use decision, including but not limited to any approval or conditional approval
of the City Council, Planning Commission, Modification Committee, or City Staff,
which action is brought within the time period provided for in Government Code
Section 88499.37 or other provision of law applicable to this project or decision.
The City shall promptly notify the applicant of any claim, action, or proceeding
concerning the project and/or land use decision and the City shall cooperate
fully in the defense of the matter. The City reserves the right, at Its own option,
to choose its own attorney to represent the City, its officials, officers,
employees, and agents in the defense of the matter.
2. Approval of MC 14-08 and Admin SFADR 14-27 shall not be of effect unless on
or before 30 calendar days after approval of this project, the property
owner/applicant has executed and filed with the Community Development
Administrator or designee an Acceptance Form available from the Development
Services Department to indicate awareness and acceptance of these conditions
of approval.
APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to
the Planning Commission within five (5) working days of the decision. Appeals are to be
filed by 5:30 p.m. on April 29, 2014. If no appeal is filed, decisions are final.
ADJOURNMENT
The Modification Committee will adjourn this meeting to May 13, 2014, at 7:45 a.m. in the City
Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia.
Any writings or documents provided to a majority of the Modification Committee regarding any item on this will
