ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None PUBLIC COMMENTS - No one appeared CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the case of Eric T. Chen and Sylvia C. Chen v. City of Arcadia, et al.; Los Angeles County (Central District) Court Case No. BC504634. No reportable action was taken on the Closed Session item. The Closed Session ended at 6:20 p.m. STUDY SESSION a. Report and discussion regarding the Los Angeles Regional Interoperable Communications System (LA -RICS) Funding Plan. City Manager Lazzaretto, Police Chief Guthrie, and Deputy Fire Chief Norwood presented the staff report. It was moved by Council Member Harbicht, seconded by Council Member Kovacic, to authorize the City Manager, the Police Chief, and Deputy Fire Chief to either negotiate entry into the LA -RICS program or opt out if the LA -RICS program is not a full or sufficient value to the City of Arcadia. AYES: Council Member Harbicht, NOES: None ABSENT: None The Study Session ended at 6:55 p.m. Kovacic, Amundson, Wuo, and Segal CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Segal called the regular meeting to order at 7:00 p.m. INVOCATION - Reverend Carol Locke, Arcadia Episcopal Church of the Transfiguration PLEDGE OF ALLEGIANCE — Kurt Norwood, Deputy Fire Chief 04 -01 -14 56:0033 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Amundson, Harbicht, Kovacic, Wuo, and Segal ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION ITEM(S) City Attorney Deitsch reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; no reportable action was taken. City Attorney Deitsch also announced that the City Council conducted a Study Session to hear a report from staff regarding the Los Angeles Regional Interoperable Communications System (LA- RICS) Funding Plan; and reported that on motion by Council Member Harbicht, seconded by Council Member Kovacic, the City Council unanimously (5 -0) authorized the City Manager, the Police Chief, and Deputy Fire Chief to either negotiate entry into the LA -RICS program or instead opt out, if in staff's professional opinion, the LA -RICS program is not a full or sufficient value to the City of Arcadia. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced that a letter was submitted by Brian Golden relating to City Manager Item 3.a. regarding construction hours was distributed to the City Council. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Amundson, seconded by Mayor Pro Tern Wuo to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Proclamation designating April 13 -19, 2014, as "National Library Week ". b. Presentation of Mayor's Certificate of Commendation to Arcadian Edward Wong for his work with NASA and Mars Rover Curiosity. C. Certificate of Appreciation presented to Council Member Harbicht by Council Member Margaret Finlay, City of Duarte for his 20 years of community service on the Arcadia City Council; and 6 years of service to the City of Duarte as a Planning Commissioner and City Council Member. PUBLIC COMMENTS Alex Green, Baldwin Stocker Elementary School PTA President, appeared and expressed appreciation to the City Council and the Arcadia Unified School Board for their support with bringing new technology to the class rooms. Steve Stafford, an Arcadia resident, appeared and complained about the parking problems in and around the medical building parking lot at 612 West Duarte Road, and requested that it be addressed. 2 04 -01 -14 56:0034 Brian Golden, an Arcadia resident, appeared and read into the record, the letter he presented to the City Council at the beginning of the meeting regarding construction hours, and requested that the hours be changed. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK {including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Amundson provided positive comments regarding the All Mail Ballot process, and reminded everyone to cast their vote before 8:00 p.m. on Tuesday, April 8; he announced that he attended the San Gabriel Valley Council of Governments meeting which included a tour of the Gold Line Maintenance Yard at the Monrovia and Duarte Stations; he expressed disappointment that the Gold Line uses overseas car manufacturers; and commented on earthquake preparedness and reminded everyone to be prepared to survive at least 7 to 10 days in the event of a catastrophic earthquake. Council Member Harbicht reminded and encouraged residents to vote on April 8; he commented on election campaign topics, and reminded City Council candidates that one of the most important jobs of the City Council is managing a $50 million dollar business that is called the "City of Arcadia," and provided a brief outline of the annual audit report that each Council Member receives from the City auditors; and referred to Consent Calendar item 1.e and thanked Mr. John M. Hill and his family for supporting the Arcadia Public Library. Council Member Kovacic thanked the speakers for attending the Council meeting and expressing their thoughts and concerns, and congratulated those individuals who received recognition; he provided information on board and commission vacancies, and encouraged residents to get involved; and reminded residents that ballots should be received by the City Clerk's Office no later than 8:00 p.m., on April 8, 2014. Mayor Pro Tern Wuo wished everyone to be safe during spring break; he congratulated Edward Wong for his achievements, and announced that he is a first time grandfather, that his daughter -in- law gave birth to a baby boy. City Clerk Glasco also provided information on the April 8 Election; he announced that the Arcadia Women's Club is celebrating their 100th year of community service, and provided information on various centennial celebration events; and on behalf of Dr. William Chang he extended congratulations to Mr. Wong and thanked the City Council for the recognition. Mayor Segal encouraged everyone to attend the Santa Anita Race Track Derby Run on Saturday, April 11; and also encouraged residents to take five minutes of their time and vote on April 8. 1. CONSENT CALENDAR a. Regular Meeting Minutes of March 18, 2014. Recommended Action: Approve b. Resolution No. 7011 authorizing designated staff to file with the California Office of Emergency Services requests for financial assistance under the Natural Disaster Assistance Act and similar statutes. Recommended Action: Adopt 3 04 -01 -14 56:0035 C. Resolution No 7015 consenting to the inclusion of properties within the City's jurisdiction in the California Home Energy Renovation Opportunity Program ( "HERO ") to finance distributed generation renewable energy sources, energy and water efficiency improvements and approving the amendment to the Joint Powers Agreement. Recommended Action: Adopt d. Ordinance No. 2314 adopting Seabiscuit Pacifica Specific Plan (SP -SP) with a Floor Area Ratio of 1.03 the Art Deco architectural style for the two hotels (Marriott and Fairfield Inn Suites) and specific land use regulations for the Seabiscuit Pacifica Project at 130 W. Huntington Drive. Recommended Action: Adopt Ordinance No. 2315 makina certain amendments to the text of the Arcadia Zonin Codes and amending the zoning designation of certain property within the City from "C -2 with Downtown and H -8 Height Overlays" to "SP -SP, Seabiscuit Pacifica Specific Plan." with respect to the Seabiscuit Pacifica Project at 130 W. Huntington Drive. Recommended Action: Adopt e. Accept the gift of $10,000 from the Estate of John N. Sill for general library purposes. Recommended Action: Approve f. License, Costs, and Maintenance Agreement for a Pedestrian Bridge to cross westbound Huntington Drive from 300 West Huntington Drive (Methodist Hospital Parking Lot) to 289 West Huntington Drive (Hale Medical Center). Recommended Action: Approve g. Renewal of the Weed Abatement Services Agreement between the City of Arcadia and the Los Angeles County Agricultural Commissioner/Weights and Measures Department for the period of July 1, 2014, through June 30, 2019. Recommended Action: Approve h. Professional Services Agreement with Bucknam Infrastructure Group, Inc. for the City's Pavement Management Program in the amount of $28,948, and approve a 10% contingency. Amendment to Employment Agreement between the City of Arcadia and City Manager Dominic Lazzaretto establishing compensation and related benefits through March 25, 2018. Recommended Action: Approve City Attorney Deitsch presented the staff report. It was moved by Council Member Harbicht, seconded by Mayor Pro Tern Wuo, and carried on roll call vote to approve and authorize the Mayor to execute an Amendment to the Employment Agreement between the City of Arcadia and the City Manager Dominic Lazzaretto establishing compensation and related benefits through March 25, 2018. AYES: Council Member Harbicht, Wuo, Amundson, Kovacic and Segal NOES: None ABSENT: None City Manager Lazzaretto thanked City Council for the opportunity. 3. CITY MANAGER ITEMS a. Ordinance_ No. 2316 amendinq Section 4261 of Division 1. Part 6. Chapter 2 of Article IV of the Arcadia Municipal Code relating to construction hours and finding that the Ordinance is exempt from the requirements of the California Environmental Quality Act (CEQA). Recommended Action: Find that this Ordinance is exempt under the California Environmental Quality Act; and Introduce Ordinance Community Development Administrator Kasama presented the staff report. It was moved by Council Member Harbicht, seconded by Council Member Amundson, and carried on roll call vote finding that Ordinance No. 2316 is exempt from the requirements of the California Environmental Quality Act, and introduced Ordinance No. 2316 amending Section 4261 of Division 1, Part 6, Chapter 2 of Article IV of the Arcadia Municipal Code relating to construction hours. Master Joint Use Agreement for use of shared sites between City of Arcadia and Arcadia Unified School District. Recommended Action: Approve Acting Director of Recreation & Community Services Wright presented the staff report.
