HomeMy WebLinkAbout4-22-14 4 ARCADIA PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, April 22, 2014 CALL TO ORDER — Chairman Beranek called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Beranek, Falzone, and Parrille ABSENT: Chairman Chiao MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone to excuse Chairman Chiao from the meeting. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Each Commissioner was given copies of two email messages in support of Item 1. In addition, they were also provided with two documents showing the recommended revised wording for Text Amendment No. TA 14-01 and a list of cities with their responses to a survey on e-cigarettes. PUBLIC COMMENTS None. PUBLIC HEARINGS 1. The applicant is requesting approval of the following Modifications (MP 14-05) and Architectural Design Review (SFADR 13-107) with an Exemption from the California Environmental Quality Act (CEQA) for a new 3,656 square-foot, two- story, Spanish-style residence with an attached 422 square-foot, two-car garage, and two patios totaling 234 square feet at 501 E. Camino Real Avenue: a. A 48'-0" front yard setback in lieu of 58'-6" required (AMC Sec. 9252.2.2); b. A 12'-0" westerly street side yard setback in lieu of the 25'-0" required for the first floor (AMC Sec. 9252.2.3.2); c. A 16'-10" westerly street side yard setback in lieu of the 20'-0" required for the second floor and to allow the second floor to encroach within the 40-degree plane, as measured from the street side property line (AMC Sec. 9252.2.3.2); and d. Architectural design review approval of the proposed residence. Applicant: Sidney Chang, Designer Recommended action: Find that this project is exempt from CEQA, and conditionally approve the applications. 4-22-14 Assistant Planner, Jordan Chamberlin, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. Jonathan Sou, project manager, responded. Chairman Beranek asked if anyone would like to speak in opposition to this project. There were none. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to close the Public Hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Parrille, seconded by Commissioner Falzone, to conditionally approve Modification Application No. MP 14-05 and Single-Family Architectural Design Review No. SFADR 13-107 with a Categorical Exemption from the California Environmental Quality Act (CEQA) for a new 3,656 square-foot, two- story, Spanish-style residence with an attached 422 square-foot, two-car garage, and two patios totaling 234 square feet at 501 E. Camino Real Avenue. ROLL CALL AYES: Commissioners Baerg, Beranek, Falzone, and Parrille NOES: None ABSENT: Commissioner Chiao There is a five (5) working day appeal period following the decision. Appeals are to be filed by 5:30 p.m. on Tuesday, April 29, 2014. 2. Text Amendment No. 14-01 with an Exemption from the California Environmental Quality Act (CEQA) to initiate the following changes to the Smoking Prohibited regulations, the Commercial and Industrial Zoning regulations, and the Conditional Uses regulations of the Arcadia Municipal Code: a. Amending the Smoking Prohibited regulations in Section 4290. b. Adding new definitions on smoking, smoking lounges, and the use of electronic cigarettes and similar devices in Section 9220 et seq. c. Amending the Conditional Use Permit requirement to allow Smoking Lounges in Section 9275.1 et seq. d. Amending the Parking Requirements to include Smoking Lounges in Sections 9265.1 and 9269.5. e. Amending the Conditional Use Permit requirement in the Commercial Planned Development (CPD-1), Limited Commercial (C-1), General Commercial (C-2), and Commercial Manufacturing (CM) zones to 4-22-14 restrict retail uses between the hours of 10:00 p.m. and 6:00 a.m. in Article IX, Chapter 2, Part 6. f. Repealing the Lot Coverage limitation in the Planned Industrial District (M-1) zone. g. Adding a Floor Area Ratio of 50% in the Commercial Planned Development (CPD-1), Commercial Office (C-O), Limited Commercial (C-1), General Commercial (C-2), Commercial Manufacturing (CM), and Planned Industrial District (M-1) zones, Article IX, Chapter 2, Part 6, for consistency with the General Plan. Recommended action: Find that this project is exempt from CEQA, and forward a recommendation to the City Council. Associate Planner, Tom Li, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this project. There were none. Chairman Beranek asked if anyone would like to speak in opposition to this project. Mr. Sarkis Ekshian, a local business owner, responded. MOTION It was moved by Commissioner Falzone, seconded by Commissioner Baerg, to continue this item to the May 13 meeting in order to obtain more information. CONSENT CALENDAR 3. Minutes of the March 25, 2014, Regular Meeting of the Planning Commission Recommended action: Approve Without objection, the minutes were approved as presented. MATTERS FROM COUNCIL LIAISON A new City Council Liaison has not yet been appointed. FROM PLANNING COMMISSIONERS Nothing to report. MATTERS FROM MODIFICATION COMMITTEE Commissioner Falzone reported that one item was approved for the addition of a garage in front of an existing workshop. 4-22-14 MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said the May 13 agenda will include the Text Amendment item that was continued, possibly an appeal of the monument sign for a church, the Determination of Consistency of the Capital Improvement Program with the General Plan. ADJOURNMENT Chairman Beranek adjourned this meeting at 7:52 p.m. to May 13, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
