Huntington Drive, Arcadia Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in order to participate in a meeting, including auxiliary aids or services,may request such modification or accommodation from Planning Services at 626-574-5423. CALL TO ORDER ROLL CALL: Sam Falzone, Chairman Dominic Lazzaretto, Committee Member Jason Kruckeberg, Committee Member PUBLIC COMMENTS (5 minute time limit per person) Each speaker is limited to five (5) minutes per person, unless waived by the Modification Committee. Under the Brown Act, the Members are prohibited from discussing or taking action on any items not listed on the posted agenda. PUBLIC HEARING You are hereby advised that should you desire to legally challenge in court any action taken by the Modification Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or prior to, the public hearing. 1. Modification No. MC 14-01 and Single-Family Architectural Design Review No. SFADR 14-05 1126 Valencia Way Applicant: Sean and Fiona French, Property Owners PROJECT DESCRIPTION: The applicant is requesting the following modifications and architectural design review for a new 455 square foot, first story addition, a 147 square foot covered porch, and a 1,053 square foot, second-story addition to the existing 978 square foot, one-story residence, and a new detached, two car garage: a. To allow the new 455 square foot, first story addition and a 147 square foot, covered porch to be aligned with the existing northerly elevation of the house and maintain a 3'-6" northerly side yard setback in lieu of the 5'-0" requirement; b. To replace the existing detached two-car garage with a new 440 square foot, detached two-car garage that will have a 3'-6" southerly side yard setback in lieu of 5'-0" required, and to allow the new garage to exceed the maximum rear yard lot coverage of 25% (proposed at 35.2%); and, c. Architectural design review to change the architectural style of the house from Ranch to American Traditional architecture. ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15305 of the CEQA Guidelines Class 5 Exemption for the minor alterations in land use limitations. Conditionally approved, 2-1, subject to the following conditions: 1. The rear addition that is connected to the covered porch shall be setback at least 5=0" from the side property line. 2. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, Modification Committee, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 3. Approval of MC 14-01 and SFADR 14-05 shall not be of effect unless on or before 30 calendar days atter approval of this project, the property owner/applicant has executed and fried with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to the Planning Commission within five (5) working days of the decision. Appeals are to be filed by 5:30 p.m. on May 21, 2014. If no appeal is filed, decisions are final. ADJOURNMENT The Modification Committee will adjourn this meeting to May 27, 2014, at 7:45 a.m. in the City Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia. Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 240 W Huntington Drive, Arcadia, California, during normal business hours.
