PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Beranek, Chiao, Falzone, and Parrille ABSENT: Commissioner Baerg SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS A copy of a memo related to Item 2 was distributed to each Commissioner and a correction to the minutes of the May 27, 2014 meeting was noted. Each Commissioner also received a copy of a memo to Chairman Beranek and Commissioner Parrille requesting an extension of their terms through July 2014. PUBLIC COMMENTS None. PUBLIC HEARINGS 1. Modification No. MP 14-03 with an Exemption from the California Environmental Quality Act(CEQA) to allow second-story side yard setbacks of 13'-6" in lieu of 27'-1" required for a proposed new two-story residence due to the irregular shape of the lot at 560 W. Orange Grove Ave. The architectural design of the proposed new residence has been approved by the Architectural Review Board of the Santa Anita Oaks Homeowners'Association. Applicant Simon Lee Recommended action: Find that this project is exempt from CEQA, and conditionally approve MP 14-03. Associate Planner, Tim Schwehr, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this Item. Mr. Corky Nicholson, a consultant for Simon Lee Assocs., responded. Chairman Beranek asked if anyone would like to speak in opposition to this item. Mr. Jason Fan, a neighbor, responded. Chairman Beranek asked if anyone would like to speak in opposition to this item. The following responded. Mr. Corky Nicholson, a consultant for Simon Lee Assocs., responded. MOTION It was moved by Commissioner Falzon, seconded by Commissioner Parrille, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Parrille, to find this project is exempt from CEQA and to approve the application subject to the conditions listed in the staff report and with the added condition that the view from the second floor balcony adjacent to the master bedroom will be blocked off, and that the balcony be set back an additional five feet to avoid intrusion into the privacy of the neighbor to the east. ROLL CALL AYES: Commissioners Chiao, Falzone, Parrille and Beranek NOES: None ABSENT: Commissioner Baerg There is a five working day appeal period after the approval/denial of the application. Appeals are to be filed by Wednesday, June 18, 2014. 2. Resolution No. 1907 — Tentative Tract Map No. TTM 72869, Multiple-Family Architectural Design Review No. MFADR 13-44, and Oak Tree Encroachment Permit No. THE 13-71 with an Exemption from the California Environmental Quality Act (CEQA) for a proposed 20-unit, residential condominium development at 550 S. Second Ave. Applicant: Sanyao International, Inc. Recommended action: Find that the project is exempt from CEQA and conditionally approve the application. Associate Planner, Tim Schwehr, presented the staff report. Chairman Beranek opened the public hearing and asked if anyone would like to speak in favor of this Item. Mr. Hank Jong, project engineer, represented the applicant. Chairman Beranek asked if anyone would like to speak in opposition to this item. The following responded. Mr. Bill Burns, a neighbor Mr. Xiaejiang Cui, a neighbor Mr. Can Chow, a neighbor Chairman Beranek asked if the applicant would like to speak in rebuttal. Mr. Charles Huang, the property owner, responded. 6-10-14 MOTION It was moved by Commissioner Chiao, seconded by Commissioner Parrille to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Parrille, to find this project is exempt from CEQA, and to approve the application subject to the conditions in the staff report including the additional conditions distributed to commissioners before meeting, and to adopt the Resolution. ROLL CALL AYES: Commissioners Chiao, Falzone, Parrille and Beranek NOES: None ABSENT: Commissioner Baerg There is a ten calendar day appeal period after the adoption of the Resolution. Appeals are to be filed by 4:30 p.m. on Friday, June 20, 2014. CONSENT CALENDAR 3. Minutes of the May 27, 2014, Regular Meeting of the Planning Commission Recommended action: Approve as corrected MOTION Without objection the minutes were approved. MATTERS FROM COUNCIL LIAISON Nothing to report. FROM PLANNING COMMISSIONERS Commissioner's terms were discussed and Chairman Beranek and Commissioner Parrille agreed to extend their terms for one month to allow the City Council additional time to appoint their replacements, except that Commissioner Parrille will not be available for the July 22 regular meeting. Commissioner Chiao said that he will not be able to attend the regular meeting on August 26. MATTERS FROM MODIFICATION COMMITTEE Commissioner Falzone reported that the Modification Committee meeting was cancelled. MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said that the June 24 agenda will include Modifications for a new house at 800 Hampton Rd., and an appeal of a design review denial at 500 San Luis Rey Rd. There are 6-10-14 also pending several appeals of design reviews in the Highland Homeowners area that were approved by City staff in the absence of an HOA Architectural Review Board Chairman. MOTION: It was moved by Commissioner Chiao, seconded by Commissioner Parrille to excuse Commissioner Baerg from the meeting. Without objection the motion was approved. ADJOURNMENT Chairman Beranek adjourned this meeting at 7:48 p.m. to June 24, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W.
