HomeMy WebLinkAbout7040 - NOT USEDRESOLUTION NO. 7040 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, C LIFORNIA, PROVIDING FOR THE FILING OF REBUTTAL AR UMENTS FOR CITY MEASURES SUBMITTED AT MUNICIPAL ELEOTIONS WHEREAS, Sections 9220 and 9285 of the Elections Code of the State of California authoriz&� the City Council, by majority vote, to adopt provisions to provide for the filing of rebutta arguments for City measures submitted at municipal elections; and WHEREAS, a Speci M,Wicipal Election has been called for Tuesday, November 4, 2014 in the City o \Wr pdia at which a measure (the "Measure ") will be submitted to the voters pertaining to tke City's Utility Users Tax Ordinance. NOW, THEREFORE, THE CII)�QUNCIL OF THE CITY OF ARCADIA, \ \J A CALIFORNIA, DOES HEREBY FIND, DET NE AND RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Sections 9220 n 9285 of the Elections Code of the State of California, when the elections official h s selected the arguments for and against the Measure which will be printed and distriNted to the voters, the elections official shall send a copy of an argument in favor of the Ivasure to the authors of any argument against the Measure and a copy of an argument a�jainst the Measure to the authors of any argument in favor of the Measure immediate upon receiving the arguments. The author or a majority of the authors of an argument relating t a city Measure may prepare and submit a rebuttal argument not exceeding 250 words or m`ky authorize in writing any other person or persons to prepare, submit, or sign a rebuttal arg A rebuttal argument may not be signed by more than five individuals. The rebuttal arguments shall be filed with the City Clerk, signed, with the printed name(s) and signature(s) of the author(s) submitting it, or if submitted on behalf of an organization, the name of the organization, and the printed name and signature of at least one of its principal officers. The deadline for submitting rebuttal arguments concerning the Measure is hereby declared by the City Clerk to be Monday, July 28, 2014, 5:30 p.m. Rebuttal arguments shall be printed in the same manner as the primary arguments. Each rebuttal argument shall immediately follow the primary argument which it seeks to rebut. SECTION 2. The provisions of this Resolution shall apply only to the special election to be held on Tuesday, November 4, 2014 and shall then be repealed. SECTION 3.
