Huntington Drive, Arcadia, California. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None PUBLIC COMMENTS - No one appeared The purpose of this Special Meeting was to interview potential candidates for appointment to the Planning Commission; and to discuss and make appointments. The City Council interviewed nine candidates, and made nominations as follows: Council Member Beck nominated Burton Brink, Jack Green, and Zi Lin Council Member Chandler nominated Lowell Lachelt, Zi Lin, and Kenneth Chan Council Member Tay nominated Lowell Lachelt, Zi Lin, and Kenneth Chan Mayor Pro Tern Kovacic nominated Raymond Cheung, Zi Lin, and Jack Green Mayor Wuo nominated Kenneth Chan, Richard Dilluvio, and Zi Lin It was the consensus of the City Council that Kenneth Chan and Zi Lin be appointed to the Planning Commission for a four (4) year term ending June 30, 2018. Mayor Wuo adjourned the Special Meeting at 8:15 p.m. A Gene Glasco, City Clerk Lisa Mussenden Chief Deputy City Clerk /Records Manager 06 -30 -14 56:0070 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, JULY 1, 2014 CALL TO ORDER - Mayor Wuo called the meeting to order at 6:00 p.m. in the Council Chamber Conference Room. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None PUBLIC COMMENTS - No one appeared CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the Workers' Compensation case of Karl Taylor. No reportable action was taken on the Closed Session item. STUDY SESSION a. Evaluation of the intersections of Huntington Drive at Santa Clara Street and Colorado Place, including potential installation of a median and other modifications /additions to recent improvements. Deputy Development Services Director /City Engineer Wray presented a report regarding the evaluation of the intersections of Huntington Drive at Santa Clara Street and Colorado Place, including potential installation of a median and other modifications /additions to recent improvements. It was the consensus of the City Council that notice be given to the neighbors to the north of Huntington Drive regarding the installation of a median and additional improvements of said intersections. The Study Session ended at 6:50 p.m. CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Wuo called the regular meeting to order at 7:00 p.m. INVOCATION - Reverend Jolene Cadenbach, Arcadia Congregational Church PLEDGE OF ALLEGIANCE - Tom Tait, Public Works Services Director ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None 07 -01 -14 56:0071 REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION AND STUDY SESSION ITEM(S) City Attorney Deitsch reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session; no reportable action was taken. City Attorney Deitsch also reported that the City Council conducted a Study Session to evaluate the intersections of Huntington Drive at Santa Clara Street and Colorado Place, including the potential installation of a median and other modifications /additions to recent improvements made to the intersection; and that by consensus of the City Council directed staff to notify neighbors to the north of Huntington Drive regarding consideration of installation of a median and additional improvements to the intersections of Huntington Drive at Santa Clara Street and Colorado Place. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Tay, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Donation of art books from Mr. Yang Lung to the Arcadia Library. b. Presentations to outgoing Board and Commission Members. City Clerk administered the Oath of Office to the newly appointed Board and Commission Members. PUBLIC COMMENTS — Mayor Wuo announced that Lawrence Papp submitted a speaker card and requested to speak prior to City Council consideration of City Manager item 2.a. regarding the Utility Users Tax Repeal Initiative Measure. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City, expense CAB 1234]). Mayor Pro Tern Kovacic thanked outgoing Commission and Board Members for their service to the City, and congratulated the new board and commission members; he announced that he and Council Member Beck will participate in the Sierra Madre Fourth of July parade and encouraged everyone to attend; he reminded everyone that fireworks are illegal in the City of Arcadia; and expressed his condolences to the family of Arcadia Fire Fighter Mike Herdman, long -time Library employee Janet Mallen, and long -time Arcadia volunteer Polly Schmutz. Council Member Tay announced that on June 21, he attended the Arcadia Chinese Association Installation dinner with Mayor Wuo and expressed appreciation to outgoing President Joanna Liang and congratulated the newly appointed co- Presidents Francine Chiu and Shelley Liu. He announced that he attended a neighborhood block party in the neighborhood of Betty and Scott Hettrick, who are considering implementing a Neighborhood Watch Program in their neighborhood; he announced that he also attended the Villa Catrina ribbon - cutting ceremony on June 26; and the 07 -01 -14 56:0072 retirement dinner for Arcadia Unified School Superintendent Joel Shawn, and congratulated David Vannasdall on his appointment as the new Arcadia Unified School Superintendent. He referred to a Press Release announcing Santa Anita Race Track as the host of the 2016 Breeders' Cup, November 4 -5, 2016. He announced that he also attended the Museum Education Center ribbon cutting ceremony and congratulated Floretta Lauber and the Arcadia Historical Society Foundation for a job well done in raising $500,000 toward the cost of constructing the building; he expressed appreciation to Mimi Hennessy, the outgoing Rotary Club President, and congratulated new President, Mike Ojeda. Council Member Tay announced that Tom Tait, Public Works Services Director will be the guest speaker at the next Government Affairs Forum on July 3; the Concert in the Park on Thursdays and Movies in the Park on Fridays this summer; and wished everyone a Happy and safe 4th of JUly. Council Member Beck expressed condolences to the family of Arcadia Fire Fighter Mike Herdman, long -time Library employee Janet Mallen, and long -time Arcadia volunteer Polly Schmutz; he stated that the City Council conducted Planning Commission interviews and selected two new commissioners; he congratulated the outgoing and incoming board and commissioners; and encouraged applicants who were not selected to continue to volunteer when there is an opportunity; and he congratulated Randall Fowler for joining the Recreation and Parks Commission. Council Member Chandler echoed the thoughts of the entire City Council regarding the passing of three members of the Arcadia family, Mike Herdman, Janet Mallen, and Polly Schmutz; he congratulated the Arcadia Historical Museum Foundation and President, Floretta Lauber, for a job well done in raising money for the construction of the Museum Education Center building. City Clerk Glasco announced that he attended the 30th Annual Patriotic Concert featuring the Southern California Mormon Choir at the Arcadia Church of the Latter -day Saints where Hilda Solis, member -elect for the Los Angeles County Board of Supervisors District 1, was the guest speaker; he encouraged everyone to attend the City of Sierra Madre Fourth of July parade; and noted that he will be driving the newly painted and refurbished 1959 police car, and expressed his appreciation to the Arcadia Body Shop for a job well done. Mayor Wuo also expressed condolences to the families who lost loved ones last week and expressed his appreciation to the Ventura County Sheriff's Department, the Arcadia Police and Fire Departments for their support; he encouraged everyone to attend and enjoy the free Concerts in the Park on Thursdays and free Movies in the Park on Fridays this summer; he expressed his appreciation to Joanna Liang, the Arcadia Chinese Association President for the last two years, who will continue her work in the community as a Library Board Member, and congratulated incoming co- presidents Francine Chiu and Shelley Liu; he also noted the Planning Commission interviews and the selection of two new commissioners and thanked the City Council for taking the time to interview nine Planning Commission candidates; and he also wished everyone a Happy and safe 4th of July. CONSENT CALENDAR All matters listed under the Consent Calendar are considered to be routine and can be acted on by one roll call vote. There will be no separate discussion of these items unless a member of the City Council, staff, or the public request that a specific item be removed from the Consent Calendar for separate discussion and action. a. Special Meeting and Regular Meeting Minutes of June 17, 2014. Recommended Action: Approve 07 -01 -14 56:0073 b. Resolution No. 7020 initiating proceedings for the annual levy and collection of assessments for the Arcadia Citywide Lighting District No. 1 pursuant to the provisions of Part 2 of Division 15 of the California Streets and Highways Code and ordering the preparation of the Engineer's Report. Resolution No. 7021 aaarovina the Preliminary Enaineer's Report of Willdan Financial Services for the Arcadia Citywide Lighting District No. 1. Resolution No. 7022 declaring its intention to levy and collect assessments within the Arcadia Citvwide Liahtina District No. 1 for Fiscal Year 2014 -15 and aaaointina a time and glace for a Dublic hearin Resolution No. 7023 initiating proceedings for the annual levy and collection of assessments for the Arcadia Kaitlyn Place Landscaping and Lighting District pursuant to the provisions of Part 2 of Division 15 of the California Streets and Highways Code and ordering the preparation of the Engineer's Report. Resolution No. 7024 approving the Preliminary Engineer's Report of Willdan Financial Services for the Kaitlyn Place Landscaping and Lighting District. Resolution No. 7025 declaring its intention to levy and collect assessments within the Arcadia Kaitlyn Place Landscaping and Lighting District for Fiscal Year 2014 -15 and appointing a time and place for a public hearing. Recommended Action: Find that these Resolutions are exempt under the California Environmental Quality Act; and adopt Extension to the Purchase Order with Black and White Emergency Vehicles, Inc. for the purchase and installation of emergency equipment and lighting for City vehicles in the amount of $84,794. Recommended Action: Approve Purchase Order with Holliday Companies to provide asphalt concrete mixes on an as needed basis in an amount not to exceed $40,000. Recommended Action: Approve e. Contract with Southwest General Engineering, Inc. for the Canyon Reservoir Facility Slope Stabilization Project and approval of a supplemental appropriation from the Water Fund in the amount of $66,315. Recommended Action: Approve Agreement for Services with the Arcadia Chamber of Commerce in an amount not to exceed $72,000, and amendment to the Lease Agreement between the City and the Arcadia Chamber of Commerce. Recommended Action: Approve Extension to the Purchase Order with HD SuaDly Waterworks for data loa radio- read water meters for the City's water distribution system in the amount of $500,000. Recommended Action: Approve Reiect all bids received for the fiber oatics Droiect and direct staff to re -bid. Recommended Action: Approve 07 -01 -14 56:0074 Accept all work performed by TKE Construction for the Museum Education Center Proiect and authorize the final Davment to be made in accordance with the contract documents. Recommended Action: Approve Mayor Wuo pulled Consent Calendar item 1.f for discussion and separate action. It was moved by Council Member Tay seconded by Council Member Chandler and carried on roll call vote to approve Consent Calendar Items 1.a. through 1.e and 1.g through 1.i. AYES: Council Member Tay, Chandler, Beck, Kovacic, and Wuo NOES: None ABSENT: None Mayor Wuo pulled this item to state that he would like to see a shorter time frame for reviewing the Chamber of Commerce's progress in order to hold them accountable to the community. In response to Mayor Wuo's comments regarding Consent Calendar item 1.f, City Attorney Deitsch suggested Section A, subsection 3 of the proposed Agreement for Services with the Chamber of Commerce to include "On or before January 1, 2015, but no sooner than December 15, 2014, and on or before May 15, 2015, but no sooner that May 1, 2015, the Chamber shall submit to the City a written progress report describing in reasonable detail the Chamber's performance and provision of the Services under this Agreement for the period of July 1, 2014, through the date of said report." It was moved by Mayor Wuo seconded by Council Member Chandler and carried on roll call vote to approve Consent Calendar Item 1.f., as revised by City Attorney Deitsch. AYES: Council Member Wuo, Chandler, Beck and Kovacic NOES: Council Member Tay ABSENT: None 2. CITY MANAGER ITEMS a. Elections Code Section 9212 Report relating to the Utility Users Tax Repeal Initiative Measure. Recommended Action: Receive and file report; and provide direction on placing the Utility Users Tax repeal initiative on the ballot Lawrence Papp, an Arcadia resident, appeared and spoke in favor of the measure, and asked the City Council to vote on placing the Utility Users Tax repeal measure on the November 4, 2014, ballot. City Manager Lazzaretto presented the staff report. City Attorney Deitsch reported that he has reviewed the proposed Measure and identified several provisions that are unconstitutional or unlawful. He provided a report outlining those issues and recommended that the City Council direct staff not to place the measure on a ballot. 07 -01 -14 56:0075 It was moved by Council Member Chandler seconded by Council Member Beck and carried on roll call vote to not place the Utility Users Tax Repeal Initiative Measure on a ballot.
