Construction of a dog park at Eisenhower Park Recommendation: Approve ADJOURN the City Council/Redevelopment Agency to February 17, 2004 at 6:00 p.m., .: Council Chambers Conference Room in memory of Milt Bade 3 Recommendation: Adopt CITY COUNCIL PROCEEDINGS ARE TAPE RECORDED AND ON FILE IN THE OFFICE OF THE CITY CLERK MINUTES CITY COUNCIL OF THE CITY OF ARCADIA and the ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING February 3, 2004 46:0016 The City Council and Arcadia Redevelopment Agency met in a Regular Meeting on Tuesday, February 3, 2004 at 6:00 p.m. in the Council Chambers Conference Room. ROLL CALL PRESENT: Council /Agency Members Chang, Kovacic, Marshall, Wuo and Segal ABSENT: None AUDIENCE PARTICIPATION None. 1. STUDY SESSION i 1a. � MIDYEAR City Manager Kelly presented the mid -year budget review, stating in part, that the City will BUDGET use a portion of its $6.5 million reserve funds to balance the budget next year. Further, the REVIEW $6.5 million reserve funds are General Fund surplus funds which Council put into an account to pay for master plan improvements. With regard to revenues, it was noted that the City is expecting property tax revenue, franchise fees, sales taxes, and utility taxes to increase. The City will not be seeing any major new revenues with the exception of the mall expansion, the possible expansion of Rusnak Auto, and any new projects at the racetrack. Minor revenues may come from City fire inspection fees and some recreation programs. The City lost about $1 million this year in vehicle license fees backfill, although, we are relying on the Governor to fully fund VLF next year. In addition, the City is facing a big hit in Public Employee Retirement System funding, which will be a problem for the City by 2004- 2005. i Reviewing expenditures, Mr. Kelly stated in part, that at this time expenditures are little under the forecast, however, at the end of the fiscal yearn tends to increase depending on vacancies and unfilled positions. There are no plans for layoffs or a hiring freeze at the present time. Each position that opens during the year will be evaluated to determine how soon a replacement will be hired. It was noted that the Unrestricted Reserve Funds, Emergency, Equipment and Capital Outlay are at approximately $20 million; therefore, there are $6 million reserve funds, plus $20 million Unrestricted Reserve Funds available to help carry the City through the state budget crisis. Overall, he. believes the City is in a very good fiscal condition and could take a significant hit from the State and try to recover, but, cannot take consecutive consistent hits. DENIAL — TPM 2003 -024 (1725 South Baldwin Ave.) (DENIED) City Attorney Deitsch announced that Items 2a. and 2b. were discussed in Closed Session held earlier this "evening. No reportable action was taken. PRESENTATION Mayor Segal presented the February 2004 Citizen of the Month Award to Erinne La Brie, Rose Princess for the 2004 Tournament of Roses Royal Court and a senior at Arcadia High School PUBLIC HEARINGS Application No. TPM 03 -024 was submitted by David G. Lackyard on behalf of the property owners, Mr. And Mrs. Laraway, to subdivide one lot into two lots located at 1725 South Baldwin Avenue. The project site is a 16,560 square foot lot located at the southwest comer of Baldwin Avenue and Sharon Road. The proposed two -lot subdivision does not comply with the minimum lot dimensions of the City's Subdivision Regulations. The applicant proposed to create two new lots, one fronting Baldwin Avenue (Parcel 1) and one fronting Sharon Road (Parcel 2). Each lot will have a substandard lot dimension. Parcel one (1) would have a width of 75 feet in lieu of a reverse corner lot requirement of 85 feet and a lot depth of 122 feet with a total lot area of 9,150 square feet; and, parcel two (2) would have a depth of 75 feet in lieu of a minimum lot depth requirement of 100 feet and a lot depth of 75 feet with a total lot area of 7,500 square feet. 2/3/04 - - 46:0018 In addition, the proposed lot configurations are not similar to other lots in the area. In fact, several of the neighboring R -1 zoned lots along Baldwin Avenue are similar in size and dimension to the existing lot, according to City staff. The Planning. Commission or the City Council may grant modifications from the Subdivision Regulations in accordance with Section 9113.6 of the Arcadia Municipal Code, based on evidence that the modifications are necessary by reason of the size, shape, topography, or other conditions of the subject property or adjacent property. Such modifications must be approved by a majority of the Council or Commission member. The.Planning Commission at its meeting of December 9, 2003 voted 3 -1 with one member abstaining. to deny the lot split. The Development Services Department recommended denial of the lot split due to the substandard lot width for Parcel 1 and substandard lot depth for Parcel 2. Mayor Segal OPENED the Public Hearing. No one came forward to address the City Council. i It was MOVED by Councilmember Kovacic, seconded by Councilmember Chang, and CARRIED on roll call vote as follows to CLOSE the Public Hearing. AYES: Councilmembers Chang, Kovacic, Marshall, Wuo and Segal NOES: None ABSENT: None Considerable discussion ensued. Councilmembers found that the proposed subdivision is not consistent with applicable general and specific plans. It was MOVED by Councilmember Kovacic, seconded by, Councilmember Chang and CARRIED on roll call vote as follows to DENY the Tentative Parcel Map 03 -024 based on findings D1, D2 and D3. as set forth in the February 3, 2004 staff report; and, specifically because the proposed Tentative Parcel Map -will create substandard parcels that would not comply with minimum requirements for lot depth and width. NO. 2188 The proposed text amendment would change Article IX (Subdivision Code) by adding lot line T.A. 2003 -006 adjustment procedures and amending the "Definitions" and "Certificate of Compliance' (Amending sections of Article IX. AMC —Art. IX Division & A lot, line adjustment is an adjustment of property lines between four or fewer adjoining Use of Land) parcels, where a greater number of parcels than originally. existed is not created. - Pursuant (INTRODUCED) to the provisions of the State Subdivision Map Act; lot line adjustments are not considered "subdivisions'. Therefore,. lot line adjustments may be processed by a local jurisdiction without filing a subdivision map. At this time, the City of Arcadia Municipal Code does not include provisions for lot line adjustments and such requests are handled as a Tentative Parcel Map. AYES: Councilmembers Chang, Kovacic, Marshall, Wuo and Segal NOES: None ABSENT: None AUDIENCE PARTICIPATION Shirly Bien, Health Care Resources representative, presented a proposal to provide health care services to low and moderate - income families. City Manager Kelly stated that staff will meet with the Health Care Resources representative and the issue will be forwarded to the appropriate department for review. Arne and Celia Kalm 100 White Oak Drive, commended the Arcadia Fire Department for their exceptional efforts and dedication on the evening of Sunday December 21, when their single story house was on fire. Mr. & Mrs. Kalm expressed appreciation to the City Council, City Manager Kelly, City staff, Fire Chief David Lugo, in particular Battalion Chief Ken Marston, neighbors and the community for helping and comforting them during this difficult time. MATTERS FROM ELECTED OFFICIALS MARSHALL Mayor Pro tem Marshall thanked Mr. & Mrs. Kalm for expressing their appreciation, and (Kalm) noted that it is always good to know that City's Fire and Police Departments go beyond the call of duty. (Badge Pinning Ms. Marshall attended the badge pinning ceremony at the Fire Department Last week. It Ceremony - FD)was a very nice ceremony and she was pleased that the City has its first female fire fighter, Beth Decoteau. (Sandona) Ms. Marshall attended a retirement dinner honoring Captain Rick Sandona. Ms. Marshall expressed congratulations to retired Captain, _Rick Sandona and'wished him health and Gods blessing. (Food for Ms. Marshall shared a food for thought, "personality is how the world sees you, character is Thought) how you see the world ". WUO Councilmember Wuo expressed his sincere sympathies to Mr. and Mrs. Kalm for the loss of (Mr. & Mrs. their home. Kalms) 4 2/3/04 46:0020 (Sandona) Councilmember Wuo also attended the retirement party for Captain Rick Sandona. It was a very moving and emotional evening for the Sandona family. Mr. Wuo expressed . appreciation to Captain Sandona for his long service to the City. (Chinese Councilmember Wuo attended the Chinese New Year Celebration hosted by the Arcadia New Year) Chinese Association and Westfield ShoppingTown. It was a great way to celebrate the culture and the New Year. (100 years of Councilmember Wuo expressed congratulations to Core Media for publishing "100 years of Arcadia) Arcadia ". The publication contains many details about Arcadia's history. i KOVACIC Councilmember Kovacic thanked Arne and Celia Kalm for their nice comments. He is glad (Kalms) that two of Arcadia's greatest treasures, the Kalms,.will return to their property, start anew and continue to make their very special contributions to the community. (Sandona Councilmember Kovacic endorsed all the good words extended by Councilmembers to & Lugo) Captain Rick Sandona. He also congratulated Fire Chief Lugo for an extraordinary "Badge Pinning Ceremony'. (AHS Women's Mr..Kovacic congratulated Arcadia High School Women's Soccer Team +for ranking second Soccer Team) in Southern California (AHS i Mr. Kovacic thanked the Council and City for allowing the Arcadia High School Constitution Constitution Team to use the Council Chambers to practice for the State National Competition. Team) CHANG Councilmember Chang expressed congratulations to the Citizen of the Month Award (La Brie) recipient Erinne La Brie. (Mr. & Mrs. Dr. Chang expressed sympathy to Mr. & Mrs. Kelm and thanked them for expressing their Kelm) appreciation and good words for the Arcadia firefighters. (Chinese New Dr. Chang expressed appreciation to the Arcadia Chinese Association for hosting a Year) wonderful event at Westfield ShoppingTown in celebration of the Chinese New Year. CONST. ,(Eisenhower Park) (APPROVED) 46:0022 ABSENT: None CITY MANAGER Consideration of the report and recommendation regarding construction of a dog park at Eisenhower Park. The idea of creating a dog park was reviewed two years ago; the major problem at that time was finding a suitable location in the City of Arcadia. The Parks and Recreation Commission requested that staff reevaluate possible locations, costs and consider a smaller location. Staff reviewed four possible park sites in Arcadia.to evaluate potential locations. The four ,parks included Newcastle, Fairview, Forest and Eisenhower. It was decided that Newcastle Park would not be suitable due to space constraints. Additional sites were also reviewed including the Arcadia County Park, the City owned property on Live Oak Avenue adjacent to the 3 -Par Golf Course and the flood control area below Wilderness Park.. These sites were not pursued due to issues ranging from lack of accessibility to excessive infrastructure costs that would, be required. . At its December 10, 2003 meeting the Parks and Recreation Commission unanimously decided that Eisenhower Park would be the first choice for a dog park (as long as the cost is under $10,000). The Commission expressed concerns with regard to the parking, as there is no parking allowed along Colorado Boulevard. However, the Commission felt that sufficient parking is available on Second Avenue and access to the off -leash area from Colorado Boulevard and from the north side of the park is only a short walk through or around the park. It was noted that sufficient funds are available in the Recreation Facilities Capital Improvement Program Fund, as several projects have been completed at significantly less than budgeted such as the Community Center Storage Project. In response to a Council question staff noted that plastic sacks will be available for self - policing by owners, but a certain amount of maintenance will be required. The City will also decide how to deal with turf damage, if problems occur. It was MOVED by Councilmember Kovacic, seconded by Councilmember Chang and CARRIED on roll call vote as follows to APPROVE the construction of a dog park at Eisenhower Park. AYES: Council /agency Members Chang, Kovacic, Marshall, Wuo and Segal NOES: None ABSENT: None ADJOURNMENT Councilmember Wuo introduced the Bade family in the audience and adjourned the meeting (In Memory of in memory of Milt Bade. "Milton Charles Bade, July 5, 1928- January 26, 2004. He was a Milt Bade) resident of Arcadia for approximately over 32 years. A homebuilder in Arcadia and other San Gabriel Valley towns since 1950. Had built hundreds of homes in Arcadia, some Arcadia streets, where Mr. Bade subdivided the land, are named after Mr. Bade's family. Patricia Way, is named after his wife, Pat. Judith Court, is named after Milton's oldest daughter Judy. Scott Place, Nicholas Way and Christine Lane, are named after Milton's grandchildren. Respected by City Planners and Inspectors, Realtors, sub - contractors, architects, engineers and homeowners for his integrity and honesty during his fifty -year career in the building "business. Known for his optimism and positive attitude, he encouraged 7 2/3104 i 46:0023 and supported many colleagues throughout their careers. An active and supportive parent and grandparent in his children and grandchildren's activities. For years Mr. Bade sponsored many Pony League teams, the Arcadia High School Apache Band and Arcadia Boosters. He was coach and equipment manager for Chris' Little League and Pony League teams. With other parents he re -built the infield at the Pony League Park in Arcadia on Second Avenue. Boy Scout Leader; who among other things hiked with his sons through to the top of Mount Whitney. Active Girl Scout parent, taking his daughters troop on several camp outs. Attended numerous parades throughout Southern California to support student's involvement in the First Avenue and Arcadia High School Marching Bands. Always attended school performances and other activities of his children and grandchildren. Milt is also a founder of the First American Bank and Bade Construction Company, Inc., was named best General Contractor in 2000 by the Arcadia, Monrovia and Sierra Madre Weekly. Milton Charles Bade is survived by his wife, Patricia, of 54 years, son, Chris Bade, daughters, Susan Bade Hull and Judy Bade Morrison; grandchildren, Scott, Nicholas and Christian Bade and Caroline Hull, daughter -in -law, Diane Bade, son -in -law, Reverend Norman Hull. I am honored to adjourn tonight's meeting in memory of Milton Charles Bade." Mayor Segal announced that he would present the Annual State of the City Address on February 17, 2004 at the Council meeting. Lackyard on behalf of the property owners, Mr. And Mrs. Laraway, to subdivide one lot into two lots located at 1725 S: Baldwin Avenue. The project site is a 16,560 square foot lot located on the southwest corner of Baldwin Avenue and Sharon Road. The proposed two -lot subdivision does not comply with the minimum lot dimensions of the City's Subdivision Regulations. The Planning Commission at its meeting of December 9, 2003 voted 3 -1 with one member abstaining to deny the lot split. On December 18, 2003, the applicant, David G. Lackyard, submitted an appeal of TPM 03 -024. The Development Services Department is recommending denial of the lot split because of the substandard lot width for Parcel 1 and the substandard lot depth for Parcel 2. BACKGROUND On April 4, 1989, the ' City Council approved Tentative Map 47234 for an eight -lot', subdivision directly north of the project site. That subdivision resulted in the Sharon Road cul -de -sac that is adjacent to the subject lot. The subject lot has 222 feet of frontage adjacent to Sharon Road. TPM 03- 024C°ip` LASER IMAGED TPM O February 3, 2004 Page 1 PK a 0,� DISCUSSION The applicant is proposing to split the lot on the southwest corner of Baldwin Avenue and Sharon Road that is approximately 75 -feet wide by 222 -feet in depth. The applicant is proposing to create two new lots, one fronting on Baldwin Avenue (Parcel 1) and one fronting on Sharon Road. ANALYSIS As noted above, each lot will have a substandard lot dimension. Parcel 1 would have a width of 75 feet in lieu of a'reverse corner lot requirement of 85 feet; and Parcel 2 would have a depth of 75 feet in lieu of a minimum lot depth requirement of 100 feet. (See Exhibits 1 and 2) The Planning Commission (or City Council) may grant modifications from the Subdivision Regulations in accordance with Section 9113.6 of the'Arcadia Municipal Code, based on evidence that the modifications are necessary by reason of the size, shape, topography, or other conditions of the subject property or adjacent property. Such modifications must be approved by a majority of the Council or Commission members. Staff does not support the substandard lot dimensions as proposed. Parcel 2 (the interior lot) has a significantly limited building envelope, an area only 25 feet deep and 80 feet wide. The building envelope of Parcel 1 is slightly less restricted. Although it may be possible to develop Parcel 2 without modifications, staff cannot justify the creation of substandard parcels. Another concern of staff is that approval of a 75 -foot deep lot could potentially set a precedent for corner lots of similar dimensions throughout the City. Furthermore, the proposed lot configurations are not similar to other lots in the area. In fact, several of the neighboring R -1 zoned lots along Baldwin Avenue are similar in size and dimension to the existing lot. (See Exhibit 2) Based on the above citations, staff is not recommending approval of any modifications to the minimum lot dimension requirements because there are no special circumstances to justify the modifications. If the City Council concurs with staff, they should consider findings of denial D1, D2 and D3. February 3, 2004 Page 2 and specific plans (Arcadia Municipal Code),_and the site is not physically suitable for the typical development prevalent in the R -1 zone. Regardless of the design of the subdivision and any modifications from the Subdivision Regulations, the applicant is required to comply with all other code requirements and development policies as determined to be necessary by the Building Official, City Engineer,, Fire Marshall,, Public Works Services Director, and Community Development Administrator. PLANNING COMMISSION ACTION The Planning Commission at its December 9, 2003 meeting voted 3 -1 and one member abstained, to deny the lot split. The Planning Commission concurred with staff's analysis and denied the project based on findings D1, D2 and D3 contained in the staff report. The Commission found that.the proposed map and, subdivision design are not consistent with applicable general and specific plans (Arcadia Municipal Code), and that the site is not physically suitable for the typical development prevalent in the R -1 zone. The Commissioner in favor of the parcel map noted that there are several lots in the vicinity that are substandard. Also, if the map were approved, it would not be completely out of keeping with the existing lot sizes in the' area. Sharon Road is a single -sided cul -de -sac,' which is less desirable than a two -sided cul -de -sac. He felt that the circumstances in this case are unique and it calls for creative activity to allow the development. Several property owners in the vicinity of the subject site spoke in opposition to the lot split. Opponents voiced concerns about the potential for a loss of privacy if two homes are built. Others thought that the lot split might set a precedent for subdivisions in the neighborhood, which would result in a denser neighborhood. ENVIRONMENTAL ANALYSIS Pursuant to the provisions of the California Environmental Quality Act, the Development Services Department has determined that the proposed use will not have a potential for causing a significant effect on the environment and is, therefore, categorically exempt; from CEQA per Section 15315. RECOMMENDATION The Development Services Department recommends denial of Tentative Parcel Map Application No. TPM 03 -024 as proposed. If the City Council wishes to consider approving the proposed subdivision, staff recommends the following conditions of approval: 1. That after issuance of a building permit .a Rough Grading Certificate shall be required prior to the placing of any concrete on the site and a final Grading TPM03- 024CCrpt TPM 03 -024 CC Report February 3, 2004 Page 3 Certificate shall be required prior to the final building inspection. Said certificates shall certify that all grading operations have been completed in substantial compliance with the final grading plan approved by the City Engineer and shall be filed with and approved by the Development Services Department. 2. Approval of Tentative Parcel Map Application No. TPM 03 -024 shall not take effect until the property owner, applicant and civil engineer have executed and filed the Acceptance Form available from the Community Development Division to indicate acceptance of the conditions of approval. 3. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officers, .employees or agents to attack, set aside, void, or annul any approval or condition of approval of the City of Arcadia concerning this project and /or land use.decision, including but not limited to any approval or condition of approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or. proceeding concerning the project and /or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officers, employees, and agents in the defense of the matter. CITY COUNCIL ACTION Denial If the City Council takes action to deny Tentative Parcel Map 03 -024, the Council should make specific findings based on the evidence presented and move to deny the subdivision. The Council may wish to consider one, all, or any combination of the following findings, and must expand upon them with specific reasons for denial: D.I. That the proposed map is not consistent with applicable general and specific plans as specified in the Subdivision Map Act. D.2. That the design or improvement of the proposed subdivision is not consistent with applicable general and specific plans. D.3. That the site is not physically suitable for the type of development DA. That the site is not physically suitable for the density of development. D. 5. That the design of the subdivision or the proposed improvements are likely to cause substantial environmental damage. A.2. Find that this project will not have a significant effect on the environment; and that this project is categorically exempt from CEQA per Section 15315. A.3. Authorize and direct the Development Services Director (or designee) to approve and execute, if necessary, a subdivision agreement for this project. A.4. Approve this project subject to any revisions required by the Planning Commission, and any conditions of approval set forth in the staff report or as added to, or modified by the Planning Commission. David Lackyard, 1501 Sequoia Dr., Beaumont, said that the proposed lot split complies with code. He noted that there are some lots in the City that are smaller than 7,500 sq. ft. and he could not understand the reason for the denial recommendation. Both lots meet or exceed minimum lot requirements. The 85' lot width is not specified in the R -1 zoning regulations. This lot is not substandard based on the R -1 regulations. This would be in keeping with the surrounding area. He realized that the property was not deep enough but it meets all code requirements. Sid Sybenga, 1735 S. Baldwin, Pastor of the church next to the subject lot, said that the church owns the lots to the south of the proposed lot split. He thought they would construct large homes on these lots. They would lose their privacy and the view of the mountains. The lot is currently vacant and has been so for a few years. He thought they would lose their visibility because the houses would be constructed very close to Baldwin and that would obstruct view. David Ma, 1741 S. Baldwin, Pastor for the past 7 years. The church anticipates building on this site within a couple of years. Any construction at this site would infringe on their visibility. Their church is in transition now. Leo Wu, 9712 Ardendale, said that he is a member of this church as well as an architect who has worked in the City. This project will have a negative impact on the community. It is substandard and will set a precedent, The parcels are much too small for development. The homes would have to be pushed in one direction just to meet the setbacks. The neighbors will lose their privacy an d it will be a nuisance to the neighbors. He realized that the owners have a right to develop their property but this is not the right approach. He hoped that the City would ask the developer to ltry another alternative. This property is unique and this is a valuable location. If developed as proposed, it will have a crowded affect and will not fit in with the City's image. In answer to a question by Commissioner Lucas, Mr. Wu felt that they should not be allowed to subdivide and the lot should be developed with one single - family house. Fung Chan, 727 W. Lemon; felt this subdivision would result in the construction of two homes which would be inappropriate for the lots. Baldwin Ave. is busy. There is not enough room on this lot for two homes. David Ma, 1741 S. Baldwin, said he is the deacon of the church. He objected to the proposed lot split. The church is in transition and is developing rapidly. They are trying to create a Chinese and English language school. They plan on developing their lots. In answer to a question by Commissioner Lucas, Mr. Ma indicated that they were not informed of the development of the property to the west and they would have also objected to that. In rebuttal, Mr. Lackyard explained that the property owners approached the church in an attempt to purchase the property to the south but the church wanted to sell that piece of property for twice the appraised value. Again, he indicated that he could not see any problems with subdividing this lot. He wondered if the church should be looking at relocating, if the size of their congregation is growing. No one else spoke in favor of or in opposition to this item. MOTION: It was moved by Commissioner Hsu, seconded by Commissioner Olson to close the public hearing. The motion passed by voice vote with no one dissenting. Commissioner Olson inquired about the setbacks for the new homes and Ms. Butler explained the setback requirements. Ms. Butler indicated that there are no special setbacks on Baldwin. She corrected Mr. Lackyard's comment the fact that the width on a comer lot was only 75' -0 ". Ms. Butler cited code Section 9113.4 which discusses the lot width requirement of 85' -0" for a reverse comer lot. In answer to a question by Commissioner Lucas, Mr. Lambert indicated that the property to the south is zoned R -1. Ms. Butler indicated that the property to the west which is under construction required minor lot width modifications. Commissioner Lucas remarked that he looked at the aerial and noticed that there are several lots that are substandard.' If this was approved, it would not be completely out of keeping with the existing lot sizes in the area. Sharon Rd. is a single - sided cul -de -sac which is less desirable than a two -sided one. He felt that the church's preferences are unreasonable. Of course, they would prefer to have a vacant lot than one that is developed because they will lose their privacy. The circumstances in this case are unique and it calls for creative activity to allow the development. Commissioner Olson agreed with Commissioner Lucas regarding the neighbor's feelings. The lot has been vacant for years. He discussed the size of the homes and how close they would be to the property lines due to the required setbacks and the lot size. He was concerned about the size of parcel 2 because it is so small. Based on his calculation, they could only construct a 2,500 sq. ft. home on parcel 2 which is a small house based on today's standards and what is being constructed. If the Planning Commission is inclined to approve this, he recommended reducing parcel 1 and adding that portion to parcel 2 to provide a little bit larger parcel. Commissioner Wen agreed with Commissioner Olson. He also liked the shifting of the property line to increase the size of parcel 2. Ms. Butler replied that the property line could be shifted, however, one major concern is that this could set a precedent because there are other similar sized comer lots along Baldwin that could be subdivided in a similar manner. This is not a unique situation. The lot could be developed without being subdivided. Commissioner Lucas wondered if they should ask the applicant to redesign the project based upon comments by the Planning Commission. He thought the applicant should withdraw this and redesign to something that would be more acceptable. Commissioner Olson replied that the lot is too small to develop. He could not see any advantages of redesigning the parcel map. If this is approved, there will be two homes adjacent to the church but if it is denied they would probably have one very large home as their neighbor. He had a hard time with supporting this request due to the setback requirements and substandard lot depth of parcel. Commissioner Lucas made a motion to approve the application but the motion died due to lack of a second. RECOMMENDATION: INTRODUCE SUMMARY Text amendment T.A. 2003 -006 was initiated by the Development Services Department to propose changes to Article IX (Subdivision Code) adding lot line adjustment procedures and amending the "Definitions" and "Certificate of Compliance" sections of Article IX. The Development Services Department is recommending approval . of this text amendment and introduction of Ordinance No. 2188 amending various sections of Article IX (Division and Use of Land) of the Arcadia Municipal Code relating to lot line adjustments. A lot line adjustment is an adjustment of property lines between four or fewer adjoining parcels, where a greater number of parcels than originally existed is not created. Pursuant to the provisions of the State Subdivision Map Act, lot line adjustments are not considered "subdivisions ". Therefore, lot line adjustments may be processed by a local jurisdiction without filing a subdivision map. At this time, the City of Arcadia Municipal Code does not include provisions for lot line adjustments and such requests are handled as Tentative Parcel Maps. Tentative Parcel Maps require a public hearing before the Planning Commission and pursuant to State law; this process is unnecessary for lot line adjustment requests. LASER IMAGED TA 2003-006/Ord. After the Development Services Department approves a lot line adjustment request, a Certificate of Compliance is filed by the applicant and is recorded by the County to document the adjusted lot lines. The proposal is to add a Lot Line Adjustment section under Article IX, Part 3, as the new "Division 2 ". The proposed lot line adjustment section (Division 2) will be numerically listed as Section 9132.1 through Section 9132.6, after the Certificate of Compliance section. (See attached exhibit) The text amendment will also add a Lot Line' Adjustment definition to Division 2 (Definitions) of Article IX. The proposed definition will be listed as 9112.31.1, which is alphabetically between the definitions of Lot Depth and Lot Line. Another component of the proposed text amendment includes minor changes to the Certificate of Compliance Division, Section 9131.1 through Section 9131.3. Throughout the entire Division, the words "Planning Commission" and "Director" have been replaced with "Development Services Director (or his /her designee)." Also, under the Fees Section, the wording of "...fifty dollars plus three dollars for each parcel." has been replaced with "...a processing fee established by resolution of the City Council." The proposed text amendment has been initiated to enable lot line adjustments to be processed administratively. The proposed process shall be less onerous to prospective applicants_ and should also take less staff time for review and provide consistency with the provisions of the Subdivision Map Act. Planning Commission Recommendation The Planning Commission; at its December 9, 2003 meeting considered the proposed text amendment. There was no opposition to the proposal. The Planning Commission voted 4 -0 with one member absent to recommend approval of Text Amendment No. TA 2003 -006. The Commission's minutes are attached. ENVIRONMENTAL ANALYSIS The proposed text amendment is exempt from the requirements of the California Environmental Quality Act (CEQA). Staff then proceeded with the asbestos remediation and demolition of the old police station. The next phase (Phase II) of the project involved the completion of the site work and landscaping around the new facility. The City Council at it's September 16, 2003 meeting approved a contract with Mariposa Horticultural to perform the Phase II work. The remediation and demolition are now complete and the Phase II improvements are well underway. Necessary field changes and additional items, outside of what was approved in the original contract, will cause the overall cost of the project to exceed the original contract amount. Many of the field changes and additional items were a result of the demolition of the old Police Station. Staff is recommending that the City Council appropriate an additional $45,000 of Police Facility project interest earnings to complete the Phase II project. DISCUSSION On September 16, 2003, the City Council approved a contract in the amount of $411,656 with Mariposa Horticultural to complete the Phase II work for the new Police Facility. The Council also approved a 5 %p contingency ($20,583) for the project. Mariposa is now approximately 70% completed with the project and as with most construction projects, changes were required in the field that were not anticipated in the original contract. These changes will cause the overall cost of the project to increase by approximately $45,000 beyond the original approved contract including the 5% contingency. LASER IMAGED Mayor and City Council February 3, 2004 Page 2 Many of these changes were not included in the original plans and specifications as they could not be quantified until the old Police Station was demolished. For example, once the old Police Station was removed, the building slab left a huge depression in the ground. The grade needed to be raised 18" in some areas for the Phase II landscaping and site work. Although the City was able to import 750 cubic yards of fill dirt for free, the site was still approximately 600 cubic yards short. The additional imported dirt and cost for grading was approximately $18,300. An additional $18,000 is also required to install new irrigation and to hydro -seed the parkways .along westbound Huntington Drive (which are not currently irrigated or landscaped) and the areas to the north of the new building including the areas beneath the mature trees. These areas have suffered from an existing malfunctioning irrigation system, some of the areas were beneath the detective's trailers when the old Police building was being used and some of the existing irrigation lines were cut and capped as part of the demolition of the old building. This additional cost is based on a plan prepared by the Public Works Department and is consistent with staffs estimate. Other changes include adding colored concrete to the banded areas at the front entrance to the new building and adjacent to the parking lot, expansion joints for the plaster on the small planter and site walls, installing approximately 300 sq. ft. of additional concrete pads for exterior doorways and paths, planting a 48" box Deodar tree on Centennial Way to replace one that died during the Phase I construction and installing additional lighting along the pathways. FISCAL IMPACT The City Council established a budget of $16 million for the new Police Station building when it was conceptualized in 1999. - The $16 million in project revenues were appropriated and placed in a project fund after the sale of the General Obligation (G.O.) bonds in June of 2001. These funds included the $8 million in G.O. bonds, $4 million in Redevelopment funds and $4 million in Capital Outlay funds. Since that time they have accumulated interest from the project. The City Council previously allocated a portion of these funds to the construction of the new building and for the construction of Phase II. Staff is recommending that an additional $45,000 be appropriated from interest earnings to complete the Phase II work as planned. Lewis, General Services M nager Ken Herman, Associate Civil Engineer SUBJECT: Professional Servic Agreement — Design of Orange Grove Booster Station Recommendation: Authorize the City Manager to enter into a contract with AKM Consulting Engineers in the.amount of $345,794 to design the new Orange Grove Booster Pump Station and appropriate $50,000 from the Water Fund SUMMARY The Water Master Plan recommends the construction of a new booster pump station at the Orange Grove Plant (location map attached). Project .design is budgeted in the 2003 -2004 Capital Improvement Program. This facility serves as a critical link to the overall operation of the City's water system. Water is transported from high producing southerly wells, to the Orange Grove reservoir system. The booster pump station then pumps water to the high demand. water zones that serve the northern portion of the City. Staff conducted a Qualification Based Selection (QBS) process and received several proposals to provide engineering design services for the booster pump station design. AKM Consulting Engineers (AKM) submitted the successful proposal for the project. Staff has evaluated AKM's qualifications and found them to be satisfactory. AKM has successfully completed similar projects for numerous cities in Southern California as well as for the City of Arcadia. Staff recommends,that the City Council authorize the City' Manager to enter into a Professional Services Agreement with AKM Consulting, Engineers in the amount of $345,794 for the design of a new -Orange Grove Booster; Pump Station and appropriate $50,000 to the Project budget from the Water Fund. DISCUSSION In 1997, on behalf of the City Of Arcadia and the City of Sierra Madre, the U.S. Army' Corps of Engineers performed a Seismic Reliability Study on the agencies' water infrastructure. One recommendation of this study was replacement of the booster pump station at the Orange Grove facility to comply with current seismic design standards. LASER IMAGED Mayor and City Council February 3, 2004 Page 2 The study recognized that the existing booster pumps only draw water from the upper 5 feet of each reservoir on this site, leaving 10.7 million gallons (MG) that cannot be pumped to the upper system: The Army Corps of Engineers' study and the most recent Water Master Plan recommends the construction of a booster pump station that could fully utilize all of the facility's reservoir storage capacity. Since the construction of the existing booster pump station in 1951, there has been dramatic growth in the upper zones. To support this growth, the storage capacity of the upper zones has increased with the construction of reservoir Nos. 3 and 4 built in 1953 and reservoir No. 5 built in 1965. However, the ability to pump water from these upper reservoirs has increased only slightly with the addition of two booster pumps in 1981. Approximately 10.71MG of stored water, or 73% of the total capacity at the Orange Grove facility, cannot be pumped to the upper zones. This project consists of multiple phases, which include: • Preparation of a detailed design of the new booster pump station, which would include preliminary site investigation, soil investigation, facility pipe flow analysis, design of the booster pump station, site improvements, facility piping and miscellaneous equipment, and the identification of interfering pipes and equipment. • Construction and support services for the new booster pump station facility, scheduled for fiscal year 2004 -05. • Demolition of the existing booster pump stations in a manner that ensures the continuous operation of the Orange Grove facility. Request for proposals'were requested and sent to five (5) qualified engineering firms. Of the five (5), three (3) proposals were received, reviewed,' evaluated, and ranked by staff in accordance with Chapter 10 of the California Government Code, Section 4526- 4529 with the following results: RANK FIRM LOCATION 1 AKM Consulting Engineers Irvine 2 Boyle Engineering Newport Beach 3 RBF Consulting Engineers Irvine ' Staff reviewed the proposals and ranked each firm according to experience, approach, and understanding of the project. All three firms were invited for oral interviews.. AKM Consulting Engineers was rated the most qualified based on their successful completion of numerous reservoir design projects, superior knowledge of Arcadia's water system, and thorough approach and understanding of the project. ENVIRONMENTAL IMPACT: As required by the federal grants procedures, the environmental study was conducted during the fund application phase of this project and received categorical exemption on state as well as federal levels. FISCAL IMPACT: Water Funds in the amount of $300,000 are budgeted in the 2003 -2004 Capital Improvement Program for the Orange Grove Booster Pump Station design. AKM Consulting Engineers submitted the most qualified design proposal for $345,794. Staff requests an appropriation of $50,000 to complete the design phase of this project and for construction and support services during the construction of this project. The U.S. Environmental Protection Agency (USEPA) has approved this project and will reimburse 55% of the cost of the design and construction of this project under their FY 2004'; Federal Budget. The current M -1 zoning does not list recording studios as a permitted use. The Development Services Department is recommending approval of this use in the M -1 zone. DISCUSSION The M -1 zone (Planned Industrial District) provides sites for light industrial and manufacturing firms processing, assembling, manufacturing and distributing products; sites for warehousing and storage and sites for essential service facilities such as restaurants, service stations and public utilities. Section 9266.1 under "Uses Permitted" states: "No building or land shall be used and no building shall be hereafter erected, constructed or established, except for the uses specified and such other uses as the City Council may deem to be included in the following subsections." In addition, they each allow studios in commercial zones. The City's C -2, General Commercial zone, permits studios, with the exception of Motion Picture studios: The M -1 zoning regulations that were written prior to 1960 do not address uses such as recording studios. Section 9266.3 et al. set forth performance standards in the M -1 zone including noise and vibration. In addition Section 4610.3 of the Arcadia Municipal Code specifically addresses Noise Limits as it relates to amplified noise in all zones. The majority of the City's M -1 zoned properties are located in the Chicago Park area, however, there is a smaller M -1 zoned area located north of the MTA railroad tracks, east of Santa Anita, South of Colorado and west of Second Avenue. It is staffs opinion that a "sound recording studio' would be an appropriate use in the M -1 zone. A sound recording studio does not generate a significant amount of vehicular traffic, is not pedestrian oriented and could be considered similar to a "processing" type of use that is "product" oriented because the end result is a recorded product. The City Council may: 1. Determine that a "sound recording studio is a compatible use in the M -1 zone and shall be a permitted per Section 9266.1; or 2. Determine that a "sound recording studio is not a compatible use in the M -1 zone and, therefore, not a permitted use. DISCUSSION In September 1999 and again in October 2001, the City of Arcadia passed Resolutions and adopted Ordinances amending the City's contract with CaIPERS permitting current employees to purchase service credit for past military service. These contract amendments did not allow the same option for retired employees. CaIPERS does allow retired employees to purchase this service credit with an additional contract amendment. Several retired employees have expressed interest in this option. Since this option provides that the employee pays both the employee and employer portions of the retirement contributions, there is no reason not to have this option available to both current and retired employees. A D City Clerk of the City of Arcadia 3 i CaIPERS California Public Employees' Retirement System AMENDMENT TO CONTRACT Between the Board of Administration California Public Employees' Retirement System and the City Council City of Arcadia The Board of Administration, California Public Employees' Retirement System, hereinafter referred to as Board, and the governing body of the above public agency, hereinafter referred to as Public Agency, having entered into a contract effective October 1, 1945, and witnessed September 24, 1945, and as amended effective July 1, 1953, January 1, 1957, January 1, 1958, January 1, 1959, January 19, 1964, February 28, 1965, October 1, 1972, June 24, 1973, January 4, 1976, April 10, 1977, March 11, 1979, June 22, 1986, November 6, 1988, December 2, 1994, June 4, 1999, October 11, 1999, December 8, 1999 and October 19, 2001 which provides for participation of Public Agency in said System, Board and Public Agency hereby agree as follows: A. Paragraphs 1 through 12 are hereby stricken from said contract as executed effective October 19, 2001, and hereby replaced by the following paragraphs numbered 1 through 12 inclusive: 1. All words and terms used herein which are defined in the Public . Employees' Retirement Law shall have the meaning as defined therein unless otherwise specifically provided. "Normal retirement age" shall mean age 55 for local miscellaneous members and age 50 for local safety members. 2. Public Agency shall participate in the Public Employees' Retirement System from and after October 1, 1945 making its employees as hereinafter provided, members of said System subject to all provisions of the Public Employees' Retirement Law except such as apply only on election of a contracting agency and are not provided for herein and to all amendments to said Law hereafter enacted except those, which by express provisions thereof, apply only on the election of a contracting agency. 3. Employees of Public Agency in the following classes shall become members of said Retirement System except such in each such class as are excluded by law or this agreement: a. Local Fire Fighters (herein referred to as local safety members); b. Local Police Officers (herein referred to as local safety members); C. Employees other than local safety members (herein referred to as local miscellaneous members). 4. In addition to the classes of employees excluded from membership by said Retirement Law, the following classes of employees shall not become members of said Retirement System: NO ADDITIONAL EXCLUSIONS 5. The percentage of final compensation to be provided for each year of credited prior and current service for local miscellaneous members shall be determined in accordance with Section 21354 of said Retirement Law, subject to the reduction provided therein for service prior to March 31, 1977, termination of Social Security, for members whose service has been included in Federal Social Security (2% at age 55 Full and Modified). 6. The percentage of final compensation to be provided for each year of credited prior and current service as a local safety member shall be determined in accordance with Section 21362.2 of said Retirement Law (3% at age 50 Full). 7. Public Agency elected and elects to be subject to the following optional provisions: a. Section 21573 (Third Level of 1959 Survivor Benefits) for local miscellaneous members and local police members only. b. Section 20042 (One -Year Final Compensation). C. Section 20965 (Credit for Unused Sick Leave). d. .Sections 21624 and 21626 (Post- Retirement Survivor Allowance). e. Section 21024 (Military Service Credit as Public Service), Statutes of 1976. f. Section 21574 (Fourth Level of 1959 Survivor Benefits) for local fire members only. g. Section 21027 (Military Service Credit for Retired Persons). 8. Public Agency, in accordance with Government Code Section 20790, ceased to be an "employer" for purposes of Section 20834 effective on April 10, 1977. Accumulated contributions of Public Agency shall be fixed and determined as provided in Government Code Section 20834, and accumulated contributions thereafter shall be held by the Board as provided in Government Code Section 20834. 9, Public Agency shall contribute to said Retirement System the contributions determined by actuarial valuations of prior and future service liability with respect to local miscellaneous members and local safety members of said Retirement System. 10. Public Agency shall also contribute to said Retirement System as follows: a. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Section 21573 of said Retirement Law. (Subject to annual change.) In addition, all assets and liabilities of Public Agency and its employees shall be pooled in a single account, based on term insurance rates, for survivors of all local miscellaneous members and local police members. b. Contributions required per covered member on account of the 1959 Survivor Benefits provided under Section 21574 of said Retirement Law. (Subject to annual change.) In addition, all assets and liabilities of Public Agency and its employees shall be pooled in a single account, based on term insurance rates, for survivors of all local fire members. C. A reasonable amount, as fixed by the Board, payable in one installment within 60 days of date of contract to cover the costs of administering said System as it affects the employees of Public Agency, not including the costs of special valuations or of the periodic investigation and valuations required by law. d. A reasonable amount, as fixed by the Board, payable in one installment as the occasions arise, to cover the costs of special valuations on account of employees of Public. Agency, and costs of the periodic investigation and valuations required by law. 11. Contributions required of Public Agency and its employees shall be subject to adjustment by Board on account of amendments to the Public Employees' Retirement Law, and on account of the experience under the Retirement System as determined by the periodic investigation and valuation required by said Retirement Law. 12. Contributions required of Public Agency and its employees shall be paid by Public Agency to the Retirement System within fifteen days after the end of the period to which said contributions refer or as may be prescribed by Board regulation. If more or less than the correct amount of contributions is paid for any period, proper adjustment shall be made in connection with subsequent remittances. Adjustments on account of errors in contributions required of any employee may be made by direct payments between the employee and the Board. B. Lewis, General Services Manager, Public Works Services Department SUBJECT: Construction of a dog park at Eisenhower Park Recommendation: Approve SUMMARY The idea of creating a dog park was reviewed two years ago, but the major problem at that time was finding a suitable location in the City of Arcadia. This review suggested the need for a large area for the animals and there appeared to be insufficient park area available. Recently the Parks and Recreation Commission requested that Staff revisit the issue and determine if a smaller facility could be considered. DISCUSSION The issue of a dog park had been looked into two years ago, but finding a suitable location with sufficient square footage in the City of Arcadia seemed to be the major problem. The Parks and Recreation Commission requested that Staff reevaluate possible locations, costs and consider a smaller location. Staff reviewed four possible park sites in Arcadia to evaluate potential locations. The four parks included Newcastle, Fairview, Forest and Eisenhower. It was decided that Newcastle Park would not be suitable due to space constraints. Additional sites were also reviewed including the Arcadia County Park, the City owned property on Live Oak Avenue adjacent to the 3 -Par Golf Course and the flood control area below Wilderness Park. These sites were not pursued due to issues ranging from lack of accessibility to excessive infrastructure costs that would be required. Aerial photos of the three remaining parks, with conceptual design plans were: distributed to the Commission for consideration. Each site had its own unique situation and set of pro and cons. After some discussion it was unanimously decided that �y LASER IMAGED Mayor and City Council February 3, 2004 Page 2 Eisenhower Park would be the first choice and the Commission directed staff to obtain more information on the costs involved and conceptual plans for the proposed dog area project. At the December 10, 2003 Commission meeting a site plan, (see attachment) with fencing, facility access points and signage was distributed to the Commission for their consideration. Construction costs Fence Construction $ 7,000 Contingencies 20% $ 1,400 Dog Mitt Dispenser $ 600 Signage $ 300 Engineering /Inspection 700 Total Project Costs $10,000 Parking will continue to be a concern as there is no parking allowed along Colorado Blvd. under the bridge due to national security restrictions. However, the Commission felt that sufficient parking is available on Second Avenue and access to the off leash area from Colorado Blvd and from the North side of the Park is only a short walk through or around the park. Following discussion, the Commission moved to recommend the off leash dog park project be brought to City Council (as long as the cost is under $10,000). Therefore, staff recommends that the City Council approve a dog park at Eisenhower Park and appropriate $10,000 from the Recreation Facilities CIP Fund. ENVIRONMENTAL IMPACT This project is categorically exempt,per Section 15301 class 1 c from the requirements of the California Environmental Quality Act (CEQA). FISCAL IMPACT Sufficient funds are available in the Recreation Facilities CIP Fund as several projects have been completed at significantly less than budgeted for, i.e., the Community Center Storage Project.
