ABSENT: None
City Attorney Deitsch announced the subjects discussed at the Closed Session held earlier
this evening. With respect to the first Item 1a. on the posted agenda, the City Council
unanimously authorized the City to join as an Amicus party in the matter captioned "Deaton
v. United States". With respect to the Item 1b. the City Council voted 4-1, Couhcilmember
Chang voting no, that the City lend its name to potential litigation against the State of
California regarding a proposed State program for use of local sales tax revenue to fund debt
service on a proposed bond measure to be submitted to the voters for approval in the
amount of approximately $15 billion, to help defray the State budget deficit. With regard to
the Item 1c. no reportable action was taken.

HOME introduced the Commission Members. Following the introductions, Commissioner Torrington
DECORATION and Mayor Wuo, Liaison, Arcadia Beautiful Commission, presented the Holiday Home

PUBLIC HEARINGS
The City has been a participant in the Community Development Block Grant (CDBG)
program for approximately 30 ,years. The Los Angeles County Community Development
Commission (CDC) has advised that the City will receive approximately $498,032 in
Community Development Grahf Funds for fiscal year 2004-05.
Federal regulations require that a maximum of 15% of a grantee's aggregate funds
($498,032) are to be used for public service programs and a minimum of 70% of the total
funds are to be designated for projects which support activities that benefit low and moderate
income families.
Following is a summary of current projects and the proposed projects for fiscal year 2004-05.

Following presentation staff,respdnded to Council questions. It was noted that staff will be
exploring other alternative prdgrams for next year, to see if there are other ways that the
CDBG funds could be utilized.
Mayor Wuo OPENED the Public Hearing. No one came forward to address the City Council.
It was MOVED by Mayor Pro tem Segal, seconded by Councilmember Marshall and
CARRIED on roll call vote as follows to CLOSE the Public Hearing.

It was MOVED by Councilmember Chang, secohded by Mayor Pro tem Segal and CARRIED
on roll call vote as follows to APPROVE the allocation of funds as outlined in table 1; and,
AUTHORIZE the City Manger to EXECUTE the Memorandums of Understanding, which are
submitted to the County at a later date.

Consideration of the report and recommendation to adopt Resolution No. 6413 establishing
Underground Utility District (UUD) No. 15 on Duarte Road, which is number one on the
priority list ofLndergrouhd projects adopted bythe City Council on August 19, 2003.
The area covered under the proposed district includes Duarte Road from EI Monte Avenue
to the westerly City limits and Baldwin Avenue from Naomi Avenue to north of Duarte Road,
also a very short section of Golden West Avenue south of Duarte.

The affected utility companies are: Southern California Edison, SBC, Altrio and Adelphia.
All affected utilities have been notified of the proposed district and are currently preparing
their estimates for budget purposes. Said utility companies using Rule 20A funds will pay for
design, construction, and administration. City staff will assist coordinating the utility
companies efforts; however, ultimately, Southern California Edison will be the lead agency
on the project.
Conversion work for the proposed Underground Utility District Na. 15 will consist of the
removal df existing street lights and wooden power poles, overhead utility lines, associated
structures, installation of new street lights on concrete poles, installation of underground
wiring and facilities for supplying electric, communication, or similar associate services.

8. MATTERS FROM ELECTED OFFICIALS
MARSHALL Councilmember Marshall congratulated the recipients of the Holiday Home Decoration
(Award Awards and expressed appreciation to the Arcadia Beautiful Commissioners for their help in

keeping the City safe.

CHANG Councilmember Chang congratulated the recipients of the Holiday Decoration Awards and,

(Chinese Dr. Chang expressed appreciation to,the Arcadia Chinese Association for hosting the annual
New Year) luncheon for City employees at the Community Center in celebration of the Chinese New
Year.
(Library. Dr. Chang expressed appreciation to the group of tutors who volunteer their time to teach
Volunteers) English to new immigrants at the Arcadia Public Library.
(Parks & Rec. Dr. Chahg congratulated David Lewis, Director of the Parks and Recreation Department and
Dept.) `. staff fdr receiving the Achievement Award from the California Parks and Recreation Society.
(Margett) Dr. Chang wished Senator Bob Margett a speedy recovery.
(PD) Dr. Chang referred to a letter from an Arcadia resident to the Arcadia Police Officers for
recovering his stolen car. Dr: Chang also expressed appreciation to Officer Bob Anderson
for giving a tour of the new police facility to a Taiwan Mayor and other visitors.
(City Services) Dr. Chang noted that the City is financially in good shape and will be able to continue offering
excellent services to the community.'
KOVACIC Councilmember Kovacic. endorsed- congratulations and appreciations extended by
(Volunteers, Councilmembers to all of the good employees and volunteers. He also congratulated Mayor
Staff, Wuo & Wuo for his leadership during his term as Mayor. Mr. Kovacic expressed congratulations to
Segal) Mayor Segal and hoped 4o see some new surprises during the next three months.
(Gold Line Councilmember Kovacic would like an item on a future agenda with regard to Gold Line
Phase II JPA) Phase II JPA and the two issues that are important to Arcadia, grade separation and station.
City Manager Kelly noted that,a Study Session with regard to this matter has been scheduled
for February 17th.
(Butterworth) Mr. Kovacic thanked the Arcadia Chinese Association for a wonderful luncheon and
endorsed their choice it selecting Edward Butterworth as Citizen of the Year.

REMARKS BY OUTGOING MAYOR JOHN WUO
"This coming Thursday will be Chinese New Year, the year of the monkey, so to start off, I
want to wish everyone a Happy Chinese New Year and if you haven't yet start your new
years resolutions, here is your second chance.
"As I complete my Mayorship, I am grateful for having the honor of representing our City for
the last three months..'It has beeh a wonderful ride for me. It all started with a very
successful Breeder's Cup at Santa Anita Race Track, we then had the Lucky Baldwin
Community Picnic, the Holiday Show Festival at the Westfield ShoppingTown, a baking

contest, the commissioners dinner, unveiling of the time capsule, the Arcadia Chinese
Association Annual City employee luncheon and many other wonderful events which I have
had the honor of attending. I hope I have done a good job representing the City as your
Mayor. My only regrets are not being able to meet each one of you in person, not being able
to converse with you a little more and not being able to recognize each one of you for all your
contributions to our City.
"I would like to thank the City staff for doing a wonderful job, providing all the necessary
research and information for all the Councilmembers in order for us to make the right
decisions. I would like to thank our Police and Fire Departments and the Public Works for
their dedication, day in and day out, they work hard to protect and ensure the safety of our
City and to make sure our City remains beautiful. I would like to personally thank the staff of
the City Manger's office especially the two Linda's, Connie and Oliver, they make me lock
good and I don't know what I would do without them. And then, there is Bill, he is always
there making sure that everything goes smoothly, thank you Bill. Finally, I would like to thank
my colleagues for helping me through my first Mayorship, your suggestions, advice and
encouraging words have definitely been appreciated. I have always believed that if they
didn't care, they wouldn't say anything. So, I am glad, I always have an earfull, but I am very
grateful for all your help, thank you. I have learned so much and have met so many fine
people in the last few months, this is an experience I will. never forget and will always
treasure. I have great pride for our City and I uphold a very high standard for myself, and I
hope I have represented our City with dignity, honestly and sincerity. It has been a great
three months and I hope you are proud of having me as your Mayor. Thank you for giving
me the opportunity."
Mayor Segal was seated as Mayor according to the approved Mayor Rotation Schedule for
the Centennial Year.
In his remarks, Mayor Segal introduced his family, his wife Lee and son Andrew, and noted
that Matthew and daughter Alison were away at school.
"I haven't prepared any real statements, but I want to make sure that I didn't make Gary a
liar tonight so I have created a new project that I 'd like to announce tonight. Tomorrow there
will be a press release, but if any of you want to go to the City's website you will now see we
created a new online community calendar of events and we owe a great deal of thanks to
Linda Garcia and the staff that helped her, including Oliver, with this. I took a look at it today
and it is actually going to be something very special for all of us..its purpose is to avoid
those dates in which all of us look at each other and ask how could it be possible that these
twc events were scheduled on:that same day? This new calendar will hopefully eliminate the
chance of that happening in the future. I want to encourage everybody to take a look at the
website, with it there is an application of which you can file to have a date recorded on the
website. Today I signed, I don't know how many, 50 or 60 letters to all the PTA's, all the
service clubs, and others, informing them of this new site, informing them of the letters that
are available, the applications are there, so that they can get their dates onto this website
and hopefully what we will end up with is,. none of us looking at each other and asking that
question about conflicts. In addition, hopefully each of these events will be just a little bit
more successful as a result of not having conflicts when these events occur. So, I am
certainly proud to be a part of this and I hope all of us benefit greatly from this new on line
community calendar of events'.
Mayor Segal announced that on February 3, 2004 the, Arcadia Council PTA is celebrating
their 50 year anniversary at Santa Anita Golf Course at 10:30 a.m.
Finally, he felt that it would be appropriate with the changes in the State budget and some of
things that could or couldn't affect our City, that we give a State of the City Address and I will
give a shorter version of one at the February 17, 2004 meeting.

Recommendation: Approve
SUMMARY
The Los Angeles County Community.Development Commission (CDC) has advised the
City that we will receive approximately $498,032 in Community Development Block
Grant Funds for fiscal year 2004-05. Costs and project summaries must be submitted
to the County by February 2, 2004. Staff recommends that the .City Council approve the
projects as set forth below for fiscal year 2004-05.
DISCUSSION
The City has been a participant in the Community Development Block Grant program
for approximately 30 years. Criteria for participation in the program-has changed. during
the years, becoming more restrictive in order to encourage programs that meet the
goals and objectives for use of the funds. As a result of these changes, Federal
regulations require that a maximum of 15% of a grantee's aggregate funds ($498,032)
are to be used for public service programs and a minimum of 70% of the total funds are
to be designated for projects which support activities that benefit low and moderate
income families (in previous years, the public services threshold was set at a maximum
of 25%).
The following is a summary of this year's projects (FY 2003-04) and the proposed
projects for FY 2004,05:

The following is a list of current projects that are being undertaken during this fiscal
year:
Meals On Wheels - $7,500 (Public Service Program)
The funds for this program helped offset. operating expenses incurred by the
American Red Cross to deliver two meals a day to approximately 40 homebound
residents in Arcadia.
Program Administration- $23.000 (Planning/Administration)
These funds offset the cost of annual general management, oversight, and
coordination of the CDBG programs.
Youth Services Program - $20.000 (Public Service Program)
This is an ongoing program directed to help youths 18 years and under who
come from low-income families. This program sends youths to day camp, music
club, educatiohal field trips, summer camp and may subsidize band equipment
and uniforms.
Congregate Meals For Seniors - $39.000 (Public Service Program)
This is an ongoing program providing senior citizens with a nutrition program that
features hot noon-time meals, Monday through Friday at the Community Center.

Information and Referral Program - $40,000 (Public Service Program
This is an ongoing program thaf provides senior citizens with essential
information to maintain independent living and healthy lifestyles. Specific
services include: government benefits assistance (Medicare, social security,
income tax, Medi-Cal, SSI), housing,. transportation, legal assistance, in-home
services, health services and educational opportunities.
Iiousiria Rehabilitation - $371.505 (Low/Mod)
This is ,an ongoing program assisting low/moderate income homeowners for
necessary home' improvements. A maximum grant of$10,000.00 is available per
household. `

Due to the success of the fiscal year 2003-04 programs, staff is recommending the
ongoing programs be continued and funded as represented in Table 1.

FISCAL IMPACT
There is not a financial impact to any City funds to implement CDBG programs.
However, staff does include CDBG program appropriations in the operating budget and
is required to seek City Council approval prior to expenditure of funds.

Utility District #15 '

SUMMARY
On August 19, 2003, the City Council adopted a priority list of future underground utility
districts. At tonight's meeting, staff is recommending that the City Council adopt a
resolution creating Underground Utility District (UUD) No. 15 on Duarte Road, which is
number one on the said list. Creating 'the 'district via the resolution will begin the
process by which.serving utility dompanies will remove all their overhead facilities within
the designated district. Once .the City Council has designated-the area as an
underground district, the affected utility companies will begin engineering plans and
budgeting for new underground facilities.
Pursuant to the Arcadia Municipal Code prior to adoption of this resolution, Council
must conduct a public hearing'to hear protests. Staff has also included in this report a
brief engineer's report identifying affected utility companies. Staff has notified affected
property owners and utility companies of tonight's public hearing.
BACKGROUND
On September 19, 1968, the Public Utilities Commission ("PUC") ruled that public
electric utility companies must budget funds to convert their existing overhead facilities
to underground facilities. The'PUC's goal was to significantly reduce overhead cables
and equipment-for aesthetic and safety purposes. The funds, referred to as Rule 20A
monies, are allocated annually to cities and counties in proportion to the number of
electric customers residing within the.'agency's limits. The funds are, eligible for
expenditure at the discretion of 4he City Council provided certain criteria are met. A city
or county's annual allocation is allowed to accumulate for a seasonable period of time;

however, it is subject to reallocation elsewhere if that city or county has no active
undergrounding program.
Since 1968, the City of Arcadia has completed 13 underground utility districts utilizing
Rule 20A funds on sections of Live Oak Avenue, Huntington Drive, Wheeler Avenue,
Baldwin Avenue, Campus Drive, .and Second Avenue. UUD No. 14, currently under
construction on Santa Anita Avenue and Santa Clara Avenue, is nearing completion
and will be completed in March 2004. Upon completion, the City will have a balance of
approximately $1,300,000 ih Rule 20A funds to go towards the next project. SCE
estimates their share of the work for UUD No. 15 to cost approximately $2,300,000.
Taking into account the City's annual allocation of $313,544 from SCE', the City will
have $1,920,000 accrued by 2007. Rule 20A allows cities to mortgage funds up to
three years in advance to make up shortfalls in funding at the time of construction,
which would provide the City with adequate funds to complete UUD No. 15.
ENGINEER'S REPORT
In an effort to establish an underground utility district for the purpose of undergrounding
overhead utility lines utilizing the-.Rule 20 funds, -the City. Council and staff have taken
steps toward achieving this goal. The City Council at its meeting of August 19, 2003
approved the priority list of undergrounding projects and authorized staff to proceed with
the highest priority as UUD No. 15. The area covered under this district as shown on
Exhibit A of the Resolution includes Duarte Road from EI Monte Avenue to the westerly
City limit and Baldwin Avenue from Naomi Avenue to just north of Duarte Road.
The effected utility companies are: Southern California'Edisori, SBC, Altrio, and
Adelphia. All effected utilities have been notified of said proposed district and are
currently preparing their estimates for budget purposes. Said utility companies using
Rule 20A funds will pay for design, construction, arid administration. City staff will assist
coordinating the utility companies efforts; however, ultimately, Southern California
Edison will be the lead agency on the project.
Staff informed all affected property owners by mail of the proposal to establish this
district and notified them of this public hearing. This public hearing is required by the
Arcadia Municipal Code after which the City.. Council should cohsider adoption of
Resolution No. 6413 creating the City of Arcadia Underground Utility District No. 15.
Conversion work for the proposed Underground. Utility, District No. 15 will consist of the
removal of existing street lights arid wooderi, power poles, overhead utility lines,
associated structures, installation of new streetlights on concrete poles, installation of
underground wiring and facilities for supplying electric, communication, or similar
associated services. Administration of the undergrounding work will be handled by the

Southern California Edison Company grid funded by Rule 20 allocations and other utility
companies.
Investigation of the project area indicates that several electrical service customers have
antiquated main panels that require conversion in order to accommodate the new
underground wiring. The costs involved with main panel conversion will be paid for by
Rule 20 funds. Work for the district is anticipated to be complete by March 2007.
ENVIRONMENTAL IMPACT
This project is categorically exempt per Section 15302 Class 2(d) from the requirements
of the California Environmental Quality Act (CEQA).
FISCAL IMPACT
Southern California Edison Co., SBC, Adelpliia and Altrio will be responsible for all
costs of the project. SCE has the greatest share of the work and estimates their cost to
be $2,300,000. Neither the City nor the property ov~ners within the district will be
responsible for any costs.
RECOMMENDATION
That the City Council conduct a public hearing and adopt Resolution No. 6413
establishing the Underground Utility District No. 15

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, ESTABLISHING UNDERGROUND
UTILITY DISTRICT N0. 15
WHEREAS, the City Council of the City of Arcadia, at its regular meeting of January
20, 2004 held a public hearing at the hour of 7:00 o'clock p.m., in the City Council
Chambers at the City Hall, Arcadia, California, to ascertain whether the public necessity,
health, safety or welfare requires the removal of poles, overhead wires and associated
overhead structures, and the underground installation of wires and facilities for supplying
electric, communication or similar or associated service, within that certain area of the City,
shown on the map attached hereto as Exhibit A and described as follows:
That portion of Duarte Road bounded as follows:
On the east by the northerly prolongation of a line parallel with and 40 feet east of
the centerline of EI Monte Avenue as shown on the Map of Santa Anita Colony, recorded in
Miscellaneous Records, book 42, page 87 of maps, in the office of the County Recorderfor
the County of Los Angeles, California; on the west by the northerly prolongation of a line
parallel with and 10 feet east of the easterly line of Tract No. 30933 as recorded in Map
Book 833, 834, and 835 in the office of the County Recorder for Los Angeles County,
California; on the north by a line parallel with and 50 feet north of the centerline of Duarte
Road; on the south by a line parallel with and 50 feet south of the centerline of Duarte
Road.

County Recorder for Los Angeles County, California; on the west by a line parallel with and
40 feet west of the centerline of Baldwin Avenue; on the east by a line parallel with and 40
feet east of the centerline of Baldwin Avenue.
Also that portion of Golden West Avenue bounded as follows:
On the north by a line parallel with and 70 feet north of the centerline of Duarte
Road; on the south by the easterly prolongation of the northerly line of Tract Map No.
34361 as recorded in Book 900, pages 42 and 43 in the office of the County Recorder for
the County of Los Angeles, California; on the west by a line parallel with and 30 feet west
of the centerline of Golden West Avenue; on'the east by a line parallef with and 30 feet
east of the centerline of Golden West Avenue; and
WHEREAS, notice of such hearing has been given to all affected property owners
as such are shown on the last equalized assessment roll and to all utilities concerned in the
manner and within the time required bylaw; and
WHEREAS, such hearing has been duly and regularly held, and all persons
interested have been given an opportunity to be heard.
NOW, THEREFORE, THE COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That pursuant to Ordinance No. 1375 of the City of Arcadia, the
above-described area is hereby declared an underground utility district and is designated
as Underground Utility District No. 15 of the City of Arcadia.

SECTION 2. That the City Council of the City of Arcadia hereby finds and
.determines that,the public necessity, health, safety, and welfare require the removal of
poles, ovefiead wires and associated overhead structures, and the underground
installation of wires, associated structures and facilities for supplying electric,
communication or similar or associated services in said area.
SECTION 3. That the City Council does hereby fix September 30, 2006 as the date
on which affected property owners must be ready to receive underground service and does
hereby order the removal of all poles, overhead wires, and associated overhead structures
and the underground installation of wires, associated structures, and facilities for supplying
electric, communication or similar or associated services with Underground Utility District
No. 15 on or before March 30, 2007.
SECTION 4. That the City Council finds and determines:
a. That the undergrounding to be accomplished pursuant to this Resolution will
avoid or eliminate an unusually heavy concentration of overhead distribution facilities.
b. That the streets, roads or rigfits-of-way in said area are extensively used by
the general public and carry a heavy volume of pedestrian and vehicular traffic.
SECTION 5. That the following exceptions in said Underground Utility District No.
15 are permissible and are hereby authorized:
a. Equipment appurtenant to underground facilities, such as surface mounted
transformers, pedestals, mounted terminal boxes and meter cabinets, and
concealed ducts.
b. Temporary poles, overhead wires and associated overhead structures used
or to be used in conjunction with construction projects.

c. Poles and cables designated by the City: of Arcadia for the purpose of
hanging banners.
SECTION 6. That the Southern California Edison Company has agreed to
charge against the City of Arcadia Rule 20A allocations all costs of converting to
underground each customer's service lateral, and of converting and relocating, as
necessary, the overhead service entrance to accept the underground service lateral.
SECTION 7. That the. City Clerk, within ten (10) days after the adoption of
this Resolution, shall mail a copy hereof and a copy of Ordinance No. 1375 to
affected property owners as such are-shown on the last equalized assessment role
and to the affected utilities. The City Clerk shall further notify such affected property
owners of the necessity that the serving utility companies will provide all necessary
facility changes on their premises so as to receive such service from the lines of the
supplying utility or utilities at a new location.
SECTION 8. That the City clerk shall certify the adoption of this Resolution.

WHEREAS, text amendment T.A. 2003-007 was initiated by the Development
Services Department to add Sections 9264.2.9.15 and 9275.1.39.4 to the Arcadia
Municipal Code allowing automobile sales in the Central Business District (CBD) zone
with a conditional use permit; and
WHEREAS, on December 9, 2003 a public hearing was held before the
Planning Commission on said matter at which time all interested persons were given
full opportunity to be heard and to present evidence; and
WHEREAS, the Planning Commission at said meeting voted 5-0 to recommend
to the City Council approval of T.A. 2003-007; and
WHEREAS, on January 6, 2004, the City Council held a public hearing on said
text amendment; and
WHEREAS, as part of the record of this hearing, the City Council reviewed and
considered;
1. All staff reports and related attachments and exhibits submitted by the
Community Development Division of the Development Services Department to the City
Council;
2. The record of the Planning Commission hearing regarding text
amendment T.A. 2003-007; and
3. All letters, information and material presented as part of the public
testimony at the City Council public hearing on January 6, 2004, including the staff
reports and all documentation presented at the public hearing; and
WHEREAS, the above recitals are hereby incorporated as part of the findings
set forth below.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA,
CALIFORNIA, DOES ORDAIN AS FOLLOWS:

Section 1. The factual data submitted by the Development Services Department
in the attached report is true and correct.
Section 2. The City Council finds:
1. .That the approval of this text amendment will not be detrimental to the public
health or welfare or injurious to the property or improvements in such zone or vicinity.
2. That the approval of this text amendment will not have the, potential for,
causing a significant effect on the environment and is, therefore, categorically exempt
from CEQA per CEQA Guidelines per Sections 15061(b}(3) and 15378(b)(2).
3. That approval of this text amendment will allow more flexibility with the types
of uses permitted in the CBD zone and is consistent with Section 9264.1 of the Arcadia
Municipal Code entitled "Purpose" of the CBD zone in terms of a use serving a
regional/community-wide need.
Section 3. Section 9264.2.9.15 is added to the Arcadia Municipal Code to
read:
"9264.2.9.15. Automobile Sales where at least 50% of the number of
automobiles sold or leased from the applicable site during each calendar year are new
automobiles."
Section 4. Section 9275.1.39.4 is added to the Arcadia Municipal Code fo
read:
"9275.1.39.4. AUTOMOBILE SALES -where at least 50% of the number of
automobiles sold or leased from the applicable site during each calendar year are new
automobiles. CBD zone."
Section 5. The City Clerk shall certify to the adoption of this Ordinahce and
shall cause a copy of the same to be published in the official newspaper of said City
within fifteen (15) days after its adoption.

RECOMMENDATION: APPROVE FINAL MAP
SUMMARY
Tentative maps and final maps are required for all subdivisions that result in five or
more parcels or condominiums. The City Council shall. approve a final map if it
conforms to all the requirements of the subdivision regulations of the Municipal Code
and the State Subdivision Map Act. It is recommerided that the City Council approve
Final Map No. 53975 for an eight-unit residential condominium project at 1012 Arcadia
Avenue.
DISCUSSION
FinaF,Map No. 53975 has been reviewed by the Los Angeles County Department of
Public Works and the appropriate City Departments. Said map has been found to be in
substantial compliance with the tentative map, as 'approved by the Planning
Commission on October 8, 2002, and is in compliance with the subdivision regulations
of the Municipal Code and the State Subdivision Map Act.
RECOMMENDATION
The Development Services Department recommends approval of Final Map No.
53975.

SUMMARY
On December 17, 2002, the City Council awarded a contract to Den Boer Engineering
and Construction Inc. in the amount of $729,300.00 for the construction of the Chapman
Well No. 7 Wellhead Facilities Project. The terms and conditicns of this project have
been complied with and the work has been performed to staffs satisfaction for a total
project cost of $745,548.21. This amount reflects the original contract amount of
$729,300.00 plus twelve (12) contract change orders totaling $16,248.21, or 2.23% of
the original contract amount.
Staff recommends that the City Council accept all work performed by Den Boer
Engineering and Construction Inc. as complete and authorize the final payment to be
made in accordance with the contract documents, subject,to a retention of $37,277.41.
BACKGROUND
The U.S. Environmental Protection Agency (USEPA) provided a grant of $6,650,065 to
the City of Arcadia to be used for the design and construction of projects, which would
improve the seismic reliability of the City's water system.

The 2001-02 Capital Improvement Program designated a portion of this grant to provide
for the following three (3) water system seismic improvement projects:
1: Rehabilitation of Santa Anita Reservoir No. 3 (Complete)
2. Water System Pipeline Interconnection with City of Sierra Madre (Complete)
3. Construction of a Water Supply Well at Chapman Water Facility (Requesting
Acceptance)
The first two (2) projects were completed previously, as well as the drilling of the
Chapman Well No.7. -The acceptance of the construction of the Chapman Well No.7,
completed by DenBoer Engineering and Construction Inc., will complete the final phase
of these projects.. The final. phase of Chapman, involved the construction of the well
pump, associated piping, an on-site sodium hypochlorite water treatment system, pump
house and emergency power generator.
DISCUSSION
The final construction cost of the Chapman No.7 Well Facility is $745,548.21. This
amount reflects the original contract amount of $729,300.00 plus twelve (12) contract
change orders totaling $16,248.21, or 2.23% of the original contract amount. A

ENVIRONMENTAL IMPACT
The City Council adopted a Negative Declaration for this project on November 21, 2000,
pursuant to the provisions of the California Environmental Quality Act. Staff did not find
substantial evidence that this project would have a significant or potentially significant
adverse effect on the environment. As a condition of federal grant approval, the USEPA
also completed an Environmental Assessment under the National Environmental Policy
Act and did not find this project to have significant environmental impact.
FISCAL IMPACT
On December 3, 2002, the City Council approved a construction budget for this project
for $729,300 and a contingency estimate of $73,000, for a total construction budget of
$802,300. Total cost to complete this work by the Contractor was $745,548.21 within
the project budget.
RECOMMENDATION
1. Accept all work performed by Den Boer Engineering and Construction Inc.
for the construction of the Chapman Well No. 7 Wellhead Facilities Project
as complete.
Authorize final payment to be made in accordance with the contract
documents, subject to a retention of $37,277.41.

SUBJECT: Purchase of Respiratory Protection Equipment for the Fire Department in the
Amount of $78,349.11 from Special T Fire Equipment to Enhance Counter
Terrorism Capability in Accordance with Homeland Security Efforts.

SUMMARY
Funding for respiratory protection and air monitoring equipment is provided for in the Los
Angeles County Operational Area - FY03 (Part I & II) State Homeland Security Grant Program.
The purpose of this Staff Report is to obtain Council Approval for the purchase of respiratory
protection and air monitoring equipment for the Fire Department. Staff recommends that the
City Council authorize the purchase of certain respiratory protection and air monitoring
equipment from Special T Fire Equipment, in the amount of $78,349.1 L
BACKGROUND
The following respiratory protection equipment was included in the homeland security grant
approval:
• six (6) MSA self-contained breathing apparatus (SCBA) ($18,725.08)
• five (5) MSA SCBA cylinders ($ 4,373.30)
• two (2) MSA supplied air systems w/accessories ($13,832.18)
• sixty (60) MSA SCBA face pieces w/amplification ($28,793.63)
• two (2) MSA Orion atmospheric monitors with calibration kit ($ 3,966.28)
• one (1) victim locator listening device ($ 8,658.64)
This equipment is consistent with the goal of the FY03 (Part I and Part II) State Homeland
Security Grant Program to provide financial assistance for the purchase of specialized
equipment to enhance the capabilities of state and local agencies to respond to incidents of
terrorism involving the use of weapons of mass destruction; for the protection of critical
infrastructure; for costs related to the design, development, conduct and evaluation of WMD
exercises; and for administrative costs associated with the implementation of the program.

DISCUSSION
Currently, the City of Arcadia Fire Deparhnent uses MSA self-contained breathing apparatus and
the requested equipment will be consistent with its operation, maintenance, and training. This
equipment will further enhance our capabilities for response in incidents of terrorism and will be
available for use for our first responders within the community and on a more regional basis in
mutual aid response.
In accordance with the City's purchasing procedures, bids were requested and obtained from five
(5) qualified vendors (LN Curtis, Arizona Hiking Shack, United Fire Equipment, Lab Safety, and
Special T Fire Equipment). Special T Fire Equipment was the lowest qualified bidder. Although
the equipment individually did not exceed the threshold for formal bidding, the combined
purchase of this equipment exceeds the $30,000 threshold requiring Council approval.
FISCAL IMPACT
Funding for the respiratory protection and air monitoring equipment is provided for in the Los
Angeles County Operational Area - FY03 (Part 1 and Part II) State Homeland Security Granf
Program. Previous council approval has established a Homeland Security Fund for purchasing
this equipment. Funds expended for these acquisitions will be returned to the City through grant
reimbursement.
RECOMMENDATION
It is recommended that the City Council award the purchase of the respiratory protection
and air monitoring equipment to Special T Fire Equipment, in the amount of $78,349.11.

Recommendation: Award a Professional Services Agreement to
Bucknam & Associates in the amount of $70,200 to continue
Program Management Support of the Water System Seismic
Reliability Program
SUMMARY
Over the past nine (9) years, the City of Arcadia has been involved in the federally
funded Seismic Reliability Program to improve the water system in the event of a major
seismic event. Along with the City.of Sierra Madre, the cities have received over $9.2
million dollars in federal funds for system studies, the design of projects identified from
the study, and construction of new facilities. Bucknam and Associates has been an
integral part of this program since its inception in 1995. Because of Bucknam and
Associates' involvement with several other cities in the Los Angeles and Orange County
area, staff has been able to take advantage of their knowledge and experience in
response to requests from the Corps of Engineers and other federal agencies.
Based on the success of the City's programs and Bucknam and Associates
demonstrated competence and qualifications, staff is recommending that the City
Council authorize the City Manager to execute a Professional Services Agreement with
Buckham and Associates for Program Management Support for the Water System
Seismic Reliability Program and related water programs in the amount of $70,200.

Since 1995, the cities`of Arcadia and. Sierra Madre worked with the Corps of Engineers
to perform feasibility. level studies .to safeguard our water supply systems -from
earthquakes.:. The studies clearly identified water system elements that would be
severely damaged during a significant seismic event.. The studies recommended
system improvements, which would assist the water system to remain in operation after
a major earthquake. The cities of Arcadia and Sierra Madre jointly applied for, and have
been successful in obtaining funds for EPA technical assistance grants for the design
and construction of the projects deemed to be most critical to maintain water operations
and fire suppression capability. During this time, .the cities have obtained over $9.2
million dollars in federal assistance for the study, design, and construction of the
projects identified from the initial studies. We ai-e currently in the bidding stage of the
new 4.4 MG Santa Anita reservoir and the design of the new booster station at Orange
Grove plant.. t.
In order to ensure the continuity of these programs, which includes submitting monthly
progress reports to the EPA ahd provide consistent efforts to acquire additional federal
funds in the coming years, staff evaluated the need for professional assistance through
consultation services. As a result, Bucknam & Associates submitted' a proposal to
contihue providing on-call consultation to the City in conjunction with its Water
Resources Program. The proposal provided for the following scope of services:
• EPA Grant Program Administration
1. Management of the Water Infrastructure Reliability Program. This includes
management in technical matters relating to the design of the water
infrastructure .projects within 'the program, and representing the' City while
intertacing with federal, state, and local agencies, and other consultants.
2. Management of the Santa Anita Watershed Program. This includes
management of the Santa Anita Watershed. Feasibility Study being developed
jointly with the City of Sierra Madre. It involves interaction with various entities,
particularly with the Los Angeles County Public Works Department.
3. Consultation in conjunction with the City's federal appropriations request for FY
2003-2004 & 2004-2005. This includes consultation relative to the conceptual
development of federal funding program proposals for subsequent stages of the
program, providing technical assistance in working with the California Office of
Emergency Services in seeking pre-disaster mitigation grants and providing
liaison technical consultation -and coordination with the City's Washington D.C.
advocacy firm, The Ferguson Group, LLC.

Assist in sub-regional and regional planning. This- provides for coordination
assistance pertaining to the development of the East Raymond Basin Water
Resources Plan and the interested parties (e.g., San Gabriel Water Basin Water
Master). The City is studying the possibility of increasing our water rights in the
Raymond Basin, which if successful, could substantially reduce the cost of
purchasing water from outside agencies.
City staff has considered the merits of utilizing the consultation services provided by
Bucknam & Associates, particularly the extensive experience in the water infrastructure
programs area and the previous success in securing federal funding. The continued
utilization of Bucknam 8~ Associates in these areas greatly enhances the City's ability to
continue -these already successful programs, while allowing City staff to provide the
fundamental services expected of a public works organization. Because of their
knowledge of our projects from the very beginning of this program, the professional
contacts and relationships that have been made with funding agency (USEPA) and the
Corps of Engineers, staff recommends that the City Council award a professional
services agreement to Bucknam and Associates for $70,200.
FISCAL IMPACT
Sufficient funds were budgeted in the 2003/04 CIP and Operating Budgets for the work
to be performed during the twelve (12) month period of the Agreement. Approximately
50% of consultant's work will be eligible for EPA reimbursement.
RECOMMENDATION
Award a Professional Services Agreement in the amount of $70,200 to
Bucknam & Associates to continue Program Management Support of
the Water System Seismic Reliability Program
2. Authorize the City Manager and City Clerk to execute an agreement in a
form approved by the City Attorney.

SUMMARY
Staff is recommending that the City Council approve the revisions to the existing class
specifications for Water Quality Backflow Inspector and new class specifications and
compensation level for Engineering Aide.
DISCUSSION
In 1999, the City Council adopted the Personnel Classification and Compensation Plan that was
prepared by Personnel Concepts. This study provided new job titles, job descriptions, and
compensation levels to manage Cityjob classifications.
Periodically, City departments experience the need to create new classifications or revise
existing job descriptions to address new operating needs. Requests are reviewed by the City
Manager, and if approved, the Administrative Services Department/Human Resources Division
will conduct assessment interviews and analysis to evaluate the requests and make
recommendations. A report is then brought to the Human Resources Commission for review
and approval of all job descriptions, prior to the job descriptions being sent to the Council for
final approval.
The proposed new and revised job classifications pertain to the following City departments:
Public Works Services Department
In June 2003, changes were made to the class specifications for Water Quality Backflow
Inspector in order to comply with the requirements set forth by the California Department of
Health Services. The changes included revisions to water certificate requirements and driver's
license class with endorsements.

It has now been determined that the changes in the requirements by the State Department of
Health Services were not made to the position of Water Quality Backflow Inspector as was
originally anticipated. The requirements for the Water Quality Backflow Inspector were already
incompliance with the State's standards.
As a result, staff recommends that the City Council reinstate the Water Treatment Operator,
Grade II Certificate requirement for the position of Water Quality Backflow Inspector. This
revision does not necessitate a change in salary and therefore does not have a financial impact.
Development Services Department
Currently, the ihcumbent Administrative Assistant in the Development Services Department's
Engineering Division is working out of her current classificatidn and is performing duties that are
more complex and technical in nature.
The recent classification audit of this position has been completed and indicates a significant
need for technician level work. At the same time, the Engineering Division has a substantial
need for clerical and administrative assistance. The establishment of the Engineering Aide
position will allow the department tb efficiently meet their administrative needs. Furthermore, it
will create a flexibility that will fulfill some of the more technical needs of the Engineering
Division.
Staff is recommending an Engineering Aide position be created at salary range 47 ($2,870-
$3,583) to more accurately reflect the duties being performed by this position.
All class specifications were presented and approved by the-Human Resources Commission at
their regularly scheduled meeting on January 8, 2004.
FISCAL IMPACT
Implementation of the proposed changes in the Development Services Department will result in
an estimated annual increase of $1,968.00 to the General Fund. The Engineering division's
budget can absorb the cost of this modest increase.
RECOMMENDATION
Approve the revisions to the existing class specifications for Water Quality Backflow Inspector
and new class specifications and compensation level for Engineering Aide.

SUMMARY
Construction of the .Arcadia Police facility commenced on March 1, 2002. The
contractor on the project, Mallcraft Inc., had seventeen months to complete construction
of the project. Though not entirely completed, the building was occupied by the Police
Department on August 11, 2003. Work has continued on punch list items for the past
several months. The project has now reached a point where the Notice of Completion
can be filed with the County Recorder's Office and staff is recommending that the City
Council authorize that this document be filed.
BACKGROUND
Mallcraft Inc. was awarded a construction contract for the Arcadia Police facility on
January 15, 2002. Mallcraft submitted the lowest bid of the five submitted, at
$12,844,000, including two bid alternate items. Construction commenced on March 1,
2002 and progressed on schedule with the Police Department taking occupancy on
August 11, 2003. Though there were elements of the facility that were not completed, it
was important for occupancy to occur so that work on the demolition of the old station
and commencement of the landscaping and site work could start.
Over the past several months, work on the uncompleted portions of the building has
proceeded to the point where there are only a few items remaining on the punch list,
and the building is substantially completed. The most recent and significant portion of
the work to be completed was the installation and operation of the security gates and
fencing, which allows the Police Department to properly secure the facility and site.
Change orders to date have totaled about $425,000, though there are still some
outstanding that are either being negotiated or are being disputed. However, for a

project of this magnitude, this is typical. A final accounting of all project costs will be
prepared after the Mallcraft contract is finaled ahd work on the Phase II landscaping and
site work is, completed, which is scheduled for mid February.
DISCUSSION
When a project is completed, a Notice of Completion is filed with the County Recorder's
Office. Once the document is fled, the retention to the contractor can be released
subject to any claims or subcontractor stop notices against Mallcraft related to this
project. The City retains 10% of all payments to the contractor during the course of
construction and releases the retention after the Notice of Completion has been filed,
again subject to any claims or disputes. If claims have been filed, certain elements of
the job have not been completed, or there are disputes between the contractor and the
City over portions of the work, the City can withhold portions of the final payment to the
contractor from the retention. As a matter of information, the retention in this case is
about $1.3 million and is held in an interest bearing account for the contractor as
required by law when requested by the contractor. ,However, the financial institution
where the funds are held cannot release the funds without the City's authorization.
BUDGET
Funds have been budgeted and are available,:including interest earnings, in the project
budget for all costs .associated with the Mallcraft contract and other project related
expenses.
RECOMMENDATION
It is recommended that the City Council authorize the filing of the Notice of
Completion for the Arcadia Police facility.

The existing septic system at Wilderness Park's Nature Center is in disrepair and must be
replaced. However, the environmentally sensitive area of Wilderness Park has current
environmental laws and permit restrictions prohibiting the repair or replacement of any
septic system. Therefore, the only suitable solution is to construct a new sewer pumping
station and pipeline that would connect the park's sewer system to the City's sewer system
located in Highland Oaks Drive.
Staff recommends that the City Council award a contract in the amount of $129,640 to
Denboer Engineering & Construction, Inc, for the Wilderness Park Pumping Station and
Sewer Pipeline Connection Project.
DISCUSSION
Currently, the septic system servicing Wilderness Park is not functioning properly and is in
need of replacement. Based on the current septic tank's proximity to the stream through
Santa Anita Canyon spreading grounds, a permit to replace the existing septic tank has
been impossible to obtain. Staff attempted to obtain a permit to replace the septic system
but was rejected by the Regional Water Quality Control Board. Consequently, the
construction of a-sewer pumping station and pipeline from the park to the City's sewer main
in Highland Oaks Drive is the only feasible option available to correct the current sewage
disposal problem.

This project was originally bid in July 2003. The City received three (3) bids ranging from
$249,260 to $340,850, all well above the approved budget amount. Based on the high bid
amounts and inconsistencies in the bids City Council rejected all bids and instructed staff to
refine the specifications and~re-bid the project. The plans and specifications were modified
to reduce the scope of work. Notices inviting bids were published in the adjudicated paper
and bid packages were distributed to area contractors. The following nine (9) bids were

Staff has reviewed the bid documents for content and has investigated the Contractor's
background and recent projects for competency. It is staff's opinion that Denboer
Engineering & Construction, Inc. can satisfactorily perform the work required and
recommends that the City Council award a cohtract in the amount of $129,640 to Denboer
Engineering & Construction, Inc for the Wilderness Park Pumping Station and Sewer
Pipeline Connection Project. -
ENVIRONMENTAL ANALYSIS
This project is categorically exempt per Section 15302 (c) replacement from the
requirements of the California Environmental Quality Act.
FISCAL IMPACT
Funds in the amount of $207,000 were budgeted in the 2003-2004 Capital Improvement
Program for this project.
RECOMMENDATIONS
1. Award: a contract to Denboer Engineering & Construction, Inc. in the amount of
$129,640 for the Wilderness Park Pumping Station and Sewer Pipeline
Connection.
2. Waive any informalities in the bid or bidding process.
3. Authorize the City Manager and City Clerk to execute a contract in a form
approved by the City Attorney.
