HomeMy WebLinkAbout07/15/201456:0078 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, JULY 15, 2014 CALL TO ORDER - Mayor Wuo called the regular meeting to order at 7:00 p.m. INVOCATION - Reverend Terrence Shay, Mandarin Baptist Church PLEDGE OF ALLEGIANCE - Kurt Norwood, Fire Chief ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY SESSION ITEM(S) City Attorney Deitsch announced that the City Council conducted a Study Session to hear a report from staff regarding the single - family design review processes and procedures in Homeowner Association areas; he reported that following discussion by the City Council and representatives of the five Homeowners' Associations, the City Council provided general direction to staff concerning things that could be done within the coming six months in order to improve the design review processes and procedures. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Tay, to read all ordinances and resolutions by title only and waive the reading in full. PUBLIC COMMENTS Rainbow Yeung, Sr. Public Information Specialist, South Coast Air Quality Management District appeared and provided information on programs, computer application, and the "Special 2014 Clean Car Buying Guide" newsletter published by the South Coast Air Quality Management District. Scott Hettrick, Chamber of Commerce Chief Executive Officer, appeared and announced that this week is the 80th anniversary of the Chamber of Commerce's official incorporation; that the Chamber of Commerce will recognize four Arcadia Businesses at the Chamber Business Awards on Thursday, July 17, and reported on different services and community projects supported by the Chamber; he mentioned that it is imperative that the Chamber has a commitment from the City for a full year of funding rather than a six month period, and requested the City Council to reconsider its decision from the last Council meeting. Lawrence Papp, a resident, appeared and distributed a letter addressed to the City Council regarding the Utility Users Tax; and urged the C)ty Council to rescind its vote of the July 1, 2014, and assign a date for the proposed Measure to be placed on a ballot. 07 -15 -14 56:0079 Britt Cole, President of the Arcadia Firefighters' Association, appeared on behalf of the Firefighters' Association and expressed the Association's support of the City Council's decision against placing the Utility User Tax Measure on a ballot. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Chandler expressed his support in the City Council's decision to not place the Utility User Tax repeal initiative on a ballot; he explained the impacts on the City's ability to provide services and programs if the Utility Users Tax were eliminated, and felt that this initiative is irresponsible and misinformed. Council Member Beck announced that he was also comfortable with his decision regarding the proposed initiative; he commended the Fire Department for the memorial service for Fire Fighter Mike Herdman; and he commented on the study session and expressed his support and appreciation for everything the Homeowners' Associations do for the City. Council Member Tay announced the different functions he attended and announced the free concerts in the Park on Thursdays, and free Movies in the Park on Fridays this summer; and encouraged everyone to attend the Chamber of Commerce Networking Breakfast promoting local businesses and the Carcadia event on July 27. Mayor Pro Tern Kovacic commented on the Utility Users Tax initiative and the comments made by Mr. Papp, he noted the unconstitutionality of some of the provisions; and also the comments made by the Arcadia Chamber of Commerce CEO, Mr. Hettrick, concerning the City Council action on July 1St meeting regarding the Chamber Use Agreement, and clarified that the City Council request was to receive a written progress report from Chamber of Commerce quarterly, describing in reasonable details, the Chambers' performances. He complimented the Arcadia Unified School District, the Arcadia Firefighters' Association, and the Arcadia Fire Department for a wonderful and heartfelt tribute and service for Fire Fighter Herdman. At the request of Mayor Pro Tern Kovacic, Deputy Development Director /City Engineer Wray announced various street closures in the next couple of months in preparation of the Gold Line. Mayor Pro Tern Kovacic discussed the Gold Line Arcadia Station, Transit Plaza and parking structure and solicited City Council support to instruct staff to make a formal request to the Gold Line Foothill Extension Construction Authority to allow use of the parking structure by the City. Council Member Beck and Council Member Chandler supported Mayor Pro Tern Kovacic's request to place this matter on a future agenda. City Clerk Glasco announced the Thoroughbred Racing Walk of Champions inauguration ceremony on September 27; he reported that eight plaques have been installed by the City on the north side of the Huntington Drive in the sidewalks, and invited everyone to visit the sidewalk in front of the Denny's Restaurant and read the history of Malicious, the horse who rivaled the famous Seabiscuit in the 1930's. Mayor Wuo announced that he attended the Independent Cities Association ( "ICA ") Summer Conference in Rancho Bernardo with City Manager Lazzaretto, he reported on topics discussed including: Water, Three Cities — Three Stories Highlighting Change, Cyber Security, Hydrogen Fuel Cell Technology, Countywide Solid Waste Conversion Technology, Elected Official Role During a Crisis, updates on AB109, SMART Justice System�Medical Marijuana, and Human Trafficking. 07 -15 -14 56:0080 In response to Mayor Pro Tern Kovacic's comments regarding the Chamber of Commerce agreement, City Manager Lazzaretto concurred that the City Council merely asked for a review at six months, but that the term remained at a full year; and read the relevant section from the meeting minutes for everyone's benefit. 1. PUBLIC HEARINGS a. Resolution No. 7026 confirming the Engineer's Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the assessment diagram connected therewith: and ordering the levy and collection of assessments for Fiscal Year 2014- 15: and Resolution No. 7027 confirming the Engineer's Report for the levv and collection of the Kaitlyn Place Landscaping and Lighting District and the assessment diagram connected therewith: and ordering the levy and collection of assessments for Fiscal Year 2014 -15. Recommended Action: Find that these Resolutions are exempt under the California Environmental Quality Act; and adopt Public Works Services Director Tait and Senior Management Analyst Taylor presented the staff report. Mayor Wuo opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to find that Resolution No. 7026 is exempt under the California Environmental Quality Act; and adopt Resolution No. 7026 confirming the Engineer's Report for the levy and collection of the Arcadia Citywide Lighting District No. 1 and the assessment diagram connected therewith; and ordering the levy and collection of assessments for Fiscal Year 2014 -15. A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tern Kovacic, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to confirm the weed abatement charges and order the County Auditor to enter the amounts of the assessment against the parcels of land as they appear on the current assessment roll. Recommended Action: Approve b. Contract with Roadway Engineering and Contracting Inc for the Civic Center Parking Lot Improvement Project in the Amount of $395,978. Recommended Action: Approve C. Purchase Order with Life Assist for paramedic field supplies in an amount not to exceed $60.000. Recommended Action: Approve d. Purchase Order with SunGard Pentamation for Financial System Software Maintenance in an amount not to exceed $34,000. Recommended Action: Approve e. Extension to the Purchase Order with Performance Truck Repair Inc for fire apparatus repairs in an amount not to exceed $135,000.
