SUBJECT: SET THE PUBLIC HEARING DATE OF SEPTEMBER 2, 2014, FOR AN
APPEAL OF THE PLANNING COMMISSION'S DECISION RELATING TO
A NEW TWO- STORY, SINGLE FAMILY RESIDENCE AT 1203
HIGHLAND OAKS DRIVE
Recommendation: Approve
SUMMARY
The City received an appeal of the Planning Commission's decision to refer a Staff
design review approval to the Highland Homeowners' Association. Per Arcadia
Municipal Code Section 9292.1.14, the City Council, at its next regular meeting after the
filing of an appeal, shall set a date for public hearings for design review appeals. It is
recommended that the City Council set the public hearing for the appeal of the
Planning Commission's decision to refer to the Highlands Homeowners' Association's
Architectural Review Board the design review of a proposed 7,096 square -foot, two -
story, single - family residence at 1203 Highland Oaks Drive for September 2, 2014.
BACKGROUND
On May 27, 2014, Planning Services approved Single - Family Architectural Design
Review No. SFADR 13 -140 for a new 7,096 square -foot, two - story, single - family
residence at 1203 Highland Oaks Drive. On June 4, 2014, an appeal was filed of the
decision to approve the subject application.
On July 29, 2014, at a scheduled special public hearing, the Planning Commission
referred the subject application to the Highlands Homeowners' Association's
Architectural Review Board.
On August 5, 2014, the property owner's attorney, Mr. Jack A. Fierstadt, filed an appeal
of the Planning Commission's decision.

Per Arcadia Municipal Code Section 9292.1.14, the City Council, at its next regular
meeting after the filing of an appeal, shall set a date for a public hearing for a design
review appeal, and the hearing is to be held within 40 calendar days from the filing date,
which would be on or before Sunday, September 14, 2014. If the next regular City
Council Meeting is not an acceptable date, the City Council can schedule a Special
Meeting on or before September 14, 2014.
April Seymour (Verlato), who was one of the appellants of this project to the Planning
Commission, has informed the City that she will not be available to attend the
September 2, 2014, City Council meeting and has requested an alternate date for the
hearing; in order to accommodate this request within the 40 day time limit, a Special
Meeting would be required.
RECOMMENDATION
It is recommended that the City Council set the Public Hearing date of September 2,
2014, for the appeal of the Planning Commission's decision relating to a new two - story,
single - family residence at 1203 Highland Oaks Drive.
