Huntington Drive, Arcadia Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation in order to participate in a meeting, including auxiliary aids or services,may request such modification or accommodation from Planning Services at 626-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure accessibility to the meeting. CALL TO ORDER ROLL CALL: Ken Chan, Vice Chairman Dominic Lazzaretto, Committee Member Phil Wray, Committee Member PUBLIC COMMENTS (5 minute time limit per person) Each speaker is limited to five (5) minutes per person, unless waived by the Modification Committee. Under the Brown Act, the Members are prohibited from discussing or taking action on any items not listed on the posted agenda. PUBLIC HEARING You are hereby advised that should you desire to legally challenge in court any action taken by the Modification Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or prior to, the public hearing. 1. Modification No. MC 14-09 and Oak Tree Encroachment No. THE 14-48 1001 Catalpa Road Applicant: Greg & Carol Kealey, Property Owners PROJECT DESCRIPTION: The applicant is requesting a Modification to allow a 105 square foot, first floor addition to the existing 3,261 square foot, two story home to encroach 5'-6" into the required 20'- 0" street side setback, which will align with the wall line of the existing house. The proposed addition will encroach into the protected area of a Coast Live Oak tree. The Rancho Santa Anita Residents' Association has reviewed and approved the architectural design of the proposed addition. ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15305(a) of the CEQA Guidelines Class 5 Exemption for the minor alterations in land use limitations. Conditionally approved 3-0, subject to the following conditions: 1. The applicant/property owner shall place a fence 12 feet around the perimeter of the Coast Live Oak Tree in the front yard, as recommended by the July 2014 Certified Arborist's Oak Tree Report prepared for this project. 2. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, Modification Committee, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 3. Approval of MC 14-09 and THE 14-48 shall not be of effect unless on or before 30 calendar days after approval of this project, the property owner/applicant has executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to the Planning Commission within five (5) working days of the decision. Appeals are to be filed by 5:30 p.m. on Wednesday, September 3, 2014. If no appeal is filed, decisions are final. ADJOURNMENT The Modification Committee will adjourn this meeting to September 9, 2014, at 7:45 a.m. in the City Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia. Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will be made available for public inspection in the City Clerk's office located at 240 W. Huntington Drive, Arcadia, California, during normal business hours.
