HomeMy WebLinkAboutItem 2a - Regular Meeting Minutes of August 19, 2014 and Special Meeting Minutes of August 20, 201456:0091 MINUTES OF THE ARCADIA CITY COUNCIL REGULAR MEETING TUESDAY, AUGUST 19, 2014 Mayor Wuo called the Special Meeting to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None PUBLIC COMMENTS Matt McSweeney, representing the Arcadia Improvement Association, appeared and provided comments on the proposed Mixed -Use Apartment Project on the City Parking lot on Wheeler Avenue between Santa Anita and First Avenue. City Attorney Deitsch requested that a Closed Session item be added to the agenda pursuant to Government Code Section 54956.9(b)(4) to confer with legal counsel regarding anticipated litigation and that in order to add an item to agenda, the City Council must by a 2 /3rd affirmative vote, as required by the Ralph M. Brown Act, make two findings (1) there was a need to take immediate action instead of waiting until the next City Council meeting; and (2) that the need to take action arose after the agenda was posted and distributed. Attorney Deitsch opined that both findings could be made. As requested by City Attorney Deitsch, the City Council unanimously 5 -0 made the required findings as required by the Ralph M. Brown Act to add a Closed Session item to the agenda pursuant to Government Code Section 54956.9(b)(4). STUDY SESSION a. Report, discussion, and direction concerning the development of a Mixed -Use project in the City's downtown parking lot between Santa Anita and First Avenue (south of Wheeler Avenue). Recommended Action: Provide Direction Assistant City Manager /Development Services Director Kruckeberg, Matt Waken of Walbern Developments, and Kai Lau of Architects of Orange presented an overview of the prospective renderings of the proposed "The Promenade on Wheeler" project in the City's downtown parking lot on Wheeler Avenue. It was noted that the proposed project has been designed in accordance with the General Plan; that it is a Transit Oriented Development and takes advantage of the forthcoming Metro Gold Line station; and it was noted that Walbern Development is also working with an adjacent privately -owned parking lot property to be incorporated into the overall plan, either for immediate use or at a future date. It was the consensus of the City Council that staff should continue working with the developer and that Walbern should be provided with a 90 day exclusive negotiating period in order to incorporate the adjacent private parking lot into the project. 08 -19 -14 56:0091 b. Report, discussion, and direction concerning a potential Mixed -Use project at 56 East Duarte Road (southwest corner of Duarte and First Avenue). Recommended Action: Provide Direction Assistant City Manager /Development Services Director Kruckeberg, and Rick Abe of Media Portfolio provided the City Council with a slide presentation of the proposed renderings of the project at 56 East Duarte Road (Southwest corner of Duarte and First Avenue), which consists of 41 residential units with 18,000 square -feet of ground commercial floor space. It was the consensus of the City Council that they would be willing to consider changing the Zoning from C -2 to Mixed Use and that the developer should enhance the architecture of the proposed development prior to submission. The Study Session ended at 7:00 p.m. CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Wuo called the regular meeting to order at 7:04 p.m. INVOCATION — Reverend Thomas Shriver, Emmanuel Assembly of God PLEDGE OF ALLEGIANCE — Mary Beth Hayes, Director of Library and Museum Services ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY SESSION ITEM(S) City Attorney Deitsch reported that the City Council conducted a Study Session to hear reports from staff regarding the two items listed on the posted agenda; he reported that staff discussed the development of a Mixed -Use project in the City's downtown parking lot between Santa Anita and First Avenue (south of Wheeler Avenue); and a potential Mixed -Use project at 56 East Duarte Road (southwest corner of Duarte and First Avenue). City Attorney Deitsch further reported that the City Council gave general direction to staff to continue working with the developers on both projects. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto noted that the City Council added a Closed Session item to the agenda, which will convene at the end of the regular meeting. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Tay, to read all ordinances and resolutions by title only and waive the reading in full. 08 -19 -14 56:0091 PRESENTATIONS a. Presentation of Certificates of Commendation to the Arcadia American Little League 9 -10 All -Stars District 17 Champions. PUBLIC COMMENTS Lawrence C. Papp appeared to discuss the letter he previously delivered to the City Council regarding the "Stop the Utility Users Tax Initiative" and urged the City Council to either adopt the proposed Utility Users Tax initiative or place it on a ballot. John Uniack, an Arcadia resident and Highland Oaks ARB Chairperson, appeared and stated that both he and April Verlato, the appellants' representative, will not be available to attend the proposed September 2 City Council public hearings regarding appeals in the Highlands (City Manager items 2.b. and 2.c.), and requested that the hearing date be rescheduled to a future date. George Zodilla, a resident of the Highland Oaks, appeared and requested that the public hearing items related to City Manager items 2.b and 2.c also be rescheduled to a future date. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). City Manager Lazzaretto announced that an Arcadia street sweeper exploded and caught fire around 5:30 a.m. at the Public Works Services Department on Goldring Road; that a tank on one of the compressed natural gas (CNG) trucks ignited and exploded; that there were no reported injuries; and that the exact cause of the fire is under investigation and that damage is estimated at about $450,000. Mayor Pro Tern Kovacic complimented the authors of The Peacock Buzz and encouraged everyone to check it out for the latest information on recreation, library, and historical museum programs; he complimented Santa Anita Park for their street banner advertising the Breeders' Cup; he commented on the Huntington bridge fagade and distributed a sample photo of a railroad bridge in Ellicott City and requested support of two other Council Members to request staff to bring back a report for adding a design element to the Huntington bridge identifying the City of Arcadia. Mayor Wuo and Council Member Beck supported Mayor Pro Tern Kovacic's request to place this matter on a future agenda. Mr. Kovacic congratulated Taylor Lagace, an Arcadia High School graduate, on being elected as the co- captain of the UCLA Football team. Council Member Tay announced the various events he recently attended; he announced that the group Cold Duck will be performing at the August 21 Concert in the Park, and the last Movies at the Park series of the season will be "E.T." on August and encouraged everyone to attend. Council Member Beck requested City Council support to schedule a future agenda item regarding adding the Sycamore tree to the City's list of protected trees. Mayor Wuo and Mayor Pro Tern Kovacic supported this request. He commented on the brown lawns around the City and urged residents to report any code violations to Code Services, and anything that needs repairing around town to the Public Works Services Department; he supported Mayor Pro Tern Kovacic's suggestion of adding the City's name to the bridge; he commented on the Little League District 17 Champions and remembered the time that he was the manager of a team in District 17. 08 -19 -14 56:0091 Council Member Chandler responded to Mr. Papp's comments on the Utility Users Tax Initiative; he commented on the street sweeper explosion and explained the negative impacts if 13% of City's operating budget was eliminated. City Clerk Glasco commented on residential break -ins through open windows and provided information on alarmed monitored window screens; and further provided information on the Neighborhood Watch Program. Mayor Wuo commented on recent burglaries in the City and urged residents to protect their families and homes by considering different protection systems such as alarms or cameras; and reminded everyone that the start of the school year is here and everyone should be extra careful when driving around the schools. CONSENT CALENDAR a. Special and Regular Meeting Minutes of August 5, 2014; and Joint Special Meeting Minutes of August 7, 2014. Recommended Action: Approve b. Accept all work performed by Gentry Brothers, Inc. for the Sewer Main Structural Repair project and authorize the final payment to be made in accordance with the contract documents. Recommended Action: Approve Accept all work performed by Gentry Brothers, Inc. for the Sixth Avenue Sewer Capacity Improvement project as complete and authorize the final payment to be made in accordance with the contract documents. Recommended Action: Approve Donation of two new soccer goals for the Civic Center soccer field by AYSO Region 2 valued at $5,000. Recommended Action: Accept e. Purchase 2,676 acre -feet of imported replacement water from the Main San Gabriel Basin Watermaster for a total cost of $1,800,948. Consideration of request to open the Gold Line Arcadia Station Parking Structure for public use in advance of the opening of the Light Rail Service. Recommended Action: Approve 08 -19 -14 56:0091 Assistant City Manager /Development Services Director Kruckeberg presented the staff report. It was moved by Mayor Pro Tern Kovacic and seconded by Council Member Beck to adopt Resolution No. 7045 requesting the Gold Line Arcadia Station parking structure to be opened for public use in advance of the opening of the Light Rail Service. The roll call vote failed 2 -3. AYES: Council Member Kovacic and Beck NOES: Council Member Chandler, Tay, and Wuo ABSENT: None It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on a roll call vote to not take any action. Set the Public Hearing date of September 2, 2014, for the appeal of the Planning Commission's decision relating to new single- family residences at 1717 Alta Oaks Drive, 1350 Highland Oaks Drive and 1800 Wilson Avenue. Recommended Action: Approve Community Development Administrator Kasama presented the staff report. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to set the public hearing date of September 2, 2014, for the appeal of the Planning Commission's decision relating to new single - family residences at 1717 Alta Oaks Drive, 1350 Highland Drive and 1800 Wilson Avenue, and if the appellants representative, Ms. Verlato, cannot attend the September 2, 2014, public hearing, the appeal fee be returned to her. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to set the public hearing date of September 2, 2014, for the appeal of the Planning Commission's decision relating to a two -story single - family residence at 1203 Highland Oaks Drive. AYES: Council Member Chandler, Tay, Beck and Wuo NOES: Mayor Pro Tern Kovacic ABSENT: None The City Council recessed at 8:20 p.m. to a Closed Session to consider the one item that was added by 2/3 vote of the City Council pursuant to Government Code section 54956.9(b)(4). Huntington Drive, Arcadia, California. ROLL CALL The Mayor announced that there was a quorum of the City Council, with Mayor Wuo, Mayor Pro Tern Kovacic, and City Council Member Beck in attendance. At 1:50 p.m. the assembled group attended a tour of the Huy Fong Foods (makers of Sriracha hot sauce) facility at 4800 Azusa Canyon Road, Irwindale.
