HomeMy WebLinkAbout08/05/201456:0084 CITY COUNCIL /SUCCESSOR AGENCY TO THE ARCADIA REDEVELOPMENT AGENCY REGULAR MEETING MINUTES TUESDAY, AUGUST 5, 2014 CALL TO ORDER - Mayor Wuo called the regular meeting to order at 7:00 p.m. INVOCATION — Reverend Terry Keenan, Police Department Chaplain PLEDGE OF ALLEGIANCE — Robert Guthrie, Police Chief ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None REPORT FROM CITY ATTORNEY REGARDING STUDY SESSION ITEM(S) City Attorney Deitsch reported that the City Council conducted a Study Session to hear a report from staff concerning the potential development of the Santa Anita Park property; he announced that representatives of Santa Anita Park were in attendance and discussed potential future development. No action was taken or requested. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Tay, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Presentation by the California Department of Food and Agriculture on Huanglongbing (HLB) and the Asian citrus psyllid that is affecting citrus trees in Southern California. b. Presentation of a $50,000 check from Friends of the Arcadia Public Library to the Arcadia Public Library. C. Presentation by Upper San Gabriel Valley Municipal Water District regarding the San Gabriel Valley Water Smart City Challenge conservation program. 1. PUBLIC HEARINGS a. Resolution No. 7041 finding the City of Arcadia to be in conformance with the Congestion Management Program (CMP) and adopting the CMP Local Development Report, in accordance with California Government code section 65089. Recommended Action: Adopt 08 -05 -14 56:0085 Associate Planner Tom Li presented the staff report. Mayor Wuo opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Kovacic, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7041 finding the City of Arcadia to be in conformance with the Congestion Management Program (CMP) and adopting the CMP Local Development Report, in accordance with California Government code section 65089; and direct the City Clerk to transmit a fully executed copy of Resolution No. 7041 and the Local Development Report to the Los Angeles County Metropolitan Transportation Authority by September 1, 2014. Amendment to the Special Use Permit No. SUP 13 -03 to allow the "626 Night Market" to add a third day (Sunday) to two of the scheduled Night Market weekends at Santa Anita Park (August 17 and September 14 2014) to allow the organizers to host three -day events instead of two -day events in the following years and to Categorically Exempt the project from CEQA per section 15304. Recommended Action: Approve Planning Services Manager Lisa Flores presented the staff report. Mayor Wuo opened the public hearing. Jonny Hwang, the applicant appeared and addressed concerns raised by the City Council regarding the reporting of sales tax. Scott Hettrick, Chamber of Commerce Chief Executive Officer, appeared and expressed the Chamber's support of the 626 Night Market, and stated that the Chamber would like to see some of the City's local businesses integrated into this event; and also shared some of the same concerns raised by the City Council regarding cash transactions and the reporting of sales tax. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. Resolution No. 7043 authorizing the Arcadia Police Department to use funds allocated from the Citizens' Option for Public Safety- Supplemental Law Enforcement Services Fund (COPS - SLESF) for the purpose of front line police services. Recommended Action: Adopt Police Chief Guthrie presented the staff report. Mayor Wuo opened the public hearing. No one appeared. A motion to close the public hearing was made by Council Member Chandler, seconded by Council Member Tay, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7043 authorizing the Arcadia Police Department to use funds allocated from the Citizens' Option for Public Safety - Supplemental Law Enforcement Services Fund (COPS - SLESF) for the purpose of front line police services during FY 2014 -15. AYES: Council Member Chandler, Tay, Beck, Kovacic, and Wuo NOES: None ABSENT: None PUBLIC COMMENTS Lawrence Papp, an Arcadia resident, appeared and urged the City Council to rescind its decision of the July 1, 2014 to not place the Utility Users Tax repeal measure on a ballot. Carol Curland, an Arcadia resident, appeared and applauded the Friends of the Library for their $50,000 donation to the Library, and pointed out how important and valuable the Library is to the community. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Mayor Pro Tern Kovacic announced that beginning Friday, August 8, the intersection of Huntington Drive and Second Avenue will be closed for Gold Line construction and that businesses in the immediate location will be open during the street closures. Council Member Tay announced the different events he attended including the Chamber of Commerce Business Mixer, and a ribbon cutting ceremony for the "Shave It Nation" at the Westfield Santa Anita Mall; he commended the Public Works Services Department for their service to the community and announced that the Fire Chief Norwood will be a guest speaker at the Government Affairs Forum on August 7. Council Member Beck thanked the Friends of the Library for the donation of $50,000 to the Library; he commented on the comments made by Mr. Papp and thanked City Attorney Deitsch for all he does for the City and for the advice he gives to the City Council and staff. Council Member Chandler expressed his appreciation to the Friends of the Library for their generous donation to the Library; and provided information on Household Hazardous Waste and E- Waste Roundup dates, hours, and locations; he commented on the Arcadia Police Department's "Safe Summer Campaign" and congratulated them for educating the community on the impacts of drinking and driving. 08 -05 -14 3 56:0087 City Clerk Glasco commented of the City's official birthday date; and remembered Monty Lindsey on a personal note as a former Senior Citizen Commissioner and longtime active member of the community. J, Mayor Wuo encouraged everyone to attend the summer concert on August 8 to celebrate Arcadia's 111th Birthday and National Night Out event. 2. CONSENT CALENDAR a. Special and Regular Meeting Minutes of July 15, 2014. Recommended Action: Approve b. Resolution No. 7042 determining the amount of revenue to be raised from property taxes for Fiscal Year 2014 -15 to pay for the debt service on the 2011 and 2012 General Obligation Bonds. Recommended Action: Adopt C. Purchase order with Falcon Fuels Inc. for the purchase and delivery of fuel for the City's fleet in an annual amount not to exceed $443,300. Recommended Action: Approve d. Contract with D & J Foothill Electrical Contractors, Inc. for electrical repairs and preventative maintenance at various City facilities in an amount not to exceed $114,760. Recommended Action: Approve e. Contract with Comet Electric, Inc. for the LED Street Light Retrofit Proiect in the amount of $382,464. Recommended Action: Approve f. Extension to Contract with ABM Services, Inc., for ianitorial and porter services at various City facilities in the amount of $288,252. Recommended Action: Approve g. Agreement for personnel related legal services with Liebert Cassidy Whitmore in an amount not to exceed $70,000. Recommended Action: Approve h. Agreement with Adminsure, Inc. for workers' compensation third party claims administration services in the amount of $298,776 over a three year period. Recommended Action: Approve i. Purchase order with L.N. Curtis & Sons for structural firefighting coats and pants in an amount not to exceed $35,000. Recommended Action: Approve j. Extension to the Purchase Order with Daniels Tire Service for the purchase of tires and tire related services for City vehicles in the amount of $86,616. Recommended Action: Approve 08 -05 -14 56:0088 k. Extension to the Professional Services Agreement with Evidence -Based Staffing Inc. for temporary dispatch services in an amount not to exceed $30,000. Recommended Action: Approve Amendment to the Professional Services Agreement with American Micro Imaging Inc. for Laserfiche software maintenance and support in an amount not to exceed $18,158. Recommended Action: Approve M. Receive a gift of $50,000 from the Friends of the Arcadia Public Library for programs and materials for the Library. Recommended Action: Accept n. Exercise option to withdraw from the Los Anaeles Regional Interoperable Communications System ( "LA- RICS ") Joint Powers Authority, and repeal Resolution No. 6650. Recommended Action: Approve o. Final Map No. 72224 for an 18 -unit residential condominium subdivision at 968 -998 Arcadia Avenue. Recommended Action: Approve P. Final Map No. 72165 for an eight -unit residential condominium subdivision at 1038- 1088 Sunset Boulevard. Recommended Action: Approve q. Grant award of $130,000 from the Office of Traffic Safety for reimbursement of costs related to the Selective Traffic Enforcement Program. Recommended Action: Approve Appointment of Voting Delegates for the 2014 League of California Cities Annual Conference. Resolution No. 7044 enacting and implementing Phase I of the City's Water Conservation Plan. Recommended Action: Adopt Public Works Services Director Tait presented the staff report. Todd Butts, appeared and expressed concerns about water usage, and the size and use of new homes being built in the City; and commented on police vehicles not following driving rules. 08 -05 -14 5 .1. 11: It was moved by Mayor Pro Tern Kovacic, seconded by Council Member Tay, and carried on roll call vote to adopt Resolution No. 7044 enacting and implementing Phase I of the City's Water Conservation Plan (As set forth in Arcadia Municipal Code Section 7553 et seq.).
