HomeMy WebLinkAbout8-26-14 4 ARCADIA PLANNING COMMISSION r+ REGULAR MEETING MINUTES Tuesday, August 26, 2014 CALL TO ORDER — Chairman Falzone called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chan, Lin and Falzone ABSENT: Commissioner Chiao MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to excuse Commissioner Chiao from the meeting. With no objection, the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Each Commissioner was given a copy of a memo on Item 2, a revised copy of Resolution No. 1912, and the APA Planning Commissioner's Guide. PUBLIC COMMENTS None. PUBLIC HEARINGS 1. Resolution No. 1910—Tentative Parcel Map No. TPM 14-08 (72285), Multiple- Family Architectural Design Review No. MFADR 14-02, Oak Tree Encroachment Permit No. THE 14-02, and Oak Tree Removal Permit No. TRH 14-02 with an Exemption from the California Environmental Quality Act (CEQA) to allow a three-unit residential condominium development at 138 California Street Recommendation: Adopt Resolution No. 1910 Applicant: Mr. Jimmy Lee, T. J. Build Mr. Kasama briefly introduced the item. Assistant Planner, Jordan Chamberlin, presented the staff report. Chairman Falzone opened the public hearing and asked if anyone would like to speak in favor of this item. Mr. Jimmy Lee, the applicant, responded. Chairman Falzone asked if anyone would like to speak in opposition to this item. Ms. Mary Hicks, representing her uncle, Mr. Will Martin, a neighbor, responded. Another neighbor, Mr. Dominic Masiello, also commented. 8-26-14 Chairman Falzone asked if the applicant would like to speak in rebuttal. Resolution No. 1912 — Conditional Use Permit No. 14-05 with an Exemption from the California Environmental Quality Act (CEQA) to allow a 1,200 square- foot tutoring center at 912 S. Baldwin Avenue Applicant: Ms. Helen Wu Recommendation: Adopt Resolution No. 1912 Mr. Kasama briefly introduced the item. Associate Planner, Tim Schwehr, presented the staff report. Chairman Falzone opened the public hearing and asked if anyone would like to speak in favor of this item. Ms. Helen Woo, the applicant, and Mr. John Coumans, another tenant in the building, both responded in favor of the application Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chan, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to find that this project is exempt from CEQA and that the proposal satisfies all requisite findings, and to conditionally approve the application, and to adopt Resolution No. 1912 including that Condition No. 3 be revised to replace, ":kindergarten" with "ten year olds," and that Condition No. 8 be amended to require handicap access to only the subject unit, or that at the option of the applicant and with the consent of all involved parties, that the path of travel may be provided by closing off the driveway approach from Baldwin Avenue and converting the existing driveway to a pedestrian-only pathway with an ADA compliant path of travel. Resolution No. 1911 — Conditional Use Permit No. CUP 13-02, Architectural Design Review No. ADR 13-03, and Tentative Parcel Map No. TPM 13-02 with a Mitigated Negative Declaration per the California Environmental Quality 8-26-14 Chairman Falzone asked if the applicant would like to speak in rebuttal. Mr. Lee responded. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Lin, seconded by Commissioner Chan, to reopen the Public Hearing and continue this item to the September 9, 2014, meeting to allow time for verification of the location of one of the oak trees on the site and to allow Mr. Masiello time to review the arborist's report. Resolution No. 1913 — Conditional Use Permit No. CUP 14-03 with an Exemption from the California Environmental Quality Act (CEQA) to allow a 2,000 square foot restaurant at 608-610 E. Live Oak Avenue Applicant: Ms. Jacqueline DiPeppe, Business Owner Mr. Kasama briefly introduced the item. Assistant Planner, Nick Baldwin, presented the staff report. Chairman Falzone opened the public hearing and asked if anyone would like to speak in favor of this item. The following responded: Mr. Larry DiPeppe, business owner Ms. Jackie DiPeppe, business owner Ms. Michelle Ritter, business customer Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chan, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Chan, seconded by Commissioner Falzone, to find that this project is exempt from CEQA and that the proposal satisfies all requisite findings, and to conditionally approve the application, and to adopt Resolution No. 1913 with the added conditions that the loading zone is in the rear of the building that 8-26-14 Act (CEQA) for subdivision of a 1.88 acre site into two lots, a Conditional Use Permit, and Architectural Design Review of a proposed four-story, Mixed Use Project consisting of three stories of residential units over 16,175 square feet of ground floor commercial space, and one level of underground parking at 57 Wheeler Avenue Recommendation: Adopt No. 1911 Applicant: DPP Arcadia, LLC Mr. Kasama briefly introduced the item. Planning Services Manager, Lisa Flores, presented the staff report. Chairman Falzone opened the public hearing and asked if anyone would like to speak in favor of this item. The following responded: Mr. Matt McSweeney, local business owner Mr. Wilson Wong, architect and local property owner Ms. Alicia Barkley, represented owner Ms. April Verlato, local business owner Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none, but some of the speakers in favor also expressed some opposition. Chairman Falzone asked if the applicant would like to speak in rebuttal. Ms. Barkley responded. MOTION It was moved by Commissioner Chan, seconded by Commissioner Baerg, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Falzone, to deny the applications based on the finding that the site is not adequate in size to accommodate the proposal. ROLL CALL AYES: Commissioners Baerg, Lin and Falzone NOES: Commissioner Chan ABSENT: Commissioner Chiao CONSENT CALENDAR 5. Minutes of the August 12, 2014, Regular Meeting of the Planning Commission Recommended action: Approve 8-26-14 MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin, to approve the minutes as presented. Without objection, the minutes were approved. ROLL CALL AYES: Commissioners Baerg, Chan, Lin and Falzone NOES: None ABSENT: Commissioner Chiao MATTERS FROM COUNCIL LIAISON Councilman Tay reminded the Commissioners of the Stakeholder Interviews for the Zoning Code Update on Thursday, the 28th at 6:00 p.m. FROM PLANNING COMMISSIONERS Commissioner Baerg suggested that Commissioner Chan's observations regarding background checks, etc. for tutoring centers should be investigated further and asked Staff to look into the matter. MATTERS FROM MODIFICATION COMMITTEE Councilman Chan reported that there was only one item on the Modification Committee Meeting agenda today and it was approved. MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said that the first item on the agenda which was continued will be on the September 9 agenda along with the continued HOA appeal on Fallen Leaf Road, and an amendment of the Specific Plan for the Santa Anita Inn project. ADJOURNMENT Chairman Falzone adjourned this meeting at 9:13 p.m. to September, 2014, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
