Shahbazi, Assistant Engineer SUBJECT: Proposed Vacation of El Monte Avenue Between Duarte Road and Campus Drive (Applicant: Arcadia Unified School District) Resolution No. 5801 • Public Hearing Summary: With the growth and reconfiguration of Arcadia High School � _..e Arcadia Unified School District is faced with a major proble,: .. -1 needs to provide additional space for its facilities placeme4 additional student and staff automobile parking needs . The Schcoi District, over the past two years, has been working with the to resolve this problem. Many ideas and alternatives were .exant nos bet\ieen City and School District staff at various meetings . appears that a solution which will meet the needs of the Schoc _ District may be found in the closure of El Monte Avenue from uua _=- Road to Campus Drive. The City Council at their meeting of May 1994 , adopted Resolution No. 5793 declaring the City' s intention - 7 vacate El Monte Avenue between Duarte Road and Campus Drive and a Public Hearing for tonight ' s meeting. As a result, Resole_ _ No. 5801 (Attachment 1) has been prepared for the City CouncL _ ' - consideration which, upon adoption, orders the vacation of El Avenue between Duarte Road and Campus Drive subject to compl ~. with the City ' s conditions set forth in the Resolution. Background: With the inclusion of ninth grade -students and additional staff Arcadia High School , there will be an increase in traf _ . - congestion around the High School as well as an impact available parking on Campus Drive. For the past two years, studies have been conducted by the City and School District to determine the best alternative for resolving the parking s '. Various options as listed below were analyzed: • LASER i PorZ1 • Mayor and City Council June 21, 1994 Page 2 1 . Closure of Campus Drive between Santa Anita Avenue and El Monte Avenue for conversion to a parking lot. 2 . Reconfiguration of Campus Drive to diagonal parking on each side between Santa Anita Avenue and El Monte Avenue allowing one lane each for eastbound and westbound traffic. 3 . Reconfiguration of Campus Drive to allow for parallel parking on the north and south side of the street and parallel parking in the center of the street allowing one lane each for eastbound and westbound traffic. 4 . Constr :lion of multi-level parking structure in the west lot o :he High School . 5 . Acquisition of a strip of property inside the County Park Golf Course for conversion to a parking structure. 6 . Vacation of El Monte Avenue from Campus Drive to Duarte Road. Closure or reconfiguration of Campus Drive (Options 1, 2 , & 3) were found not to be feasible or acceptable since Campus Drive is a major roadway and carries considerable commuter traffic and is a primary response route for emergency vehicles . Options 4 and 5 were also found to be unreasonable due to the cost constraints . Therefore, the only option which seemed to be the most feasible was the closure of El Monte Avenue between Campus Drive and Duarte Road. The closure of El Monte Avenue would allow for the conversion of the entire area to a parking lot . • Discussion: El Monte Avenue is shown on Exhibit "A" of the attached proposed Resolution. It is a forty-foot (40 ' ) wide (curb to curb) , two-lane roadway within a fifty-foot (50 ' ) right-of-way having an Average Daily Traffic (ADT in a 24-hour period) of approximately 2 , 700 vehicles . The morning and afternoon peak hours are at approximately 320 and 330 vehicles respectively. The primary use of the roadway is to provide vehicular circulation around the high school , provide acc=ess to existing parking lots and provide commuter access between Duarte Road and Campus Drive. Pursuant to Chapter 2 of Part 3 of Division 9 of the California Streets and H_ghways Code the City Council may vacate any street in the manner provided therein. More specifically, after a public hearing of evidence offered by interested persons, the City Council may determine, from all the evidence submitted, that the pu'clic roadway is unnecessary for present and prospective future us= and may adopt a resolution vacating the roadway. The following Mayor and City Council June 21 , 1994 Page 3 paragraphs offer various, but not necessarily all , points of evidence for Council consideration in this matter. Closure of this segment of roadway would inhibit emergency vehicle access to the High School in a relatively limited fashion. The primary impact of this closure would be the likelihood that pesons who wish to make the transition between Campus Drive and Ddarte Road may use Park Avenue, one block west of El Monte Avenue. Because this is a residential area, increased vehicle flow could have a detrimental effect on the neighborhoods of Park A enue (between Duarte Road and Campus Drive) having an existing A T of approximately 770 vehicles and Fairview Avenue (between Park Avenue and Holly Avenue) having an existing ADT of approximately 640 vehicles. Existing morning and afternoon peak hours on Park Avenue are at approximately 100 and 90 vehicles respectively. Morning and afternoon peak hours on Fairview Avenue are at 80 and 70 vehicles respectively. The majority of persons who use El Monte Avenue as a transition roadway might use Holly Avenue instead. The exception to this would be those persons who circulate around the High School in the morning or afternoon for the purpose of dropping off/picking up students . They would probably take the most expeditious route around the school, which would be Park Avenue. It is possible to mitigate some use of Park and Fairview Avenu s by posting signs that say "No Through Traffic" at each end. hese signs would be advisory only to the traveling public as the' are not enforceable regulatory signs . However, because most drivers do obey posted signs , this could reduce potential problems . S ould the signs not be effective, prohibition of turning movements into and out of the area could be considered during peak hou s in consonance with increased police patrol . Pursuant to the City Council ' s adoption of Resolution No. 5793 at it ' s meeting of May 17 , 1994 , staff has prepared for the City Council ' s consideration Resolution No. 5801 (Attachment 1) ordering the vacation of El Monte Avenue between Duarte Road and. Campus Drive . Following vacation, the right-of-way will revert ba k to the underlying fee owner which, in this case, would be the Ar adia Unified School District. Resolution No. 5801 also stipulates that the Arcadia Unified School District shall construct all nece sary drainage improvements and off-site improvements necessary for the roadway-to-parking lot conversion to the satisfaction of the Director of Public Works . In accordance with the requirements of Part 3 of Division 9 of Streets and Highways Code the required notices were published and posted along El Monte Avenue. In addition, notices were mailed to properties as shown on Attachment 2 . As a result of notification, Mayor and City Council June 21, 1994 Page 4 staff received several petitions and letters opposing the proposed vacation. Attached are copies (Attachment 3 ) of the petitions and letters, and a map indicating the property owners in opposition at the writing of this report. Also, appropriate utility companies were notified of the City ' s intention to vacate El Monte Avenue from Duarte Road to Campus Drive. Only Southern California Edison Company and TCI Cablevision requested easements be reserved for the operation and maintenance of their facilities. Environmental Impact P . .cant to the provisions of the Californ . Environmental Quality ac .: , an initial study was conducted f the proposed street vacation by the City of Arcadia . The ;itial study did not disclose any individual or cumulative ac :se effect on wildlife resources, or the habitat upon which ne wildlife depends . However, the Initial Study indicated that -::.e vacation would result in a substantial alteration of the present land use (residential) of the area and substantial impact upon existing transportation systems and present patterns of circulation. Therefore, a Negative Declaration was prepared for the proposed street vacation (Attachment 4) . The finding is that the Vacation of El Monte Avenue will have no significant effect upon the environment as long as the stated mitigated measures are implemented. Conformance With The General Plan On June 14 , 1994 , the Planning Commission determined that the proposed vacatizn of El Monte Avenue between Campus Drive and Duarte Road is :fit in conformance with the City ' s General Plan. The Planning Co- nission' s position can be summarized as follows : 1 . The General Plan contemplates consistency with the Street and Highway code section mandating the finding that "vacation" requires a determination that the street is unnecessary for present or prospective public use. Since they don't believe this finding can be made there can be no consistency. 2 . The Commission also indicated that the proposal deletes a street and creates problems on another street and that is not consistent with "circulation. " If the City Council ..sires to procee.._i with the proposed vacation, the City Council - _st make a deter - `_nation that the proposed vacation is in conformance with the C- - .:eral Plan. Mayor and City Council June 21, 1994 Page 5 Fiscal Impact In accordance with City Council ' s direction at its May 17 , 1994 meeting, Resolution No. 5801 contains provisions for the School District to reimburse the City for the administrative costs involved in completing the vacation process . It is estimated that the administrative costs will be approximately $3 , 000 . Recommendations It is recommended that the City Council take the following actions : 1 . Open the Public Hearing and receive any comments or objections to the City' s intent to vacate El Monte Avenue between Duarte Road and Campus Drive. 2 . If the City Council desires to proceed with the proposed vacation, and finds that the proposed vacation is in conformance with the City ' s General Plan and that subject street is unnecessary for present or prospective public use, the Council should: a) Approve and file the Negative Declaration and find that the vacation of El Monte Avenue between Duarte Road and Campus Drive will not have a significant effect on the environment as long as the stated mitigated measures are implemented, and b) Adopt Resolution No . 5801 finding conformity with the General Plan and - ordering the Vacation of El Monte Avenue between Duarte Road and Campus Drive. The City Council of the City of Arcadia, of May 17 , 1994 , adopted Resolution No. 5793 declaring the intention of the Arcadia City Council to vacate El Monte Avenue between Duarte Road and Campus Drive in the City of Arcadia, County of Los Angeles, State of California. SECTION 2 . Notices of the proposed street vacation were duly published, mailed, and posted in the- manner and form and at the time required by street and Highway Code, Section 8322 . SECTION 3 . The City Council of the City of Arcadia h- id a Public Hearing on the proposed street vacation on June 21, 1994 , at 7 : 00 p.m. at the City Hall Council Chamber of the City of Arcadia, 240 West Huntington Drive, Arcadia, California, at which time, said . Council heard all evidence offered by persons interested i:; the proposed vacation . SECTION 4 . The City Council of the City of Arcadia dces fir..: . a) That pursuant to Government Code 65402 , the proposed vacation is in conformity with the City ' s General Plan, b) That the vacatiof of El Monte Avenue between Duarte Road and Campus Drive as sh wn C.. the attached Exhibit "A" is being made in accordance with Chapter 2 and Chapter 3 of Part 3 of Division 9 of the California Streets and Highways Code (Streets and Highways Code Section 832p e_'. -1- - AttachmLent »1 seq. ) ; c) F.:-suant to Streets a.. : Highway Codes Section 8323 , the City Council finds from all the evidence submitted that El Monte Avenue between Duarte Road and Campus Drive is unnecessary for present or prospective street purposes, and therefore, it is ordered that the above described street be vacated, subject to the following conditions, reservations, and exceptions: I 1) to the Southern California Edison Company the permanent easement and right at any time, or from time to :_me, to con -ruct, maintain, operate, replace, remove, renew, and enlarge 3 of pipe, conduits, cables, wires, :_ales, and other convenient structures, equipment and fixtures for the transportation or distribution of electric energy, and incidental purposes in, upon and over the street, or part thereof proposed to be vacated; and 2) to TCI Cablevision a permanent easement and rig'h any time, or from time to time to construct, maint_: _:-. . operate, replace, remove, renew and enlarge lines of conduits, cables, wires , poles and other conve7: 7- structures, equi,pment .and fixtures for --the operation of ca _ - in, upon and over the street, or part thereof proposed vacated; and 3 ) the Arcadia Unified School District shall funi . _ _ costs and expenses incurred by the City including attt_ fees with regard to any litigation that arises out of street vacation process , subject to whatever assurances are deemed advisable by the Ar _ -dia City Attcr7 -= SECTION 5 . The City Council of the City of Arcadia •oes hereby order that El Monte Avenue between Duarte Road and Campus Drive be vacated after all of the following conditions 'are meet : a) Arcadia Unified School District reimburse all Cit;• ' _ administrative costs . b) Arcadia Unified School District enters into an Improvement Agreement with the City of Arcadia for off-s : -_ improvements . c) Arcadia Unified School District shall construct z . height curb, gutter, sidewalk, parkway trees , and other site improvements on Duarte Road and Campus Drive which required subject to approval of Director of Public d) Arcadia Unified School District shall pay for . costs associated with the construction of off- , . - improvements and drainage facilities such as plan chec:- permit fees, inspection charges, and all other nec - charges not specifically mentioned herein. e) Reservation of utility easement ( for So.:- California Edison and TCI Cablevision) within permanent structure (building, etc. ) is allowed . This letter is being written to officially object to the "NEGATIVE DECLARATION' sent to residents on May 31st, 1994 for the following reasons. • 1 . Disagree with 'D - FINDING' and request an Environmental Impact Report (EIR). 2. Because of disagreement with 'D' it will NOT be mitigated by 'E'. 3. There has been only ONE party of interest (Arcadia Unified School District) considered and the RESIDENTS' position has not been fully taken into account in this report. Lip service from the Police and Fire Departments has been given to the problems faced. 4. We disagree with many answers under 'B' i.e. 11, 12, 13 including a. b. and f., 19 and 21b. These, in our opinion, should be answered YES. 5. Over the years many allowances have been made to accept, and work around the High School activities, but this quiet residential section, in what we all proudly consider "The City of Homes", should not be sacrificed for changes that appear to be poorly thought out. It also points out that planning for the overall changes at the High School have not had a full Environmental Impact Investigation or this problem would have surfaced earlier. It should be done while school is in session. 6. This area is impacted by traffic from sources other than the High School i.e. the Race Track, The Mall, Holy Angeles and the Senior Citizens Activity Center. This point should be added to the considerations being made. 7. Copies of this letter will be sent to the Police and Fire Departments ' and the Community Development and Planning Commission. It will give them the opportunity to consider more fully the concerns of residents. "Unenforceable" NO THROUGH TRAFFIC signs are no answer. We trust representatives from these Departments will :e present at the Public Hearing before the City Council on June 21st at 7 p.m. to answer questions from residents. . The existing surface is asphaltic concrete with curb and gutter on both sides. As a result of the proposed vacation this site will bl used as part of the Arcadia High School parking lot. The surface of the proposed parking lot will also be asphaltic conrete. 13 . TRANSPORTATION/CIRCULATION c) Closure of El Monte Avenue Extension would result in the diversion of traffic that normally uses this particular street as the travelway to circulate around the High School campus. The primary use of this roadway is as a coniector allowing traffic to pick several options in accessing or leaving the campus. Commuters also use this connector as a shortcut in traveling to Holly and Huntington or in making the transition from Campus Drive to Duarte Road for purposes of traveling south from Duarte Road. The primary impact of this closure would be the likelihood that persons would use Park Avenue and Fairview Avenue. Because this is a residential area, increased vehicle flow could have an ffect on the perceived quality of the neighborhood. However, it is possible to mitigate some use of Park and Fairview Avenges by posting signs that say "No Through Traffic" at eack, end. Lopez, Director o Public Work 2 SUBJECT: Parking Alternatives at Arcadia High School Public Safety Considerations With the inclusion of ninth grade students in the populatio at Arcadia High School, we recognize that there will be an increase in traffic congestion around the High School as well as an impact Upon available parking around the campus. In light of this, the following is an analysis of the impact of various options for increasing perimeter parking dealing with Campus Drive and El Conte Avenue. A. Campus Drive: Option 1 - Closure of Campus Drive between Santa Anita and El ' Monte Extension - convert to parking lot. Option 2 - Reconfigure Campus Drive to diagonal parking on each side between Santa Anita and El Monte Extension. Provide one lane each for east and west bound traffic. Option 3 - Reconfigure Campus Drive to allow for parallel parking on the north and south side of the street and parallel parking in the center of the street. Provide one lane eac for east and west bound traffic. • Analysis: Campus Drive is a major east/west arterial that allows p blic safety access to the north side of the High School as we 1 as facilitating the flow of traffic through the Community. The Fire Department uses Campus Drive as their primary res onse route for the Truck Company and support equipment when traveling to emergency calls at the Race Track, Fashion Park andl the Arboretum. Access to Campus Drive allows for both Police and Fire emer l ency response.to all sides of the High School. Police Units are able to conduct inspections of the High School campus from all sides • Page 2 and this enhances the overall safety of the school. The Fire ' - Department has the ability to provide immediate response to all " the buildings on the school grounds and can readily stage equipment around the entire campus. Closure of Campus Drive would add time to emergency response to the west end of the City and to the facilities noted above. It would preclude effective response to service calls from both Police and Fire as well as place an unreasonable traffic flow burden on Duarte Road as traffic is relocated to that street from Campus Drive. Closure of Campus Drive would force the relocation of through traffic -from Campus Drive to Duarte Road via Holly Avenue, Santa Anita Avenue, El Monte Avenue .and Park Avenue. In 1938 , ownership_of the L. A. County Park was transferred ,from the U. S. Government to L. A. County. Note that the deed contained the following provision: "PROVIDED ALWAYS, that this conveyance is made upon the express- condition and limitation that the above described premises shall be limited to the retention and use for public park, playground, and recreation purposes only by the party of the , second part, and upon cessation of such retention and use shall revert to the United States of America without notice, demand, or action brought. " This provision remains in affect,. regardless of the fact that portions of the 'originally deeded property are now Campus Drive • roadway. or the newly constructed Community Center. Closure of Campus Drive is an unacceptable alternative to create additional parking. Both Options #2 .and #3 provide for reconfiguration of Campus Drive. One would allow for diagonal parking, the other for central parallel parking. Both have a negative impact. Each of these options present major safety considerations as well as the fact that each provides for the ,reduction of Campus Drive from four lanes to two travel lanes. Reduction in the traffic lanes will inhibit general traffic flow. We would be creating problems not only during morning and evening commute periods, but due to the nature of individuals stopping in traffic lanes to dropjoff or pick up students , we would foresee that traffic circulation would be sev..ely_ .mpacted. Diagonal parking in this a::-.a will sign:. icar.tly increase the probability of traffic accents because of the reduced visit:: caused by angular parking and the fact that vehicles will e Page 3 backing into the sole travel lane. Speeds of vehicles though this area, even with reduced travel lanes, are high enough to lead to severe accidents. Diagonal parking also tends to encourage people to move from between cars and dart intd the traffic lanes in an attempt to cross the street. The likelihood of pedestrian accidents is very high. Parallel parking in a center median area is extremely hazardous. _ Persons have to cross in a helter skelter fashion simply to get to vehicles parked in the median. The opening of vehicle doors from both sides of the vehicle creates an overwhelming pote' tial for accidents for vehicles traveling in both directions. The options shown above do create a nominal amount of addit' onai parking, however the increased hazard level that would occur to both pedestrians and motor vehicles does not offset the dangerous conditions that we would see created. B. El Monte Avenue: . Option 1 - Close El Monte Avenue Extension between Duarte Road and Campus Drive - convert to parking lot. Analysis: Closure of El Monte Avenue Extension would result in the diversion of traffic that normally uses this particular street as the travelway to circulate around the High School cammpus. The primary use of this roadway is as a connector al owing traffic to pick several options in accessing or leavin .-`the campus. Most probably, the majority of persons who have used El Monte Extension as their -transition roadway will use Holly venue instead. The exception to this would be those persons who circulate around the High School in the morning or afternon for the purpose of picking up students. They would probabq, take the most expeditious route around the school, which would be Park Avenue. . Page 4' C. Recommendation: None of the options listed are without adverse impact. The least detrimental is the closure of El Monte Avenue Extension. This would allow for the conversion of• the entire area to a parking lot. We would suggest that the school maximize its use of this area by extending the lot as close to the Flood Control Wash as right of way and building codes will allow. Driveways allowing entry/exit to Campus Drive would be on the west side of the current Administration Building. Traffic exiting to the south would have to go out the driveway at the signal at El Monte Avenue and. Duarte Road. This would tend to maximize the safety issues of entry/exit to the lot. Butler, Assistant Community Development Director/Planning SUBJECT: Ordinance 2011 - Approving Text Amendment 94-002 adding regulations to the S-1 Zone Allowing outdoor entertainment events in the S-1 zone SUMMARY The Planning Commission at its May 24 meeting voted 4 to 0 with one member abstaining to recommend approval of Text Amendment 94-002 adding regulations to the S-1 (Special Use) zone to allow for-profit outdoor entertainment events at the Santa Anita Race Track (SART). DISCUSSION The Los Angeles Turf Club is requesting a text amendment to allow for-profit, non- racing single-or multi-day events, festivals, concerts and/or similar entertainment activities with a special permit at Santa Anita Park. These events would be scheduled during alternate times of the year when racing is not taking place (predominantly May through September). The live horse racing season at the race track is from late December to late April and from early October to mid November. The S-1 Special Use Zone currently permits the following uses: • Any use permitted in zones R-O and R-1 • Barbecues • Conventions • Dancing • Daytime baseball and football games and track meets • Dog shows • Gasoline service stations • Horse breeding, raising, training and sale • Horse shows LASER 1M ra o June 21, 1994 O0 Page1 • • Daytime horse racing with or without pari-mutua..-1 wagering on the results thereof • Horse racing via satellite feed one night a week, no later than 11:30 p.m. with or without pari-mutuel wagering on the results thereof • Motion picture production • Picnics • Turf clubs, including retail on sale of liquor • Any use by an organization, association or corporation which is organized and carried on wholly for the benefit of religious, charitable, educational, recreational or scientific purposes, and from which no individual person other than bona fide employees and assistants necessarily employed receives any gain, remuneration or profit, including v -ans' associations and corporations, and including say City, County, State .deral, Governmental, Political, public or quasi public unit, bo agency and entity for periods not to exceed five (5) consecutive day : a total of ten (10) days in any one calendar year. Throughout the year, Santa Anita hosts a limited number of non-profit events such as the Greek Festival and the Irish Festival. Over the past few years, attendance at the race track has declined. This is partially a result of off-track betting, a sluggish economy and the spread of other forms of gambling, including card clubs. Craig Dado, Marketing Manager for the Los Angeles Turf Club (LATC) indicated in a letter to the City Manager, "the purpose of our [LATCI request for a text amendment to the municipal code is to complement our racing program by presenting family- oriented special events that will be commercially viable ventures and be a credit to our community." Section 9273.1.15 is proposed to be added to the S-1 zoning regulations to read: "Any outdoor entertainment event including but not limited to single or multi-day events such as fairs, concerts, rodeos, festivals and similar entertainment oriented activity as further defined and described in Division 7, Part 1, Chapter 4 of Article VI of the Arcadia Municipal Code (sections 6417 through 6417.9 - Outdoor Entertainment Event Permits), subject to compliance with the referred to code sections and permit requirements." This wording has been revised since the original proposal to the Planning Commission, however, it is consistent with the prior version and input of the Commission. The original wording included the number of events which has been included in the new Outdoor Entertainment Permit Ordinance. T.A. 94-002 June 21, 1994 Page 2 Ira. b. The Planning Commission in recommending approval of this text amendment noted the following: • This was a good alternative use of the site, especially in this economy and will be additional revenues for the City. 1, • Applauded Santa Anita Race Track for coming up with alternative marketing strategies. • Indicated that the race track has been a good neighbor and has contributed a lot to the City and thought this was a good use of the land. • Thought that conceptually this was a good idea but had concerns (see below). The Commission also expressed concerns,regarding hours, noise levels, fees and number of days events may be held. They concurred with staff's position that a sunset clause be included which would limit the new use and applicable permits to a one year period. This would allow the City the opportunity to review and reconsider, if necessary. Accompanying this text amendment is a new Outdoor Entertainment Permit (OEP) Ordinance which will be set forth in the Businesses, Professions, Trades and Occupations section of the Arcadia Municipal Code. This ordinance will addre s the issues of noise, traffic, vending, number and scope of events, and days and hours of the events. ENVIRONMENTAL ANALYSIS Pursuant to the provisions of the California Environmental Quality Act, the Planning Division has prepared an initial study for the proposed text amendment. Said initial study did not disclose any substantial or potentially substantial adverse change in any of the physical conditions within the area affected by the project including land, air, water, minerals, flora, fauna, ambient noise and objects of historical or aesthetic significance. When considering the record as a whole, there is no evidence that the proposed text amendment will have any potential adverse effect on wildlife resources or the habitat upon which the wildlife depends. Therefore, a Negative Declaration has been prepared for this project. RECOMMENDATION The Planning Division recommends approval of Text Amendment 94-002 subject to the wording in the staff report.
