Kinnahan, Assistant Community Development �Director/Economic Development RE: REQUEST TO APPROVE AGREEMENT FOR FINANCIAL CONSULTING SERVICES (TAX INCREMENT ANALYSIS WITH HINDERLITER DE LLAMAS COREN & CONE) Background Because of the size and complexity of the County's tax records, neither the Agency or the City have the technical background or the staff time to investigate the records of the Los Angeles County Tax Collector, Auditor-Controller, and Assessor to verify that all properties are in the Central Redevelopment Project area, that property transfers and new construction are correctly entered in County records and that the Agency is in fact receiving the tax increment which it is due. Discussion . Agency staff prepared a Request for Proposal (RFP) and forwarded it to five financial consulting firms with experience in this area. Staff is seeking an experienced consultant who could not only investigate and verify the County property and tax records, but would follow up with the County to convince them to correct their records. The consultant would not be paid unless and until the Agency received mis-allocated tax increment. (The Agency can receive up to 3 years of mis-allocated tax increment. Receipt of the "back" payments could take up to 2 years. ) The consultant was required in the RFP to describe how they would handle our assignment, how they have handled similar previous contracts with other agencies, which of their staff would be assigned to Arcadia's contract, time period, and cost. Optional Tasks The County also collects and distributes the State-assessed unitary property taxes for railroads, pipelines, utility lines, etc. County errors in this area can also result in lost Agency revenue. The County is now processing, we are informed, a significant number of property tax appeals. Errors in this process can affect our revenue. In addition, timely comments by the Agency during an appeal may provide additional information. to the Appeals Board LASER IMAGED which may benefit the Agency. We also get advance information of possible reduction in anticipated Agency revenues if the appeal is granted. Proposals Three Consultants submitted proposals. These are summarized on Attachment 1. Based upon review of the proposals by the Finance Department and Economic Development Division and a reference check, staff recommends the retention of Hinderliter de Llamas Coren & Cone. (HdLCC) They will provide the basic tax increment analysis for 25% of the mis-allocated net revenue to be paid when the Agency receives it. HdLCC has advised that their initial unverified computer runs indicate that the Agency could be entitled to receive possibly $150, 000 in mis-allocated funds ie, $50, 000 for each of the last three years. Approximately $15, 000 (ie, $5, 000 for each of the last three years) of this amount is money which may have been mis- allocated by the County to the City of Arcadia and is properly due to the Agency. Repayment comes from the County, not from the City. Staff has also reviewed the HdLCC Optional Task proposal, and recommends that the Agency obtain a report on the County's payment of State assessed unitary taxes and on assessment appeals above $100, 000. This will cost $5, 000. Fiscal Impact- Basic- Possible net increase in revenue to the Agency of $112,500 in total for the last 3 fiscal. years ($150, 000, less a 25% payment to HdLCC of $37, 500) , plus $50, 000+ in revenue every year after 1994-1995. Possible loss of property tax revenue to the City of Arcadia of $15, 000, plus a loss of approximately $5, 000 a year every year after 1994-1995. Note: These are unverified figures. The actual amount of loss or gain to both the City and Agency is not known at this time. Optional- Estimated Cost of $5, 000 for the two optional tasks. Payment of this amount is not contingent upon receipt of the revenue.
