ORDINANCE No. 2021 - INTRODUCTION - An Ordinance of the
City Council of the City of Arcadia, California, adding a design
overlay (D) to the properties located in the area bordered by Virginia
Avenue on the north, Santa Anita Avenue on the west, Highland
Oaks on the east extending to the east end of Sycamore Avenue
and bordered by the commercial properties fronting on Foothill
Boulevard on the south and including said area into the Highland

SUBJECT: REQUEST FOR FINANCIAL ASSISTANCE FROM THE
ARCADIA TOURNAMENT OF ROSES ASSOCIATION
SUMMARY
The Arcadia Tournament of Roses Association ( "Association ") has requested
assistance from the City with regard to publicizing several of their upcoming functions
and their 1995 membership drive.
DISCUSSION
At the City Council meeting of September 6, 1994, the City Council considered a
request from the Arcadia Tournament of Roses Association for financial assistance with
regard to three mailings they had intended to make to Arcadia residents to publicize
several of their upcoming functions and to provide general information on Association
membership (the staff report is attached). After consideration of the request, the City
Council directed staff to bring back a revised report offering other, less expensive
alternatives for providing assistance to the Association. Accordingly, City staff met with
Association representatives to put together another proposal for City Council
consideration.
At this time, the proposal before the City Council is for support in one of the following
ways:
Option 1
Printing, folding and envelope- stuffing services for two notices of 500 regarding
upcoming functions (one page /one side each, plus envelope with return address) and
three notices of 500 regarding membership information (two pages /one side each, plus
envelope with return address), with all notices being printed on two -color Tournament

With this option, the Association would be responsible for providing us with camera -
ready art, and they would take care of labeling the envelopes and paying for the
postage. Allowing for the fact that the City will waive its labor cost for folding and
stuffing the envelope, our cost to provide these services is approximately $500 for a
high quality bond paper, and approximately $415.00 for a lesser quality paper.

A cash grant could be granted to the Association in order to pay for these same
services, which they could purchase from an outside printing company.
Of special note with this option is that providing a cash grant to the Association will
enable them to go to local printing establishments and perhaps solicit them for a
contribution in the form of lower printing rates and /or a donation of a certain amount of
printing services. This could, in essence, allow the Association to obtain more for the
same amount of money.
As a point of reference, staff is not suggesting placing this information in a water bill
because of the City Council established guidelines directing staff to not use the water
bill inserts to advertise fund raisers or other events put on by community organizations.
Staff will need direction from the City Council if you would like to revise this policy.
FISCAL IMPACT
The City's cost to provide the printing and associated services mentioned previously
is approximately $500.00 for a high quality bond paper, the kind that is typically used
for letterhead purposes, and approximately $415.00 for a lesser quality paper.
It is suggested that if the City Council desires to support the Tournament of Roses with
a cash grant, that said grant be in the amount of $500.00.
If the City Council desires to support the Tournament of Roses in this manner, funds
would be available in the Community Relations Division budget. It is important to note
that it does not make a difference to the City's budget if the support is provided in the
form of services or dollars, in that the Community Relations Division will be charged the
actual cost of the support. Whether we pay the City's print shop or issue a check to
the Association, the money is no longer available for use on other projects.

RECOMMENDATION
The City Council should discuss this request, and if it finds that supporting the
Tournament of Roses in this fashion would be of benefit to the community, and serve
a City /public purpose, that the City Council:
1) Direct staff to coordinate with the Tournament of Roses Association on the
production of the publicity information pursuant to the details of this report; or
Direct staff to issue a check to the Arcadia Tournament of Roses Association in
the amount of $500.00; and
2) Appropriate the specific dollar amount from the Community Relations Division
budget.

REQUEST FOR ASSISTANCE FROM THE
ARCADIA TOURNAMENT OF ROSES ASSOCIATION
The Arcadia Tournament of Roses Association has requested assistance from the City
with regard to three (3) mailings they would like to make to Arcadia residents in the
near future. This assistance would be in the way of printing and mailing services for
mailings that would be used to advertise several of their functions for the remainder of
1994.
DISCUSSION
The Arcadia Tournament of Roses Association is a local organization whose purpose
is to serve as a public relations arm of the City of Arcadia. Their primary means of
promoting the community of Arcadia is through participation in the annual Tournament
of Roses parade in Pasadena with a City of Arcadia float. For your information, the
City has had a float in said parade every year since 1915, with the Tournament of
Roses Association sponsoring the float since 1966.
The Tournament of Roses Association has received funding from the City in the past;
the most recent being a $3,000 payment in FY1975 -1976 for funding of the float.
The Tournament of Roses Association recently requested financial support from the
City in the amount of $13,250. However, during the recent budget deliberations, they
withdrew their request as a way of helping the City balance its FYI 994-1995 budget.
Since that time, and at their request, staff has had informal discussions with members
of the Tournament of Roses about the possibility of providing other, indirect support.

We have received the attached request from the Tournament of Roses for assistance
with three mailings they would like to make to Arcadia residents to publicize the
Wineshed Mixer, Coronation Ball, Float Preview Party, the Workout Breakfast and to
provide some general information on Tournament of Roses membership. The
Association would like the mailings to go to as many Arcadia residents as possible with
the Association providing one -color camera -ready art for an 8 1/2" x 11" flyer and the
City providing the paper, printing, postage and mailing services. The City would have
approval of the content of the mailings.
On July 5, 1994, the City Council adopted a Donation Policy (attached) which allows
the City Council to authorize the expenditure of funds for City - related functions that
appear to be beneficial to the community.
FISCAL IMPACT
The City's cost to provide this type of service to the Tournament of Roses Association
is detailed below:

The prices listed above include delivery to all postal customers in the City. Mailing to
residential customers only would save approximately $400.00 - $450.00 per mailing.

Please note that the postage cost was determined by our being able to take advantage
of the simplified address /bulk rate program which is available to government agencies
only. To utilize this program, we must either mail to the entire City, or to all residential
customers, or all business customers and the words "City of Arcadia" must make up
the main portion of the return address (e.g. City of Arcadia, in conjunction with the
Arcadia Tournament of Roses Association). Using the simplified address system
enables us to address each envelope /flyer with one of the following phrases (instead
of individual addresses): Arcadia Postal Customer, Arcadia Residential Postal Customer
or Arcadia Business Postal Customer.
As a point of reference, the reason staff is suggesting using the simplified address
system is because the Tournament of Roses Association does not have a specific
mailing list they want to use. They are hoping to reach as many residents as possible,
and since neither the Tournament of Roses or the City has a way to come up with an
acceptable list of specific names and addresses to mail to, it was determined that
mailing to all postal customers, or at least all residential customers, would be the best
way to go (if, in fact, the City is going to be sponsoring a mailing).
As an alternative, the City Council may wish to choose a particular element(s) of the
above described options as opposed to sponsoring an entire mailing(s). That is, you
can pick and choose any combination of the above components from paying only for
the cost -of the flyers to paying for the cost of the flyers and envelopes, etc.
Additionally, the City Council can exercise the option of providing financial assistance
in the form of a cash grant in an amount of your choice. The Tournament of Roses
Association would then arrange for any printing and mailing services themselves. With
this option, the City does not necessarily have approval of the content of the mailings
or of how the money is actually used.
If the City Council desires to support the Tournament of Roses, funds would have to
be appropriated from the General Fund and /or the Community Relations Division
budget in an amount determined by the level of support. Please be advised that there
is no money budgeted specifically for this purpose. The Community Relations Division,
however, is capable of absorbing up to $1,000 toward the cost of this project out of its
program expenses account.

RECOMMENDATION
The City Council should discuss this request, and if it finds that the subject matter of
these mailings are indeed a City /public purpose, of benefit to the community, and the
City Council is desirous of supporting the Tournament of Roses in this fashion, that the
City Council:
1) Direct staff to coordinate with the Tournament of Roses Association on the
production of the flyer pursuant to the details of this report; or
Direct staff to issue a check to the Arcadia Tournament of Roses Association;
and
2) Determine the level of support, and
3) Appropriate the specific dollar amount from the General Fund and /or Community
Relations Division budget.

SUMMARY
We request support services to assist in achieving the goals stated below.
DISCUSSION
The Arcadia Tournament of Roses Association ( Tournament ) has been a
community organization in this city, in one form or another, since its first
parade entry in 19 le The recognition that the group brings to the city is well
recognized.
Historically the City had provided support for the Tournament in the way of
direct funding. That process was discontinued at the request and
recommendation of the Tournament when our financial position was very
secure.
Resumption of direct funding was recently considered as a budgetary line item
during planning review. We then withdrew our request, in order to assist the
City in its challenge to set realistic budgetary goals.
In July of this year, the Council adopted a Donation Policy. The Tournament
MRS. JOYCE MACARTNEY requested information regarding same. The City Manager indicated there
TOURNAMENT COORDINATOR might be support services available to assist us in meeting our fiscal
challenges; To wit,
( 1) Increasing membership
( 2) Promotion of fund raising community activities.

We feel we qualify for this type of support, as we meet all requirements of the Policy; the
benefit to the City is beyond quantification. ( Please see attached Fact Sheet).
The Tournament therefore respectfully requests assistance and support from the City, as
delineated in the City Manager's project outline and report.
We feel that the " three mailing" level of option A would have the greatest impact and would
assist in goal achievement. Also, as an optimistic viewpoint, possibly eliminate the need for
support in the future.
We ask that the Council review and issue decision, since major fund raising activity is calendar
sensitive and time is of the essence. Thank you for your consideration.

ADMINISTRATIVE POLICY GUIDELINES
DONATION POLICY Date Adopted July 5, 1.994 _

The purpose of this policy is to establish procedures and guidelines for response to
requests from outside agencies for donation of City funds for non -City projects,
programs and activities.
"Donation" means gift of City funds for non -City purpose.
"Community Organization" means service clubs, charitable /non - profit groups in Arcadia.
As always, it will be the City's goal to expend public funds in a prudent and responsible
manner. From time to time, requests are received from community organizations for the
City of Arcadia to donate funds and /or gifts for various events. This policy formally
restricts the City Council to allocating funds only for City- related functions.
The denial of donation requests from community organizations shall be routinely
administratively handled by the City Manager or his /her designee. If a request arises
which appears to be beneficial to the community and is considered to be a City- related
function, the City Council may authorize such expenditure. This authorization shall be
an exception to this policy and shall require formal approval by a majority vote of the City
Council at a regular City Council meeting.
It has been City policy and shall continue to be policy, that in an effort to promote good
community relations and in lieu of monetary donations, presentations of certificates for
achievement and service will be made as they have in the past, as will the presentation

of City plaques for special recognition. A guideline for presentations to the public and to
employees is contained in the City's Commendation/ Presentation Policy.
This policy is a procedural guideline and may be modified as the City Council deems
appropriate.

SUBJECT: RECOMMENDATION TO ADOPT RESOLUTION NO. 5820
ESTABLISHING PARKING VIOLATION LATE PENALTIES
Summary
Staff is recommending an increase in parking penalties and late charges in order to
bring these rates more in line with parking penalties charged by other Agencies.
Discussion
Penalties for various parking violations are rebated to the city in which the violation
occurs. Revenues collected for violations of the Arcadia Municipal Code are deposited
in the General Fund, while violations of the California Vehicle Code are deposited in
the Traffic Safety Fund. The resources generated from this revenue source are
expended in accordance with State regulations for traffic control devices and the
maintenance thereof; the maintenance of equipment and supplies for traffic law
enforcement and traffic accident prevention; and the maintenance improvement and
construction of public streets.
The parking penalties imposed by the City of Arcadia have not been changed or
increased since April 1987, with the exception of a $2 State - mandated surcharge which
was added in August 1991.
Section 40203.5 of the California Vehicle Code states, among other things, that to the
extent possible, parking penalties shall be standardized with other Agencies within the
County. Attached is a survey of parking penalties imposed by several Los Angeles
County Agencies. The survey shows that the penalties currently charged by Arcadia
are generally below those penalties charged by other Agencies within Los Angeles
County.

Attached as part of the Resolution is the proposed schedule of parking penalties and
late charges (Exhibit A) recommended for adoption. These rates will bring our parking
penalties more in line with those charged by other Agencies in compliance with the
California Vehicle Code.
Fiscal Impact
The implementation of the recommended parking penalties and late fees will generate
an estimated $10,000 to $15,000 additional revenue annually.
Recommendation
It is recommended that the City Council adopt Resolution No. 5820 imposing parking
penalty fees and late penalty fees which are comparable to those fees charged by other
agencies within Los Angeles County.

SUMMARY
Pursuant to the January 19, 1993 Easement Purchase Agreement (EPA)
between Anita Associates and the City of Arcadia, Anita Associates
has requested a Certificate of Completion for construction of the
Mall improvements (Nordstrom store and other improvements. )
According to the Community Development Department, the building
(Nordstrom store and additional retail structure) , the 8. 2 acre
parking lot and related roadway improvements have beeen completed
and a Certificate of Occupancy authorized.
There are several conditions in the EPA which must be met before
the $3 million can be released to Anita, e.g. completion oflthe
improvements, proof of insurance on the City lot to be provided by
Anita, issuance of an ALTA title policy on the City lot. The
issuance of the Certificate of Completion meets one of the
conditions.
The attached Certificate of Completion is a formal document by
which the public body acknowledges that the work has been
completed. It has been approved by the City Attorney.
FISCAL IMPACT
Approval of this request will allow staff to release to Anita the
City's $3 million dollars when all other conditions for the close
of escrow are met.

Staff recommends that the City Council approve the issuance and
recordation of a Certificate of Completion for the Mall
improvements pursuant to the Easement Purchase Agreement subject to

We, Mary Young, Mayor and June Alford, Clerk of the City of Arcadia
(the "City) hereby certify as follows:
By its Minute Order, adopted and approved September 20, 1994, the
City has resolved as follows:
Section 1. The improvements to be constructed in accordance
with that certain Easement Purchade Agreement (the "Agreement")
dated January 19, 1993 , between the City and Anita Associates, a
California limited partnership (the "Developer") , on that certain
real property (the "Property") more fully described in Exhibit "A"
attached hereto and incorporated herein by this reference, have
been completed in accordance with the provisions of the Agreement.
These improvements are: construction of 146, 000 square feet
Nordstrom store, 8.2 acre surface parking lot, and related roadway
improvements.
Section 2 . This Certificate of Completion shall constitute a
conclusive determination of satisfaction of the Agreements and
covenants contained in the Agreement with respect to the
obligations of the Developer, and its successors and assigns, to
construct and develop the improvements on the Property, excluding
any normal and customary tenant improvements, and including anyiand
all buildings and any and all parking, landscaping and related
improvements necessary to support or which meet the requirements
applicable to the construction and its use and occupancy onIthe
Property, all as described in the Agreement, and to otherwise
comply with the Developer's obligations under the Agreement with
respect to the Property and the dates for the beginning and
completion of the construction of improvements thereon under the
Agreement; provided, however, that the City may enforce any
covenant surviving this Certificate of Completion in accordance
with the terms and conditions of the Agreement and the Fifteen year
Easment Grant Deed (as defined in the Agreement) . The Agreement is
an official record of the City and a copy of said Agreement may be
inspected in the office of the Secretary of the City located at the
City Hall, 240 West Huntington Drive, Arcadia, CA 91007, during
regular business hours.
Section 3 . The Property to which this Certificate of
Completion pertains is more fully described in Exhibit "A" attached
hereto.

SUMMARY
Agency Resolution 172 adopted January 19, 1993 does not permit a gun shop in the
downtown project area. Mr. Gulbeyan, Sr. is requesting a waiver of the prohibition
in order to obtain a business license to operate a gun shop/jewelry shop at 50 E.
Huntington Drive, a vacant retail store to the west of Home Savings.
Staff is recommending approval of this request.
BACKGROUND
•
In January 1993, the City Council/Redevelopment Agency was considering a
comprehensive downtown revitalization strategy and program. A list of inappropriate
land uses and a statement on design criteria were prepared by staff for the City
Council/Redevelopment Agency.
ARA Resolution 172 was the formal document which proposed to establish land uses
and design-requirements. (A summary of prohibited uses and ARA 172 are provided
as Exhibit 1). The purpose of the Resolution was to encourage high quality retail
outlets and stores in the downtown project area and to discourage incompatible and
non-harmonious uses. Further,the Agency through this resolution desired to eliminate
or prevent inappropriate uses which might detract from the market acceptance and
image of the downtown project area. It was intended as an interim land use control
pending completion of the downtown precise plan and revitalization program. A
waiver provision was provided as an "escape clause". Following a public hearing the
Agency adopted the Resolution.

Mr. Gulbeyan states that he formerly operated a gunsmith/jewelry store used by local
police officers and the public at 602 E. Live Oak. He wants to locate his business in
the downtown, because he believes that the downtown is going to revitalize. His
letter requesting a waiver of the requirements of ARA 172 is attached (Exhibit 2).
With the continuing economic recession through 1993 and 1994, and the need for
additional retailers in the downtown, staff feels that Mr. Gulbeyan's request for a gun
shop/jewelry shop should be approved.
•
The Planning staff is now preparing for a review and update of the City's General
Plan. During this process staff will be working with the Planning Commission and
City Council/ Redevelopment Agency on a reanalysis of these prohibited land uses.
In the meantime, these requests will be considered on a case by case basis.
Mr. Gulbeyan has received a complete copy of Resolution 172. He will be present at
the meeting to address the Agency.
FISCAL IMPACT
Increased revenues to the City from business license fees and sales taxes.
RECOMMENDATION
That the Agency approve a waiver from ARA 172 for Mr. Gulbeyan's request for a
gun shop/jewelry shop at 50 E. Huntington Drive.

A RESOLUTION OF THE ARCADIA REDEVELOPMENT AGENCY
ESTABLISHING USE AND DESIGN REQUIREMENTS AND GUIDELINES
WHEREAS, the Arcadia Redevelopment Agency (the "Agency") has
expended over $30, 000, 000 to redevelop the area (the "Project
Area") subject to the Redevelopment Plan for the Central
Redevelopment Project (the "Redevelopment Plan") ; and
WHEREAS, the City of Arcadia (the "City") has expended over
$1, 000, 000 in Community Development Block Grant, Gas Tax, Lighting
Maintenance District, Sewer Fund, Proposition A, SB 821 and General
Fund monies and proposes to spend an additional $1, 100, 000 over the
next three years to revitalize the downtown Project Area; and
WHEREAS, in order to eliminate blight and to meet the policies
and objectives of the Community Redevelopment Law of the State of
California (the "Redevelopment Law") within the Project Area, both
the Agency and the City desire to encourage and facilitate the
establishment and growth of high quality retail outlets, stores and
restaurants, professional office uses and industrial uses in the
Project Area, and to discourage unattractive, incompatible and non-
harmonious uses, materials, colors, lights, signs, landscaping,
architectural designs and treatment; and
WHEREAS, certain inappropriate uses exist or might otherwise
be permitted in the Project Area which cause blight or detract from
the reputation, market acceptance, security, attractiveness and
image of the Project Area, and are not consistent with the policies
and objectives of the Redevelopment Law; and

• WHEREAS, certain unattractive and non-harmonious architectural
design styles, materials and colors exist or might otherwise be
permitted in the Project Area which detract from or conflict with
existing, new or rehabilitated buildings, the policies and
objectives of the Redevelopment Law, and standards set forth in the
City's Design Review Ordinance; and
WHEREAS, in accordance and consistent with Sections 301 (6) ,
410 through 413, 416 through 420, 424, 427, and 600 of the
Redevelopment Plan, and in order to eliminate blight, to enable the
Agency to concentrate and develop signific _ redevelopment
projects and uses which are needed in the Project Area and in the
City, and to facilitate the achievement of adequate revenue for the
City, the Agency now desires to establish and adopt requirements
and guidelines pertinent to uses and development standards within
the Project Area; and
WHEREAS, the Agency has published notice of, and has conducted
a public hearing concerning the adoption of such requirements and
guidelines, pursuant to section 424 of the Redevelopment Plan, and
has duly considered all evidence and testimony submitted to the
Agency at the public hearing; and
WHEREAS, the Arcadia Redevelopment Agency has adopted a
program Environmental Impact Report ("EIR") on November 20, 1973 a
the time of the establishment of the project area, and has adopted
a program EIR on May 5, 1981 at the time of the amendment of land
uses east of Second Avenue to (Commercial) Planned Development, and
the City Council ham adopted a Negative Declaration on June 17,
1986 for Ordinance No. 1883, a zone change adopting architectural
and land use standards for a portion of the Central Redevelopment
Project Area, and an initial study has been prepared on the
proposed adoption of this Resolution and a Negative Declaration
prepared.
NOW THEREFORE, THE ARCADIA REDEVELOPMENT AGENCY OF THE CITY OF
ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The Agency finds that the Use and Design
Requirements and Guidelines (the "Guidelines") attached hereto as
Exhibit "A" and incorporated herein by reference, are reasonable
and necessary in order to eliminate blight and to facilitate and
encourage the policies and objectives of the Redevelopment Law. In
particular, the Agency finds that without the Guidelines, there
will likely be developed in the Project Area uses incompatible with
high quality office, restaurant and retail centers and industrial
facilities, and structures which create a haphazard and
inconsistent mix of architectural design, all o=_ which promote
blight and discourage investment in real property and redevelopment
activities. The Agency further finds that the needs of the
community would be adequately served by the location of certain
uses, described in the Guidelines as inappropriate for the Project
Area, in other more suitable areas within the City, since (a) the
Project Area constitutes merely a small area within the City, (b)
other areas within the City generally do not contain the blighted
conditions which caused the need for adoption of the Redevelopment
Plan for the Project Area, and (c) there is sufficient demand from
residents, businesses and community organizations in other areas of
the City for such uses to be located in those areas. The Agency

further finds that the uses described in the Guidelines as
inappropriate for the Project Area do not constitute uses which
would facilitate development of integrated, high quality office
complexes and retail centers, and that many of such uses would be
incompatible with existing structures and desired redevelopment
projects due to the appearance, traffic, noise, glare, smoke, or
similar factors typically associated with such uses.
SECTION 2. The Agency hereby approves and adopts the
Guidelines, and requires that any and all development,
redevelopment, and rehabilitation, repair, alteration, construction
or reconstruction of structures within the Project Area be
undertaken and completed in conformity with the Guidelines. A copy
of the Guidelines shall be forwarded by the Agency Secretary to the
City's Planning Department and Business License office in the
Finance Department for their reference and use in considering
applications for permits and approvals pertinent to the Project
Area.
SECTION 3 . This Resolution shall take effect upon adoption.

FOR THE
CENTRAL REDEVELOPMENT PROJECT AREA ("PROJECT AREA")
Statement of Policy
1. These Use and Design Requirements and Guidelines are intended
to supplement and clarify the City of Arcadia General Plan,
the Arcadia Municipal Code, in particular Article IX - Zoning
Ordinance, the Redevelopment Plan for the Central
Redevelopment Project, as each may be amended from time to
time and the Agency's Design Review regulations (ARA
Resolution 13) .
2 . The Agency desires and intends to encourage construction of
new and rehabilitation of existing buildings to include
attractive quality high end retail stores and restaurants, as
well as professional offices and industrial buildings. These
buildings and facilities should be constructed of attractive,
quality, durable materials, architecturally designed and
constructed to be compatible and harmonious with the downtown,
with ample landscaping using preferably mature flora and
shielded lighting (as appropriate) .
3 . The Agency desires and intends to discourage and reject uses
and architectural elements such as incompatible,
inappropriate, or non-harmonious signage, colors, materials,
building size or mass, accessories, architectural styles or
treatments, etc. which are of themselves unattractive or
blighting or tend to induce a blighting influence in the area
as shown by an increase in illegal and/or unattractive
signage, economically marginal uses, unusual security systems,
criminal activity, increased vehicular traffic resulting in
traffic violations, accidents and illegal parking.
Inappropriate Uses
Inappropriate uses in the project area, which the Agency will
generally not approve, include the following and anything which the
Agency determines to be similar in character:
- pawn shops
- flea market or second hand "swap meet" or surplus stores
- second hand or used merchandise stores
- antique stores, if merchandise is less than 100 years old
- laundromats
- thrift stores
- bail bonds offices
- dance studios/halls
- karaoke bars or halls
- modeling agencies
- palmistry, fortune telling
- astrology, psychic

Desirable Architectural Design Styles
The ' Agency will generally approve only the following design
elements: the use of red or brown brick or wood with base and
accent colors consistent with the Downtown. Revitalization
Ordinance.
Other design elements, architectural treatment and colors may be
permitted by the Agency if the proposed development or building
offers some unique amenities or benefit to the community and the
downtown area.

Inaoorocri-ate Architectural Design Styles
Inappropriate design, which the Agency will not permit, includes
without limitation domes, minarets, windmills, exterior stairways
or hotel room access, intermixed and incompatible or non-harmonious
architectural styles/designs on one building or one site, buildings
predominantly of reflective glass, buildings out of character and
inconsistent with other buildings in the downtown, including
landscaping.

Notwithstanding the above, the Agency in its reasonable discretion
may, for a building or project of unusual economic significance or
potential positive architectural impact, approve a variation for,
waive or modify the above Use and Design Guidelines.
Existing non-conforming uses will generally ;continue to be
permitted subject to the Arcadia Municipal Code and the
Redevelopment Plan. If any existing inappropriate use is abandoned
or discontinued for a period of 90 days, any rights under these
Guidelines shall terminate.
Increased Intensity of Uses
The land in the areas bounded by W. Huntington, Santa Anita and
Santa Clara, and the land bounded by E. Huntington, the AT & SF
railroad tracks, N. Second and Santa Clara is in the .heart of the
redevelopment project area. As such, they have high visibility
from surface, freeway and rail traffic and therefore have an
unusual impact on the future development of their immediate area,
the entire downtown project area, and the City's overall image and
reputation. Therefore, the Agency desires and intends this land be
developed for more intense and attractive commercial uses than
permitted under the existing zoning, including but not limited to
