SUBJECT: RESOLUTION NO. 7048 ORDERING THE VACATION OF A PUBLIC
UTILITY EASEMENT THAT WAS PREVIOUSLY RETAINED IN THE
VACATION OF FRONT STREET FOR THE CONSTRUCTION OF THE
METRO GOLD LINE FOOTHILL EXTENSION RAIL PROJECT
Recommendation: Adopt
RESOLUTION NO. 7049 ACCEPTING THE REAL PROPERTY IN FEE
FOR THE ARCADIA TRANSIT PLAZA AND AN EASEMENT FOR
MAINTENANCE PURPOSES ON A STRIP OF LAND OWNED BY MTA
ADJACENT TO THE TRANSIT PLAZA

SUMMARY
In the early stages of planning for the Metro Gold Line Foothill Extension, the Metro
Gold Line Foothill Extension Authority ( "Authority ") identified an unusable parcel of land
adjacent to the proposed Arcadia Station parking structure and offered it to the City for a
transit - related use. In early 2012, the City Council approved the concept of a City -
owned transit plaza at this location and directed staff to pursue a preliminary design. In
September 2013, the City Council approved the vacation of Front Street for the
construction of the parking structure and Transit Plaza. At that time, the City retained a
Public Utility Easement ( "PUE ") over the vacated street because utility lines from
Southern California Edison and AT &T were still in the right -of -way. Shortly after the
City's action, all utilities were removed from the PUE and the Authority's contractor
began construction of the parking structure and the Transit Plaza.
As the Transit Plaza construction nears completion, the Authority is requesting several
actions to clear the title to the property and establish the permanent ownerships and
maintenance responsibilities as follows:
• Vacate the PUE over the vacated Front Street

• Accept an offer of real property in fee for the Transit Plaza
• Accept an offer of an easement for a 12.5 -foot wide strip of land at the west edge
of the Transit Plaza for maintenance, with ownership to be retained by Metro.
It is recommended that the City Council adopt the Resolutions for the vacation and the
acceptance.
BACKGROUND
The Authority is responsible for the construction of the Metro Gold Line Foothill
Extension, Phase 2A, from Pasadena through Azusa, and has the authority to act on
behalf of Los Angeles County Metropolitan Transportation Authority ( "Metro "), the
eventual owner, on all construction matters, including land transactions. During the
early planning stages of the Gold Line Project, the Authority, in cooperation with the City
of Arcadia, selected the location of the parking facility for the Arcadia station to be on
Santa Clara Street just west of First Avenue. The site was selected because of its close
proximity to the proposed station and the majority of the land was owned by either
Metro or the City of Arcadia (Front Street). Because of its irregular shape, the easterly
triangular portion was determined to be unusable for a parking facility and was offered
to the City of Arcadia for a transit - related use. (See the Arcadia Station Site Plan
attached.)
In April 2012, the idea of a City -owned and maintained transit plaza was presented to
the City Council. The City Council approved the concept and gave direction to pursue a
preliminary design. AHBE Landscape Architects was hired to prepare several
alternative concepts. During this period, grant funding was obtained from two sources:
Metro's Call- for - Projects Program, and the Federal Transit Administration's
Transportation Enhancements Program through the Gold Line Authority. In October
2012, the City Council approved the preliminary design for the Transit Plaza and the
City's share of the funding to match the Metro and FTA grants. (See the Transit Plaza
Rendering attached.)
In early 2013, the Authority selected WebCor/Watry to design and construct all Phase
2A parking facilities and station area enhancements, which included the Arcadia parking
structure and Transit Plaza.
In September 2013, at the request of the Authority, the City Council approved the
vacation of Front Street for the construction of the parking structure and Transit Plaza.
At that time, the City retained a Public Utility Easement (PUE) over the vacated street
because utility lines from Southern California Edison and AT &T were still in place.
Since that time, all utilities have been removed from the PUE and the construction of the
parking structure and the Transit Plaza has commenced.

DISCUSSION
The Authority has notified the City that all utilities have been removed from the PUE and
that the utility companies consent to the vacation of the PUE. The Authority requests
that the PUE be vacated to clear the title to the property. Resolution No. 7048 has been
prepared for the vacation of the PUE, which is in accordance with Chapter 4 of Part 3 of
Division 9 of the Streets and Highways Code of the State of California (Streets and
Highways Code Section 8334.5, et seq.)
As the Transit Plaza construction nears completion, the Authority also requests that the
City accept the transfer of land for ownership and maintenance. Resolution No. 7049
has been prepared for the acceptance of the Transit Plaza land conveyance. The
Authority proposes to convey the Transit Plaza in two parcels. The majority of the plaza
is conveyed to the City in fee as described on Exhibits IA" and I B" to the resolution.
The balance of the Transit Plaza, the westerly strip of land, 12.5 feet wide, is conveyed
to the City as an easement, as described on Exhibits "2A" and "213" to the resolution,
over land retained by Metro. The reason for Metro retaining ownership is because the
land is directly adjacent to the parking structure (owned by Metro) and contains critical
elements such as structural footings and utilities. The City will have the right to operate
and maintain the Transit Plaza on this parcel as long as the City's actions do not
interfere or conflict with Metro's purpose.
As part of the conveyance of the parcel in fee, Metro proposes to retain an easement
over the westerly strip of land, 17.5 feet wide, as described on Exhibits "3A" and "313" to
the resolution, for storm drainage purposes. The Authority installed an underground
drainage structure in the easement area to capture and dispose of drainage from the
parking structure. Since this is an integral part of the parking structure function, it is
Metro's maintenance responsibility, and thus the easement is retained for that purpose.
All of these parcels are identified in the Land Conveyance Diagram attached.
ENVIRONMENTAL ANALYSIS
The proposed PUE vacation and the acceptance of the real property and easement are
categorically exempt from the California Environmental Quality Act (CEQA) pursuant to
Section 15301(c) because the actions consist of a legal transfer of ownership, which will
result in negligible or no expansion of use beyond the project analyzed in the EIR,
adopted in 2007 for the Metro Gold Line Extension

FISCAL IMPACT
In accordance with the City's Cooperative Agreement with the Authority, the vacation
process is to be administered by the City at no cost to the Authority. The land transfer
to the City is at no cost to the City.
RECOMMENDATION
It is recommended that the City Council:
a. Adopt Resolution No. 7048 ordering the vacation of a public utility easement that
was previously retained in the vacation of Front Street for the construction of the
Metro Gold Line Foothill Extension Rail Project; and
b. Adopt Resolution 7049, accepting the real property in fee for the Arcadia Transit
Plaza and an easement for maintenance purposes on a strip of land owned by
MTA adjacent to the Transit Plaza.

RESOLUTION NO. 7048
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA ORDERING THE VACATION OF A
PUBLIC UTILITY EASEMENT THAT WAS PREVIOUSLY
RETAINED IN THE VACATION OF FRONT STREET FOR
THE CONSTRUCTION OF THE METRO GOLD LINE
FOOTHILL EXTENSION PROJECT
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council finds as follows:
A. On September 17, 2013, a Public Hearing was duly held in the Arcadia City
Hall Council Chamber, at which time the City Council of the City of Arcadia ( "City Council ")
received all comments and evidence offered by persons interested in the proposed
vacation of Front Street.
B. As a result of the hearing, the City Council found from all evidence submitted
that Front Street was unnecessary for present or prospective public use and, therefore,
adopted Resolution No. 6989 ordering Front Street to be vacated.
C. As part of the vacation, the City Council found that pursuant to the Streets
and Highways Code Section 8340 and 8341, the public convenience and necessity
required the reservation and exception of a Public Utility Easement from the vacation.
D. Subsequent to the City Council's action, all utilities previously located in the
public utility easement were relocated outside the easement, and the easement area is
now clear of any utility conflicts.
SECTION 2. As a result of the foregoing, the City Council finds from all evidence
submitted that the Public Utility Easement retained in the previously vacated Front Street,
as described in Exhibit "A" and "B ", is unnecessary for present or prospective public use

and, therefore, the City Council hereby orders the Public Utility Easement to be vacated.
SECTION 3. The City Council does further find that the vacation of the Public Utility
Easement is being made in accordance with Chapter 4 of Part 3 of Division 9 of the Streets
and Highways Code of the State of California (Streets and Highways Code Section 8334.5,
et seq.)
SECTION 4. Pursuant to Section 15061(b)(3) of the California Environmental
Quality Act (CEQA), the proposed vacation is covered under the general rule that CEQA
applies only to projects that have a potential for causing a significant effect on the
environment. Where it can be seen with certainty that the activity will not have a significant
effect on the environment, a Notice of Exemption is sufficient. Therefore, a Notice of
Exemption shall be filed with the County Clerk of the County of Los Angeles.
SECTION 5. The City Clerk of the City of Arcadia shall certify to the adoption of this
Resolution and shall cause a certified copy thereof to be recorded without
acknowledgement, certificate of acknowledgement, or further proof in the Office of the
County Recorder of Los Angeles County after the aforementioned conditions have been
satisfied.

THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY
FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. The City Council finds as follows:
A. On September 17, 2013, the City Council of the City of Arcadia found from all
evidence submitted that Front Street was unnecessary for present or prospective public
use and, therefore, adopted Resolution No. 6989 ordering Front Street to be vacated.
B. As a result of the vacation, the Metro Gold Line Foothill Extension Authority
( "Authority ") took ownership of the vacated street for the purpose of constructing a parking
structure and transit plaza as part of the Metro Gold Line Foothill Extension Project.
C. The Authority and the City of Arcadia ( "City ") have agreed that both parties
will share the cost of construction of the Transit Plaza; the Authority will be responsible for
the construction of the Transit Plaza; and the City will take ownership and be responsible
for the maintenance.
D. The Authority wishes to retain an easement on the Transit Plaza, over the
westerly 17.5 feet, for the benefit of installation, operation, maintenance and improvement
of underground drainage facilities.
E. The Authority and the City have also agreed that the City will maintain a strip
of land, 12.5 feet wide, adjacent to the transit Plaza and improved consistent with the
Plaza, as an easement granted by the Authority to the City.
F. The Construction of the Transit Plaza is nearly complete and the Authority
wishes to offer the real property in fee, as described in Exhibit 1A and 1 B, and the adjacent
easement, as described in Exhibit 2A and 28, to the City of Arcadia for the Transit Plaza,
and retain an easement on the Transit Plaza, as described in Exhibit 3A and 3B for
drainage purposes.
G. The City hereby accepts the offer the real property in fee, as described in
Exhibit 1A and 1 B, and the adjacent easement, as described in Exhibit 2A and 2B, for the
Transit Plaza.
SECTION 2. Pursuant to Section 15061(b)(3) of the California Environmental
Quality Act (CEQA), the proposed offers of land and easement are covered under the
