Dear Mr. Berrios:
At its February 25, 2014 meeting, the Modification Committee voted 3-0 to
conditionally approve Modification No. MC 13-27 & Admin. Architectural Design
Review No. Admin. ADR 14-14, subject to the following conditions:
1. The property owner/applicant shall file a covenant in a form approved by
the City Attorney, requiring that the accessory dwelling unit shall not be sold
independently of the main dwelling unit and parcel.
2. The property owner/applicant shall defend, indemnify, and hold harmless
the City of Arcadia and its officials, officers, employees, and agents from
and against any claim, action, or proceeding against the City of Arcadia, its
officials, officers, employees or agents to attack, set aside, void, or annul
any approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval or
conditional approval of the City Council, Planning Commission, Modification
Committee, or City Staff, which action is brought within the time period
provided for in Government Code Section 66499.37 or other provision of
law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or
land use decision and the City shall cooperate fully in the defense of the
matter. The City reserves the right, at its own option, to choose its own
attorney to represent the City, its officials, officers, employees, and agents
in the defense of the matter.
3. Approval of MC 13-27 and Admin. SFADR 14-14 shall not be of effect
unless on or before 30 calendar days after approval of this project, the
property owner/applicant has executed and filed with the Community
Development Administrator an Acceptance Form available from the
Development Services Department to indicate awareness and acceptance
of these conditions of approval.
There is a five (5) working day appeal period for this application. The decision is
not effective until Wednesday, March 5, 2014, provided the Committee's action is
not appealed. An appeal must be submitted in writing to the Community
Development Division with the $540.00 appeal fee by 5:30 p.m. on Tuesday,
March 4, 2014. If an appeal is filed, you will need to provide fifteen (15) sets of
plans.
The approval granted by this application shall expire one year (March 5, 2015)
from the effective date unless the project is completed or the approval is
renewed.

The actual project must be consistent with the action of the Modification Committee. Any
deviation from the Committee's action shall be subject to review and approval by the
Community Development Administrator and may require a new application and another
public hearing.
