Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification or accommodation
in order to participate in a meeting, including auxiliary aids or services, may request such modification or accommodation from Planning
Services at 626-574-5423. Notification 48 hours prior to the meeting will enable the City to make reasonable arrangements to assure
accessibility to the meeting.

Each speaker is limited to five (5) minutes per person, unless waived by the Modification
Committee. Under the Brown Act, the Members are prohibited from discussing or taking action
on any items not listed on the posted agenda.
PUBLIC HEARING
You are hereby advised that should you desire to legally challenge in court any action taken by
the Modification Committee regarding any Public Hearing item, you may be limited to raising only
those issues and objections you or someone else raised at the public hearing or in written
correspondence delivered to the Modification Committee at, or prior to, the public hearing.
1. Modification No. MC 14-14 and Single-Family Architectural Design Review
No. SFADR 14-66

Applicant: Simon Lee, Architect
PROJECT DESCRIPTION: The applicant is requesting a Modification to allow a 25’-0”
street side yard setback in lieu of the 35’-0” special
setback required for this portion of Fourth Avenue for a
new 4,368 square-foot, two-story, traditional style
residence with a 432 square-foot two-car garage.
ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15305 of the
CEQA Guidelines for minor alterations in land use limitations.
Any writings or documents provided to a majority of the Modification Committee regarding any item on this agenda will
be made available for public inspection in the City Clerk’s office located at 240 W. Huntington Drive, Arcadia, California,
during normal business hours.
Conditionally approved 3-0, subject to the following conditions:
1. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials,
officers, employees, and agents from and against any claim, action, or proceeding against
the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or
annul any approval or conditional approval of the City of Arcadia concerning this project
and/or land use decision, including but not limited to any approval or conditional approval of
the City Council, Planning Commission, Modification Committee, or City Staff, which action is
brought within the time period provided for in Government Code Section 66499.37 or other
provision of law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or land use decision
and the City shall cooperate fully in the defense of the matter. The City reserves the right, at
its own option, to choose its own attorney to represent the City, its officials, officers,
employees, and agents in the defense of the matter.
2. Approval of MC 14-14 and SFADR 14-66 shall not be of effect unless on or before 30
calendar days after approval of this project, the property owner/applicant has executed and
filed with the Community Development Administrator or designee an Acceptance Form
available from the Development Services Department to indicate awareness and acceptance
of these conditions of approval.
2. Healthy Oak Tree Removal Permit Application No. TRH 14-04

Applicants: Robert and Margaret Lihani
PROJECT DESCRIPTION: The applicant is requesting a permit for the removal of
three healthy Coast Live Oak trees and encroachment
upon one oak tree to accommodate future development
of a new residence.
ENVIRONMENTAL DETERMINATION: Categorically Exempt per Section 15304 of the
CEQA Guidelines for minor alterations to the land.
Conditionally approved 3-0, subject to the following conditions:
1. This approval shall expire in one year from the effective date. The three (3) healthy Coast
Live Oak trees shall not be removed until the design of the new residence has been
approved by the Santa Anita Oaks Homeowners Association and the Modification
Committee; the City has approved the Certificate of Demolition to demolish the existing
house; and an Oak Tree Encroachment Permit for any development improvements under the
dripline of all the oak trees have been approved.
2. A Certified Arborist shall supervise the planting of four 72-inch box Coast Live Oak or
Engelmann Oak trees on the subject property: two in the front yard area and two in the rear
yard area. The Certified Arborist shall submit a follow-up report to Planning Services to verify
fulfillment of this condition.

APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to
the Planning Commission within five (5) working days of the decision. Appeals are to be
filed by 5:30 p.m. on Thursday, November 20, 2014. If no appeal is filed, decisions are
final.
ADJOURNMENT
The Modification Committee will adjourn this meeting to November 25, 2014, at 7:45 a.m. in the
City Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia.
