SUBJECT: RESOLUTION NO. 1923 – APPROVING CONDITIONAL USE PERMIT
NO. CUP 14-06 AND ARCHITECTURAL DESIGN REVIEW NO. ADR 14-
17 WITH A CATEGORICAL EXEMPTION UNDER THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT (CEQA) FOR A NEW 3,372 SQUARE-
FOOT SANCTUARY BUILDING AT AN EXISTING CHURCH AT 23 W.
FOOTHILL BOULEVARD
Recommendation: Adopt Resolution No. 1923
SUMMARY
The applicant, Emmanuel Assembly Church of God is proposing to construct a new
3,372 square-foot sanctuary building at their existing church. The proposed project is
subject to approval of a Conditional Use Permit to amend the layout and operations of
the existing church, and Architectural Design Review approval of the new building.
Construction of a new structure of less than 10,000 square-feet in floor area is exempt
from the California Environmental Quality Act (CEQA). It is recommended that the
Planning Commission approve the proposed project, subject to the conditions listed in
this staff report, and adopt Resolution No. 1923 (Attachment No. 1).
BACKGROUND
The subject site consists of two parcels developed with a 5,513 square-foot, two-story
church and administrative building, and 70-space surface parking lot. The church and
administrative building consist of a sanctuary, lobby, offices, classrooms, restrooms,
and a pastor’s living quarters. The westerly parcel of the church site is zoned R-0-
30,000, and the easterly parcel is zoned C-2, General Commercial – see Attachment
No. 2 for an Aerial Photo with Zoning Information. The existing church was originally
constructed in 1963, and the two-story administrative portion of the building was added
in 1974 through CUP 74-19 (Resolution No. 868 – see Attachment No. 3). A list of
current activities at the church is shown on Attachment No. 4.
PROPOSAL
The church proposes to construct a new 3,372 square-foot sanctuary – see Attachment
No. 5 for the architectural plans. The existing 5,513 square-foot church and

administrative building are proposed to remain, along with a small, detached storage
building at a rear corner of the property. The existing sanctuary will be repurposed as a
fellowship hall for receptions, meetings, classroom activities, and other uses as shown
in Attachment No. 4. Adjustments are proposed to the existing parking lot to
accommodate the new building, and to comply with current accessibility requirements
and current parking standards. These adjustments will result in 55 parking spaces on
site.
The new building is designed to be architecturally compatible with the style and
materials of the existing church and administrative building. As part of the project, the
existing building will be repainted to match the color palette of the new sanctuary.
ANALYSIS
The proposed new sanctuary will be used for weekend church services, and is similar in
size to the existing sanctuary, which will be repurposed as a fellowship hall for other
church-related activities. Because these other activities will occur at different times than
the weekend church services, the parking demand for the church will not change.
Attachment No. 4 is a list of the church activities.
As part of their applications, the church conducted an informal parking survey during
weekend services, which found the current parking usage ranges between 25 and 40
spaces. The City’s parking requirements for churches and other assembly uses is one
parking space for every 28 linear feet of bench area; one parking space for every 35
square-feet of area with non-fixed seating; and one parking space per five (5) fixed
seats. For the existing sanctuary building that will be repurposed to a fellowship hall,
and the new proposed sanctuary, this calculates to a combined parking requirement of
53 spaces. Based on the applicant’s parking survey, the church’s activities, and the
City’s parking requirements, the 55 on-site parking spaces are sufficient for the new
sanctuary building and the fellowship hall.
Regarding the architecture of the proposed sanctuary, the style and massing of the
building is consistent with the existing church and administrative building. The existing
building will be repainted to match the color palette of the new sanctuary, which features
off-white walls, green doors, and orange and blue accents. The proposal is consistent
with the City’s Design Guidelines, and compatible with the site and surrounding
neighborhood. See Attachment No. 6 for photos of the subject property and
surrounding properties.
FINDINGS
Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use
Permit to be granted, it must be found that all of the following prerequisite conditions
can be satisfied:

1. That the granting of such Conditional Use Permit will not be detrimental to the
public health or welfare or injurious to the property or improvements in such
zone or vicinity.
The existing church has operated at this location since 1963. The proposed
sanctuary building and conversion of the existing sanctuary to a fellowship hall are
consistent with the church use of the property. Because activities within the
fellowship hall and sanctuary will not occur at the same time, and the overall parking
demand is not anticipated to increase, the proposal will not be detrimental to the
public health or welfare or injurious to the other properties in the area.
2. That the use applied for at the location indicated is properly one for which a
Conditional Use Permit is authorized.
The zoning of the parcel at which the sanctuary is proposed is R-0-30,000, a single-
family zone with a minimum 30,000 square-foot lot size. Arcadia Municipal Code
Section 9275.1.43 authorizes churches in a R-0 zone with an approved Conditional
Use Permit.
3. That the site for the proposed use is adequate in size and shape to
accommodate said use, and all yards, spaces, walls, fences, parking, loading,
landscaping, and other features required to adjust said use with the land and
uses in the neighborhood.
The project site is currently developed with a church and administrative building and
a parking lot. The proposed new building will fit comfortably within the site with minor
adjustments made to upgrade the parking lot to comply with current standards, and
upgrade the trash facilities to comply with federal pollution control standards. Based
on the City’s parking requirements for assembly uses and a parking survey
conducted by the applicant, the proposed 55-space parking lot will be sufficient to
accommodate the parking demand of the church and its various activities. As such,
the site is adequate in size and shape to accommodate the new proposed sanctuary
building and conversion of the existing sanctuary to a fellowship hall, and no other
adjustments of the use or site are necessary.
4. That the site abuts streets and highways adequate in width and pavement type
to carry the kind of traffic generated by the proposed use.
The site is located on West Foothill Boulevard with access to its parking lot off of
North Santa Anita Avenue. These streets are adequate in width and pavement type
to carry the traffic generated by the church use and the new sanctuary building will
not impact these streets.
5. That the granting of such Conditional Use Permit will not adversely affect the
comprehensive General Plan.

Approval of the new sanctuary on the westerly parcel of the site is consistent with
the Residential Estate Land Use Designation of this parcel, and the continuation of
the parking lot use on the easterly parcel is consistent with the Commercial Land
Use Designation of this parcel. The proposal will not adversely affect the
comprehensive General Plan.
The architectural design of the proposed new sanctuary is consistent with the existing
church and administrative building. And, all buildings will be painted to match a new
color palette. The proposed design is consistent with the City’s Design Guidelines, and
compatible with the site and surrounding neighborhood.
ENVIRONMENTAL ASSESSMENT
If it is determined that no significant physical alterations to the site are necessary, then
this project, as an addition to an existing facility, qualifies as a Class 3 Categorical
Exemption per the provisions of the California Environmental Quality Act (CEQA)
pursuant to Section 15303 of the CEQA Guidelines for new construction of a structure
of less than 10,000 square-feet in area. A Preliminary Exemption Assessment is
attached to this staff report (Attachment No. 7).
PUBLIC NOTICE
Public hearing notices for this item were mailed to the property owners and tenants of
those properties that are located within 300 feet of the subject property – see
Attachment No. 8 (Radius Map).
RECOMMENDATION
It is recommended that the Planning Commission approve the proposal, subject to the
following conditions, and find that the project qualifies as a Categorical Exemption from
the California Environmental Quality Act (CEQA), and adopt Resolution No. 1923:
1. The existing sanctuary building shall no longer be used for church services
following the issuance of a Certificate of Occupancy for the new sanctuary building,
but is permitted for use as a fellowship hall for receptions, classes, and other
church-related events. No receptions or other large gatherings or events shall occur
in the fellowship hall during weekend church service times.
2. The applicant/property owner shall upgrade the trash enclosure to be fully roofed
prior to issuance of a Certificate of Occupancy for the new sanctuary. The revisions
to the trash enclosure shall be subject to the review and approval of the Community
Development Administrator, or designee.
3. Prior to issuance of a Certificate of Occupancy, the applicant/property owner shall
execute and record a covenant prepared by the City Attorney at the expense of the
applicant/property owner to hold the two parcels of the project site as one.

4. Approval of CUP 14-06 and ADR 14-17 is limited to the existing church, with a new
sanctuary building, and repurposed fellowship hall, all of which shall be operated
and maintained in a manner that is consistent with the proposal and plans
submitted and approved for these applications, and shall be subject to periodic
inspections, after which the provisions of this Conditional Use Permit may be
adjusted after due notice to address any adverse impacts to the adjacent streets,
rights-of-way, and/or the neighboring businesses or properties.
5. Noncompliance with the plans, provisions and conditions of approval for CUP 14-06
and ADR 14-17 shall be grounds for immediate suspension or revocation of any
approvals, which could result in the cessation of church activities.
6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its
officials, officers, employees, and agents from and against any claim, action, or
proceeding against the City of Arcadia, its officials, officers, employees or agents to
attack, set aside, void, or annul any approval or conditional approval of the City of
Arcadia concerning this project and/or land use decision, including but not limited to
any approval or conditional approval of the City Council, Planning Commission, or
City Staff, which action is brought within the time period provided for in Government
Code Section 66499.37 or other provision of law applicable to this project or
decision. The City shall promptly notify the applicant of any claim, action, or
proceeding concerning the project and/or land use decision and the City shall
cooperate fully in the defense of the matter. The City reserves the right, at its own
option, to choose its own attorney to represent the City, its officials, officers,
employees, and agents in the defense of the matter.
7. Approval of CUP 14-06 and ADR 14-17 to allow construction of a new sanctuary
building, repurposing of the existing sanctuary as a fellowship hall, and operation of
a church shall not be of effect unless on or before 30 calendar days after Planning
Commission adoption of the Resolution, the property owner and applicant have
executed and filed with the Community Development Administrator or designee an
Acceptance Form available from the Development Services Department to indicate
awareness and acceptance of these conditions of approval.
PLANNING COMMISSION ACTION
Approval
If the Planning Commission intends to approve this proposal, the Commission should
move to approve Conditional Use Permit No. CUP 14-06 and Architectural Design
Review No. ADR 14-17, stating that the proposal satisfies the requisite findings, and
adopt the attached Resolution No. 1923 that incorporates the requisite environmental,
Conditional Use Permit, and Architectural Design Review findings, and the conditions of
approval as presented in this staff report, or as modified by the Commission.

Denial
If the Planning Commission intends to deny this proposal, the Commission should move
to deny Conditional Use Permit Application No. CUP 14-06 and/or Architectural Design
Review No. ADR 14-17; state the finding(s) that the proposal does not satisfy with
reasons based on the record, and direct staff to prepare a resolution for adoption at the
next meeting that incorporates the Commission’s decision and specific findings.
