HomeMy WebLinkAboutItem 1e - Set Public Hearing for new two-story residence at 211 Monte PlaceG �iFOU.vI��d r 5,a I �, Auguai 5, 119D3 ri STAFF REPORT 0 aity of 41 Development Services Department DATE: December 2, 2014 TO: Honorable Mayor and City Council FROM: Jason Kruckeberg, Assistant City Manager /Development Services Director By: Jim Kasama, Community Development Administrator Thomas Li, Associate Planner SUBJECT: SET A PUBLIC HEARING DATE OF DECEMBER 16, 2014, FOR AN APPEAL OF THE PLANNING COMMISSION DECISION TO DENY AN APPEAL AND UPHOLD THE HIGHLANDS HOMEOWNERS' ASSOCIATION'S ( "HOA ") ARCHITECTURAL REVIEW BOARD'S DENIAL OF THE PROPOSED ARCHITECTURAL CONCEPT PLANS FOR A NEW, TWO STORY RESIDENCE AT 211 MONTE PLACE Recommendation: Set Public Hearing Date SUMMARY The appellant and project designer, Mr. Kurt Von Hatten, filed an appeal of the Planning Commission decision to deny his appeal and uphold the Highlands Homeowners' Association's ( "HOA ") Architectural Review Board's denial of the proposed architectural concept plans for a new, two -story residence at 211 Monte Place. Per Arcadia Municipal Code Section 9292.1.14, the City Council shall set a date for a public hearing of an HOA design review appeal. It is recommended that the City Council set a Public Hearing date of December 16, 2014, for the appeal of the Planning Commission decision. BACKGROUND On October 14, 2014, the Highlands Homeowners' Association's Architectural Review Board (ARB) held a noticed public hearing and denied the proposed architectural design concept plans by a vote of 3 to 0, with 2 members absent, for a new 6,967 square -foot, two -story residence at 211 Monte Place. On October 21, 2014, the project designer, Mr. Von Hatten, filed an appeal of the ARB decision to deny the proposed architectural design concept plans. At its meeting on November 12, 2014, the Planning Commission held a noticed public hearing and denied the appeal and upheld the ARB decision. Denial of a two -story residence at 211 Monte Place December 2, 2014 Page 2 of 2 On November 13, 2014, Mr. Von Hatten filed an appeal of the Planning Commission decision. Pursuant to Arcadia Municipal Code Section 9292.1.14, the City Council shall set a date for a public hearing of an HOA design review appeal to be held within 40 days, which would be on or before Tuesday, December 23, 2014. This appeal can be heard at the next regular City Council meeting on Tuesday, December 16, 2014. RECOMMENDATION It is recommended that the City Council set a Public Hearing date of December 16, 2014, for an appeal of the Planning Commission to deny an appeal and uphold the Highlands Homeowners' Association's Architectural Review Board's denial of proposed the proposed architectural concept plans for a new, two -story residence at 211 Monte Place.
