REVIEW BOARD DENIAL OF THE DESIGN PLANS FOR A NEW, TWO-
STORY RESIDENCE AT 1600 HIGHLAND OAKS DRIVE
Recommendation: Set Hearing Date of January 20, 2015
SUMMARY
On December, 17, 2014, the City received two appeals concerning proposed single-
family homes in the Highlands Homeowners' Association Area. Pursuant to Arcadia
Municipal Code Section 9292.1.14, the City Council shall set a date for public hearings
of design review appeals to be held not less than ten calendar days, nor more than 40
calendar days thereafter. It is recommended that the City Council schedule the public
hearings for the two appeals of the Planning Commission decisions to overturn the
Highlands Homeowners' Association's Architectural Review Board denials of the design
plans for new single-family residences at 29 E. Orange Grove Avenue, and 1600
Highland Oaks Drive, for January 20, 2015. Separate motions are recommended.
BACKGROUND
On November 12, 2014, the Highlands Homeowners' Association's Architectural Review
Board (ARB) held a noticed public hearing for a design review of proposed plans for a
new, one-story residence at 29 E. Orange Grove Avenue. By a vote of three-to-one, the
ARB denied the proposal. The applicant/appellant and project designer, Mr. Robert
Tong, filed an appeal to the Planning Commission of the ARB decision on November
18, 2014. The Planning Commission heard the appeal at its December 9, 2014,

meeting, and voted unanimously to approve the appeal, and overturn the ARB denial.
The Planning Commission decision also included approval of Modifications for the front
yard setback, and an Oak Tree Encroachment Permit.
The design review for 1600 Highland Oaks Drive was initially submitted to the City on
January 21, 2014, at the time when there was not an ARB Chairperson for the
Highlands Homeowners' Association. The applicant made two sets of revisions based
on staff's comments and public input. But, before a decision was made, the ARB
resumed processing design reviews, and this project was turned over to the ARB in
June, 2014. The ARB held a noticed public hearing on September 24, 2014. The
hearing was continued so that the applicant could address the ARB's and neighbors'
concerns. The applicant made several revisions, and the continuance of the hearing
was held on November 19, 2014, and the ARB denied the design review by a vote of
three-to-one. On November 20, 2014, the applicant/appellant and project designer, Mr.
Robert Tong, filed an appeal to the Planning Commission of the ARB decision. The
Planning Commission heard the appeal at its December 9, 2014, meeting, and voted
unanimously to approve the appeal, and overturn the ARB denial. The Planning
Commission decision also included an Oak Tree Encroachment Permit.

RECOMMENDATION
Separate motions are recommended.
It is recommended that the City Council approve the setting of a public hearing date of
January 20, 2015, for the appeal of the Planning Commission decision to overturn the
Highlands Homeowners' Association's Architectural Review Board denial of the design
plans for a new, one-story residence at 29 E. Orange Grove Avenue.
