PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chan, Chiao, Lin and Falzone ABSENT: None SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS Two letters relating to Item 4 and one letter on Item 5 were distributed to the Commissioners. Also five pieces of additional information were delivered earlier by email for Item 8. PUBLIC COMMENTS None PUBLIC HEARINGS 1. Appeal No. HOA 14-06 - An appeal of the Santa Anita Village Homeowners’ Association’s Architectural Review Board’s design review denial for a new residence at 1122 Drake Road. The applicant/appellant is requesting a continuance to January 27, 2015. Applicant/Appellant: Jack Ng, Designer Mr. Kasama introduced the item and explained that the applicant has requested a continuance to January 27, 2015. Chairman Falzone opened the public hearing. There being no one present to testify at this meeting, the Chairman asked for a motion to continue the hearing to January 27, 2015. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao, to continue the public hearing to January 27, 2015. ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None The Planning Commissioners were asked to hear Items 7 and 8 next and they agreed. 12-9-14 7. Appeal No. HOA 14-05 – Appeal of the Highlands Homeowners’ Association’s Architectural Review Board’s denial and consideration of Modification No. MP 14-21 and Oak Tree Encroachment Permit No. TRE 14-65 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new one-story, 6,522 square-foot, single-family residence at 29 E. Orange Grove Avenue. Applicant/Appellant: Robert Tong, Designer Mr. Kasama introduced the item. Assistant Planner, Jordan Chamberlin, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant/appellant would like to speak on this item. Mr. George Voight and Mr. Josh Grohs, the developers, responded. Chairman Falzone asked if anyone wanted to speak in support of the project and Mr. Mike McKay, a neighbor, responded. Chairman Falzone asked if anyone from ARB wanted to speak. Ms. April Verlato and Mr. John Uniack responded. Chairman Falzone asked if anyone would like to speak in opposition to this item. Mr. Voight and Mr. Grohs responded. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Baerg, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Lin, to approve Appeal No. HOA 14-05, and approve Modification No. MP 14-21 and Oak Tree Encroachment Permit No. TRE 14-65 and the Categorical Exemption, subject to the findings and conditions in the staff report. Appeal No. HOA 14-07 – Appeal of the Highlands Homeowners’ Association’s Architectural Review Board’s denial and consideration of Oak Tree Encroachment Permit No. TRE 14-77 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new two-story 6,149 square-foot, single-family residence at 1600 Highland Oaks Drive. Applicant/Appellant: Robert Tong, Designer Mr. Kasama introduced the item. Associate Planner, Tom Li, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant/appellant would like to speak on this item. Approval of Modification No. MC 14-12 and Architectural Design Review No. ADR 13-42 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new four story, 15,614 square-foot, contemporary style medical office and retail building at 205 N. Santa Anita Avenue. Applicant: Norberto Nardi, Architect Mr. Kasama introduced the item. Assistant Planner, Nick Baldwin, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant would like to speak on this item. Mr. Norberto Nardi, project architect responded Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chan, seconded by Commissioner Chiao, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao to approve Modification No. MC 14-12 and Architectural Design Review No. ADR 13-42 and the Categorical Exemption, subject to the findings and conditions in the staff report, with some landscaping to be added along the frontage along Santa Anita Avenue and the amount of landscaping should satisfy the 10% requirement. Resolution No. 1928 – Approving Tentative Parcel Map No. TPM 14-13 (71492) with a Categorical Exemption under the California Environmental Quality Act (CEQA) to subdivide a 1.88 acre parcel into two lots at 57 Wheeler Avenue and 125 N. First Avenue. Applicant: DPP Arcadia, LLC Mr. Kasama introduced the item. Planning Services Manager, Lisa Flores, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant would like to speak on this item. Ms. Alicia Barkley, DPP Arcadia, responded. MOTION It was moved by Commissioner Baerg, seconded by Chairman Falzone, to approve Tentative Parcel Map No. TPM 14-13 (71492) and the Categorical Exemption, subject to the findings and conditions in the staff report, and to adopt Resolution No. 1928. Appeals are to be filed by 4:30 p.m., on Friday, December 19, 2014. 4. Resolution No. 1927 – Approving Conditional Use Permit No. CUP 13-18 and Oak Tree Encroachment Permit No. TRE 14-49 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new wireless communication facility with a 50’-0” tall monopole antenna structure camouflaged as an elm tree and a 230 square-foot, 12’-6” tall equipment shelter with a gravel access road and underground utility installations that will encroach upon four oak trees at the northeast corner of the Santa Anita Racetrack property, 285 W. Huntington Drive. Applicant: AT&T Mobility Mr. Kasama introduced the item. 12-9-14 Associate Planner, Tim Schwehr, presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant would like to speak on this item. Ms. Brittany Pell and Ms. Terry Cresenti of AT&T responded. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Baerg to deny Conditional Use Permit No. CUP 13-18 and Oak Tree Encroachment Permit No. TRE 14-49 and for staff to prepare a Resolution for adoption at the next meeting that incorporates the Commission’s decision and findings. A Resolution will be presented at the next Planning Commission meeting. 5. Appeal of the conditional approval of Single-Family Architectural Design Review No. SFADR 13-128 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new two-story, 6,700 square-foot, single-family residence at 2110 S. Baldwin Avenue. Applicant: Joanna Lee of Creative Design Associates, Designer Appellant: David and Victoria Law, property owners at 642 W. Longden Avenue Mr. Kasama introduced the item. ROLL CALL AYES: Commissioners Baerg, Chiao, Lin and Falzone NOES: None ABSTAIN: Commissioner Chan MATTERS FROM COUNCIL LIAISON Nothing to report FROM PLANNING COMMISSIONERS Commissioner Chan reported on the question of trash pick-up and absentee landlords. He said that Waste Management will pick up and return up to three trash cans for a monthly charge and will provide this service for the disabled at no cost if the disability exception is approved by City Hall. MATTERS FROM MODIFICATION COMMITTEE Commissioner Lin reported that the Modification Committee approved Modification No. MC 14-13 and Single-Family Architectural Design Review No. SFADR 14-102 at 6 W. Londgen Ave. MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said that so far there are two continued items scheduled for the January 13, 2015 meeting. 12-9-14 ADJOURNMENT Chairman Falzone adjourned this meeting at 11:37 p.m. to Tuesday, January 13, 2015, at 7:00 p.m. in the City Council Chambers located at 240 W.
