HomeMy WebLinkAbout01-27-15 PC MinutesARCADIA PLANNING COMMISSION REGULAR MEETING MINUTES Tuesday, January 13, 2015 CALL TO ORDER — Chairman Falzone called the meeting to order at 7:00 p.m. in the Arcadia City Council Chambers. PLEDGE OF ALLEGIANCE ROLL CALL PRESENT: Commissioners Baerg, Chiao, Lin and Falzone ABSENT: Commissioner Chan MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao, to excuse Commissioner Chan from the meeting. With no objection, the motion was approved. SUPPLEMENTAL INFORMATION FROM STAFF REGARDING AGENDA ITEMS None PUBLIC COMMENTS None PUBLIC HEARINGS 1. Conditional Use Permit Application No. CUP 14 -08, with a Categorical Exemption under the California Environmental Quality Act (CEQA) for the conversion of an existing 15,585 square -foot commercial building into a classroom building at 325 N. Santa Anita Avenue. This item was continued from the November 12, 2014, meeting at the request of the applicant, and is being withdrawn. Applicant: Mr. Thomas P. Clarke Mr. Kasama introduced the item. Mr. Clarke, the applicant, thanked staff for their cooperation and assistance and thanked the commission for their consideration. He restated his request to withdraw the application. Chairman Falzone noted that this is a continued public hearing, but the application is being withdrawn. He asked if anyone would like to speak on this item. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Baerg, to close the public hearing. Without objection, the motion was approved. 1 -13 -15 2. Appeal of the conditional approval of Single- Family Architectural Design Review No. SFADR 13 -128 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new two -story, 6,700 square -foot, single- family residence at 2110 S. Baldwin Avenue. This item was continued from the December 9, 2014, meeting. Applicant: Joanna Lee of Creative Design Associates, Designer Appellant: David and Victoria Law, property owners at 642 W. Longden Avenue Mr. Kasama introduced the item and presented the staff report. Commissioner Chan joined the meeting, Chairman Falzone opened the public hearing and noted that this is a continued public hearing, and the applicant was asked if any further measures could be taken to address the appellant's concerns. He asked if the applicant would like to speak to describe the added measures. There was no response. Chairman Falzone asked if anyone would like to speak in favor of this item. The following responded: Ms. Patricia May, a neighbor Ms. Joanna Lee, applicant Mr. David Law, appellant Ms. Victoria Law, appellant Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin to approve the appeal to relocate the air - conditioning condensers, and conditionally approve Single - Family Architectural Design Review No. SFADR 13 -128 per revision Solution No. 2 as presented in the staff report and with a Categorical Exemption under the California Environmental Quality Act (CEQA). Appeals are to be tiled by 5 :30 p.m, on Tuesday, January 20, 2015. 1 -13 -15 3. Approval of Modification No. MP 14 -07 and Single - Family Architectural Design Review No. SFADR 14-47 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new 5,917 square -foot, Prairie style single- family residence at 2031 Leafwood Lane. Applicant: KVH Design Group, Designer Mr. Kasama introduced the item and presented the staff report. Chairman Falzone opened the public hearing and asked if the applicant would like to speak on this item. Mr. Kurt Von Hatten, project designer, responded. Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chan, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Commissioner Lin to approve Modification No. MP 14 -07 and Single- Family Architectural Design Review No. SFADR 14 -47 and the Categorical Exemption, subject to the findings and conditions in the staff report. ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None There is a five working day appeal period after the approval/denial of the applications. Appeals are to be filed by 5:30 p.m. on Tuesday, January 20, 2015. 4. Resolution No. 1931 - Approving Tentative Parcel Map No. TPM 14 -12 (72947), Modification Application No. MP 14 -20, and Multiple- Family Architectural Design Review No. MFADR 13 -33 with a Categorical Exemption under the California Environmental Quality Act (CEQA) for a new two (2) unit residential condominium development at 507 S. Third Ave. Applicant: Armando Olguin, Project Designer Mr. Kasama introduced the item and presented the staff report. 1 -13 -15 Chairman Falzone opened the public hearing and asked if the applicant would like to speak on this item. Mr. Herman Cortez, representing the project designer, responded. Chairman Falzone asked if anyone would like to speak in favor of this item. There were none. Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. MOTION It was moved by Commissioner Baerg, seconded by Chairman Lin, to approve Tentative Parcel Map No. TPM 14 -12 (72947), Modification No. MP 14 -20, Multiple - Family Architectural Design Review No. MFADR 13 -33 and the Categorical Exemption, subject to the findings and conditions in the staff report, and to adopt Resolution No. 1931. ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None There is a ten calendar day appeal period after the adoption of the Resolution. Appeals are to be filed by 5:30 p.m., on Monday, January 26, 2015. 5. Approval of Text Amendment No. TA 14 -03 with an Exemption under the California Environmental Quality Act (CEQA) to amend Chapter 7 of Article IX of the Arcadia Municipal Code to add Sycamore trees to the City's tree preservation regulations. Mr. Kasama introduced the item and presented the staff report. Chairman Falzone said this is a continued public hearing and asked if anyone would like to speak in favor of this item. Ms. April Vertato, a resident, responded Chairman Falzone asked if anyone would like to speak in opposition to this item. There were none. MOTION It was moved by Commissioner Chiao, seconded by Commissioner Lin, to close the public hearing. Without objection, the motion was approved. 1 -13 -15 MOTION It was moved by Chairman Falzone, seconded by Commissioner Lin, to recommend against codifying regulations protecting sycamore trees but to proceed with preparation of Text Amendment No. TA 14 -03 for the City Council noting the Commission's observation that the Design Review process is adequate for the protection of sycamore trees and no additional regulations are required. ROLL CALL AYES: Commissioners Baerg, Chiao, Lin and Falzone NOES: Commissioner Chan Commissioner Chan asked to be advised of the method used to publicize these regulations if they are adopted. CONSENT CALENDAR 6. Resolution No. 1927 — Denying Conditional Use Permit No. CUP 13 -18 and Oak Tree Encroachment Permit Application No. THE 14 -49 for a proposed new wireless communication facility with a 50' -0 tall monopole antenna structure camouflaged as an elm tree and a 230 square -foot, 12' -6" tall equipment shelter at the northeast corner of the Santa Anita Race Track property at 285 W. Huntington Drive. 7. Minutes of the December 9, 2014, Regular Meeting of the Planning Commission MOTION It was moved by Commissioner Baerg, seconded by Commissioner Chiao, to adopt Resolution No. 1927 and to approve the minutes as presented. ROLL CALL AYES: Commissioners Baerg, Chan, Chiao, Lin and Falzone NOES: None MATTERS FROM COUNCIL LIAISON Councilman Tay was not present. FROM PLANNING COMMISSIONERS Commissioner Chiao said he received an email from a long -time resident who asked how to initiate the process for construction of a sidewalk along Colorado Blvd. between Michillinda and the section where Colorado Boulevard intersects with Colorado Place. Mr. Kasama said that the question should be referred to the Engineering Division for follow up and noted that City Engineer, Phil Wray, was present in the audience. MATTERS FROM MODIFICATION COMMITTEE Commissioner Lin reported that the Modification Committee meeting was canceled. 1 -13 -15 MATTERS FROM STAFF INCLUDING UPCOMING AGENDA ITEMS Mr. Kasama said that the annual League of California Cities Planning Commissioner Academy is scheduled for March 3 through 6 in Newport Beach and encouraged the Commissioners to attend. He also said that the first Zoning Code Update Community meeting which relates to commercial topics is scheduled on January 29 and the second meeting that is tentatively set for February 26 will be about residential development standards. The consultant requests the attendance of the Planning Commissioners at these meetings if possible. Mr. Kasama said the next agenda will include two Conditional Use Permits; one for a tutoring center as 23 Las Tunas Boulevard and the other for the sale of alcoholic beverages for off - site consumption at Wa!greens at 140 E. Live Oak Avenue. The continued hearing for an appeal of a Homeowners' Association decision for construction of a new house on Drake Avenue may also be included. This application involves substantial grading, a basement and environmental and geological issues. Mr. Kasama told the Commissioners that the appeals for the denial of Homeowners' Association decisions on the applications for houses at 29 E. Orange Grove Avenue and 1600 Highland Oaks Avenue will be heard by the City Council at their January 20 meeting. ADJOURNMENT Chairman Falzone adjourned this meeting at 7:59 p.m. to Tuesday, January 27, 2015, at 7:00 p.m. in the City Council Chambers located at 240 W. Huntington Drive, Arcadia.
