CUP 14-15 WITH A CATEGORICAL EXEMPTION UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) TO EXPAND A PRESCHOOL BY CONVERTING A CHURCH OFFICE BUILDING INTO A CLASSROOM BUILDING AT 66 W. Duarte Road Recommendation: Adopt Resolution No. 1930 SUMMARY The applicants, Mr. Derek Chen and Ms. Annie Chen of Starkids Preschool, are requesting approval of a Conditional Use Permit to expand an existing 1,535 square- foot preschool with 42 students to a 62-student, 2,576 square-foot preschool. The expansion is to be achieved by converting an existing church office building of 1,041 square feet into three classrooms. The expansion will use an existing facility, and thereby qualifies as a Categorical Exemption under the California Environmental Quality Act (CEQA). It is recommended that the Planning Commission approve CUP 14-15, with an Exemption, subject to the conditions listed in this staff report, and adopt the attached Resolution No. 1930 (Attachment No. 1). BACKGROUND The subject property is developed as the Lutheran Church of the Cross that was originally approved in 1963 under City Council Resolution No. 3609 (Attachment No. 2) for a zone variance. The buildings are located toward the center of the site, and a parking lot with 67 spaces is at the rear, which is accessed by a 30-foot wide driveway along the easterly property line – refer to Attachment No. 5 for the Site Plan, and Attachment No. 6 for an aerial view and photos of the subject property. Starkids preschool has been in operation at the subject location since 2009. They took over the preschool portion of the classroom building, in which a preschool was approved in 1974 under Planning Commission Resolutions No. 875 and No. 1337 (Attachment Nos. 3 & 4). The Resolutions do not specify a maximum number of children allowed at the preschool. However, the California State Department of Social Services, and City Codes limit the preschool to a maximum attendance of 42 children. The current hours of the preschool are 7:30 a.m. to 6:30 p.m., Monday through Friday. Resolution No. 1930 – CUP 14-15 66 W. Duarte Road February 10, 2015 – Page 2 of 6 There is also a tutoring center operating on the second floor of the existing classroom building, above the existing preschool. The tutoring center replaced a Montessori School that was utilizing the second floor of the classroom building that was approved by Resolution No. 875. The class hours of the tutoring center are Monday to Friday, from 3:30 p.m. to 6:30 p.m., and the maximum attendance is 30 students of high school ages. A Conditional Use Permit (CUP) is required for preschools and schools in the R-1 zone per Arcadia Municipal Code (AMC) Section 9275.1.35. PROPOSAL The applicant is requesting a Conditional Use Permit to expand an existing 1,535 square-foot preschool with 42 students, five (5) employees, and three (3) classrooms, to a 2,576 square-foot preschool with 62 students, seven (7) employees, and six (6) classrooms. The expansion involves the conversion of an existing 1,041 square-foot church office building into three classrooms. The office building is situated to the north of the two-story classroom building – refer to Attachment No. 5 for the Site Plan and Floor Plan. Except for signage, no external changes to the building are anticipated. The outdoor play area of the preschool will also be expanded to a total of 5,520 square feet by utilizing the enclosed play area between the office building and the existing classroom building, and a fenced lawn area to the west of the classroom building. The preschool hours will remain from 7:30 a.m. to 6:30 p.m., Monday through Friday. The preschool is closed on weekends and holidays. ANALYSIS The preschool expansion will occupy a 1,041 square-foot building that is currently used as church offices. The expanded preschool will occupy a total area of 2,576 square feet, and accommodate 62 children, with seven (7) employees. The proposed class hours occur on the weekdays, when the church has no other activities on site. The only other use on the site is the tutoring center, which holds classes, Monday through Friday, from 3:30 p.m. to 6:30 p.m. The preschool and tutoring center do not conflict with the other uses along West Duarte Road. The adjacent properties to the east and west are developed with institutional uses, the properties to the rear are single-family residences, and the Arcadia High School sports field is across the street – refer to Attachment No. 6 for an aerial view with zoning information and photos of the subject property. The Code requires one (1) parking space for each employee for a preschool. Therefore, the subject preschool is required to have seven (7) parking spaces. The tutoring center is required to have 16 parking spaces, based on 30 students of driving age and six (6) employees. Therefore, a total of 23 parking spaces are required for the educational uses. There are 67 on-site parking spaces on the subject property, and because the hours of the preschool and the tutoring center do not overlap with any church activities, the entire 67-space parking lot is available. This satisfies the parking requirements for the two educational uses. The parking lot for the subject property is accessed by a 30-foot wide driveway from Duarte Road that is along the east side of the property. This provides adequate vehicular ingress and egress, and there is proper on-site circulation that facilitates convenient drop-off and pick-up activities for the preschool and tutoring center. Duarte Road February 10, 2015 – Page 3 of 6 subject plans were reviewed by Engineering Services and it was determined that there would not be any traffic issues as a result of this proposal. The proposed preschool expansion is compatible with the other uses on the site, the surrounding uses, and complies with the City’s General Plan and Zoning Code. FINDINGS Section 9275.1.2 of the Arcadia Municipal Code requires that for a Conditional Use Permit to be granted, it must be found that all of the following prerequisite conditions can be satisfied: 1. That the granting of such Conditional Use Permit will not be detrimental to the public health or welfare or injurious to the property or improvements in such zone or vicinity. The proposal is to expand an existing preschool to 2,576 square feet, and increase the number of children from 42 to 62. The age of the children are to be from two (2) years of age to first grade ages. This use will not be detrimental to the public health or welfare, or the surrounding properties. A preschool is consistent with the R-1 Zoning and the Low Density Residential General Plan Land Use Designation of the site, and will not conflict with the other uses on site, or in the neighborhood. 2. That the use applied for at the location indicated is properly one for which a Conditional Use Permit is authorized. The zoning of the site is R-1, and Arcadia Municipal Code Section 9275.1.35 allows preschools in the R-1 zone with an approved Conditional Use Permit. 3. That the site for the proposed use is adequate in size and shape to accommodate said use, and all yards, spaces, walls, fences, parking, loading, landscaping, and other features required to adjust said use with the land and uses in the neighborhood. The primary use of the project site is as a church. The subject preschool, with the proposed expansion, will occupy 2,576 square feet of existing accessory buildings. No exterior changes are proposed for the use. The hours of the preschool do not conflict with church activities, and the existing 67 parking spaces will be adequate to accommodate all uses on the site. The property features, lighting, landscaping, and other improvements that are adequate for the uses. The proposed preschool expansion will not require any adjustments to the site. 4. That the site abuts streets and highways adequate in width and pavement type to carry the kind of traffic generated by the proposed use. The site is located along West Duarte Road. This street is adequate in width and pavement type to carry the traffic that will be generated by the proposed preschool expansion. Resolution No. 1930 – CUP 14-15 66 W. Duarte Road February 10, 2015 – Page 4 of 6 5. That the granting of such Conditional Use Permit will not adversely affect the comprehensive General Plan. Approval of an expansion of the existing preschool is consistent with the Residential Land Use Designation of the site. The proposal will not adversely affect the comprehensive General Plan. The proposed project satisfies each prerequisite condition, and all City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, emergency equipment, environmental regulation compliance, and parking and site design shall be complied with by the property owner/applicant to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director, or their respective designees. The changes to the existing facility are subject to building permits after having fully detailed plans submitted for plan check review and approval by the aforementioned City officials. ENVIRONMENTAL ASSESSMENT If it is determined that no significant physical alterations to the site are necessary, then this project, as a use of an existing facility, qualifies as a Class 1 Categorical Exemption under the provisions of the California Environmental Quality Act (CEQA) pursuant to Section 15301(a) of the CEQA Guidelines. Refer to Attachment No. 7 for the Preliminary Exemption Assessment. PUBLIC NOTICE/COMMENTS Public hearing notices for this item were mailed to the property owners and tenants of those properties that are located within 300 feet of the subject property on Friday, January 30, 2015 – refer to Attachment No. 8 for the radius map. As of February 4, 2015, no comments have been received in response to the notices. RECOMMENDATION It is recommended that the Planning Commission conditionally approve the project and exempt it per CEQA Section 15301(a), by adopting the attached Resolution No. 1930, which includes the following conditions of approval: 1. The subject preschool shall comply with all requirements as set forth by the California State Department of Social Services. Proof of a State license is required for the issuance and renewals of City licenses. 2. The use approved by CUP 14-15 is limited to a preschool, which shall be operated and maintained in a manner that is consistent with the proposal and plans submitted and approved for CUP 14-15, and shall be subject to periodic inspections, after which the provisions of this Conditional Use Permit may be adjusted after due notice to address any adverse impacts to the adjacent streets, rights-of-way, and/or the neighboring businesses and properties. A maximum of seven (7) teachers and 62 children shall be permitted, with classes limited to Monday through Friday from 7:30 a.m. to 6:30 p.m. No preschool classes shall occur on weekends or holidays. 4. All City requirements regarding disabled access and facilities, occupancy limits, building safety, health code compliance, emergency equipment, environmental regulation compliance, and parking and site design shall be complied with by the property owner/applicant to the satisfaction of the Building Official, City Engineer, Community Development Administrator, Fire Marshal, and Public Works Services Director, or their respective designees. The changes to the existing facility are subject to building permits after having fully detailed plans submitted for plan check review and approval by the aforementioned City officials. 5. Noncompliance with the plans, provisions and conditions of approval for CUP 14-15 shall be grounds for immediate suspension or revocation of any approvals, which could result in the closing of the preschool. 6. The applicant shall defend, indemnify, and hold harmless the City of Arcadia and its officials, officers, employees, and agents from and against any claim, action, or proceeding against the City of Arcadia, its officials, officers, employees or agents to attack, set aside, void, or annul any approval or conditional approval of the City of Arcadia concerning this project and/or land use decision, including but not limited to any approval or conditional approval of the City Council, Planning Commission, or City Staff, which action is brought within the time period provided for in Government Code Section 66499.37 or other provision of law applicable to this project or decision. The City shall promptly notify the applicant of any claim, action, or proceeding concerning the project and/or land use decision and the City shall cooperate fully in the defense of the matter. The City reserves the right, at its own option, to choose its own attorney to represent the City, its officials, officers, employees, and agents in the defense of the matter. 7. Approval of CUP 14-15 shall not be of effect unless on or before 30 calendar days after Planning Commission adoption of the Resolution, the property owner and applicant have executed and filed with the Community Development Administrator or designee an Acceptance Form available from the Development Services Department to indicate awareness and acceptance of these conditions of approval. PLANNING COMMISSION ACTION Approval If the Planning Commission intends to approve this proposal, the Commission should approve a motion to approve Conditional Use Permit No. CUP 14-15, stating that the proposal satisfies the requisite findings, and adopt the attached Resolution No. 1930 that incorporates the requisite environmental and Conditional Use Permit findings and the conditions of approval as presented in this staff report, or as modified by the Commission. Duarte Road February 10, 2015 – Page 6 of 6 Denial If the Planning Commission intends to deny this proposal, the Commission should approve a motion to deny Conditional Use Permit Application No. CUP 14-15, state the finding(s) that the proposal does not satisfy with reasons based on the record, and direct staff to prepare a resolution for adoption at the next meeting that incorporates the Commission’s decision and specific findings. Thestaff report was presented. Staff indicated that theplayground asit existis notwalled in and wasnever approved. In response to a question fromCommissioner Fee, staffsaidthllt they did not feelthat theplayground wouldcreate substantialnoise, therefore, it wasnotincluded intheEnvironmentalCheck List. Ifthis was approved, the structures would have tobe aminimunof3' fromthewall. TheStateLicnese for a day carecenter requires thatsuchfacility shallhave a specific sq. ft. of insideandoutdoor areaavailableforeachchild. The publichearing was opened. ScottAlvik, 8610 E, liveOak, SanGabriel was thereto represent LutheranChurch oftheCross. In answer toCommissionerPapay's question, hesaidthat the extendedhours of the playground wouldbeforchildrenwhomtheir parentspick them up afterwork. Heexplained thatthey needed a larger space that would provide for approximately 4000 sq, ft. vs. theexisting 1120 sq. ft. Hecommented that oneofthe alternatives suggested wasto relocate some ,of the parking stalls to the reartoprovide roomforthe playground; however, this wouldforce them toeliminate2 handicapped spaces andrelocate themand Inoted that they would havetofence theplay area, thereby, blocking offtheentrance totheeducation building wheretheMontessoriacademY islocated which would not besafein caseof afire. Thecourt yard area hasbeenutilizedfor many different usesand purposes such as special events, youth activities andchurch servicesand by placing theplayyard therethey wouldeliminate any wide open space forthe church to use forthementioned purposes. The useofthe c, ourtyard areaasalunch area ora recess areawoulddisturbthestudentsthat are still inclassandworking ontheirschoolwork. Heexplained thattheacademY divides the studentsinsmall groups, whereas the majority ofthestudents are stillin classduring a2-hour period lunchtime. Withtheabove-mentionedaltern~tive the entiresideofthewallwouldhave tohaveshatter proofglass inthe event that achild was pushed into it. However, the proposed sitewould put the children away from thebuilding andwouldavoid any possible safetyproblems with theglass. Hecommentedthat they wouldutilizethe play areaforapproximately 3 hours a day andnotedthat they intendedto keep the noisedown to aminimum. They would be wll11ng tomodify the areatoinclude ablockwall and aroof if permi'tted. Hesaidthat none ofthe residents on Magna Vista are against theintended use. There are currently 37studentsenrolled intheMontessorischoolandremarked thatthey didnotintend toincreasethenumberofstudents. Approximately ISto 18studentsbetween preschoolthrough 4th grade wouldbeusing theplay area whichwouldhave aswing setand a jungle-gym at anyone time. In response to CommissionerFee's question ofhowtheyproposed tomonitor the useoftheplayground during non-schooltime, Mr. Alvik said that they wouldlock the areawith2 gates. Thi~ areawouldnotbeutilized ontheweekends during' church hoursandsaidthat they intended touseitfrom11to2andfor approximately ~ hour inthe evening on weekdays. Staffclarifiedthat the ,proposedplay area intheconditional use permit for the church wasa25' easementfor a possiblealley andcommentedthat thechul'ch could uti1fze the areafor abarbecue ora wedding withoutviolating theCode. Underthecurrent Codethechurch wouldbe'd~ficientinits parking andwent on to say thatatthetimethatthe c.u.p. was granted, there wereno parking standardsforchurches. DorisPfeifer, 160 W. CaminoReal was present andsaidthatshe is achurch member. Sheaskedif any restrictions were put onthe play areaandstaff commentedthatthere wereno restrictions put on playyard 12. BernieWijesiriwardena, Monroviasaidthat they arethe operators ofthe Montessori school. Hecommentedthat they have operated theschoolforg years andhave neverhad any complaintsduring thattime. They have always heard positive commentsfromthe parents becausethis is aneducational program. He was infavorofmoving theplay yard theproposed area away fromthebuilding, He believedthe proposal is a good oneandaskedfor approval. Playground '1is usedforthelittlechildren and saidthatthey have oneteacher and one - aide eachfor every 12students. They arelisencedtohave42students, Mr. Weidaw, 65W. Magna Vista, directly behindthechurch, spOkeagainst the proposal. He wasconcernedaboutthechurch leasing its property to the Montessorischoolandcommentedthat they arenot opposed to children or play yards. Heremarked thatchildrendo not playquietly in playyards andshout, screamandlaugh whichwouldcreate noise. Thelocationoftheplayyard asit existsisideal forthe neighbors to the south. He went onto say that play areasare usuallyright nexttoclass roomsandnot100' fromthem. Heasked the Commission to move the play areanexttothe educationbuilding whichwould not create anyproblems withthe neighbors. He was againsthaving the play areain a~ placealong the southerlyboundary line. CommissionerGalinskiaskedwhat structures onhis property is located nearthe proposal and Mr. Weidawsaid immediately next tothisfenceis agarage buthis study islocated nearthe rearoftheirhousewhichwouldbeabout30' fromthe play ground. Thenoisecreatedby theplayground wouldbe a problem. He mentioned thatthechildren were supervisedby teacherswhoutilized whistlesand shouted atthechildren toget theirattentton. By doi ng so they would probably lose 4-6 parki ngspaces butwouldnothaveproblem withthe, residentstothe southandthey wouldstillhavetheirbuffer zone. They could gain about12 parking spaces tothe rearinlieuof placing theplayground there. Hesaidthatin a recentexperience (Sunday, March22), three boys wereonthe wallwho werethrowi ng rocks atthei r dog, hetold the k,i dstoget down and upon leaning overthewallhenoticedthatseveraladults were standing intheparking lotanddidnot say anything. He was concernedthatthechildrenwouldc11imb up thewalland get intohis swimmingpool or antagonize hisdog whocouldbite them, Hefeltthatanotheralternative might suitthechurch, Montessorischool andthe neighbors. He explained thattheplayyard would be approximately 70' from someofthehomestothesouthwith2blockwalls in betweenthe'noiselevel would decreasesubstantially. Hecommentedthathedid notfeelthat amaximumof18childrenwould create morenoisethanthe high schoo1 duri ngany eventthattheschool might havesuch as afootball gam,e or a band practice, StaffsaidthatCodeallows a maximum6'.0" high wall, Mr. Alvick, in response to a question fromtheCommisisonsaidthatthestudents have a specific lunch hourandplace astowheretheirfoodisconsumed. Foodis notallowedinthe play area. Itis possible thatthe high schoolkids are the onesthat are creating thetrash problem. Hefeltthat they havetried to accommodate everyone andsaidthat they would evenlockofftheir parking lot so thehigh schoolkidscould not get in. Mr. Shaw's suggestion ofrelocating the play area tothewesterly areawould notbe feasiblesincethe areawould notbe largeenough. CommissionerFeecommentedthatthechurchwouldbe ableto place a largeplay area along the westerly property 11 ne byrelocating 6westerly parki ng stall s along the southerly wall. He remindedtheapplicant thatthechurchisin R-l zonewhtchabutsresidential properties andnotedthat tothe westofthe property isanotherchurchand feltthat backing up tothechurch wouldbe less of a problem thanbacking up to residential properties.
