HomeMy WebLinkAbout10/07/2015 56:0111 MINUTES OF THE ARCADIA CITY COUNCIL REGULAR MEETING TUESDAY, OCTOBER 7, 2014 Mayor Wuo called the Special Meeting to order at 6:00 p.m. ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None PUBLIC COMMENTS - No one appeared CLOSED SESSION a. Pursuant to Government Code Section 54956.9(d)(1) to confer with legal counsel regarding the case of Marites Suribas as Guardian ad litem for Caitlyn Hodges v. City of Arcadia, Arcadia Unified School District, Amanda Lynne Gibbs, et al.; Los Angeles County (Central District) Superior Court Case No. BC547760. There was no reportable action taken on this item. The Closed Session ended at 6:30 p.m. STUDY SESSION a. Report, discussion and direction regarding field allocation policies and potential user fees. Recommended Action: Provide direction Director of Recreation and Community Services Somogyi provided the City Council with a report regarding field allocation policies and potential user fees relating to soccer fields. It was moved by Council Member Chandler, seconded by Council Member Beck, and carried on roll call vote to bring back proposed user fees regarding City soccer fields for City Council consideration at the meeting on October 21, 2014. AYES: Council Member Chandler, Beck, Tay, Kovacic, and Wuo NOES: None ABSENT: None The Study Session ended at 6:50 p.m. CITY COUNCIL REGULAR MEETING CALL TO ORDER - Mayor Wuo called the regular meeting to order at 7:00 p.m. INVOCATION — Reverend Stephen Wilson, Methodist Hospital Chaplain PLEDGE OF ALLEGIANCE — Sara Somogyi, Director of Recreation and Community Services 1 10-07-14 56:0112 ROLL CALL OF CITY COUNCIL MEMBERS PRESENT: Council Member Beck, Chandler, Kovacic, Tay, and Wuo ABSENT: None REPORT FROM CITY ATTORNEY REGARDING CLOSED SESSION AND STUDY SESSION ITEM(S) City Attorney Deitsch reported that the City Council met in a Closed Session to consider the one item listed on the posted agenda under Closed Session regarding pending litigation; no reportable action was taken. City Attorney Deitsch also announced that the City Council conducted a Study Session to hear a report from staff and provide direction regarding field allocation policies and potential user fees pertaining to sports fields which are owned or operated by the Arcadia Unified School District and the City of Arcadia; and reported that by unanimous vote, the City Council directed staff to bring back proposed user fees for consideration at City Council meeting on October 21, 2014. SUPPLEMENTAL INFORMATION FROM CITY MANAGER REGARDING AGENDA ITEMS City Manager Lazzaretto announced there was no supplemental agenda information. MOTION TO READ ALL ORDINANCES AND RESOLUTIONS BY TITLE ONLY AND WAIVE THE READING IN FULL A motion was made by Council Member Chandler, seconded by Council Member Tay, to read all ordinances and resolutions by title only and waive the reading in full. PRESENTATIONS a. Proclaiming October 5, 2014 to October 11, 2014, as Fire Prevention Week. b. Presentation of Mayor's Certificate to the Global Leadership Institute members/students of Arcadia High School, who offer free math tutoring. 1. PUBLIC HEARINGS a. Ordinance No. 2319 amending the Seabiscuit Pacifica Specific Plan (SP No. 13-02) to modify conditions of approval for two new hotels and a hotel condominium at 130 W. Huntington Drive. Recommended Action: Introduce Assistant City Manager/Development Services Director Kruckeberg presented the staff report. Mayor Wuo opened the public hearing. Andy Chang, owner/developer of the Seabiscuit Pacifica appeared and expressed his concerns regarding the Development Agreement and the need to move forward with the Project; and requested that the Specific Plan be amended to allow the Santa Anita Inn to remain open during the construction period in order to support the cash flow. 2 10-07-14 56:0113 A motion to close the public hearing was made by Council Member Chandler, seconded by Mayor Pro Tern Kovacic, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Beck, seconded by Council Member Chandler, and carried on roll call vote to continue the public hearing to the October 21, 2014, City Council meeting. AYES: Council Member Beck, Chandler, Kovacic, Tay, and Wuo NOES: None ABSENT: None b. Special Assessment in the amount of $41,709.89 to recoup costs and fees incurred in the prosecution of the People v. Corregidor nuisance abatement action. Recommended Action: Approve City Attorney Deitsch presented the staff report. Mayor Wuo opened the public hearing. Wilfredo and Roseanna Corregidor, property owners, appeared and indicated that his house is not complete yet and he is currently in Chapter 13 Bankruptcy. A motion to close the public hearing was made by Mayor Pro Tern Kovacic, seconded by Council Member Chandler, and seeing no further objection, Mayor Wuo declared the public hearing closed. It was moved by Council Member Chandler, seconded by Council Member Tay, and carried on roll call vote to approve a Special Assessment in the amount of $41,709.89 to recoup costs and fees _• incurred in the prosecution of the People v. Corregidor nuisance abatement action. AYES: Council Member Chandler, Tay, Beck, Kovacic, and Wuo NOES: None ABSENT: None PUBLIC COMMENTS Jane Garzona, Executive Director of the Downtown Arcadia Improvement Association appeared to show her support to those members who will be recommended to the Arcadia Improvement Association Board; she handed out "I Love Downtown Arcadia" stickers; and reported on the enthusiasm of the business owners of the revitalization of the Downtown area and events that are being planned. REPORTS FROM MAYOR, CITY COUNCIL AND CITY CLERK (including reports from the City Council related to meetings attended at City expense [AB 1234]). Council Member Chandler congratulated Bruce McCallum and Scott Hettrick on a successful Taste of Arcadia event; and congratulated those who volunteered in the planning of the Thoroughbred Racing Walk of Champions event, and noted that both events were a great success and well attended. Council Member Beck indicated that the Arcadia High School baseball field is in need of repairs and requested support of two Council Members to add this matter to a future agenda on whether the City should contribute $12,500 for the cost of renovations. Council Member Chandler and Mayor Pro Tem Kovacic supported Council Member Beck's request; he also requested the support of two 3 10-07-14 56:0114 Council Members for a future study session regarding a preservation ordinance. Council Member Tay and Mayor Pro Tem Kovacic supported Council Member Beck's request. Council Member Beck commended and thanked Scott Hettrick on the Taste of Arcadia event and also thanked Betty Hettrick for all she does; he noted that he attended the Arcadia Museum Education Foundation fundraiser BBQ on September 28, and a water forum on October 2 with Council Member Tay, City Manager Lazzaretto, and Public Works Services Director Tait; he noted that he personally has cut down on water usage and will be remodeling his front and back yard to be more water conscientious. Council Member Tay also announced that he also attended the water forum on October 2 and encouraged everyone to try and do their share to conserve water, and also attended the Arcadia Museum Education Foundation BBQ; and thanked Community Services Officer Vercillo for attending the Neighborhood Watch meeting at his home. He commented on the Taste of Arcadia; and commended Public Works Services Department for their quick response in fixing the pothole he called and complained about; and he announced that Thursday is "Coffee with a Cop" at the Chamber of Commerce and invited the public to attend. Mayor Pro Tern Kovacic noted that he also attended most of the events mentioned and a ribbon cutting at the Arcadia Par 3 Golf Course; he also noted that he presented the Mayor Certificate of Commendation to the Arcadia Presbyterian Church in honor of their 100th anniversary; he commented that he read on the City Clerk's Facebook page that he will soon be able to administer civil marriages beginning January 1; he also commented on a letter the City Council received from Arcadia resident Terry Schriner regarding the development of big homes in Arcadia that have more than two kitchens and bathrooms and the amount of water being used. In response to a question raised by Mayor Pro Tern Kovacic regarding water conservation restrictions relating to big homes, City Manager Lazzaretto responded that the largest user of water in a home is the landscaping; and that the City has a landscaping ordinance for all new construction which is geared to dramatically reduce the amount of water used in a home. Assistant City Manager/Development Services Director Kruckeberg commented on the Water Efficient Landscape Ordinance and indicated that the ordinance is designed to reduce the amount of water used for landscaping for each new home being built and making sure that it meets all ordinance requirements. City Manager Lazzaretto indicated that Public Works Services/Water Division is currently is doing a study of water usage between new homes and old homes. In response to Mayor Kovacic's inquiry regarding complaints of broken sprinklers or water spillage in the street, Public Works Services Director Tait responded that residents should call the Public Works Services Department at (626) 256-6554. City Clerk Glasco also noted that he attended the Thoroughbred Walk of Champions and commended City staff and the Police Department for all their efforts; he further announced that he attended the Arcadia Museum Education Foundation fundraiser and the Arcadia Presbyterian Church 100th anniversary celebration; and announced the book sale at the Library and invited everyone to attend. Mayor Wuo had no additional comments but mirrored everything that was said. 4 10-07-14 56:0115 2. CITY CLERK REPORTS a. Appointments to the Board of Directors of the Downtown Arcadia Improvement Association (AIA). Recommended Action: Make Appointments Assistant City Manager/Development Services Director Kruckeberg presented the staff report. It was moved by Council Member Chandler, seconded by Mayor Pro Tem Kovacic, and carried on roll call vote to appoint Council Member Sho Tay, Peter Amundson, and a member of the City staff to the Board of Directors of the Downtown Arcadia Improvement Association ("AIA"). AYES: Council Member Chandler, Kovacic, Beck, Tay, and Wuo NOES: None ABSENT: None 3. CONSENT CALENDAR a. Regular Meeting Minutes of September 16, 2014. Recommended Action: Approve b. Accept donations from the Community in support of the Children's Summer Reading Program at the Library. Recommended Action: Accept c. Accept all work performed by Doug Martin Contracting, Inc. for the Fiscal Year 2013- 14 Annual Slurry Seal Project as complete and authorize the final payment to be made in accordance with the Contract documents, subject to the retention of $18,286.20. Recommended Action: Accept d. Professional Services Agreement with IBI Group for a Transit Service Needs Assessment and Restructuring Plan in the amount of $74,996, plus a 10% contingency, and approve an additional appropriation of $8,000 from Proposition C Local Return funds. Recommended Action: Approve e. Reject the one bid received for the purchase of water pipeline fittings, brass valves, and other related accessories for the City's Water Distribution System and direct staff to re-bid. Police Chief Guthrie presented the Police Department's Annual Review.
