Tuesday, March 24, 2015, 7:45 a.m.
Location: City Council Chambers Conference Room, 240 W. Huntington Dr., Arcadia
Pursuant to the Americans with Disabilities Act, persons with a disability who require a disability related modification
or accommodation in order to participate in a meeting, including auxiliary aids or services, may request such
modification or accommodation from Planning Services at 626-574-5423. Notification 48 hours prior to the meeting
will enable the City to make reasonable arrangements to assure accessibility to the meeting.

PUBLIC COMMENTS (5 minute time limit per person)
Each speaker is limited to five (5) minutes per person, unless waived by the Modification Committee. Under the
Brown Act, the Members are prohibited from discussing or taking action on any items not listed on the posted
agenda. The matter will be referred to staff for an appropriate response, or will be placed on the agenda of a future
meeting.
PUBLIC HEARINGS
All interested persons are invited to appear at a public hearing and to provide evidence or testimony concerning any
of the proposed items set forth below for consideration. Separate and apart from the applicant (who may speak
longer in the discretion of the Committee) speakers shall be limited to five (5) minutes per person. The applicant may
additionally submit rebuttal comments, at the discretion of the Committee.
You are hereby advised that should you desire to legally challenge in court any action taken by the Modification
Committee regarding any Public Hearing item, you may be limited to raising only those issues and objections you or
someone else raised at the public hearing or in written correspondence delivered to the Modification Committee at, or
prior to, the public hearing.
1. Modification No. MC 14-15 and Single-Family Architectural Design Review No.
14-49 with Categorical Exemption from the California Environmental Quality Act
(CEQA) for a new two-story single-family residence with a special setback for the
front yard at 1418 Holly Avenue.
Applicant: CT Max, Designer
Recommendation: Conditional Approval
Conditionally approved, 3-0, subject to the following conditions:
1. The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against
any claim, action, or proceeding against the City of Arcadia, its officials,

approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval or
conditional approval of the City Council, Planning Commission, Modification
Committee, or City Staff, which action is brought within the time period
provided for in Government Code Section 66499.37 or other provision of
law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or
land use decision and the City shall cooperate fully in the defense of the
matter. The City reserves the right, at its own option, to choose its own
attorney to represent the City, its officials, officers, employees, and agents
in the defense of the matter.
2. Approval of MC 14-15 and SFADR 14-49 shall not be of effect unless on or
before 30 calendar days after approval of this project, the property
owner/applicant has executed and filed with the Community Development
Administrator or designee an Acceptance Form available from the
Development Services Department to indicate awareness and acceptance
of these conditions of approval.
2. Modification No. MC 15-01 and Administrative Single-Family Architectural Design
Review No. SFADR 15-06 with Categorical Exemption from the California
Environmental Quality Act (CEQA) for an addition to one of the four existing
legal-nonconforming, single-family residential property with three detached
residential units at 1411 S. Sixth Avenue.
Applicant: Dennis Lopez, Property owner
Recommendation: Conditional Approval
Conditionally approved, 3-0, subject to the following conditions:
1. The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against
any claim, action, or proceeding against the City of Arcadia, its officials,
officers, employees or agents to attack, set aside, void, or annul any
approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval or
conditional approval of the City Council, Planning Commission, Modification
Committee, or City Staff, which action is brought within the time period
provided for in Government Code Section 66499.37 or other provision of
law applicable to this project or decision. The City shall promptly notify the

Recommendation: Conditional Approval
Conditionally approved, 3-0, subject to the following conditions:
1. The applicant shall defend, indemnify, and hold harmless the City of
Arcadia and its officials, officers, employees, and agents from and against
any claim, action, or proceeding against the City of Arcadia, its officials,
officers, employees or agents to attack, set aside, void, or annul any
approval or conditional approval of the City of Arcadia concerning this
project and/or land use decision, including but not limited to any approval or
conditional approval of the City Council, Planning Commission, Modification
Committee, or City Staff, which action is brought within the time period
provided for in Government Code Section 66499.37 or other provision of
law applicable to this project or decision. The City shall promptly notify the
applicant of any claim, action, or proceeding concerning the project and/or
land use decision and the City shall cooperate fully in the defense of the

APPEAL PERIOD: All decisions made by the Modification Committee may be appealed to
the Planning Commission within five (5) working days of the decision. Appeals are to be
filed by 5:30 p.m. on Tuesday, March 31, 2015. If no appeal is filed, decisions are final.
ADJOURNMENT
The Modification Committee will adjourn this meeting to April 14, 2015, at 7:45 a.m. in the City
Council Chambers Conference Room, 240 W. Huntington Drive, Arcadia.
